Development Potential Summary
Dear Duane,
Thank you for your interest in the development potential of the referenced Lot 9 in East Vail. Per our
conversation yesterday, I have researched the files and reviewed the plans and tally which you submitted,
which allowed me to make some conclusions.
Lot 9 is located in the Two-Family Residential zone district and consists of 23,600 square feet which limits the
allowable Gross Residential Floor Area (GRFA) for both units upon the Lot to 7,618 square feet. This formula
is based upon 46% of the first 10,000 square feet of lot size able to be used as GRFA (4,600 square feet),
38% of the next 5,000 square feet of lot size able to be used as GRFA (1,900 square feet), and 13% of the
next '15,000 square feet of lot size able to be used as GRFA (1,118 square feet).
Per my (rather rough) calculations, the sum of both sides of the existing residence totals to 5,061 square feet
GRFA. This number is about 11% greater than the sum that you have calculated for both sides of the
residence: 4,543 square feet. Therefore, we will average our numbers and make the rough assumption that
the residence is about 4,800 square feet in size. This number allows approximately 2,816 square feet of
GRFA remaining to the entire residence. Please note that the calculation of all existing floor area may
change slightly depending upon the "as-built" plans that will need to be submitted and re-calculated as a
result of any application to add GRFA to either side of the residence.

Dear Duane:
As requested we surveyed the finish floor elevation of the
west unlt located on the referenced property. This survey was
based on the Flood Plain study of the core Creek forrned by Hydro-TrLad in 1975. The basis of our elevatlon was from a spot
elevation on the Nugget Lane bridg:e across the Gore Creek as shown
on plate 17 (encLosed) of the fl,ood plain study. From this survey
we determlned the living roorn flnish floor elevation to be 48.9.
The nearest cross-secti.on on the flood plain study ( No.58.1)
shows the 100-year flood elevation to be 8439,0, as shown on Table
III-2-B (enclosed), which indicates the fj.nish floor to be
approxj.nately 9.9 feet above the 100 year flood stage.

Dear Mr Patten:
I am in receipt of a copy of your letter to Cliff Towns. I
was immediately able to discern that you had become friends of my
very good friend, John Baum of oklahoma City. I called John and
actvised him of the contents of your letter, and we had a visit
about you and the Virgin Islands trip. It sounds like you had a great time.
I certainly am not intending to cause Mr. Ruder of
Ruder,/Reinecke Construction Co. any significant difficulties.
However, he has demonstratetl a real lack of concern for us now
for many months, and I think he has had a significant amount of
time already to remove this junk. I contacted the City a year
ago this past summer about the stuff and something was going to
be done immediately!
If he's going to leave the stuff on the property, which is
in my judgnent illegal , it needs to be moved to the very far end
of the lot against and contiguous to the apartments to the east
of this acreage which he constructed. There should be some
screening of the equipment, materials and implements from public
view.
Again, I do not intend to cause hardship, but likewise, I do
not intend to spend the money I did for my property, pay the 1I0t
tax increase recently levied, only to have an opportunity to
travel to Vail once or twice a year to look at his junk
immediatety across the creek from my patio. I hope you will

Construction Company and zoned for residential cluster
homes, but is not yet developed. In the interim
Ruder-Rejnke Construction Company is using the property
as a constructjon yard in which to park dirt moving
equipment, trucks and construction trai lers, and store
scaffolding, construction'l umber, trash lumber, trash
meta1, oil barrels, etc.
I understand that this is a violation of a Vail ord'i -
