WHEREAS, the Owner wishes lo place certain restrictions on the use of a unil or apartment located on
the Property for the benefit of lhe Owner and the Town of Vail, Colorado ("the Town").
NOW, THEREfORE, the Owner does hereby impose, establish, acknowledge, and declare for the
benefit of all persons who may hereinafter purchase, or lease, or hold the subject land the folloting restrictions,
covenanls, and conditions, all of which shall be deemed to run with the land and inure to the benefit and be
bonding upon the Owner, its respective grantees, successors, and assigns.
The Employee Housing Unit (EHU), containing 7/ 6 square feet, is hereby restricted as a
Type ll EHU which must comply with all the provisions of Chapter 13, Title 12 of the Town Code
of Vail as amended.
The Type ll EHU shall not be subdivided or divided into any form of timeshares, inlerval
ownership, or fraclional fee.
The Type ll EHU shall be leased to and occupied by tenants who are full-time employees who
work in Eagle County. The Type ll EHU shall not be leased for a period less than thirty (30)
consecutive days. For the purposes of this paragraph, a full-time employee is one who works
an average of a minimum of thirty (30) hours each week on a year round basis. The owner of
the Type ll EHU shall rent the unit at a monthly rental rate consistent with or lower than those
market rates prevalent for similar properties in the Town. The Type ll EHU shall be continuously
rented and shall not remain vacant for a period to exceed five (5) consecutive months.
Occupancy of the Type ll EHU shall be limited to a maximum of two persons per bedroom.
lf the Type ll EHU is constructed without a dedicated garage, a minimum of seventy-five (75)
square feet of storage area in addition to normal closet space is required for the exclusive use
of the occupant of the Type ll EHU.
The Type ll EHU shall have its own entrance. There shall be no interior access from any EHU
to any dwelling unit to which it may be attached.
The Type ll EHU must contain a kitchen or kitchenette and a bathroom.
The Type ll EHU may.not be sold, transferred, or conveyed separately from the unit with which
it is associated.
No later than February 1 of each year, the owner of lhe Type ll EHU shall submit two (2) copies
of a sworn affidavit on a form to be obtained from the Community Development Departmenl, to
the Community Development Department, setting forlh evidence establishing that the employee
housing unit has been rented or owner-occupied throughoul the year, the renlal rate, the

employer, and that the tenant who resides within the employee housing unit is a full-time
employee in Eagle County.
The Type ll EHU shall be operated and maintained in accordance with Chapter 13, Title 12 of
the Town Code of Vail. Failure to do so may result in enforcement proceedings in a court of
competenl jurisdiction and in accordance with Chapter 3, Title 12 of the Town Code of Vail.
The conditions, restrictions, stipulations, and agreements contained herein shall not be waived,
abandoned, terminated, or amended except by the written @nsent of both the Town of Vail and
the Owner of the Property.

I have reviewed the site plan and it appears we can stage in ihe driveway. lf there are vehicles in the
driveway at the time of the fire, it appears we can jump the deck reiling (deck on grade) and gain access.
Measuring around the exterior perimeter from the street, including the tteck, it appears lhe circumference
is 345 fi. Access to the driveway gains 50 feet.
Bottom line, we're close enough to approve without sprinklers.

\ The Town of Vail Building Department has developed the following prrtcedures to
ensure that new construction sites have adequately established prop(lr drainage
from building sites along and adjacent to Town of Vail roads or streets.
\ The Town of Vail Pr-rblic Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streels and the installation oI temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection, Please call Leonard Sandoval at 479-2198 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.

at Vail, 1420 Moraine Drive, Vail, Colorado.
Dear Mr. Oberley:
As requested, a representative of Hepworth-Pawlak Geotechnical, Inc. observed the
excavation at the subject site on February 16 and 22,2OOl to evaluate the soils exposed
for foundation support. The fudings of our work and recommendations for the
foundation design are presented in this report. The work was done in accordance with
our agreement for geotechnical engineering services to DMC Construction, dated
February 16,2OOl.
The proposed residence will consist of a two story wood frame structure over a
basement level and crawlspace. The basement floor will be slab-on-grade. The garage
floor will be structural over a crawlspace. A second story of living area will be located
above the gamge. Spread footings sized for an allowable soil bearing pressue of 2,000
psf were assumed in the design.
At the time of our initial visit to the site, the excavation was about half complete and
had been cut in fwo levels from 4 to 8 feet below adjacent ground surface. A boulder
about 4 feet in size was removed from the eastern part of the excavation, leaving a hole
about 3 feet deep. When observed on February 22, the foundation excavation had been
completed and cut in two levels from 3 to 10 feet below the adjacent ground surface.
The soils exposed in the bottom of the excavation consisted of silty sand aud gravel with
cobbles and occasional boulders. The hole created by the removal ofthe boulder had
been an baclcfilled with on-site soils. We understand that the backfill was placed in four
lifts and compacted. The results of a gradation analysis performed on a sample of sand
and gravel (minus 5 inch fraction) obtained ftom the site are presented on Fig. 1. No
free water was encountered in the excavation and the soils were slightly moist to moist.
Considering the conditions exposed in the excavation and the nature ofthe proposed
co$truction, spread footings placed on the undisturbed natural soil designed for an
allowable soil bearing pressure of 2,000 psf should be adequate for support of the
proposed residence. Footings should be a minimum width of 16 inches for continuous
walls and 2 feet for columns. Loose and disturbed soils in footing areas should be
removed and the bearing level extended down to tle undisturbed natural soils. Exterior

footings should be provided with adequate soil cover above their bearing elevations for
frost protection. The excavation should be protected against freezing and concrete
should not be placed on frozeu ground. Continuous foundation walls should be
reinforced top and bottom to span local anomalies such as by assuming an unsupported
leugth of at least 12 feet. Foundation walls sgting as retaining structures should be
designed to resist a lateral earth pressure based on an equivalent fluid unit weight ofat
least 45 pcf for on-site sand and gravel soils, excluding oversized rock, as backfill. A
perimeter foundation drain should be provided to prevetrt temporary buildup of
hydrostatic pressure behind the walls and prevent wetting ofeach below grade level.
Structural fill placed withil floor slab areas can consist of the on-site soils compacted to
at least 95 % of standard Proctor density at a moisture content near optimum. Backfill
placed around the structure should be compacted and the surface graded to prevent
ponding within at least 10 feet of the building.
The recommendations submitted in this letter are based on our observation of the soils
exposed within the foundation excavation and do not include subsurface exploraliou to
evaluate the subsurface conditions within the loaded depth of foundation influence.
This study is based on the assumption tlat soils beneath the footings have equal or
better support tlan those exposed. The risk of foundation movement may be greater
than indicated in this report because of possible variations in the subsurface conditions.
In order to reveal the nature and extent ofvariations in the subsurface conditions below
tle excavation, drilling would be required. It is possible the data obtained by
subsurface exploration could change the recommendations contained in this letter.
