NOTES TO ALL APPLICANTS
Pre-application Meetinq
A pre-application meeting with Town of Vail staff is encouraged. The purpose of a pre-application meeting is to
identify any critical issues pertaining to the applicant's proposal and to determine the appropriate development
review process for an application. In many cases, the pre-application meeting helps to expedite the
development review process as critical issues are rdentified and dealt with in the,preliminary stages. A pre-
appf ication meeting may be scheduled by contacting Judy Rodriguez al970.479.2128 or jrodriguez@ci.vail.co.us
Time Reguirements
The Design Review Board meets on the 1st and 3rd Wednesdays of each month. A complete application form
and all accompanying material must be accepted by the Community Development Department prior to
application deadlines. A schedule of DRB meetings and associated application deadlines may be found on the
World Wide Web at http:i/ci.vail.co.us/commdev/planning/drb/meetings/default.htm For a new residential
development, the application deadline is typically 3.5 weeks prior to a Design Review Board hearing.
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in Title 12, (Zoning
Regulations) and Title 14 (Development Standards) of the Town of Vail Municipal Code. t
Requirements for properties located in hazard areas
lf a property is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rockfall, debris flow,
floodplain, wetland, poor soils, etc.), the Community Development Department may require a site-specific
geological investigation. lf a site-specific geological investigation determines that the subject property is located
in a geologically sensitive area, the property owner(s) must sign an affidavit recognizing the hazard report prior
to the issuance of a building permit. Applicants are strongly encouraged to consult with Community
Development staff prior to submitting a DRB application to determine the relationship of the property to all
mapped hazards.
Required Plan Sheet Format
For all surveys, site plans, landscape plans and other site improvement plans, all of the following must be
snown.
1. Plan sheet size must 6e 24"x 36". For large projects, larger plan size may be allowed.
2. Scale. The minimum scale is 1"=20' .All plans must be at the same scale.
3. Graphic bar scale.
4. North arrow.
5. Title block, project name, project address and legal description.
6. lndication of plan preparer, address and phone number.
7. Dates of original plan preparation and all revision dates.
8. Vicinity map or location map at a scale of 1"=1,000' or larger.
9. Sheet labels and numbers.
10. A border with a minimum left side margin of 1.5".

Design Review Board Meeting Requirements
For new construction and additions, the applicant must stake and tape the project site to indicate property lines,
proposed buildings and building corners. All trees to be removed must be taped. The applicant must ensure
that staking done during the winter is not buried by snow. All site tapings and staking must be completed prior
to the day of the DRB meeting.

The applicant, or their representative shall be present at the Design Review Board Hearing. Applicants who fail
to appear before the Design Review Board on their scheduled meeting date and who have not asked in advance
that discussion on their item be postponed, will have their items removed from the DRB agenda until such time
as the item has been republished.
lf the DRB approves the application with conditions or modifications, all conditions of approval must be resolved
prior to the issuance of a building permit.
Staff Approval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve with certain modifications, deny the application, or refer the application to the Design Review Board for
a decision. All staff approvals are reviewed by the Design Review Board and any staff decision is subject to
final approval by the DRts.
Additional Review and Fees
lf this application requires a separate review by any local, state or Federal agency other than the Town of Vai,,
the application fee shall be increased by $200.00. Examples of such review, may include, but are not limited to:
Colorado Department of Highway Arcess Permits, Army Corps of Engineers 4@, etc.
The applicant shall be responsible for paying any publishing fees in exc,ess of 5Oo/o of the application fee. lf, at
the applicant' srequest, any matter is postponed for hearing, causing the matter to be re-published, then the
entire fee for such re-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have design, land use or other issues,
which may have a significant impact on the community, may require review by external consultants in addition
to Town staff. Should a determination be made by Town staff that an extemal consultant is needed, the
Community Development Department may hire the consultant. The Department shall estimate the amount of
money necessary to pay the consultant and this amount shall be fonryarded to the Town by the applicant at the
time of filing an application. The applicant shall pay expenses incurred by the Town in excess of the amount
forwarded by the application to the Town within 30 days of notification by the Town. Any excess funds will be
retumed to the applicant upon review completion.

C. The Company must receive an appropriate affidavit indemnifuing the Company against unfiled
mechanic' s and materialmen' s liens.
D. The company must receive payment of the appropriate premium.
E. If there has been construction, improvements or major repairs undertaken on the property to be
purchased, within six months prior to the Date of the Commitment, the requirements to obtain coverage
for unrecorded liens will include: disclosure of certain construction information; financial information
as to the seller, the builder and/or the contractor; payment of the appropriate premium; fully executed
Indemnity agreements satisfactory to the company; and, any additional requirements as may be
necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured has contracted for or
agreed to pay.
NOTHING HEREIN CONTAINED WILL BE DEEMED TO OBLIGATE THE COMPANY TO PROVIDE

CONDITIONS
1. DEFINITIONS
(a) "Mortgage" means mortgage, deed of trust or other security instrument. (b) "Public Records"
means title records that give constructive notice of matters affecting your title - according
to the state statutes where vour land is located.
2. LATERDEFECTS
The Exceptions in Schedule B - Section II may be amended to show any defects, liens or
encumbrances that appear for the first time in the public records or are created or attach
between the Commitment Date and the date on which all of the Requirements (a) and (c) of
Schedule B - Section I are met. We have no liabilitv to vou because of this amendment.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule
B, we may amend Suchedule B to show them. If we do amend Schedule B to show these defects,
liens or encumbrances, we shall be liabile to you according to Paragraph 4 below unless
you knew of this information and did not tell us about it in writilg.
4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to rn this Commitment, when you
have met its Requirements. If we have any liability to you for any loss you incur because
of an error in this Commitment, our liability will be limited to your actual loss caused
by your relying on this commitment when you acted in good faith to:
Comply with the Requirements shown in Schedule B - Section I.
or
Eliminate with our written consent any Exceptions shown in Schedule B - Section II.
We shall not be liable for more than the Policy Acount shown in Schedule A of this Commitment
and our liability is subject to the terms of the Policy form to be issued to you.
5. CLAIMS MUST BE BASED ON THIS COMMITMENT.
Any claim, whether or not based on negligence, which you may have against us concerning the title
to the land must be based on this Commitment and is subiect to its terms.
INFORMATION
The Title Insurance Commitment is a legal contract between you and the Company, It is issued
to show the basis on which we will issue a Title Insurance Policy to you. The Policy will
insure you against certain risks to the land title, subject to the limitations shown in the Policy.
The Company will give you a sample of the Policy form, if you ask. The Commitment is based
on the land title as of the Commitment Date. Any changes in the land title or the transaction
may affect the Commitment and the Policy. The Commitment is subject to its Requirements,
Exceptions and Conditions.

Thank you for submitting plans for a new two-family residence at the above address. The proposal is
currently scheduled to be heard by the Design Review Board at their next meeting on Wednesday, August
17m, 2005 at 3 p.m. in the Town Council Chambers. A conceptual review of the project by the Planning,
Public Works, and Fire Departments yielded the following comments:

Therefore, garages are allowed to encroach into the front setback pending Design Review Board
approval of such a proposal. However, the slope calculations will need to be verified by a surveyor at
the time of finalsubmittal.
Floor Plan Sheets:

yielded the following numbers: the Primary unit (left side) is currently 8,081 square feet and the

crawlspace deductions due to the lack of section and lower level elevation/grade drawings needed to
accurately make such calculations.

Thank you, and Todd, for attending yesterday's Design Review Board hearing of a final review of the
Purchase residence at the aforementioned address. The model that was made was very helpful for the Board
in "reading'the site and the situation of the residence upon it. As you know, the Design Review Board
unanimously approved the project with the following conditions:
1. At the time of building permit submittal, the applicant shall submit a wet-stamped suruey of
the lot.
2. At the time of building permit submitlal, the applicant shall have fulfilled the
requirements of the site specific geologic investigation pursuant to Section 12-21-15-
B, Vail Town Code.
3. At the time of building permit submittal, the applicant shall provide the Community
Developme nt Depaftment with all utility sig natu res.
4. At the time of building permit submittal, the applicant shall submit to the Town of
Vail professionally-engineered and stamped drawings of all walls on the site that are
tiered and/or over four feet () in height.
5. Prior to the time of buitding permit submittal, the applicant shatt reiurn to the
Design Review Board with a revised landscape plan and a revised site plan.
Thank you for fulfilling the first and third conditions at yesterday's meeting through the submittal of the
stamped survey and the utility signatures. I have indicated in the computer that these conditions no longer
need to be fulfilled.
Regarding the fifth condition, the Board felt the need to see a more detailed landscape plan signifying
vegetation that will thrive on the site while appropriately mitigating the cut areas. The suggestion was made
that the walls to the rear of the residence could be increased in height (up to six feet) if that change better
allowed for the possibility that landscaping or sod would survive in that area of the site. The Board requested
that the revised site plan indicate more accurately the treatment of drainage on the site.

The fjrst item on the agenda was a vote on appo'inting a new Planning and
Env'ironmental Commiss'ion member. After a short discussion by Counc'i1, a vote was
taken and Brian Hobbs was chosen to replace Eric Affeldt on the PEC.
The second item was the second reading of 0rdinance No. 32, Series of 1.985, making
supplemental appropriations in the Town of Vail 1985 budget. Mayor Johnston read
the t'itle in full. Steve Barwick expla'ined the background of this ord'inance. After
a short discussion by Council, Kent Rose made a motjon to approve the ordjnance,
which Dan Corcoran seconded. A vote was taken and the motion passed unanimouslv
7-0.
The third item on the agenda was the second reading of Ord'inance No.31, Series of
1985, regard'ing I ea"i ng pri vate parki ng spaces. Mayor Johnston read th: 'u j tl e 'i n
full. Tom Braun expla'ined the background information of the ordjnance. Larry
Eskw'ith gave addit'ional jnformation. After a short djscussion, Gordon Pierce made a
motion to approve the ordinance. Kent Rose seconded the mot'ion. A vote was taken

The next'item was the reading of Resolution No. 37 establishing a computer system
fund.- Charlje tdick gave a short explanation of the resolution. Hermann Staufer
made a motion to approve the resolution, which Gail Wahrlich-Lowenthal seconded. A
vote was taken and the motjon passed unanimously 7-0
The fjfth item was, Biqhorn Park Bridge easements. Kristan Pritz explajned there
were four easements for Council approval: 1) utility easement for Publ'ic Service,
2) utility easement for Fred Hiller,3) Fred H'i11er granting the Town of Va'il a
pedestrian access easement, and 4) Gore Creek Meadows granting the Town of Vail a
pedestrian access easement through the common area. Larry Eskwith gave legal
infcrmation on the easements. Gary Ha11, a Publjc Servjce representative, and Fred
Hiller answered quest'ions from the Council. Gary Hall noted he needed a street cut
permit at Gore Creek Meadows. Bill Hart and Brian Hobson gave their reasons why
they urant the approvals. Larry Eskw'ith djscussed with Council broaden'ing the jndemnificat'ion clause, and the Council agreed'it should be done. Council also
requested the lighis at the bridge be changeC to down l'ights. Afrer much
discussion, Kent Rose made a motion to approve the easements, with the stipulat'icri
tha: the ianguage be broadened in the indemnification clause and the lights be
changed at the bridge. Dan Corcoran seconded the motion. A vote was taken and the
motion passed unanimous'ly 7-0. Kent Rose noted the street cut permit was a separaue 'issue. Gary Hall of Public Service discussed the street cut with the Council. Kent
Rose made a motion to approve the street cut permit at Gore Creek Meadows and that

0n November 25th, I sent the enclosed letter to Glen Solomon concerning the duplex subd'ivision on Lot 4 of White R'iver Estates. i have now been jnformed-that you are the person jn charge of these dup'lex rrUaiv.isjons for.Sun Savings- As mentioned in the pr6vious letter,-r-wouia-appreciate 'it if you would add wording concerning the maintenance of common area and painting of exterior struciures for t[e dup'lex subdiv1s.ions for Lot I and Lot 2 as well as Lot 4. The Town has djffjculty requiring both ownens to
P3inq their duplex at the same time. In ou. r"lntenance i.qui..r.nts for the duplex subdivjsions we do have the power to requ'ire the'owners of the property to include the pajnting of the duplex s.imultaneous'ly by both owners according to our Town attorney.
On-December 10, .1985 I talked wjth Diane Meehan who is workjng on the sales for these properties. She informed me that it was necelsary that they receive approval of the easement vacation and the plats leiore January 'lst. In order to fac'il jtate this review, I am scheduling the vacation of the easement for the. evening Town Councit meeting-on gecember ]7. I expla'ined to Diane that this arring.r.ni would only O! plr.ible.if our Town Attorney would be able to draw up trre vacation eire*ent agreement in time for the meeting. Our attorney is out of town for the week of December 9 through December .|3. TherLfore, 'it will oe impoii'ibie to work on the agreement thjs week.
I also want to make sure that you understand that there are certain requirements that must be met before the subdivision meets Town of Vail standards:
l. The easement must be abandoned before the Town will be able to sign off on the subdivision p1ats. This requirement periains only to Lots I and Z.
2. upper Eagle valley t{ater and san.itat.ion District must accept the new water line.
The Town of Vail engineer must accept the 'it is my understanding that Bill Andrews,js jn the process of writing th'is letter
