CODE 5-2-10: ITEPOSITS ON PUBLIC WAYS PROHIBITIIT
A. Unlawful deposits: Subject to subsection C thereoi it is unlawful for any person to litter,
track or deposit, or cause to be littered, tracked or deposited, san{ gravel, rocks, mud, dirt,
snow, ice, or any other debris or material upon any streeL sidewalk, alley or public place, or
any portion thereof.
B. Notice; Abatement: The Director of Public Works may notifr and require any person who
violates or causes anotler to violate the provision of subsection A hereof, or who has in the
Director's employment a person who violates or causes another to violate the same, top
remove such sand gravel, rocks, mud, dirt, snow, ice or any other debris or material wittrin
twenty four (24) hours after receipt of said notice by the Director of Public Works. In the
event the person so notified does not comply with the notice within the period of time herein
specified" the Director of Public Works, or other authorized agent, may cause any such sand,
gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed from any street
or alley at tle expense ofthe notified.
C. Exceptions: The provisions of subsection A hereof shall not be applicable:l. Within the immediate area of any constructioq maintenance or repair project of any
street or alley or of any watcr main, sewer md4 electricity line, gas line, telephone line
or any appurt€nance thereto;
2. To deposits of sand, dirt or materials necsssary for the protection ofttre public safety; and
3. To public areas designated for the dumping or depositing of said materials.
D. Summons; Penalty: As an alternative to lhe notice for removal provided in subsection B
above, any
person who violates or ciruses another to violate the same, may be issued a summons to
appear before the Municipal Court of the Town for said violations, and upon being found
guilty ofa violation hereunder be punished as provided in Section l-4-1 of this code.
E. Notice; Penalty: It is unlawful for any person to fail or refirse to comply with the notice of
the
Director of Public Works as provided in subsection B hereof, and any such person shall, in
addition to payment of the expense of removal incurred by the Director of Public Works, as
provided in subsection B hereof, upon being found guilty ofa violation hereunder, be
punishable as provided in Section l4-l ofthis Code. (1997 Code: Ordinance 6 (1979)

BUILIIING PERMIT ISSUANCE TIME F'RAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Plaruring Department review of Health Department review, and a review
by the Building Deparhnent, the estimated time for a total review may take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount of
time. However, if residential or smaller proJects impact the various above mentioned
deparhnents with regard to necessary review, these projects may also take the three (3) week
period.
Every attempt will be made by this departrnent to expedite this permit as soon as possible'

In consideration of the issuance of a revocable permit for the structure above indicated,
applicant agrees as follows:
1. That the struc{ure herein authorized on a revocable permit basis is restricted
exclusively to the land above described.2. That the permit is limited specifically to the type of structure described in this
application.3. That the applicant shall notify the Town Manger, or his duly authorized agent, twenty-
four hours in advance of the time for commencement of construction, in order hat
proper inspection may be made by the Town.4. The applicanl agrees to indemnity and hold harmless the Town ol Vail, its otficers,
employees and agenb from and against all liability, claims and demands on account of
injury, loss or damage, including wilhout limitation claims arising from bodily injury,
personal injury, sickness, disease, death, property loss or damage, or any other loss of
any kind whatsoever, which arise out of or are in any manner connected with
applicant's activities pursuant to this permit, if such injury, loss, or damage is caused in
whole or in part by, or is claimed to be caused in whole or in parl by, the act, omission,
error, professional error, mistake, negligence or other fault of the applicant, his
contractor or subcontractor or any otficer, employee or representative of the applicant,
his contractor or his subcontactor. The applicanl agrees to investigate, handle
respond to, and to provide defense for and defend against, any such liability, claims, or
demands at the sole expense of the applicant. The applicant also agrees to bear all
other expenses relating thereto, including court costs and attomey's fees, whether or
not any such liability, claims, or demands alleged are groundless, false, or fraudulent.
Applicant agrees to procure and maintain, at its own cost, a policy or policies of
insurance sutficient to ensure against all liability claims, demands and other obligations
assumed by lhe applicant pursuant to this Paragraph 4.

obstruction, or other struciurs constitubs a nuisance, destrop or impairs the use of
the right-of-way by the public, constitutes a traffic hazard, or the property upon which
the encroachment, ohstruction, or structure exists is required for use by the public; or it
may be revoked at any time for any reason deemed sufficient by the Town of Vail.
That the applicant will remove, at his exponse, the encroachment, obstruc'tion, or
structlre within ten days after receiving notice ol any revocation of said permit.
That the applicant agrees to maintain any landscaping associated with the
encroachment on ths right-oFway.
Thal in the event said removal of the encroadrment, obsfuction, or structure is not
accomplished within ten days, the Town is hereby auhorized to remove same and
havs the right to make an assessment against tho prop€rty and collect the costs or
removal in the same manner as general ta(es are collected.

3, PERMITTEDTRANSFEREES

When the presenter is a permitted Transferee under paragraph 3 above, the documents required for a draw shall include:
A. All documents required elsewhere in this Lefter of Credit, except that such documents may be in the name of and executed by either
the original Beneficiary or the prelenter permitted by paragraph 3; and
B. When the presenter is a permitted Transferee under paragraph 3.A or a third party under 3.8, a certified copy of the one or more
documents which show the presenter's authority to claim through or to act with authority for the original Benenciary.
5. TIMING OF DISHONOR
Under no circumstances shall Lender be precluded from relying upon any reason for dishonor given in a communication which
Beneficiary or the presenter receives within three (3) Banking Days after Lender has received the last document forming part of
Beneficiary's presentment (the "Three-Day Period'). Lender shall be entitled to rely upon any such reason without regard to eilher (i) the
timing of any presentment made before the Expiration Date, or (ii) the timing inside the Thre+Day Period of any preliminary
communication(s) from Lender concerning the dishonor decision itself or any reason for dishonor. For any such reason so given during
the Three-Day Period, Lender shall be conclusively deemed to have met the 'reasonable time', 'without delay', and other timing
requirements as the Uniform Customs and Practice for Documentary Ctedits, 1993 Revision, ICC Publication No 500, as most recently
published by the International Chamber of Commerce (hereinafter called the "UCP') may impose. The Expiration Date shall not be
e)dended to accommodate a presentment made with less than three (3) Banking Days to go before the Expiration Date, and Beneficiary
shall not be entitled to submit a draw request or provide Lender with any documents in support of a draw after the Expiration Date
hereof. Nor shall Lender ever red to communicate a dishonor decision or its reasons within a time less than the Three-Day
