ATTIC REQUIREMENTS:L) Provide an access to all attic areas with a clear height of 30 inches or more. The minimum size is 22 inches by 30 inches. There must be 3o
inches or more clear height above the access. -- Sec. 3205. (a)
2) Provide ventilation in aLL attic areas. The net free vent area is to be not less than L square foot for each l-50 square feet of attic area.

The neeting was informally called to order at 3:15PM by Kathy
langenwalt-r. In the absence of a quorum, the Conrmission
reviewed items not requiring a vote.
1. Review of draft SPraddle Creek minutes frorn the Februarv 11'
1991 neetinq.
This iten was taken out of order. The Corornission nerobers
present, Kristan Pritz and ilay Peterson gave their corrections of
the urinutes to the Secretary to be input into the final ninutes.
2. A recruest for a rear setback variance at Cascade Cros9ing at
1031 South Frontacre Road on a oarcel of land located ln lhe
northrtest l-l4 of section 12, TortnshiD 5s, R81w of the 5th
Plil. Town of Vail. Eaqle County' colorado
Apolicant: Vail Enterprises Partnership
Mike Mollica briefly presented the request. The background
infornation on the project was explained. Cascade Crossing
originally received approval for a rear setback variance of 5
fee€ on January 26, L987. A front setback variance for parking
was also approved at that tiure. The project was issued a
building pernit on December 1, 1989 based on the original plans
subnitted, which relied on previous surveys perforrned on the
site. Thi original property survey, perforrned by InterMountain
Engineering, indicated that the project was within stated bounds,
Subsequently, after the building pernit and Certificate of
occupJncy wlre issued, Eagle valley Surveying' Inc. was hired to
prepare an ALTA survey for the site. According to that survey,
Lhe- northerly property line of ttre cascade Crossing parcel vas
reconfigured, based on the original property.deeds to the I-7o
right-oi-way. Because of the nelt proPerty line location, the
existing building now slightly encroaches into the rear
(northerly) setback.
At the tirne the project nas built, all construction was in
accordance with the approved drawings, Hortever, since the
correct property line had been identified, the building was now out of compliance with the previously approved variance.
Staff reconmended approval of the rear setback variance, citing
Section Iv, subsections A, B, and C (1-3) of the staff memo as
being appropriate to this application. llore specifically, the granting of the variance would not constitute a grant of special privilege, ttre variance would not be detrinental to the public
health, safety or welfare, and that the variance is warranted for
the following three reasons:1. The strict literal interpretation or enforcement of the specified regulation would result in practical
difficulty;2. There are exceptions or extraordinary circurnstances or
conditions applicable to the same site of the variance
that do not apply generally to other properties in the
same zone; and 3. The strict interpretation or enforcement of the specified regulation would deprive the applicant of privileges enjoyed by owners of other properties in the
saure di.strict.
In addition, the applicant agreed to perrnanently disconnect the
exterior lighting on the north side of the building as a
condition of approval of this variance, as wel-l as plant
additional evergreens (consisting of 3 ponderosa pines) along the
north wall to minimize the visual effects from I-7o.
Jiro Shearer opened the discussion by stating that he was in favor
of granting the variance. He also indicated he liked the fact
that the north lights would be turned off, but that be would like
to see even more plantings along the northern wall.
Ludwig Kurz agreed with Jirn's cornrnents, and said they reflected
his thinking. However, !1r. Kurz felt that rnore landscaping,
specifically along the west side of the north walI would be
beneficial .
Kathy Langenwalter commented she felt strongly that the site
would benefit from nore evergreens, perhaps a total of I trees,
consisting of a mix of pine and spruce and, for better visual
variety, the trees should be between 7-11 feet in height. When
she asked the applicant if that would be acceptable' the
applicant agreed.
At this point, since no quonrm was present, discussion ceased on
this request until a quorum could be obtained.
Applicant: Nowell Mav
Jill Karn'nerer sunmarized the staff position on the variance
reguest for an entrlrway and bay window. She explained that the
entry encroachment would be an approximate 6'-9tr encroachment
into the front setback. The bay window would have an
encroachment of approxinately 1'-3'r into the front setback.
Jill explained ttre allowances for bay windons. She stated that a
bay window may project not more than 3 feet into a required
setback, provided ttrat the surface area of the projection does
not exceed lot of the surface area of the wall surface fron which
it projects. However, the proposed wl-ndow's surface area equates
to 49* of the surface area of the wall from which it projects.
This exceeds the allowable projection by 39t.
There would be no impacts on other existing or potential uses or
structures in the vicinity. However, staff believes that
approval of the variance would constitute a grant of special privilege. There would be no effect on light and air,
distribution of population, transPortation and traffic
facilities, public facilities and utitities or public safety.
In order for the Conrnission to grant the variance, there should
be a finding of:
1. No grant of speciat privilege;
2. No detriment to the public health, safety or welfare,
or rnaterialty injurious to properties or improvements
in the vicinity;3. That the variance is warranted because:
a. The denial htould result in physical hardship
inconsistent with the objectives of the title.
b. There are exceptions or extraordinary
circumstances applicable to this site which do not
apply generally.
c. The strict enforcement of the regruJ.ation would
deprive the applicant of privileges enjoyed by
others in the sarne district.
Staff recommended denial of the variance due to the fact that it
nas a part of a najor renodel of the house. and it was believed
that other alternatives could be found which would not require a
variance. Staff also stated that the project did not meet any of
the criteria for a variance.
The architect for applicant, Pan Hopkins, addressed the
Connission with the rationale behind the requested variances.
She explained that the original structure was built i'rL L977,
before that section was incorporated into the Town. At that
time, the setback reguirements were either non-existent, or
consisted of 1O feet.
Parn stated that the remodel project was not one intended to inpact the entry area of the house. The applicant wanted the addition of an airlock in the entry in order to provide the fanily nith a place to store their coats. In addition, the bay
windov sas requested to provide archltectural balance through the
use of two donmers. The bay window, in her opinion, would be a visual |treasonlr for the eecond dormer.
Applicant Noel May stated that his instructions to Pan had been to save as many trees as posslble, and the result had been tlrat the window and entry moved out, rather than back. In addition,there was a problem with drainage in the current configruration,with the result being dangerous ice at his entryway. He
expressed his desire to have the architectural balance through the use of the dornrer and bay window.
Kathy Langenwalter asked Parn Hopkins to explain the reason a variance was being proposed. Parn answered by explaining that they had been unable to find another, more practical , location for the entry. The request for the bay window was simply for a
window seat and to give purpose for the second roof dormer, and provide a unifying architectural therne.
Kathy responded that she could not find a reason for granting the
variance for the bay window, and that she believed the same effect could be achieved through another method whereby the entire area of the bay window would be reduced by 2 feet.
Ludwig Kurz agreed with Kathy and further explained that he could
see no reason for the window to encroach further into the setback
when there rrere other areas avai]abl.e. He did indicate that he Iiked the idea of an arctritectural tie-in, but felt it could be
achieved without the use of the bay window.
I{r. Kurz stated that he felt that the entry encroachment rras
acceptable, since it did present a hardship to the applicant if the variance was not granted.
Jim Shearer asked Ms. Hopkins if it would be possible to cut the
bay window down. Pam thought it niglit be possible. In resPonse,
Jim stated that he could see no reason to repeat the dormer at the expense of a variance. He did express his support of a
variance for the entryway, rrith the provision of an airlock, as it posed a hardship for safety to the applicant.
Connie Kniqht Joined the meeting at 3:4o p.n. She asked staff for a clarification of the current policy on airlocks. Kristan Pritz explained that there rtas no longer a specific provision on
ttre size of an airlock and that it was now considered a part of

the cRfA. Connie asked applicant when they were planning on
buLlding the entry and bay sindow. NoeI Uay answered that it nas
planned at the same tine the rest of the remodel was completed.
Connie expressed her feeling that a variance was not varranted for the entry, as she did not feel there was a hardship presented. She indicated she believed the entry could be moved
back an additional 2 feet to elirninate the necessity of a
variance.
Kathy Langenwalter discussed her opinions on the request. She
supported the entry variance on the basis of hardshl.p, since the
present location was Ln better proxinity to the garage and
driveway, and to move the location would be detrinental .
However, she could find no hardship to justify the bay window.
Jin Shearer uoved that the entrance variance be accepted wlth the
provision of an airlosk. Ludwig Kurz seconded the rnotion.
Pan Hopkins said the applicant would accept that motion, as there
was no provision for a window in the building pernit. rf they
could re-design the bay window, they would come back to the
Connission if reguired.
Kristan Pritz asked for a clarification of the motion to add the
reasons the Conrnission lras approving the variance for the entry.
She requested that staff memo, section 5, subsections A, B, and
cl be used as the justification for the variance. Jim Shearer
agreed to that amendnent to his motion, with Ludwig Kurz further
accepting the amendment to his second. ilim Shearer proposed a
furtler imendment to his notion that the issue of the bay vindow
be tabled to a future meeting. Ludwig Kurz amended his second to
include that provision. A further anendment by Jin shearer, and
seconded by Ludlrig Kurz, was to add the provision that an airlock
be providea in tht entryway. The vote in favor of the motion was
a unanirnous 4-0.
Since a quorum htas now present, the Cornmlssion returned to iten
2, the reguest for a rear setback variance for cascade Crossing.
Kristan biiefly reiterated the reason for the variance request to
Connie l(night, with the additional provisions the applicant had
agreed to as a condition of approval .
Ludwig Kurz moved that the application for a rear setback
variance at the cascade Crossing Retail Center, located at 1031
South Frontage Road on a parcel of land located in the Northwest
L/4 of Section 12, Township 5S, R81W of the 5ttr Plt' Town_of VaJ'l ,
Eagle County, Colorado be approved per staff recommendation, with
the additional provisions that 8 spruce or pine trees, between 7-
11 feet in height, be placed along ttre north wa1l, and that the
owner penranently disconnect the outdoor lighting along the north .wall. Jin Shearer seconded the motion. The vote was 4-0 in favor of the notion.
Since it appeared that a quomm may not be able to be maintained
through discussions of the renaining agenda itens, the Coromission
discussed alternatives available to then. The eventual consensus
was that the Coromission felt Lt was important for the full
Commission to revl-ew the view corridor ordinance, and have the fuII weight of the Connission behind any reconmendation to
Council . Ludwig xurz moved to table the discussion of the view corridor amendnent until the March 11 neeting. Connie Knight
seconded the noti-on. The affirnative vote nas 4-0.
Kristan Pritz asked the Conmission for approval of the January 28t L99L minutes before the quorue was lost. Connie lKnight moved to approve the minutes as written. Jirn Shearer seconded. The vote was 4-O in favor of the motion.
At this point, Kristan Pritz reviewed the action taken by the
comrnission during the meeting. She summarized:
1. Cascade Crossing variance was approved with the above-stated
conditions.2. The front setback variance reguest for Noel lltay was approved with regard to the entry, with conditions, and the bay
window variance request was tabled.3. The view corridor ordinance amendrnent was tabled until the
March L1, 19.91. meeting.4. The ninutes fron the January 28t L99J- rneeting nere approved
as written.5. The draft ninutes for Spraddle creek from the February 11,
1991 neeting were reviewed. Staff will contact Diana
Donovan to discern any cortrments she has. The revised
ninutes of the entire February 11, 1991 neeting will be
presented to the Cornrnission for approval at the March 11,
1991 neeting.
The date for the Planning and Environmental Conmission's ltorkshop
was discussed. It was concluded that the staff would contact the
absent Conmission menbers and propose Thursday, March 28 at
5:30PM for the workshop. The alternate dates would be April 1 or April 4.
Kristan Pritz stated there would be a joint work session of the
Conmission with the Council on March 5 to discuss the Master
lransportation Plan. Staff will call the conrnissioners with
confirmation of this date and tine.
Kristan also presented the actions of the Zoninq Code Task Force to the Commission, stating that the 25o ordinance was most likely
going to be elininated. On Thursday, Februaty 28, the Task Force
would meet on the issue of l{u1ti-Fanlly districts and possibly
the parking pay-ln-lieu ordinance.
The final discussion centered around staff's direction with
regard to the woodburning fireplace ordinance. Kristan presented
a iunnary of the current actions and course for future review.
Since a guorum was not available for further action, the meetLng
was adjourned at 4:50 P.U.

The archltect for apPllcant, Pam Hopkins, addressed the

Pan stated that the reuodel proJect was not one intended to

window waa requested to provide architectural balance through the
use of tso do:rners. The bay window, in her opinion, vould be a visual ireasonrr for the second dor:uer.

they had been unable to find another, more practical , Iocation for the entry. The request for the bay window was sinply for a
uindow seat and to give Puryose for the second roof dorner, and
provJ.de a unifying architectural thene.
Xathy responded that she could not find a reason for grantlng tbe
variince for the bay window, and that Ehe believed the sarne
effect could be achieved through another nethod rhereby the
entire area of the bay window would be reduced by 2 feet.
Ludvig Xurz agreed with Kathy and further explained that he could
see no reason for the window to encroacb further into the setback
when there uere other areas available. IIe did indicate that he
liked tbe idea of an architectural tie-in, but felt lt could be
achieved rrithout the use of the bay window.
Ur. Xurz stated that he felt that the entry encroachment was
acceptable, since it did present a hardship to the applicant if
the variance wa6 not granted.
Jiro Shearer asked Us. Hopkins if it would be possible to cut the
bay window down. Pam thought it uight be possible. In response'
Jiru etated that he could see no reason to repeat the dorner at
the expense of a variance. He did express,his suppor9 9f a
varianLe for the entrlntay, with the prov5'sion of an airlock, as
it posed a hardship for safety to the appllcant.
