At your request I conduded a site inspection of your property at3747 Lupine Drive
yesterday- The purpose of my inspec|ion was to evaluate the exposute of your property
and the proposed addition on the east end of the existing building b rocKall, debrisflolt,
and avalanches. lvly observations and conclusions are summarized below.
'1. Rockfall - According to Town of Vail hazard maps, a "high severi$" rocKall area
extends as far north as Gore Creek, including all of the existing house and area
of the proposed addition. I believe this rockfall hazard designation should be
revised. The rockfall-hazard area shouH extend dgtt*DRonly as far as the
uphitt (southem) side of the existing house tocatdlacroqglrrpine Drive. This
house will prevent rocks from reaching your houihffhouse and the
proposed addition is not located in a rockfall area.
2. Debris Flow - According to Town of Vail maps, the house (and the proposed
addition) is not located in a debris flow area. As a result of my site inspection, I
concur with the Vail debris-flow designation. Your property is not in a debri+flow
area.
3. Snow and debris avalanche - According to the Town of Vail debris avalandte
and snow avalanche maps, your property is not affected by debris or snow
avalanches. I also agree with this designation.
Because the existing house and the proposed addition on the east end of the house are
not located in rockfall, debris-fbw, or avalandle areas, mitigation will not be required.

1 ' The Board commented that the driveway should be re-surfaced as a part of this proposal. From our brief conversation in the lobby, it seemed as though this suggestion is already being coniemplated by the owner.

Dear Sean,
Thank you for submitting an application for final review of an addition and minor exterior alteration at the
referenced address. Both the Planning and Public Works Departments have reviewed the project and are in
need of the following items prior to final review of the addition and alteration:
Plannino Department comments
. Please show 9'x '19' parking spaces for each required parking space, whether enclosed or
unenclosed. According to my calculations, four full sized parking spaces are required at Unit A and
three full sized parking spaces are required at Unit B. A total of seven spaces must be delineated
upon the site plan.
. Please submit section drawings of living areas which are greater than 15'11" in height. This will allow
me to correctly verify the amount of vaulted space within each unit.
. Please submit utility company approval signatures prior to final review.
. Please submit plans that detail the boulder retaining wall that is going to be erected upon the
Andrews' parcel, per your letter to me dated January 23'. The fact that the wall is being changed
prompts the submission of new plans for the wall, even if it is in the same location in order to carry out
the same purpose.

. Please provide a site plan with a 1" = 10' scale prior to final review.
. Please signify on the site plan the proposed Limits of Disturbance fencing.
. Please provide the slope of the driveway and spot elevations upon the driveway prior to final review.

(30%) of the total paved areas must be provided adjacent to such paved areas upon the property.
Currently, it appears that snow storage in the equivalent of only 1O% of the total paved areas has

rrrEJ 5. lt is mutually agreed that the Developer may apply for and the Town ma
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of the collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements referred to in this Agreement.
6. lf the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall not be required to, draw upon the security referred to in this
Agreement and complete the uncompleted improvements referred to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy referred to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent'
(12o/o) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements referred to in this Agreement, such failure or refusal shall be considered a violation
of Titfe 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements refened
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail-Town Code, for a period of two years after the Town's acceptance of said
improvements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

Thank you for stopping in T'imberline's office during your recent visit
to Vail. It was a pleasure meeting you.
0n the morning of November Bth I talked with Diana Toughill and told
her of your vis'it to Vail during her vacation. |'le talked about your
request for informatjon and the necessdry steps to divide your lot
into two parcels. Diana said the Planning Cormission would probably
require an enviQonmental impact study so they could be assured that
they would not be creatfng a double problem by allowing the division
of a slide area.
She suggested talkrng to Abe Shapiro. I disclosed that I had already
talked to Abe whr; said he would, for $1 ,000, share hjs report; rather
the porti.on of his report in which you are interested. She also mentioned
that Abe, tc her knowledge, had determined how to construct on his five
