BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this depaftment to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

o Unlawful deposits: Subject to subsection C thereot it is unlawful for any person to litter, track or
deposit or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
o Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
a Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of

storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge, (Ord. 2(1968) 5 3: Ord, 28(i981) 5 1)

Problem Statement
The Vail Village and Lionshead Village are invaluable assets to the community. Thousands of people
come to Vail each year to sightsee, recreate, shop and to enjoy everything the Vail Valley has to offer.
The community and merchants rely upon our guest to generate revenue. Our summer/winter guests
expect a pleasant experience while in Vail.
To insure that all of the proposed construction has as little negative impact on the community and on our
guest as possible, the Town of Vail finds it imperative to create and implement the Vail Village and
Lionshead Village Construction Hours Handout.

General Information:
This application is required for proposals involving minor exterior alterations and/or site
improvements. Proposals to add landscaping do not require DRB approval gflggg they involve
the addition of patios, water feafures, grading, or the addition of retaining walls.

drawings, specifications, samples and other materials (including a model) if deemed
necessary to determine whether a project will comply with Design Guidelines or if the
intent of the proposal is not clearly indicated.
Please submit three (3) copies of the materials noted with an asterisk (*).
**For interior conversions with no e)fterior chanoes, the submittal requirements include a
complete set of existing and proposed floor plans, a title repoft, and written approval from a
condominium association, landlord, and joint owner, if applicable.

second f'loor only intruded slight)y into the front setback. Donovan asked why the addition was not coRnected more strongly to the house and was told that there were windows which interfered. She felt strongly that the addition could have been designed within the setbacks.
Tom-Braun presented the proposai and showed a site plan. The garage encroached 10 feet jnto the required 20 foot front setback, and 9 feet jnlo tie required 15 foot side setback. The neeting was cal|ed to order at 3:00 PM by the chairman, Duane Piper.

3. Proposal for a mjnor subd'i vision of Lot 2. Pitkin Creek Meadows.
App'l icant: Tom and Nick Kiahtjpes
Tom Braun showed site p'lans and gave the background of the proposal . He stated that proposed was to subdiv'ide one existing duplex zoned lot into two
individual parcels. The existing dup'l ex lot contained a legal duplex structure
(Lot 2), and the proposed 1ot (Lot 3) would have the development potential for
an additional duplex. Braun stated that two sets of criterja were to be
involved in reviewing a request of this nature. The first was the PEC review criteria as outlined in the Subdivision Regulations, the second set addressed
issues such as minimum 1ot size, buildable site area, geo'l ogic hazards, access,
and utility service. Braun said that the clarification of the easement should
be a condit'ion of approval , as well as utility verification by a'l I applicable
uti'l ities indicating that service can be provided to the proposed Lot 3 prior
to the recording of the subdivision.
Tom Allen of Internountain Engineering said that he wou'ld answer questions
about the survey. Stan Gil1is, a resident of the unit adjacent to the proposed
Lot 3listed several other points to consider. These included the fact that
the original request when the subdivision was first planned was for 3 lots, but
that the Town saw fjt to grant only 2, the lot was too close to I-70 which
resulted in vehicles in accidents'l anding in the area and traffic also made the lot noisy, there was a botanica'l hazard, as there were many dead aspen trees
standing on the 1ot, and they had a tendency to fall over, there would be a
parking problem, and the value of the existing structures would decrease with
the added traffic across them. Jane Bemish, one of four owners of one half of
Lot 1, stated an objection to the subdivision until she would have more time to
review the access agreement. She also agreed with Gi11is'objection to added traffjc on the property and noise from the Interstate
Tom Kiahtipes stated that he would wonk with hjs attorney on the easement
agreement. He felt that it was very feasible to add another lot.

Hopkins seconded to approve the minutes. Vote was 6-0-l in favor.
Sid Schultz asked why the Town did not allow 3 lots ori ginal 1y, and was told
that at the time of the origination of the subdivjsion, the min'imum lot size for duplex lots was 17,500 square feet, but that now it is .l5,000 square feet.
The parking situatjon was discussed, and then Diana Donovan asked whether there
cou'l d be a condition placed upon the approval that stated that a variance could
not be requested upon building on this 1ot- Braun replied that legal 1y, no one
could be denied permission to apply for a variance. Jim Viele asked Tom Allen of Intermountain Engineering how the 40% slope had been figured and Allen felt it probably had been measured contour line to contour line which original ly had
been measured with a plenemeter Viele felt that the measurement would only be
as good as the drafting job,
Peggy 0sterfoss asked where on the site the structure would be placed and was told that most likely it would be placed on the lower part. Peggy pointed out
that she lived across the creek and that there had jn the past been difficu'l ty
wjth unstable soil in that area. Braun said that the property was not in a
debris flow area. Peter Patten speculated that setback varjances may have to
be given in order to construct the building in a logical location on the lot,
and that the PEC could say that they would look very closely at a varjance
request. Jane Bemish wondered if the request for Lot 3 could be given if the
owners on Lot I withdrew their access agreement.
Diana wondered which group of people should address the fact that that section of I-70 was dangerous, and who should be concerned? Braun suggested that in light of the concern over the access agreement, the commissioners may want to
table the item.
Osterfoss moved and Donovan seconded to table this request untiI the easement
agreement was resolved and the safety question was addressed. The vote was 7-0

Peter Patten stated that the submittal was inadeouate in that it\did not
address the fact that the project would require a variance from a stream
setback and the staff was asking to table so that it could be republished with
the additional information. Viele moved and Donovan seconded to table unti'l it

Kristan Pritz explained that the applicant was requesting to amend Special
Development District No. 5 (Simba Run), Development Area B) to exclude the
requirement that the owners construct a tot lot. They propose jnstead to
contri bute $.|0,000 to the Town of Vail Recreationa'l Amenities Fund which would
be broken down into three equal payments usjng an interest rate of l0%.
The Simba Run project provides recreat'i onal amenities that include 1 indoor
swimming pool ,2 racquet ball courts,3 tennis courts, 2 video games and a pool
table. The ordinance creating the special development district required that
the approved development plan include a minimum of 5 tennis courts, a bike and
