Dear Jim:
Unforlunately, your August 5, 1994 letter is still drawing some questions from my legal
colleagues back in Minnesota. The buyer is represented in this transaction by the firm of
Faegre & Benson, and I have simply been retained as local counsel, I have had to send
everything to Faegre & Benson's firm in Minneapolis for further review.
The Faegre & Benson attorneys have asked that you revise your August 5, 1994 letter
by deleting the final sentence in ihe first paragraph and substituting the following language:
In the event your client wishes to expand the existing building on
Lot 4 or construct a new building on Lot 4, the portions of either
of those slructures which extend into the setback area could not
extend beyond the perimeter line established by the existing
building walls in lhat area or break the plane of the existing roof
or chimney lines which exist in that area. Any expansion within
the setback area in excess of these limitations would require
appropriate variances under the nonconforming and setback
sections of the Vail Municipal Gode. These restrictions apply, of
course, only to the improvements within the setback area.

Dear Jim:
As you requested, this letter is intended to document our previous conversations regarding the
above-referenced lots. As I understand it, the existing building on Lot 4 encroaches into the
20 foot front yard setback area. I also understand that the building was built before
annexdtion into the Town of Vail, and therefore the building setback encroachment is
considered to be a legal nonconforming situation. That being the case, the existing perimeter
lines of the building establish the extent of the setback nonconformity. The building may be
demolished and a new building constructed provided that the wall and roof line locations of
the existing building are not expanded. Any expansion of the existing building, or a new
building, which would extend beyond the perimeter line established by the existing building
walls, or break the plane ol the existing roof or chimney lines would require variances from the
nonconforming and setback sections of the Vail Municipal Code.
I hope the above information is what you needed to complete your property transaction,

Thank you again for your letter of ,tuly l-8 regardinq your proposal to trade Lot L of the Bighorn Second Addition, for the Town,s assistance in filling the pond on Lot 5 and thereby creatinq a developable lot.After discussion of your proposal with the Town's planning staff, it
appears that a number of approvals would be necessary prior to any modification of the 1-00-year floodplain on Lot 5. We have identified the following:
1-. A Town of Vail Planning and Envj.ronmental Comrnission approval of a floodplain modification is required. This would require the subrnittal of an Environmental frnpact report, and more specifically the hydraulic analysis necessary for the
f loodplain nodif ication.
2. An Arny Corps of Engineers permit, either an Individual or a Nationwide Permit, would be required.
3. A Conditional Letter of Map Revision from the Federal
Emergency Management Agency (FEMA), would also be required.
Due to the specific expertise necessary to complete the Environrnental Impact Report and the required Town of Vail approvals, I believe it
would not be in the Town's best interest to pursue your proposal.

RE: Modification of the Floodplain on Lot 5, Bighorn Subdivision 2nd Addition
Dear Athena:
The staff discussed your request to fill the existing pond on Lot 5 of Bighorn Subdivision 2nd Addition. fn order to fill the pond which is in the 100-year floodplain, according to the
Improvement Location Certificate completed by Eagle Valley
Engineering dated December 8, 1985, you would need to do the following:
l-. Subrnit an Environmental Impact Statement in
accordance with Section 18.56 of the Town of Vail
Municipal Code which states that the rnodification of the floodplain by fill and construction will not
adversely effect adjacent properties or increase the guantity and velocity of flood waters.
2. Your written request to rnodify the floodplain and the
Environrnental Impact Statement would be reviewed by our Planning and Environmental Cornrnission. They neet the second and fourth Monday of every month.
Subrnittals are required approxirnately one month
before each neeting. Attached to this letter is a
schedule of their upcorning meetings as well as their subrnittal dates.
3. fn respect to your question, as to how much floodplain wouLd need to be filled in, it depends on the design of the house. The primary/secondary zone district requires that you maintain a twenty foot front setback and fifteen foot side and rear setbacks. The structure rnust also be located so that it does not encroach into the fifty foot stream
centerline setback. Staff lrould recomrnend removing as little of the floodplain as possible.
4. I also checked our geological hazard maps, and it
appears that Lot 5 is also in a high hazard rockfall area. Before we could release a building perrnit for a unit on this property, you would be required to subnit a study from an engineer capable of reviewing rockfall. If the report stated that rrthe site is a geologically sensitive area, but development will not
increase the hazard to other properties or structures, or to public buildings, rights-of-way,roads, streets, easements, utilities or facilities,or other properties of any kind,I then you would be able to build your project without having to do any special nitigation for the rockfall. If, however,the report would state that your structure would
impact and increase the hazard to other adjacent properties or structures, then you would be required to do the nitigation.
