Dear Richard:
As requested by Nancy yesterday, during our phone conversation, I have included a
calculation of the maximum gross residential floor area (GRFA) allowed on Lot 8, Bighorn
Subdivision. This 33,267 square foot lot is zoned Residential Duplex. Based on the
aforementioned information, the total GRFA allowed on Lot 8 is 6,263 square feet. In addition,
each half ol the duplex located on Lot 8 may apply for an additional "250" square feet of
GRFA.
Until recently, the total GRFA used on the property was 5,919 square feet (2,673 square feet
in Unit A and 3,246 square feet in Unit B). However, a remodel was recently approved for the
lsaacs residence (Unit A) whidh included a 431 square foot addition ('l 81 square feet of
remaining GRFA plus "250" allowance). The remaining GRFA on Lot 8 is 163 square feet
plus a "250" allowance for unit B.

Dear Kristan;
Thank you for the letten of June 13, 1984 stating the Planning
Departmentrs positi-on that the ttcabin" must be removed before
the Plat for the duplex subdivision will be signed off.
I would think there could be a letter from me stating that the t'cabin" will be moved before permanent occupancy permit would
be issued to me. This was my understanding with the Building
Department when the Permit was issued to build and in all the
recent conversation.
I am trying to see if someone who needs a small home ean use
the structure before I simply demolish it. Does someone in
your department really think I want it on my property to
detract from my new duplex?
Letts see if there is some way to solve this matter.

Thls avalanche loadlng analysls was tequested by l'1r. Bob l{eller' the
orner of the propoged Keller duplex ln Vall' Colorado. The proposed duplex
ls exposed to snal I porder aval-anches that xUI prcduce noderate forces on
the structure. This study presents the resul ts of the analysls of load.lng
on the varlous exposed surfaces. Archltectural and structural englneerlng
cletalls used to satisfy the glven Loads are beyond the scope of thls stuily.
The results 6iven here are slte speclflc and apply only to archltect-
ural detatls given ln drarlngs provlded by the Trout Creek Archltects of
ValI and dated 11 February' 1983. The results presented here should not
be applled at other locatlons because avalan che condltlons x111 ' ln general ,
dlffer ntth locatlon. Furthernore ' alterations of shape ' posltionr and
angular relatlonshlps ln the duplex deslgn could lnvalldate the resul ts
glven here .
DESIGI{ AVALANCi[E C9NDITIONS
The deslgn avalantche has an estirnated retuln Perlod of one century
(a constant L% annual- probablllty), tna ls larger than any observed at this
Iocatlon during the Z0-year hlstory of ValI . The avalanche ulll occur as
a large volune of dry snor.r fractures and accelerates on the 35o to +0o slopes
above the pronlnent llrnestone cliffs 100 to J00 feet abo ve and to the south
of Luplne Drlve. As the avalanche falls over the cllffr alr xill becone
entralned lnto the flon and a deep, dlffuse cloud of flnely-pulverIzed,
snon and tce particles (the powder avalanche), will rush ahead of the rnain
snow nass arld cross Luplne Drlve at approxlrnately )O n/s (65 mpn) veloclty,
(ffgure 1). The nex bul1dlngs south of Luplne Drlve rill block sorne of the
dense avalanche but rlII not prevent the poxder avalanche frln reachlng the
Keller duplex.
DESIGN AVALAT{CHE EFFECTS
Flgure 1 ls a scherlatlc draxing of the avalanche *"rtron rlth respect
to the Keller duplex. The dlstal llnlt of avalanche debrrls 1s located
app'roxlnately 100 feet south of the structures, but the poxder avalanche

travels furlherr engulflng the bulldlngs and produclng forces slnllar to
an lntense rlnd gust. The Ioads on exposed surfaces rlII rlse fron zero
to the naximurn speclfled ln Table 1 ln 0.1 second and r11I perslst fot 5
seconds. Two pressure zones are shorn ln Flgure 1 be cause avalancbe veloclty
and gressure decrease as the avalanche decelerates slth dtstance.
A total of 18 surfaces (9 r.all and 9 roof surfaces), are exposed on
the garage and. rnaln bulldlng, as shoxn ln Fl6ure 2. These sane surfaces
are also r€ferred to ln Table 1 where the rnagnltudes of the pre ssures are
glven .
Loadlng detalls are glven ln Flgure l. For powder-avalanche plessures
of the rnE€nltudes glven here (40 to 1OO fts/ftz), deslgn shouLd assune only
the surface-nornal conponent of p'ressure on nost surfaces. The only exceP-
tlon lnvolves the overhanglng eaves upon xhlch an upllft conponent is equal
to the nornal conponent on the Yall belox.

The purpose of this letter is to inform you that the.Design. Review Board's decision
apprbvihg the Ke'l1er Duplex on Lot 8, Bighorn Subdiv'ision, has been called up and
overturned by the Vail Town Council .
The DRB's decision was called up by the Council at their afternoon work session
of April 12, 1983. The call up was placed on a Council agenda and heard at a
public hearing the evening of April l9' 1983.
At this meeting the Council overturned the DRB's decision, effectively denying
the application to construct the Ke'l ler duplex, In their motion to overturn
the Council ruled that:
a. The application djd not meet 18.54.0.l0, Purpose statement, of the Design
Revievr Chapter. This section reads:
Inordertopreservethenatura.lbeautyofthetown'ssiteand
setting, and to prevent jndiscriminate c'learing of property,
remova] of trees, and earthmoving, and to attain the objectives
set out jn this section, exterior design of al'l new development
and add'itions to existing development shal'l be subject to design
review.
b. The application did not meet paragraphs L, R, and S of Section'18.54.070
Des'ign Guidel ines:
L, Removal of trees, shrubs, and nonhazardous native plant materials
general'ly should be limited to remova1 of those essential for
development of the site.

stated the need for an additional pa,ragraph to the resolution regarding the deed of trust. There was some discussion following regarding default pro-edures, payment schedules, and other items relevant to the purchase, After more-discussion, a motion was made by Paul Johnston to approve Resolution #g and Ron Todd seconded the motion. A vote was taken ana the moti-on passed unanimously.
The next item discussed which was not on the agenda was the first read.ing of ordinance #18, Serigs of 1983, an ordinance auihorizing an appropriation in the amount-of $45o,Oo0.oO in connection with the purchase and acquisition by the Town of Vail of the Pulis Ranch on the Vail golf course for a purchase price of $2,650,000. There t'as some discussion following. Ron Todd made a motion to approve ordj-nance #18 on flrst read.ing with typos corrected on the names of the Councilmembers, and Bill wilto seconded the motion. A vote was taken and-the motion passed unanimously and the ordinance was ordered published in fu11 on flrst read.ing.
There was no citizen participation.
The next j-tem on the agenda was a discussion of proposed expanded bus service duringSulnmerhours.liIr.FiroozZadehpresenffipetition of over 400 signatures representing resid.ents who would like to see extended bus servi-ce provided. There wa,s discussion between the councir and citizens.It wa"s f e1t tha"t because of a decrease in revenue dollars, i-t would. probably not be possible to extend the service this summer, but i.t asked that the

A vote was taken and the motion was defeated 3 - 2 - Todd, Slifer and Johnston opposing. Chuck.Anderson a.bstained.Ron Todd then made a motion to overturn the DRg decision and deny the duplex as outli-ned. Paul Johnston second.ed the motion. There u'as some discussion following. Rod Slifer then ma.de a motion overruling Ron Toddrs motion to approve plan "A-1' of the Keller duplex. on Tuesday, March 15, 1983, a regular meeting of the vail rown council was held in the Vail Municipal Building.

The first item on the
award to Colleen Kline presented the award to her past 10 years with
agenda was a presentatj,bn of L ten year belt buckle for her service to the Town of Vail. Rich Caplan Colleen and Colleen gave a fe,$, rema.rks relating to the Town.
Tbe next item on the agenda. was the second reading of O_r{!4ance #10, Series of 1983, an ordinance relating to the dumping of snow on FiJvaTE-T-roperty.Mr. Caplan explained that no changes Eatl-TEEi-made to-TEIE-oidinance since first reading. After some discussion Bill Wilto ma.de a motion to pass Ordinance #10 on second reading and Gail Wahrlich seconded it. There was some discussion. A vote was ta.ken and the motion passed s - z - Hermann staufer and Ron Todd opposing.. The ordinance wa-s ordered published by title on1y.
The next item on the agenda was the second reading of Ordinance #12. Series of 1983, aro ordinaDce-providing for an earlj-er subnitta-L deadline for exterior alteration and modification in Commercia,l Core III for the spring of 1983 on1y.ItwassuggestedbyRodS1iferffibetab1ed-unti1nextmeeting
after further discussions relating to the Lionshead Improvement Program were held. After some discussion Bill Wilto made a motion to table Ordinance #12 and Paul Johnston seconded it. A11 voted in favor of the motion.
The next item on the agenda was the r9 { Resolution #6,a resolution relating to rezoning ofalhe_ll1_l]eir. Bill post,Series of 1983,
representj-ng the applicant' was present. After some-discusGion Bon Todd made a motion to pass Resolution #6 and Hermann Staufer seconded i-t. A11 voted in favor and the motion passed unani-mously.
The next item on the agenda was Citizen Parti.cipation. Mary Ann Mue11er,represeDting the Lea.rning Tree, gave a. presentation to tbe Council requesting.the parking area adjacent to the school be paved. There was some discussion following. Bill Wilto suggested that she approach the Rotary Club or some other community service group in Vail to help with the funding and stated that the Town was not in a position at this time to cover the expenses. It was finally decided that the Town would grade the lot when the dj-rt was dry and purchase some gravel to be spread about the area, and that was the best they could do at this point in tlme.
Also under Citizen Participation, Bill Wi1to, representing several East Vaj.1 residents, expressed their desire for a tot 1ot in the East Vail Park. It was decided that this would be considered when funds were available.

There was a generaL feeling arnong the council that there were too many trees being "ii."tEa--uy tr,u place-ler-t! of this project. Bon ?odd made a moiion to uphold the DRB deeision and Gail wahrlich seconded it. A vote was taken and the motion passed s _ 1_Hermann Staufer opposing.
The next item on the agenda was a department report by Bill pyka, Finance Department ' Bill gave a rundown on the specific areas of the finance depa.rtment and thei'r vari-ous duties- There was some discussion as to the Town,s intent to look into collecting its own sales tax from the businesses in Town. There was also discussion on sales ta.x projections for the remainder of the 1gg2-g3 ski season.

0n March 2, 1983 the Design Review Board denied an application
to erect the Kel'l er Duplex on Lupine Drive. The vote was none for, five against, with Al Amaral abstaining. The Board cited
section 18.54.070, paragraph L, in their motion for denial:
L. Removal oftrees, shrubs, and nonhazardous native plant materials should be 'limited to removal of those
essential for the development of the site.
The majority felt that the house cou'ld be resited in order to
save a number of trees.
Enclosed is a copy of the topographic survey with the approximate
location of the proposed duplex, decks, garages and existing trees.
The existing residence is to be torn down.
