The Birenbaurn reguest entails construction of a new deck to the south of the existing structure. you are correct in your berief of stream setback requirenents. The Town of vair zoning code requires a setback of 50 feet from the centerline of Gore-creek for any structure. There is an exception, however, that allows unencrosed decks and patios to encroach no more than halfway into this setback. The Birenbaum apprication incrudes a survey which verifies the proposed deck tolation is within the allowable encroachment. You are arso correct in understanding that the property is in a geologically sensitive area.
