reVieW and approval, a Planning Deparunent review or Health Departrnent review, and a review
by the Euilding Deparunent, the estimated time for a total review will take as long as three (3)
weeks.

Amendment to the 1999 N,E.C. Town of Vail Ordinance 10-1-6.
Overhead services are not allowed in the Town of Vail,
Underground services have to be in conduit (PVC) from the transformer to the electric meter, main disconnect
switch and to the first electrical distribution circuit breaker oanel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easilv
accessible.
All underground conduits are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted.
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platForm,
a structural engineer must review the existing condition and verify that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.

o If this permit is for a commercial space, two (2) sets of stamped drawings are required.

Do not use flexible or conugated duct. This type of duct will restrict air flow and reduce performance. Only use smooth galvanized metal duct observe local codes regarding special duct requirements and placement of duct against combustibles.
Make the ducl run as short and as straight as possible with as few turns as possible. Avoad sharp angled turns. Instead, use smoorh 9radual turns such as adjustable elbows. Forductruns over 20 feet, increase the duct size by 1"afterthefirst 10feet, and for every 10feet thereafter.

Variances may be granted in order to prevent or to lessen such practical difficulties and unnecessary
physical hardships as would result from the strict interpretation and/or enforcement of the zoning
regulations inconsistent with the development objectives of the Town of Vail. A practical difficulty or
unnecessary physical hardship may result from the size, shape, or dimensions of a site or the location of
existing structures thereon; from topographic or physical conditions on the site or in the immediate
vicinity; or from other physical limitations, street locations or conditions in the immediate vicinity. Cost or
inconvenience to the applicant of strict or literal compliance with a regulation shall not be a reason for

Architectural Floor Plans:
o Scale of 1/8" = 1'or larger; 1/4" is preferred
a Floor plans of the proposed development drawn to scale and fully dimensioned. Floor plans and
building elevations must be drawn at the same scale.
o Clearly indicate on the floor plans the inside face of the exterior structural walls of the building.
tr Label floor plans to indicate the proposed floor area use (i.e. bedroom, kitchen, etc.).
o One set of floor plans must be "red-lined" indicating how the gross residential floor area (GRFA) was
calculated. See Title 12, Chapter 15 - Gross Residential Floor Area for regulations.
o Provide dimensions of all roof eaves and overhangs.
Architectural Elevations:o Scale of 1/8' = 1' or larger; 1/4" is preferred
o All elevations of the proposed development drawn to scale and fully dimensioned, The elevation
drawings must show both existing and finished grades, Floor plans and building elevations must be
drawn at the same scale.a If building faces are proposed at angles not represented well on the normal building elevations, show
these faces also.o Elevations shall show proposed finished elevation of floors and roofs on all levels.
D All exterior materials and colors shall be specified on the elevations.o The following shall be shown graphically and fully dimensioned: fascia, trim, railings, chimney caps,
meter locations, and window details.

PRE-APPLICATION CONFERENCE
A pre-application conference with a planning staff member is stiongly encouraged, No application will be
accepted unless it is complete. It is the applicant's responsibility to make an appointment with the staff
to determine submittal reouirements,
TIME REOUIREMENTS
The Planning and Environmental Commission meets on the 2nd and 4th Mondays of each month. A
complete application form and all accompanying material (as described above) must be accepted by the
Community Development Department by the appropriate submittal date, which is a minimum of four (4)
weeks prior to the date of the PEC public hearing.
Approval of a variance shall lapse and become void if a building permit is not obtained and construction
not commenced and dilligently pursued toward completion within two (2) years from when the approval
becomes final.

ADDITIONAL REVIEW
A. If this application requires separate review by any local, State or Federal agency other than the Town
of Vail, the application fee shall be increased by $200.00. Examples of such review, may include, but
are not limited to: Colorado Department of Highway Access Permits, Army Corps of Engineers 404,
etc.
B. The applicant shall be responsible for paying any publishing fees which are in excess of 500/o of the
application fee. If, at the applicant's request, any matter is postponed for hearing, causing the
matter to be re-published, then, the entire fee for such re-publication shall be paid by the applicant.
C. Applications deemed by the Community Development Depatment to have design, land use or other
issues which may have a significant impact on the community may require review by consultants in
addition to Town staff, Should a determination be made by the Town staff that an outside consultant
is needed, the Community Development Department may hire the consultant. The Department shall
estimate the amount of money necessary to pay the consultant and this amount shall be forwarded
to the Town by the applicant at the time of filing an application. Expenses incurred by the Town in
excess of the amount forwarded by the applicant shall be paid to the Town by the applicant within 30
days of notification by the Town. Any excess funds will be returned to the applicant upon review
completion,

VARIANCE - DESCRIPTION of NATURE
Encroachment on T.o.V. l5 ft set-back from old Hwy 6 R.o.w. (Just past " Dead End.. sign in
East Vail.
Set-back on one corner of existing garage is 1l'2" vs required l5'. Distance from this corner to
the Hwy is 96ft! (The c.D.o.T. R.o.w. makes a sftange "v" into the prop€rty for which they no
longer know why. )
when I wanted to build this garage several years ago I took the original survey (made by
Intermountain ) into the planning committee ( Brent Wilson ) and asked what was required. I
followed everv requirement as given to me by the planner including an onsite inspection and
measurements made by him. All construction, plans and inspections were completed as required.
When I went in to request tlre final inspection another individual cane out of the back office and
said (exact words): " I don't know what is going on in this office- But you have to have an
I.L.C." I then asked what that was, and then, considering it only a minor inconvenience, though
major expense, had it accomplished. The LL.c. by peak, however, showed a set-back on on€
comer of 1Ift 2"" vs 18ft 9" on the original survey.
At frst I thought the new survey by Peak was incorrect because they had the house located on
Main Gore Drive vs Gore Circle. However, after a couple of trips back and forth between the
surveying companies, Peak admitted to the wrong street but it was the lntermountain survey that
was off. (The reaction of the gentleman at Intermountain who admitted to the discrepanry was " I
can't comment as I did not work here then.")
I am requesting a variance because:
I' I acted in good faith and accomplished everything in the fime and m.urner requ€sted. I beliwe
a variance is a better way to go than lsrsrits to clear this up.
2. The gaage is firlly completed, mostly concretg and built into the hillside. Lmpossible to
move or alter.
3. The area in question is not visible by any other homes and all neighbors are in agreement
with my request.
4 The comer in question is barely visible from old Hwy 6 as it is a heavily wooded area at least
10ft below and almost.l00 ft horizontally from the road. (The neighbois garage is actually
clos€r to the highway, but not to the R.O.W,)
5' I would like to make further improvements to th€ dining and kitchen areas (in a different
direction) this fall so probably can not 'Just let it sit" as originally suggested by planner.

Row manager b*ois Derroo I was informed thnt c.D.o.T. has no concern with the matter. Itis onty a T.O.V. requirement. If the sructure actually encroached on their Row I would probably be given an "Encroachment Licens€" as they had no plans for this road other than as a bike path, according to him.
The corner in question is the ffuthest point of the entire house ftom any neighboring home and not visible except possibly from the old highway: atnost root a*avia-i6?ligh"r.
b' The garage corner is frrther from the highway than the next door neighbors garag6 so I am not getting special treannert.

7. Linitation of Liabiliry
No claim shall arise or be maintainable under this poiicy ia) if the
Company, after having received notice of an alleged defect, lien or
encumbrance insured against hereundel by litigation or otnerwise,
removes such defect, lien 0r encumbrance 0r estabiishes the title, as
insured, within a reasonable time after receipt of such notice; (b) in the
event of litigation until there has been a final determination by a couft 0f
competent lurisdiction, and disposition of all appeals therefrom, adverse to
the title, as insured, as provided in paragraph 3 hereof; or (c)for liabiliV
voluntarily assumed by an insured in settling any claim or suit without prior
written consent of the Company.
B. Beduction of LiabiliU
All payments under this policy, except payments made for costs, attorneys'
fees and expenses, shall reduce the amount of the insurance pro tanto. No
payment shall be made without producing this policy for endorsement of
such payment unless the policy be lost or destroyed, in wh ch case proof of
such loss or destruction shall be fumished to the satisfaction of the
Company.
9. LiabilityNoncumulative.
It is expressly understood that the amount 0f insurance under this policy
shall be reduced by any amount the Company may pay under any policy
insuring either (al a mortgage shown or refened to in Schedule B hereof
which is a lien on the esrate 0r interest covered by th s pol cy, or {b) a
mortgage hereafter executed by an insured which is a charge or lien on the
estate or interest described or refened to in Schedule A, and the am0unt
s0 paid shall be deemed a payment under this policy. The Company shall
have the option t0 apply to the payment of any such mortgages any
amount that otheMlse would be payable hereunder to the insured owner
of the estate or interest covered by this policy and the anrount s0 paid
shall be deemed a payment under this policy to said insured owner
10. ADDortionnent
lf the land described in Schedule A consists of two or more parcels which
are not used as a single site, and a l0ss is establisl'ed affectrng one or
more of said parcels but not all, the loss shall be computed and settled on
a pro rata bases as if the amount of insurance under this policy was
divided pro rata as t0 the value on Date of Policy of each separate parcel
to the whole, exclusive oi any improvements made subsequent t0 Date 0f
Policy, unless a liability or value has othewise been agreed upon as to
each such parcel by the Company and the insured at the time 0f the
issuance of this policy and shown by an express statement herein or
by an endorsement anached hereto.
11. Subrogation Upon Payment ar Settlement
\Menever the Company shall have settled a ciaim under this policy, all
right of subrogation shall vest in the Company unaffected by any act of the
insured claimant. The Company shall be subrogated to and be entitled to
all rights and remedies which such insured claimant wouid have had
against any person or property in respect to such claim had this policy not
been issued, and if requested by the Company, such insured claimant shall
transfer to the Company all rights and remedies against any person or
property necessary in order to perfect such right of subrogation and shall
permit the Company to use the name of such insured clairnant in any
transaction 0r litigation involving such rights or remedies. lf the payment
does not cover the loss of such insured claimant. the Comoanv shall be
subrogated to such rights and remedies in the proportion which said pay-
ment bears t0 the amount of said loss. l{ loss should result from any act o{
such insured claimant, such act shall not void thrs policy. but the Company,
in that event, shall be required to oay on y that part 0f any iosses insured
against hereunder which shall exceed the amount, if any, lost t0 the
Company by reason of the impairment of the right of subrogation.
12. Liability Limtted to this Policy.
This instrument together w th all endorsements and other instruments, if
any, attached hereto by the Company is the entire policy and contract
between the insured and the Company.
Any claim o{ loss or damage, whether Dr not based on
negligence, and which arises out ol the status 0f the title to the estate 0r
interest covered hereby or any action asserting such clarm. shall be
restricted to the provisions and conditions and stipulations 0f this policr.

the above-referenced property. Pursuant to the improvement location certiilcate (ILC)
dated I lll1/99 by Peak Land Consultants, a sctback encroachment exists where the ncw
garagc addition was constructed. Section l2-6C-6, Town of Vail Code requires a
minimum 15-foot setback between thc geiragc walls and the properfy line. Your ILC
indicates a I 1.2-fbot setback between the garage and the property line.
The Town of Vail will not conduct any more inspections on this project until this

Roofing Specilication for the Hammelin Residence
I. TnlnOrr/MIscELLANEous:
1l Tear off existing roofing and drop to the ground. **The owner will be responsiblefor Ql cedar.

to protect the interior of the building from water and weather. However, Plath Construction will
not be held liable for any interior damage sustained from leaks caused by sudden and/or unforseen
storms that occur during the tear offphase of this work.
2] Inspect the plywood for water damage, and replace as needed.** This work, if required, will
be an additional charge over and above the contract price, and will be charged at the rate of
$ 1.95 per square foot. No additional charges will be incurred without prior notification of, and
authorization from, the owner or owner's agent.**
3l Plath construction will provide all insurance and permits required by the Town of VailBuilding
Department.

Exclusions and Qualifications:
I I The pricing in this proposal assumes that the existing roof consists of cedar shakes over #30 felt
over plywood. Any existing conditions that vary from this specification will require changes in the
specification and pricing ofthis proposal.
2l The pricing in this proposal assumes that the existing roof is the same size as indicated in the
blueprint drawings dated 3/18/79. Any changes in the actual roof dimensions will require changes
in the pricing of this proposal.
II. Dny-In / SruKEs /FLASHTNG:
l] Install "Jiffr-Seal" Ice and Water Guard by "Protecto Wrap" over entire pitched roof area,
according to manufacturers' specifications. Extend membrane up walls a minimum of 12" at
roof-to-wall iunctures. Use mastic as needed.
2] At the stone chirnn"y, remove the rock to a point 24" abovethe roof line. After the new roof is
installed the lock will be put back into its original place.

ridge shingles as needldd. ** The shakes in this bid do not have a fire rating.
4l Install 26 gauge, prefinished flashings as needed, including valley, step, and endwall flashing.
Install 26 gauge, prefinished drip edge flashing at eave and rake edges. The color is to be selected
from the manufacturer's standard color chart.
5] At roof to wall junctures, install 26 gauge counterflashing over the new roof flashings. Caulk
the top edge to assure a watertight seal.

I ] Please be advised that materials for this proposal have been bid at current market prices. Due to
volatility ofthe market, material prices cannot be guaranteed past 30 days. * Please take note
that a "letter of intent'r received by Plath Construction, Inc. within the 30 day period will
allow us to "lock in" current material prices even if actual purchases are made several
months later.
2l Cedar shakes for this proposal have been bid at the current market price of$ 115.00 per square.
Due to the extreme volatility of the cedar market, price changes prior to the acceptance of this
proposal will require renegotiation ofthe contract price, to reflect any such changes.
3l Plath Construction carries property damage liability insurance in the amount of $2,000,000.00
per occwrence. Plath Construction carries auto insurance in the amount of $2,000,000.00. Plath
Constructio:r carries pppropriate Workman's Compensaliorr insurance tluough Colorado State
Compensation. No further insurance coverage is included in our price.
4] Upon receipt of the contract price, Plath Construction will issue a warranty certificate
guaranteeing roofing against leaks due to flaws in workmanship for a period of one year from the
iiate of roofing com[leiion. Leaks qualifuing under the terms df said ivarranty will 6e repaired
promptly at no cost to the owner. This warranty does not cover any subsequent interior damage
that may occur.
5l All pricing in this proposal assumes that the work will be scheduled and completed before
October 15, 1997. Any delays beyond Plath's control that extend the roof workpast October 15,
1997 will require extra charges to cover snow removal, weather protection, primir for the Jift '
Seal membrane, and an addJd charge to cover our loss ofproduclion due toidverse winter
conditions.
6] There is a temporary lean to on the north side of the home. This proposal excludes any work on
the roof of this structure.
IV. Oprrons:
ll;Substitute Riva Select metal shingles for the cedar shakes in the base bid. Install all flashing
and trim as needed for a complete system. All other specifications in Section I and Section II are
to remain the same.
Price for option #1: Add to the base bid

Bl Riva Select in a Special Color: $ 4,955.00 ** Please see our attached brochure which indicates Value Colors and Special Colors.
2] Install 65' of snow fence along the west elevation of the garage and main roof. Install 4' of snow
fence on the east elevation ofthe main roof over the hot tub and 25' of snow fence on the east side
of the garage over the patio. Total footage is 94'. The snow fence will be painted to match the
color of the gxisting fascia. The pricing for the snow fence is contingent upbn approval of the
oeslgn ano lastentng system.
Price for option #2: Add to the base bid $ 3,584.00
3] It may be possible to reuse the counterflashing on the chimney curb and leave the stone in place.
We cannot make this determination until we teaf off the roof. If the stone is not disrurbed- deiete
the amount below.
Price for option #3: Deduct from the base bid $ 710.00
