BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the tsuilding Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departrnents with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

looding. Do not overdrive so os to dimple or distort. Estimofing Noils: On overoge, estimate one pound of noils per
squore of roofing ond siding.

Generolly, screw fosteners ore ploced in the flot oreo of the sheet ot 9" on center. Do not overdrive so os to dimple
or distort. screw fosteners must be checked to iustoin opplicoble looding. lf purlins ore ploced over 24" oporr,
stitching screws ore recommended on the lopping rib in between the purlins. Estimoting Screw Fosteners: As on
overoge, eslimofe 85 screw fosteners per sguare of rafing ond siding.

Dear Ms. Byers,
Thank you for submitting an application for a re-roof of your residence. The Design Review Board was made aware
of the problems you have encountered with the current tar-and-gravel roof : they then visited your residence
yesterday and reviewed the application in the presence of Benny Lopez, of T.A. Beck Roofing. The application was
tabled until August 20, 2003, due to the fact that two different materials are being proposed for your residence. In
addition, there was some concern over the weight of the proposed metal roof. The regulations regarding roofing
materials are outlined below as they appear in the Town of Vail's Development Standards Handbook, 10-D-6:
"Roof surfacing materials shall be compatible with the site and surrounding buildings. The use of wood
shakes and metal roofs is acceptable, however in no instance will metal roofs which reflect direct sunlight onto an
adjacent property be permitted. lf metal roofs are used they shall be surfaced with a low-gloss finish or capable of
weathering to a dull finish. Metal roofs shall generally have a standing seam in order to provide some relief to the
roof surface and be of a heavy gauge. Asphalt and fiberglass shingles shall be permitted provided that they weigh no
less than three hundred (300) pounds per roofing square and are of a design and color to be compatible with the
reouirements of this Section.'
There are several options at this point:
,,1 You may choose to re-roof the side forms of the duplex "same-for-same' in the existing tar and gravel. The
application would then retum for a second hearing an August 20, 2003.2) You may choose to re-roof the side forms of the duplex with the same asphalt shingle lhat is currently in
place on the center roofing form- I would then be able to staff-approve the application and there would be
no need for a second hearing.
3) You may choose to re-roof the entire roof (center and side forms) in the proposed metal, provided that it was
of a heavier gauge. The application would then retum for a second DRB hearing on August 20, 2003.

The proposed landscape plan for the Byer,s residence at 4562
Streamside Circle is a very nice improvement to the area and I lrould be happy to grant this plan staff approval, however, I do
have one concern that must be addressed and will require sorne slight redesign. The renote patio area with the barbecue and
bench is currently located in the required side setback and possibly in a pedestrian and drainage easement that is 20 feet in width that runs along the rear property line of the Byerrs lot. The required side setback is 15 feet. A patio or deck
may extend halfway into this required setback, which allonrs the patio to be designed within 7 L/2 feet of the property line.
The rear of the property does contain a 20 feet easement along Gore Creek to allow pedestrian access. The patio may not be located in this area. I have enclosed for your use a copy of the duplex subdivision plat on file with the Town of Vail_ that you may utilize to measure your reguired distances in the setback and from the south property line easement.
I have.granted and noted in the file approval of the landscape plan with the exception of this patio area. So, if you wish,you may begin construction on the bulk of the plan. please

a. Proposed surface dra'inage on and off site showing size and type of
culverts, swales, etc.
b. Exact locatjons of all utilities to include existing sources and proposed
service lines from sources to the structure. Utilities to include:

l. Approval of ninutes of meeting of February 9, 198i.
Duane Piper requested that the staff check a notion rnade by Dan Corcoran concerning the exterior alteration and rnodification and height variancl of the Sitzmark building,to see whether or not it included the condition of participating in the Vail Village irnprovenent di-strict.
Dan Corcoran moved to approve the minutes subject. to the correction above, and Scott seconded the notion. The vote was 7-0, unarinous,

Peter Patten described the expansion of the issue from the original request on 7/12/87'
as stated in the meno of f/19/8I. (The correct date on the nost recent nemo should
have read 2/\9/81), He added that. interior spaces do not perform the sane functions
as those directly on the street. He recommended approval nf the Hoevelnann request
with the arnendnent of Section 18.060, paragraph A to add:
8. No Conditional Use pernit will be approved for barber or beauty shops on first
or street 1eyel in uith"t Conmercial Core I or Cornnercial Core II unless the appl icant
has denonstrated, to the Conmunity Devel oprnent Departnentrs satisfaction, that
the space in question contajls no extexior fiontage on a nzli or pedestrian or vehi-

Barry Pernut representing Mr. Hoevelmann, stated that Mr. Hoevelmann agrees with the
stafi on the wording of the amendment. He added that he felt there was also a hardship
in this case.
Discussion followed concenring whether or not the anendnent should cover a broader use.
Finally, Jirn Morgan rnoved, and Roger seconded to reconnend to the Gotmcil an anendnent
to Conditional Uses on street level in CCI and CCII to allow personal services as defined
in the Code as conditional uses with the addcd provision of No. 8 as defined in the
neno dated 1/19/87. The yote was 5-2, with Dan ar.rd Gaynor voting against. l'lotion

3. Pepi Sports Expansion
Dick Ryan explained that he had visited Pepi's and that it was quite crowded, with
employees in offices that were forrnerly closets. He added.that .the display was also
ctowded, and that there was not a lot of r,oon to rnov e around. ltre question of giving
up 3 lodge rooms was discussed, and Dick said that the staff was reconmeDding denial
of the conditional use permit request because of the fact that. the Tonn of Vail policy
that the lodge base is important to Vail.
Of Part II, the Exterior Alteration request, Dick felt that it is in conformance with
the Urban Design Guide P1an, and that the staff was recorunending approval (subject
to the one condition in the merno).
Discussion followed concerning overcrowdi-ng rnayb e not being a criteria, and then PePi
listed many reasons why he felt the change was needed. He needs nore retail spa:e.
. He uses one small room for
office space for both busjnesses and has no place to talk to soneone unless he takes
them upstairs to his apartnent where the children are. He mentioned that his businesses
were growing with Vail like everyone else. He added 2 rooms on the 4th floot that
were not on the original plans, He estimated that the Townts incone on his sales
taxes would grow from $2,000 to $20,000. Pepi felt that the space one floor up would
be good for his use. He stated that these roons were noisy, and they were difficult
to rent out. In fact, he did not rent thern at all during the sununer. He added that
the Town of Vail had changed so rnuch that it lras not the same as it was, and that
no one had predicted such growth. He felt that rrrith the 2 rooms on the 4th floor,
he was really only taking away one roon. He llsted other people who had received
permits- -Timerhouse, Rucksack, Gorsuch, etc. He felt in working to get things better,
he was naking the shopping experience better for the tourist,
Gerry enphasized that the purpose of horizontal zoning was to have a nixture of uses in the Village, and that this request rnight set a precedent. Pepi repeated that he
could not rent out the 5 lodge roorns in the suruner at all. Ron Riley spoke in pepirs
favor emphasizing that each case should be looked at individually, and ihat the Town
needs flexibility, for the needs of Bridge Street change. Gaynor agreed, and Duane felt that perhaps the policy of the zoning here was too strict. Jirn Morgan added that- there was, a possibility to build additional rooms in another location, perhaps the back. Dick stated that under the present zoning, Pepi couldrt build as rnany rooms
as he has.
Gaynor noved, and Duane seconded that the corunission gran t a conditional use pernit to Pepi to convert 3 lodge rooms into corunerci-al space as presented in the staff neno subject to the condition that the applicant agrees to participate in and not renonstrate agaist a special improvement district for Vail village if and one is forned.
Ilte- vote was 4-3 , with Dan, Jirn and Gerry opposed, because they were against converting lodge units to conmercial space.
Discussion followed concerning the exterior alteration section of the request. Dick
TePeated that the staff recommended approval subject to the condition that the applicant agrees to participate in and not remonstrate against a special irnprovernent district for Vail Village if and when one is forrned. Gerry asked Pepi if he would agree to this conditj.on. Pepi replied that he would.
Scott stated that after visiting the site and standing in the street, he fowrd 2 things.1, that it look like a window will be blocked off, and asked Pepi. if the owner was
aware that it would be blocked? Pepi answered that he didntt talk to the oyner.Dick nentioned that public notices had been scnt out to adjacent property owners.

such as drive-up facilities. He said that the staff recorurends approval of CCIII.
A discussion of side set backs followed and it. was decided that the section on
setbacks be changed to indicate that the exterior district boundaries have a 201

Peter Patten explained that the staff still is in farror of zoning this property
Residential Cluster zone, though at the neeting the previous week' the issue was
raised as to whether or ;ot this would be better zoned Cornnercial Core III. He added
that when the Brandess Building was zoned Conmercial Core III several years ago, the
pEC had been opposed to extending corunercial areas that far east.
Barry permut, representing Tim Garton reiterated that Garton feels the Residential
Cluster zoning is not appiopriate zoning. He felt that a lor'r profi'le professional
building would be " goo?- transition frorn CCIII on the East to the RC zone on the west.
He ad<Ied that Mr. caiton sent out letters to the 3 lot owners adjoining behind this
lot, and received no rePlies.
Dick reminded the cornnissj-on that if thi.s was zoned CCIII, there would be no guarantee
that a lorv profile professional building would in fact be built. The lot could be
sold, or plans could change.
Marka Moser spoke in opposition to zoning this comnercj-al .- she felt that there was
a need to havl a buffei^betrceen the residential area and the highway, and also
that the traffic Pattern had becone very heavy in that area'
ldary Jo Al1en spoke in opposition to changing this to commercial , and added that she
hoped the Town would consider this for a park.
Loyette Goodell opposed the cornmercial zoning for lot 40, and added that she had
letters from 2 other Buffer Creek property owners who felt the sane way' She felt
that to nake this cornrnercial would down grade the other property iJr the area.
Jfun King was opposed and added the idea of rnaking this a park'
Dick Peterson opposed the change, especially with respect to the heavy traffic in
the area. He felt the area "ai one of th" highest in density with respect to perrnanent
residents. He, also, wanted to see this as green space.
Barry Permut responded by saying that Tin Garton would leiteTate his offer to sell
the land to the Town.

2. Highland Meadows
Peter Patten explained that having spent much time in the past week studying the minutes
of the County, and records. He Said that
they had not found anything that would chapge their proposed zoning of Highland Meadows,
and that they still felt that Prinary,/Secondary was the appropriate zoning, and that
Highland Meadows shouldnrt be treated differently fron the rest of West Vail .
Peter added that there was an amendment to the Highland Meadows covenants, concerning
rninimurn GRFA of 1500 sq ft per. $tructure, but that Eagle County did not aPProve the
arnendrnent.
Scott asked about the plat. Peter responded that the plan says that duplexes can
be put on these lots, and that there wete no restrictions beyond those words.
Jin asked if this was Planned llnit Developnent set up with duplexes, why change to
P /S?
Terrill Knight, fornerly with the County, gave a brief history of Highland Meadows,
and said that the final approval was for duplexes. He added that this was the first
Planned Unit Development, iside from Beaver Creek, that the County had done, and that
it was rnore like a standard subdivision. The prelirninary plat was changed to duplex
lots wi.th legal descriptions of each 1ot. In stages of evaluation, additional restriction;
were not put on. The covenants were not enforcable as far as the County was concerned.
therefore, the docunents r,/ere a little of this and a little of that. He added that
he was jaded by the past history of these events, and felt that duplex was appropriate
for Highland I'teadows. However, he qualified this, and stated that he did not know

Scott felt that if this subdivision had been approved as PUD, that to change to P/S
would be going too far.
Jin felt that to be fair, they ought to try to bring people into the Torrrn as they
were zoned. Roger agreed, adding that it would be good to try to avoid nirror duplexes
which perhaps the DRB could enforce, and that there was a pretty substantial
number of people objecting to P/S, and that since these lots tvere not highly visible,
perhaps duplex zoning was more appropriate.. Gerry White disagreed, stating that
tnis haa never evolved into PUD, and P/S was the nost appropriate designation. He
also felt that it vas important that a.precedent was being set.

Peter said that rnost of the Lcts were highly visible, and that was one concern- Gaynor
felt that since the lots hadnrt a3let been zoned, they were not setting a Precedent
by changing them. Irlore discussion followed concerning PUD and the covenants. Jim

Barry Pernut stated that this subdivision had always been referred to as PUD, that
the Iegal notices, Environmental Impact Statements, alI reflected PUD, and the final
plat showed building envelopes. He stated that the Town of VaiI had a chancc to
review this PUD and approve with certain changes, that the Town of Vail had anple
time and opportunity io oppose this zoning and just 5 years a8o approved it.
Mona Look said that she represented about half of the lot owners, most of whon fcel

West Vail annexation, but would not have voted for it if she had known their zoning

subdivision was PUD. The building envelopes were created and protective covena ts
relate to building size, site, dedication of green space, etc. He added that 15 1.ots
in #1 and IL in #2 were under 7/2 acre is size.
larry Eskwith felt that this particular subdivision is subject to whatever zoning the Plarining Conrnission anc Councll feel is appropriate.
Jin Morgan moved and Roger Tilkemeier seconded to recorunend to the Town Council
to nake the zoning for Highland Meadows #1 and #2 straight duplex.
The vote was 4-2 in favor. Dan and Gerry voted against. Motion passed.
