Town of Vail Mechanical Codes and Desion Criteria
I You must obtain Design Review Board (DRB) approval if any of the medhanical work will invotve
ANY exterior work. This includes and is not limited to removal and replacenent of driveway snow
melt systems. Please contact a Planner at479-2L28 for additional information.
r The Town of Vail has adopted the 2003 International Mechanical Code and the 2003 International
Fuel Gas Code.
o All new construction within the Town of Vail is considered to be of unusually tight construction,
thus all combustion air is required to be drawn from outside the structure for mechanical
equipment.
Town of Vail Fireolace Ordinance
In September of 1991, the Vail Town Council adopted an ordinance which res;tricts te construction and
use of open hearth fireplaces within municipal boundaries. Since that time the ordinance has
undergone numerous changes and revisions, striving for compromise, yet effectiveness in addressing
the a:r quality issue. Therefore the following criteria has been adopted:
r Construction of open heafth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
r Dwellino Units - Each new dwelling unit may contain:
One (1) EPA Phase II ceftified solid fuel burning device and no more than two (2) gas appliances
(B vent)
OR
Two (2) gas log fireplaces and no more than two (2) gas appliance fireplaces (B bent).
r Restricted Dwellino Units - Each new restricted dwelling unit may contain:
One (1) gas log fireplace and not more than one (1) gas appllance fireplace.
r Accommodation Units - Each new accommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fireplace.
o If two or more separate dwelling units or accommodation units are combined to form one larger
unit, the combined unit may retain one woodburning fireplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas.
r If during the course of a remodel an existing woodburning fireplace is altered or moved, the unit
must then comply with all provisions of the ordinance. That is, the fireplace must be converted to
natural gas or replaced by an EPA Phase II ceftified unit.

Per our telephone conversation, I would like to confirm some of the issues that we discussed.
The application requirements for this addition are more complex than the deck addition last year
due to the change in site coverage and the increase in Gross Residential Floor Area (GRFA).
Please refer to the Town of Vail's Application for Design Review for more details. There is a
checklist attached to the application. The outstanding materials needed for the review are:
. Survey showing the entire property including the northwest corner of the property to
determine site coverage.. The height of the proposed addition at existing grade showing the ridge elevation.. No sidewalks are on the property, but the driveway needs to be on the site plan or plat of
survey. A driveway is not indicated on the survey in the submittal.. The Spa Mechanical room height is 3.5 feet.. No additional lighting is proposed.. Unit A addition in 1996 included a garage and possibly an office. Plans must be
submitted reflecting the addition to that unit. Unit B has not had any additions, other
than the deck.
' Trees that will be removed due to the addition will be marked on the property.
' Legible and accurate floor plans must be submitted for the review of the addition.
Please submit the necessary information to the Department of Community Development no later
than 5:00 p.m. on June 25, 2004, otherwise the Design Review application lor 4126 Columbine
Unit B will be considered as withdrawn.

After reviewing the plans submitted for a bathroom addition to the existing duplex at 4126
Columbine Drive Unit B, the following materials and information are needed:
A survey showing entire property and the location and size of trees that will be removed.
Please see application for survey requirements.
A roof plan illustrating the height of the proposed addition from grade. Please identify
ridge elevation.
Site plan indicating the location and dimensions of driveways and sidewalks.
What is the head height of Spa Mechanical room on Sheet No. 4?
ls any additional lighting being proposed? lf so, the location of the lights must be shown
on the plans and cuts sheet must be provided.
Why is the dumpster located on the property?. The floor plans were very difficult to read, but archive sets were located from previous
projects. The plans submitted appear to be inconsistent as garage and office addition
was approved in 1996. Accurate floor plans will be needed to determine the Gross
Residential Floor Area (GRFA) and site coverage.
Also, please be aware that if this application is approved, an amended plat will be required
before a temporary certificate of occupancy or a certificate of occupancy can be issued. This is
due to the proposed addition being located outside of the platted area for the west half of the
duplex.

Your letter to the VaiI Town Council of August 3 has been passed down to rne. r am a pranner in the -ornrnunity Developrnent Department and am responsible for review and issuance of building permits.
The Birenbaum reguest entairs construction of a new deck to the south of the existing structure. you are correct in your berief of stream setback requirernents. The Town of vair zoning code reguires a setback of 50 feet from the centerline of Gore creek for any structure. There is an exception, however, that allows unenclosed decks and patios to encroach no more than halfway into this setback. The Birenbaum apprication incrud.es a survey which verifies the proposed deck loLation is within the aLlowable encroachrnent.
You are also correct in understanding that the property is in a geologically sensitive area. No worl will be ailowed to conmence until the proper geologic reports have been subnitted.

Dear Mr. Burrows:
Your letter to the VaiI Town council of August 3 has been passed down to ne. r am a planner in the cornnunity Development Department and am responsible for review and issuance of building perrnits.
The Birenbaurn reguest entails construction of a new deck to the south of the existing structure. you are correct in your berief of stream setback requirenents. The Town of vair zoning code requires a setback of 50 feet from the centerline of Gore-creek for any structure. There is an exception, however, that allows unencrosed decks and patios to encroach no more than halfway into this setback. The Birenbaum apprication incrudes a survey which verifies the proposed deck tolation is within the allowable encroachment.
You are arso correct in understanding that the property is in a geologically sensitive area. No work will be aitowea to conmence until the proper geologic reports have been subrnitted.
with respect to the Party walt Agreement you have with the adjacent unit, the Town of Vail is not a larty to that agreement and does not, as a natter of policyl enforce private covenants or agreenents. rn concrusion, the-Birenbaum iequest meets, or is in the process of cornprying with, arl appri"iur"-Town of Vail requirernents.

Dear Sir:
We are wrlting you in reference to a Building Pernit for a large porch extension issued to Mr.Dennis Birbenbaum, 4LZ6 Columbine Drive-West unit of a duplex. We ovrn 4L26 Columbine Drive, East unit and wish to indicate two things.
1. We have not been contacted by him for permission ylti"t is requi-red as per the- ',party Wall_" Agreement.This extension woul_d violate this Lgreement and intrude in our privacy for our entiie unit.
2. We bel-ieve that there is a Town Ordinance that prohibits building any eloser to the Gore Creek due to the environmental effect and the rock zone declaration.
Thus, we respectfully request that whatever is necessary be done.to resend the permit and comply with the agreement.
