General Information:
This application is required for proposals involving minor exterior alterations and/or site improvements,
Proposals to add landscaping do not require DRB approval unless they involve the addition of patios,
water features, grading, or the addition of retaining walls.

. Rock outcroppings and other significant natural features (large boulders, intermittent streams,
etc.).. All existing improvements (including foundation walls, roof overhangs, building overhangs, etc.).. Environmental Hazards (ie, rocKall, debris flow, avalanche, wetlands, floodplain, soils). Watercourse setbacks, if applicable (show centerline and edge of stream or creek in addition to
the required stream or creak setback). Show all utility meter locations, including any pedestals on site or in the right-of-way adjacent to
the site. Exact location of existing utility sources and proposed service lines from their source to
the structure. Utilities to include:r Cable W Sewer Gas . Telephone Water Electric . Size and type of drainage culverts, swales, etc.. Adjacent roadways labeled and edge of asphalt for both sides ofthe roadway shown for a
minimum of 250' in either direction from property.

have the following comments.
In order to provide Fire Dept. access to the site, the existing driveway will need to be
widened to a minimum of 12 feet.
Upon inspection of the site, there appears to be water running from the norlheast corner
oi tne prdperty down along lhe driveway. You will need to provide a drainage swale. in

grading that might be necessary in order to achieve this.

liability and obligations hereunder shall cease and terminate six months after the effective date hereof
or when the policy or policies commined for shall issue, whichever first occurs, provided that the
failure to issue such policy or policies is not the fault of the Company.

CONDITIONS AND STIPULATIONS
l. The term mortgage, when used herein, shall include deed of trust, tmst deed, or
other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interes{ or
mortgage thereon covered by this Commitment other than those shown rn
Schedule B hereof, and shall fail to disclose such knowledge to the Company in
writing, the Company shall be relieved from liability for any loss or damage
resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge. If the proposed Insured shall disclose
such knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any such defect, lien, encumbrance, adverse claim or other matter,
the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liabiliry of the Company under this Commitment shall be only to the named
proposed Insured and such parties included under the definition of Insured in the
form of policy or policies cornmitted for and only for actual loss incurred in
reliance hereon in undertaking in good faith (a) to comply with the requirements
hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or
create the estate or interest or mortgage thereon covered by this Commitment. In
no event shall such liability exceed the amount stated in Schedule A for the policy
or policies committed for and such liability is subject to the insuring provisions, the
Conditions and Stipulations, and the Exclusions from Coverage of the form of
policy or policies committed for in favor of the proposed Insured which are hereby
incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may
bring against the Company arising out of the status of the title to the estate or
interest or the status of the mongage thereon covered by this Commitment must be
based on and are subject to the provisions of this Commitment.

SURIECT: A request for a side setback variance in order to
add a garage and addition to a residence on Lot 5, Block 1, Bighorn 5th Addition.Applicant: Mr. Peter Gonbrich
I. DESCRIPTION OF VARIANCE REQUESTED
The applicant is requesting a six foot encroachment into the
15 foot side setback in order to construct a garage and
storage/Iaundry room area. Please see attached drawings.
Applicant's staternent:
ItThe existing residence has a one-car garage at the rear of the house vith no driveway access. In order to provide access to this garage, the driveway would need . to wrap around the house and snake through a number of large evergreen trees. The applicant is proposing to build a new tvo-car garage to the east of the house that
would encroach approximately 6 feet into the side setback. This location of the garage, as opposed to other possible locations, will not interfere with any of the existing trees. The adjacent house is currently set back approximately 35 feet from the property line
and is separated from the proposal by mature trees on both properties. This variance is warranted because of the unique situation with the orientation of the existing house, its proximity to the numerous large
trees and because of the separation that is preserved
between the proposal and the neighboring property.
There will be no effeet on light and air, distribution of population, transportation, traffic facilities,utilities or public safety.rr
II. CRTTERTA AND FINDINGS
Upon review of Criteria and Findings, Section L8.62.060 of the municipal code, the Department of Community Development
reconmends approval of the reguested variance based upon the following factors:

VI . STAFF RECOMMENDATION
Staff recomrnends approval of the variance with the condition that additional landscaping (4 to 5 spruce) be added along the east side of the garage. We agree with the applicant that the garage has been located in a sensitive way
considering the existing location of the house and
surrounding evergreen trees. we feel this approval is not a grant of special privilegte, as there are special

The existtng residence has a one-car garage at the rear of the house with no driveway access. In order to provide access to
this garage the driveway would need to wrap around the house and snake through a number of J-arge evergreen trees. The applicant is propoeing to build a new two-car garage to the east of the house that would encroach approximately six feet into the side setback.This location of the garage r 8s opposed to other poesible
locations, wi1-1- not interfere with any of the existing trees.The adjacent house is currently setback approxinately 35 feet fron the property line and is seperated fron the proposal by mature trees on both properties. This variance is warranted
because of the unique situation with the orientation of the existing house, its proxinity to the nunerous large trees and

IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
1. In add'ition to meeting submittal requirements, the applicant must stake the site
to indicate property lines and build'ing corners. Trees that will be removed
should also be mart<Ld. This work must be completed before the DRB visits the
site.
2. The review process for NEW BUILDINGS will normal 1y involve two separate meetings
of the Desi!n Revjew Board, so plan on at least two meetings for their approval.
3. people who fail to appear before the Design Revjew Board at their scheduled
meeting and who have'not asked for a postponement will be required to be
republ i shed.
