TO BUILDINGS AND SITE IMPROVEMENTS
SUBMITTAL REQUIREMENTS
General Information:
This applicaUon is required for proposals involving minor exterior alterations and/or site improvemenE.
Proposals to add landscaping do not require DRB approval unless they involve the addition of paUos, water
features, grading, or the addition of retaining walls.
I. SUBMITTAL REOUIREMENTS

should also be marked. This work must be completed before the DRB visits the

2. The revjew process for NEW BUILDINGS wjll normally involve two separate meetings
of the Oesign Review Board, so plan on at least two meetings for the.ir approvai.
3. Peopie who fail to appear before the Design Review Board at their scheduled
meet'ing and who have not asked for a postponement wiil be requ'ired to be
republ'i shed.

that no neighbors would be affected by the encroachrnent. Bob Ruder said tirat
the lot line was 20 feet flqn Streamside Circle. Gerry stated that
the board had just bcen out to look at the property.
Roger mentioned that thc planning department now required an inprovenent
survey, a survey wh j-ch j-s done after a foundation is in to show location of the building in relation to setbacks. This r,ra s not reqrriled when this bttilding was constrt.rcted, so that in this case, thc board rvould not be sctting

County, there was a problen with the garage and the applicant changed his
plans to suit the County. He felt that the owner was bcing asked to change
back to what had already becn changed. He complinented the staff on their helpfulness. Gerry asked if the int.ent was to keep the employee housing for enployee housing, and Elmer replied that it was, and that Mr. Saba had
signed an affidavit that is part of the application process in the planning office to the effect that the unit $/ould renain enployee housing.
Dan pointed out that what the County had approved was a single family house,
and that this reguest was not the same, for it was a request for a second unit for which the Town had different requirernents. He added that the board
had'just ret.urned from looking at the site and felt that in the place where
there was parking for 5 cars would be a good place for a garage and tte drive-
way wouldnrt have to change at all. Gerry stated that there bras more than
artple roon and that the site lent i.tself to the garage and he could see no
reason not to require it.
Discussion followed concerning whether or not to grant one of the requested
variances without granting the other. It r.ras decided that it was possible.

because the granting would be inconsistent with the intentions on other properties
and that there was nohardship. to the applicant. The vote was 6-0 to deny.

if he was aware that the Lj.ons Square Lodge people were concerned about noise,
and was told that noise controls would be handled by the Lodge. Dan moved

The applicant requests a front setback variance of 1.8 feet fron the required
20 fool front setback to allow a front setback of 18.2 feet fron the front
property line on lot 12, Bighorn Subdivision, Fourth Addition. The applicants
reguest the variance due to a survey error in laying out the building and the
fait that the building now sits 1,8 feet within the required front setback.

off bf the street. Gore Creek is located to the rear of the building and there
is a setback of 29 feet to the east of the building. The Staff feels that the
1.8 foot encroachnent will not have any negative impacts upon adjacent properties
and has not received any objections to the variance reguest fron adj acent property
owners. A positive effect of the etrot is that trees which would have been
destroyed hid tne error not been made, have been saved. At the time the building
went before the Design Review Board, the Board suggested that the applicant
exanine the possibility of moving the house to the west to save existing trees.
It uas deter;ined that to move the building would require either a strean setback
variance or front setback variance. Due to tine constraints on building, the
applicant expressed desj.re to locate the building as shown and it uras approved
by the Design Review Board.

proxinately six feet to the east has preserved existing trees which would
have been destroyed had the house been placed where approved by the Design

STAFF RECOMT{ENDATIONS :
The Department of Commrnity Devel oprnent reconnends approval of the request.ed
variance. Although the encroachnent occurred as a result of an error in building layout, we feel that the resulting buitding location has
created the possibility of saving existing vegetation which would have
otherwise not been saved. The encroachment into the front setback has
no negative inpact upon any adjacent properties or uses within the vLcinity.

1. Upon the execution and delivery of this Agreement
to Va'il by Timber Fal ls, Vail agrees to apProve and execute
the duplex subdivision plat for the resubdivision of the
Property notwithstanding the existence of the above-referenced
Encroachment (as described and depicted jn said subdivision
plat).
2. Timber Fa'l 'l s agrees to immediately make appl icat'ion
for a variance as to the Encroachment in accordance w'ith the
appf icable provisions of the zon'i ng ord'i nances of Vail ' and
di I igently pursue such appl ication until a decision is rendered
thereon by the applicable authorities of Vail.
3. In the event that a variance pertaining to the
Encorachment is not granted by the appl icab'l e authorities
of Vail, and upon the exhaustion by Timber Falls of all
appf icable rejmedies which it may have by law by reason of
the denial of such variance appl icat'ion, Timber Fal'l s agrees
to promptly take such action, at its sole cost and expense
and in its discretion, as may be reasonably required to cause
