Dear Mr. Gibson:
Qwest Corporation is upgrading and enhancing telecommunication services in the Bighorn Townhouses
Subdivision and surrounding area. [n order to complete these enhancements, they would like to install a new
(Digital Service Line) cabinet in the platted easement that extends along the southem l0-feet of Tract D,
Bighorn Townlouses Subdivision titled to the Town of Vail. The telecommunications cable route will extend
into the common platted easement area of the northem 5 -feet of Lot l, Block 7, Bighorn Subdivision Fifth
Addition titled to East Vail Realty Holding LLC.
This equipment will be used in conjunction with the existing equipment located at 4768 Juniper Lane and will
bring ttre availability of high-speed communication services to the residents in this area. The new cabinet will
measure approximately 3 /z-feet square, by 5 %-feet. tall and will rest on a concrete slab approximately l0-feet
by l0-feet.
This letter serves, as notice of Qwest's intent to construct these facilities. A sketch of the lots has been encloscd
to show the area of the proposed construction. Qwest's contractors will be responsible fbr pulling applicable
permits. Qwest will be responsible for eight 5-gallon shrubs to screen cabinet.

(one copy for your records) in the envelope provided.

1. If the utility approval & verification form has signatures from each of the utility companies, and no comments are
made directly on the form, the Town will presume that there are no problems and the development can proceed.
2. If a utility company has concerns with the proposed construction, the utility representative shall note directly on
the utility verification form that there is a problem which needs to be resolved. The issue should then be detailed in
an attached letter to the Town of Vail. However, please keep in mind that it is the responsibility of the utility
company and the applicant to resolve identified problems.
3, These verifications do not relieve the contractor of the responsibility to obtain a Public Way Permit from the
Department of Public Works at the Town of Vail. Utilitv locations must be obtained before digging in any public right-
of-way or easement within the Town of Vail. A building oermit is not a Public Way permit and must be obtained
separatelv.

PUBLIC WORKS PERMIT PROCESS
How it relates to Building Permits:
1) Fill out our check list provided with a buildinq permit apolication.
lf yes was answered to any of the above questions then a "public way" is
required. You can pick up an application at either community Development,
located at 75 S. Frontage Road or Public Works, located at 1309 Vail Valtey Drive.
2) Notice sign offs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies require up
to a 48 hour notice to schedule a locate.
3) A construction traffic control/staging plan must be prepared on a separate sheet
of paper.An approved site plan may also be used. This plan will show locations
of all tratfic control devices(signs, cones, etc..) and the work zone, (area of
Construction, Staging, etc..). This plan will expire on Oct. 1sth. and will need to
be resubmitted for approval through the winter.
4) Sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the traffic control plan or a site
plan for the job.
5) Submit completed application to the Public Works's office for review. lf required,
locates will be scheduled for the Town of Vail Electricians and lrrigation crew. The
locates take place in the morning but, may require up to 48 hours to perform.
6) The Public Work's Construction lnspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any that may
needed. Most permits are released within 48 hours of being received, but please
allow up to one week to process.
7) As soon as the permit is processed, a copy will be faxed to community
Development allowing the "Building Permif'to be released. Please do not confuse
the "Public Way Permit" with a "Building Permit" to do work on a project itself.
NOTE:
* The.above"process is.for work in a public way only.* Public Way Permits are vatid only until November 1Sth.
' A new Public way Permit is required each year if work is not complete.

This letter is intended to document our telephone conversation today regarding staff approval
of your final plan for the paving and addition of a sidewalk and stairs at the Bighorn
Townhomes. The staff approval of the revised paving plan is contingent upon the lollowing:
1. The overall amount of asphalt shown on your revised plan shall not exceed the
amount shown on the previously approved plan, dated October 13, 1993. This
plan was drawn by Sydney Schultz in response to Mike Mollica's concerns
regarding a reduction in the amount ol paving on the property.
2. Per discussions with Mike McGee of the Vail Fire Department, the minimum
aisle width between opposing parking spaces must be a minimum of 20 feet.
3. A public way permit must be approved by the Vail Public Works Department
prior to beginning any work 0n this property.

Dear Mike,
Attached hereto is the final plan for the paving and addition of a sidewalk and stairs leading to Building A. This plan prepared by Sidney Schultz of Gwathney Pratt Schultz Architects vrras approved by the otrners at their annual meeting held JuIy 9, L994.
Also attached is the Agreenent between B&B Excavating and Bighorn showing a cost of $15,497 to cornplete the paving.
The cost of the stairs and sidewalk is estinated at 9J.r200.
Please address this issue at the Tuesday, July 19, L994 Design Review Board neeting. Because of a project that B&B is doing for the Town of Vail at the Bighorn Park, Bighorn
Townhomes could receive a discount in the paving price as a result of not having to nove equipnent being used in the TOV project back out to the site. Bighorn Townhorners paving will tegin by the end of next week if ipproval can be grantei Uy
Tuesday.
AIso, in accordance with your letter dated August i-8, Lgg3,Bighorn agrees to vegetate the road area southeast of them,if the Town of Vail will set boulders and till the soil.

Dear Sid:
The Town of Vail Planning Depaflment has granted staff approval to your request, on behall
of the Bighom Townhomes Association, regarding asphalt paving of the parking area. This
approval is contingent upon your agreement to reduce the amount of asphalt to the north of
the trash dumpster as we discussed today. Additionally, you agreed to coordinate with the
Vail Fire Department (Jeff Attencio) regarding the required fire-tumaround.
The Town of Vail is willing provide and set b_oulders at the southem-most end of the asphalt
parking area. Additionally, the Town of Vail is willing to till the soil to the east of the new
asphalt area, up to the intersection with Meadow Drive. As originally agreed to, revegetation
of this area will need to be provided by the Bighom Townhomes Association.

RE: Notification of Bighorn Townhouse of AvaLanche Hazard and filing of Public Notice with EagIe County
The Planning Commission has requested the
Community Development staff to notify all property
located in avalanche hazard areas.
In reviewing the K.A.C. avalanche
pinpoints the Bighorn Townhouse project as being in
avalanche path and indicates a 6e% probability that
will be destroyed in their estimated lifetime.
I have talked with Larry Rider at length regarding
the 1egal implications of notifying property owners as requested
by the Planning commission, He feers the Town is not i-ncurring
,a legal liability by the notification and, i,n fact, feels we
have an obligation to do so. on properties where we have very
speci-fic information such as KAC and Bighorn Townhouses, he feels
we should file a "public Notice" with Eagle county so the avaranche
Itazard becomes a part of the permanent property record so as to
notify potential purchasers of the hazard. rn addition, r wourd
also like to notify a1r locaf real estate companies as two of the
units are presently on the rnarket.

set a date for public hearing for the council to review the
avalanche reporti and that we should notify the King Arthur
people (Don Thomas, Sliver State Savings) at least 15 days
prior to the hearing by certified mail so that they can attend
