RECITALS:
A. Timber Falls Associates, a Colorado general part-
nership ( "Declarant" ) is the owner of certain real property
described as Lot I8, BIGHORN SUBDIVISION, FOURTH ADDITION, Town of Vail, Eagle County, Colorado (the "Property").
B. The Property has been or will be subdivided into Lot 18-E and Lot 18-w by the recording of a Final Plat and
Resubdivision Map of the Property (tne "Mapn) in the records of
the Clerk and Recorder of EagIe County. Colorado.
NOI.I, THEREFORE, Declarant does hereby publish and declare that the folloving covenants, conditions, easements and restric-tions shal1 be deerned to run with the land described herein,
shall be a burden and a benefit to Declarant, its successors and
assigns, and to any person acquiring or owning an interest in the
Property and irnprovements built thereon and their heirs, succes-
sors, and assigns.
t. Access Easement. There is hereby created an easement for access to the inprovements constructed on the Property over
and across that part of the Property depicted on the Map as an
access easement. The owners of Lots 18-E and 18-W shall have
equal rights to the use of such access and no o\./ner shal-l hinder or permit his invitees to hinder reasonable access by the other
orrner and his invitees to the other owner's improvements or park
or permit his invitees to park any vehicle on the easement. The
orrners of Lots 18-E and 18-91 shalt each be responsible for one-half of the costs of maintenance, repair, and replacement of that
portion of the driveway and access easement vhich is used by both parties. In the event an o,rner fails to pay his share of the
reasonable costs of maintenance, repair or replacement of that portion of the drivevay and access easement r+hich is used in
conmon, then the other owner may undertake the naintenance,
repair or replacement, as necessary, and all sulns so paid by an
owner on behalf of the other owner shall bear interest at the
rate of 18? per annum. All sums unpaid by the defaulting owner,
together with interest and attorneys' fees shall constitute a tien upon the lot of the defaulting owner in favor of the other
owner prior to all other liens and encurnbrances except: (1) liens for taxes and special assessments; and (21 the lien of any first
mortgage or first deed of trust of record encumbering such lot.
Notice of the lien shatl be filed in the real estate records of
Eagle County, Colorado and may be foreclosed in a manner similar to foreclosure of a mortgage on real property. In any such fore-

and expenses of such proceedings, including reasonable attorneys'

2. Utilitv Easement. There is hereby created an easement for the

maintenance, and repair of utilities,
including meters, within and upon the Property. This easement shall encompass so nuch of the Property as is necessary or conve-
nient for the proper installation, maintenance, and repair of all
utilities of any kind or nature which may service the improve-
nents located on the Property.
3. Term. This Declaration shall have a term of fifty (50)
years from the date hereof and thereafter sha11 be automatically
ieneved for successive periods of ten (10) years, until this
Declaration is terminated by aIl of the owners and holders of
first ]ien mortgages of record of the Property by a document
recorded in the real estate records of Eagle County. Colorado.
4. Successors and Assiqns. This Declaration is intended
to run rrith the land and be a benefit and a burden upon the Prop-
erty and all parts thereof and shall inure to the benefit of and
be a burden upon Declarant and each o$/ner of any portion of the
Property and their respective heirs, successors and assigns.

It has come to the attention of the Department of Community
Devel-opment that there is an area in the east unit of the above
property which was specified on the approved building pernit
drawings as crartl space that has not been filled with soil . If a
floor were installed at this time, the area would not meet the
crawl space definition. As defined in Section L8.04.130 of the
Vail Municipal Code, a crawl space shall be defined as lan area
where the distance between the surface of the earth and or floor
system, and the underside of the structural mernber(s) of the
floor directly above does not exceed five feet and is accessible
by an opening not to exceed nine sguare feet in area.rl
rn addition, it was noted on the building departrnent list of
comments that alt crawl spaces were to conforrn to sai.d
definition.
In this situation, the office of conmunity Development rnust
require that the area be filled in order to conform with the
crawlspace definition of the Vail Municipal Code before a
Tenporary Certificate of occupancy is issued. we are explaining
the situation in order to avoid a problem in the future. Please
l-et me know if you have any questions concerning the crawl space.
It has also come to the attention of the staff that fill is being
placed on the unplatted parcel of the Tinberfalls Condorninium
Association property without a grading perrnit. It is necessary
for a grading plan to be subrnitted by September 4, L990 for
Design Review Board approval in order to rectify the situation.
