manner, all-impiovements referred to in this Agreement, in accordance with all approved plans
and specifications filed in the office of the Community Development Department of the Town of
Vail, and to do all work incidental thereto according to and in compliance with the following:

complete until approved and accepted as completed by the Community
Development Department and Public Works Department of the Town of Vail.
2. To secure and guarantee performance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:

referred to in this Agreement, in the event there is a default under this Agreement
by the Developer.
3. The Developer may at any time substitute the collateral originally set forth above
for another form of security or collateral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein in this Agreement and the performance of
the terms of this Agreement. Such acceptance by the Town of alternative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
officer or employee thereof, be liable for any persons or property injured by reason of the nature
of said work, but all of said liabilities shall be and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) arise out of or are based upon
any performance by the Developer hereunder; and the Developer shall reimburse the Town for
any and all legal or other expenses reasonably incurred by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which the Developer my have.
5. lt is mutually agreed that the Developer may apply for and the Town may
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of the collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements referred to in this Agreement.
6. lf the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
speciflcations filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall not be required to, draw upon the security refgrred to in this
Agreement and complete the uncompleted improvements referred to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy referred to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent
(12%) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements referred to in this Agreement, such failure or refusal shall be considered a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developei shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements referred
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

Thank you for submitting a Developer lmprovement Agreement for the proposed re-roofing
project at 4512 Streamside Circle. As we have discussed, it is your, and your adjacent property
owner's, intention to remove the entirety of the existing wood shake roofing material on both
sides on the duplex and replace it with a brown, standing seam metal roof. The funds deposited
with the Developer lmprovement Agreement for project number DRB07-0699 will be refunded to
you when either one of the following occur:
. The entirely of the existing wood shake roofing materials on both sides of the duplex
focated al 4512 Streamside Circle have been replaced with the approved brown,
standing seam metal roof; or,
. In the event that the wood shake roofing materials are not replaced with metal roofing on
the entirety of the duplex, the metal roofing materials currently installed on the east unit's
rear roof have been "repaired" (i.e. replaced) with wood shakes.

Dear Mr. Brody:
At your request, Wiss, Janney, Elstner Associates, Inc. (WJE) has performed an initial investigation of the
water infiltration problems at your private residence located in Vail, Colorado. This letter summarizes
our initial findings and recommendations.
BACKGROUND
The residence was constructed in 1977 and was purchased by you in 1981. It is our understanding that
problems with water infiltration have occurred annually, each spring, since you purchased the property.
These problems have been isolated to a specific portion of the residence and are not widespread
throughout the entire structure.
Various repairs and investigative openings in the roof have been made, and a new roof was installed
approximately 15 years ago. None of these efforts have alleviated the water infiltration problem. WJE
has been asked to investigate the source(s) of the water infiltration, and to recommend a remedial course
of action.
OBSERVATIONS
Scott Riley and John Farr of WJE visited the site on March '7,2006. The purpose of this site visit was to
determine the configuration of the roof assembly and to evaluate the possible source(s) of the water
infiltration. For the purposes of this report we will consider the street/garage side of the house as the
north elevation and the creek/balcony side of the house as the south elevation.
General
The residence is part of duplex, with the subject unit situated on the east side of the property. The roof of
this unit consists of two offset gables with the ridgelines running roughly east-west. The only area of
reported water infiltration has been at the eastemmost south facing roof, which corresponds with the
living room below. The ceiling in this area follows the slope ofthe roof and is open to the second floor.
Three exposed timber beams span east-west across the living room ceiling and provide the structural
support for the roof rafters. Two skylights are located between the second and third beam (counting from
lowest to highest). An additional timber beam is located at the roof s ridge, but is concealed within rooms
on the second floor of the home.

It is our understanding that the adjacent unit has had similar, though less extensive, problems witb water
infiltration in their living room area as well. We briefly visited the adjacent unit and observed water
staining on the ceiling and walls in the vicinity of the lowest timber beam.
Within the Brody residence, we observed water staining at various locations on the lower portion of the
living room ceiling (particularly at the lower beam), above the south facing windows, and at recessed
light fixtures. During a brief walk of the roof we observed the increased soffit venting, the ridge vent, and
the additional roof ventilation that had been installed above and below the skylights (see Figure l).
Exoloratory Openinps
W.fE created three exploratory openings, from the interior, to document the components of the roof
assembly below the roof sheathing, and to examine the vapor barrier system.
. Exploratory Opening No. I was located at the low point of the living room ceiling just above the
south facing windows. This location was selected because it has historically been the most active
area of leakage. The width of the opening was approximately 32 ia. wide, which provided access
to two adjacent rafter spaces. Removal of the gypsum sheathing revealed a polyethylene (poly)
sheet vapor barrier that was stapled to the underside of the rafters and kraft paper backed
insulation batts between the rafters. While some damage to the vapor barrier was caused by the
removal of the gypsum sheathing, it also appeared that a significant tear in the vapor barrier and
some disruption of the insulation at this location were pre-existing and likely occurred during
construction (see Figure 2). Water stains were observed on the top surface of the poly sheet and
on the bottom edge of the roof rafter (see Figures 3 and 4). We also observed that the batt
insulation in this area had been installed up into the rafter space such that the batts were likely in
contact with the underside of the sheathing and the bottom I ll2 in. to 2 in. of the rafter was
exposed (see Figures 4 and 5).
When the batt insulation was pulled out of the rafter space, the top surface of the batts was
discolored and had clearly been subjected to moisture (see Figure 6). Rust was observed on the
staples that held the vapor barrier in-place and on the tips of nails that penetrated through the
structural roof sheathing. We also noted water dripping from a small hole in the sheathing
located about 2 ft. up slope from the exploratory opening (see Figure 7) and a moist area in the
sheathing located over the soffit.
' Exploratory Opening No. 2 was located at the low point of the second floor guest bedroom
ceiling just above the north facing windows. This location has not historically been an area of
lezrkage, and was chosen to determine what, if any, differences in construction existed between
this area and the area examined in Exploratory Opening No. l, where problems have been
ongoing. The same sequence of disassembly was used and the differences and similarities
between the two openings were noted. The most notable difference was that the poly vapor
barrier in this location was very clean and appeared to have been more carefully installed (see
Figure 8). Another important difference was that the batt insulation was installed more closely to
the bottom of the roof rafters, which would presumably allow for a more open and unintemrpted
air space above the batts. When the batt insulation was pulled out of the rafter space, the top

surface of the batts appeared relatively clean and no signs of significant moisture were observed
(see Figure 9). It should be noted that the tips ofnails that penetrated through the structural roof
sheathing did have rust on them.
. Exploratory Opening No. 3 was located at the top of the west facing sidewall of the living room
adjacent to the lowest timber beam. The wall finish in this area indicated significant water
leakage had previously occurred in this area. Removal of the gypsum sheathing revealed a poly
vapor banier over unfaced batt insulation. It should be noted that this is an interior wall at this
location.
This opening was extended into the ceiling above to examine how the vapor barrier was
transitioned to the horizontal plane and how it was terminated to the timber beam. At this
location, the vapor barrier of the ceiling had simply been extended down the face of the vertical
wall framing using a single sheet. Adjacent to the beam a slit was cut through the poly at the
horizontal to vertical transition and the sheet abutted, but was not sealed to, the beam at the
horizontal or vertical edges (see Figure 10). Both of these conditions would allow moisture
collecting and running to this area to seep through the breach in the vapor barrier and into the
gypsum sheathing or down the face of the beam. We also observed a small un-insulated gap
between the beam and the adjacent stud framing. If this same condition exists where these beams
terminate at the exterior wall they could allow cold air flow that would likely increase the
potential for condensation at these beam terminations. In addition, if the beam disrupts or
penetrates the weather barrier installed on the exterior of the building, as it appears to do on the
east elevation, the potential for water leakage from the exterior is also increased.
While not confirmed during our site visit, we would anticipate that the recessed light fixtures located in
the living room ceiling penetrate the poly vapor barrier and could allow significant air flow and, therefore,
moisture into the roof assembly. It is typical for wood blocking to be placed between rafters at bearing
locations, such as over the wood beams that run east-west across the living room ceiling. This blocking
can restrict or cut-off air flow within the ventilation soace located above the batt insulation.
G & G Roqfing
During our site visit Mr. Larry Greer of G & G Roofing (G & G) stopped by the site to discuss his
knowledge of the roof assembly and the repair work that has previously been done in an attempt to
address this issue. The original roof construction consisted of (from top to bottom):
. shingles over a roof membrane. plywood sheathing. 2xl0 rafters at 16 in. on center. 6" kraft paper backed batt insulation between rafters (kaft paper on interior side). poly vapor barrier
' gypsum board.
Approximately 15 years ago, a re-roofing project was undertaken by G & G. During this project the
shingles and roof membrane were removed. Over the original structural sheathing the following materials
were installed; 30# felt, two layers of 2" polyisocyanurate, plywood sheathing, Ice & Water Shield, and

wood shake shingles. Based on this description of the roof assembly and what we observed in our
exploratory openings we developed the sketch below, which approximates the existing cross-section of
the roof.

Mr. Greer also discussed various repair projects that have been undertaken over the years. Of most
interest to our investigation was his discussion of a recent exploratory opening made in the roof. In an
effort to track down the source of the water infiltration, G & G created an exploratory opening in the roof
(in the vicinity of V{E's Exploratory Opening No. 1). Once the shingles had been removed, the Ice and
Water Shield was cut and peeled back. Frost was reportedly observed on the underside of the membrane.
Once this was discovered, their investigation was suspended and the membrane and roofing were
reinstalled.
It should be noted that the compact roof assembly described above is neither a true ventilated roof, cold
roof, nor super-insulated roof, but is a hybrid of sorts. A true ventilated roof assembly typically consists
of an attic space or other large volume where air exchange with the outside air occurs beneath the roof
sheathing and above the insulation in the ceiling joists. In this ventilated assembly the air temperature
and relative humidify within the attic space is very close to that of the exterior air, and no insulation is
placed within the roof rafters or above the structural sheathing. A cold roof assembly relies on a

relatively narrow ventilation space (approximately 2 in.) located above the structural sheathing and
roofing membrane. Sleepers are used to create the air space that must be connected to a soffit vent and
ridge vent to ensure air circulation. An additional layer of sheathing is placed over the sleepers to provide
a substrate for the roofing material. The intent of the cold roof system is to keep the surface temperature
of the roofing very close to that of the exterior air so that snow on the roof doesn't repeatedly melt and re-
freeze, which can lead to ice damming. A super insulated roof is also used to prevent ice damming, but
accomplishes this with the use of significant amounts of insulation (in the range of R-60) instead of a
ventilated air space. To address the thermal bridging that can occur at roof rafters, some percentage of the
over all insulation is installed using rigid board insulation located above the structural sheathing. A
second layer of sheathing is installed over the rigid insulation to provide a substrate for the roofing
materials.
The assembly depicted above attempts to provide a narrow ventilation space as is used in a cold roof, but
it is positioned between the structural roof sheathing and the batt insulation of the ceiling as is typically
done in a ventilated roof. In addition, rigid insulation has been installed above the structural sheathing as
if this were a super-insulated roof.
DISCUSSION
Based on the seasonal nahrre of the water infiltration problem and the consistency with which it has
occuned, it appears that the primary source of water infiltration into the residence is the result of excess
moisture collecting within the roof assembly.
During the winter months when the interior relative humidity is typically significantly higher than the
relative humidity of the exterior air, a vapor pressure is created across the building envelope (exterior
walls and roofl. This vapor prcssure is similar to air pressure in that it is constantly trying to equalize by
moving from high pressure (high relative humidity) to low pressure (low relative humidity). This force
can drive moisture into and through building materials; however, the amount of moisture that travels
through materials (particularly something like a poly sheet, which has a low perm rating) is relatively
small. Significantly more moisture travels by way of air movement through disruptions in the materials
that allow warm moisture laden air to penetrate into the assembly. Breaks in the poly sheet vapor barrier,
such as recessed light fixtures or tears, and poody terminated edges, such as at the roof beams, result in
open pathways that allow moisture into the roof assembly. This moisture can accumulate and be held
within many of the materials that make up the roof assembly, including the plywood sheathing, felt paper,
and polyisocyanurate insulation, or it can collect on the surface of non-porous materials, such as the frost
that was reported on the underside of the Ice & Water Shield membrane.
In the spring, when temperatures rise and the snow on the roof melts away, allowing the sun to further
increase the roof temperature, the stored moisture in the roof assembly is driven back toward the interior.
The poly sheet on the interior side of the assembly prevents this moisture vapor from quickly diffusing to
the interior. The restricted air flow in the ventilation space, caused by the insulation being installed too
far up into the rafter space, also doesn't evacuate this moisture sufficiently. The result is a dramatic rise
in the relative humidity in the roof assembly which leads to condensation. This condensation Iikely
drains onto the poly sheet and runs down the slope ofthe roofuntil it finds a break in the sheet through
which it leaks into the residence. This occurs at the timber beams, recessed light fixtures, and the south
wall windows.

RECOMMENDATIONS
The existing roof conflguration is not ideal with regard to preventing condensation. However, given that
the other sections of the roof have not experienced the same water infiltration problems it appears that
modiflcations to the existing roof assembly in the problematic area should be sufficient to alleviate this
seasonal issue. The two primary issues that have caused this problem are:
1. Breaches in the vapor barrier that have allowed excess moisture to enter into the roof assembly.
2. Lack of sufficient air flow within the ventilation space to remove this moisture to the exterior.
Based on our initial investigation we propose the following preliminary repair to address this problem:
1. Remove the existing gypsum board ceiling, vapor barrier, and baft insulation.
2. Ensure that continuous ventilation is provided at every rafter space. This will likely require the
modification of blocking between the ra"fters, the addition or modification of vents, and
verification of the sofflt and ridge vent function.
3. Install compressed cathedral ceiling batt insulation with an asphalt-impregnated paper facing on
the interior side. These batts provide the same insulating R-value as conventional batts with less
thickness so that the ventilation space is maximized.
4. Use a suitable vapor retarder such as Jumbo Tex by Fortifrber to create a continuous and sealed
air barrier on the underside of the roof rafters. Jumbo Tex retards the transmission of moisture
vapor, which will help to minimize moisture build-up in the roof assembly. However, it also
becomes more porous when it becomes wet, so if excess moisfure does accumulate within the
roof assembly some of that moisture will be able to dry to the interior instead of accumulating
and running down the slope of the roof.
5. Reinstall a painted gypsum board ceiling.
The success of this system will require proper detailing and carefirl execution in the freld. Therefore, we
recommend that WjE, or another qualified consultant, be involved in the final development of the repair
documents and site observations of the contractors work.
Due to the number of years that this moisture infrltration problem has occurred, we are concerned that
deterioration of wood structural members may have occurred, but remains concealed within the assembly.
Therefore, before repairs are made to address the moisture infiltration problem, we recommend that
additional exploratory openings be made at the ridge of the roof from the exterior to verify that the roof
framing and sheathing are sound. If deterioration of the roof structure is discovered, the extent of this
damage will need to be assessed and the repair approach outlined above may need to be reconsidered.

A. Unlawfirl deposits: Subjcct to subsection C thercof, it is unlaufirl for any person to litter,
track or dcposit, or cause to be littered. trackcd or deposited, sand. gravel, rocks, mud, dirt,
snow. ice, or any other dcbris or matcrial upon any street, sidewalk, allcy or public place, or
any portion thercof.
B. Notice: Abatement: The Director of Public works may noti| and require any person who
violates or causes anotler to violate thc provision of subsection A hereof, or who has in the
Director's employment a person who violates or causcs another to violate the same, top
remove such sand. gravel, rocks. mud. dirt, snow. ice or any other dcbris or material rvithin
trventv tbur (24) hours aftcr receipt of said notice by the Director of Public Works. In the
event thc person so notified does not comply with the notice within the period of time hcrein
specified, thc Director of Public Works, or othcr authorizcd agent. may cause any such sand,
gravel, rocks. mud. dirt, snolv, ice, debris or any other material to be removcd liom any street
or alley at thc expense of the notificd.
C. Exccptions: The provisions ofsubsection A hereof shall not be applicable:
l. Within the immediate area of any construction. maintenance or repair project of any
street or alley or of any water main, sewer main, electricity line, gas line, telephone line
or any appurtcnance thercto:
2. To deposits of sand. dirt or matenals necessary for thc protection of the public safety; and
3 . To public arcas designatcd for the dumping or depositing of said matcrials.
D. Summons: Penalt_v: As an altcrnative to thc notice for rcmoval provided in subsection B
above, any
person who violates or causcs another to violatc the samc. may be issued a summons to
appoar befbre the Municipal Court of the Town for said violations, and upon being found
guiltv ofa violation hcrcunder bc punished as provided in Section l-4-l of this code.
E. Noticc; Penalt-v: It is unlarvful for any person to fail or reftrsc to comply r,'rth the notice of
the
Director of Public Works as providcd in subsection B hercot', and any such person shall. in

How it relates to Building Permits
Fill out our check list provided withg Building Permit Application.
If yes was answered to any of the questions then a "Public Way" is required. You
can pick up an application at either Community Development, located at 75 South
Frontage Road or Public Works, located at 1309 Vail Valley Drive.
Notice sign offs for utility companies. All utilities must field verify (locate)
respective utilities prior to signing application. Some utility companies require up
to 48 hours notice to schedule a locate.
A construction traffrc control/staging plan must be prepared on a separate sheet of
paper. An approved site plan may also be used. This plan will show locations of
all traflic control devices (signs, cones, etc.) and the work zone, (area of
Construction, Staging, etc.). This plan will expire on November 1st and will need
to be resubmitted for approval through the winter,
Sketch of work being performed must be submitted indicating dimensions (length,
width and depth ofwork). This may be drawn on the traffic control plan or a site
plan for the job.
Submit completed application to the Public Work's oflice for review. If required,
locates will be scheduled for the Town of Vail Electricians and Irrigation crew.
The locates take place in the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and
approve or disapprove the permit. You will be contacted as to the status and any
requirements that may be needed. Most permits are released within 48 hours of
being received, but please allow up to one (l) week to process.
As soon as the permit is processed, a copy will be faxed to Community
Development allowing the "Building Permit" to be released. Please do not
confuse the "Public Way Permit" with a "Building Permit" which is to do work
on a project itself.
NOTE:
The above process is for work in a public way ONLY.
Public Way Permits are valid only until November 15'.
A new Public Way Permit is required each year if work is not complete.

Complete Heat-
How It Works
The CompleteHeat'u system consists
of two modules, @ a heating
module that produces heat and
O an air handling module that
sends warmed air through your
home's heating ducs. 0 The
process begins when water fills the
water storage tank through the pipe
at the rop o[ the hearing module.
When heat is needed to warm your
indoor air and water, @ the
heating module tells the combustion
blower to draw in outside air which
is used for combustion. This means
the system doesn't waste your home's
conditioned air. After a short safety
delay, @ a fuel mixture is sent
into the burner where ir's ignited by
an electronic spark. The ignited fuel
is super-hor @ and, as ir moves
through the srainless steel coil within
the water storage tank, the water in
the tank is heated to 120" F (49" C)
or your preferred temperature.
@ ef,.t the combustion producs
have traveled all the way down
through the coil in the tank,
condensate (warer) is separated and
drained, and exhaust gases are
vented safely out the top o[ the unit
and on through the PvC piping to
the outdoors. @ Hot water is
directed to your laucets through
plumbing at the top of rhe heating
module. @ The same fuel thar
heats your water also hears your
indoor air. When your home's
thermostat senses a need lor heat,
@ a small warer circulating pump
draws hot water from the heating
module and sends it rhrough rhe
space heating coil in the air handling
module. @ The hot water in the
coil warms the surrounding air.
@ rn" blower turns on only after
the coil has been heated and

throughout the air duct system into
the rooms o[ your home.

. Community Development, I would like to express my congratulations. to you for the fine building you recently constructed on the
above named property. I feel that your home is a welcome
addition to Vail and on behalf of the Department of Community
Development, would like to express my appreciation for your
efforts.
In order to receive a Certificate of Occupancy (the official
document that permits you to occupy your permises) it is necessaiy
that youi driveway and parking area be paved in accordance with the
Zoning Ordinance of the Town of Vail . It is also necessary that
you submit a landscaping p1an, receive approval of the plan from
the Design Review Board, and install the plantings shown on your
approved plan.
If it proves i-mpossible to have this work done in the near
future, the Town of Vail can issue you a Temporary Certifieate of
Occupancy upon you agreeing to have this work done prior to a
mutually agreed date in the future.
