BUILDING PERMIT ISSUANCE TTME FRAME
If this permit requlres a Town of Vail Fire Depaftment Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements, Residential and small prolects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this depaftment to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Buildine Permits:.
Fill out the attached check list with the Buildinq Permit Application.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifl7 (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper,
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.), This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. if required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released, Please do not confuse the "Public Way Permit" with a
"Building Permit".
) NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not

u The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culveds at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2t98 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.
Also, the Town of Vail Public Works Depaftment will be approving all final drainage
and culveft installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Ceftificate of Occupancy issuance.

D Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
a Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hermf, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dift, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
tr Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
tr Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 7-4-l of
this Code. (1997 Code: Ordinance 6 (i979).

s No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interFere with the free movement of vehicular traffic or proper

o Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

Amendment to the 1999 N.E.C. Town of Vail Ordinance 10-1-6.
Overhead seruices are not allowed in the Town of Vail.
Underground services have to be in conduit (PVC) from the transformer to the electric meter, main disconnect
switch and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall be located next to the meter on the exterior wall of the structure easily
accessible.
All underground conduits are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are accepted,
NM Cable (Romex) is not allowed in commercial buildings or structures exceeding three (3) stories.
No use of aluminum wire smaller than size #8 will be permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of elterior hot tubs or'spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade/ you must also obtain a building permit.
If this permit is for installation of an elterior hot tub or spa on any existing deck or elevated platForm,
a structural engineer must review the existing condition and verin/ that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.

Change to Approved Plans
Background - At it's meeting on March 15, 2000, the DRB approved the submitted plans for
the addition to the Simmons residence. The approval was done at the stafflevel and the planner
was Ann. In August of this year a building permit was issued, permit number 8000186, to begin
construction on the addition. As the construction began there were two changes identified that
needed to be submitted to the DRB for approval. The two changes are described below.
Addition of Window - On the bottom floor of the North East side, it was originally planned to
have a crawl space. There was also a stairway from the garage to the upper floor. It is requested
that the stairway be removed. Also, a room 20 feet by l0 feet will replace the existing crawl
space. In the room will be a window 4'10" by 4'. See exhibit Al and 42 for floor plan and
elevation. This will add 200 feet of GFRA. Even with this addition, there is still more available
GFRA. This addition does not change the footprint of the structure; it only replaces a crawl
space with livable space.
Change in Roof - Also on the North East Side the roofline was changed in the approved
addition. However. I would like to extend the half dormer out tluee feet to match the roofline
on the South East Side. This change will improve the overall appearance of the structure. See
exhibit Bl for North East Side and exhibit 82 for the South East Side. It is only the North East
Side that the change is requested.
I have also attached a full size copy of the plans approved by the DRB.

Bill, attached you will find revised exhibits related to changes requested to
our approved plans. The exhibits are based on the copies ofthe approved
plansthat you provided to me. As you remember, I requested two changes
to the approved plans and the changes are described below:
Addition of window - onExhibit A, you will find the requested window.
The exhibit shows that we are adding two windows. I discussed this with
my architect and he said that one of the windows (window A) had already
been approved. Window A is a bedroom window and is an outside egress
that is required. window B is the addition that I am requesting. Both
windows will be the same size and will match existing materials. My
architect could be mistaken about the approval of window A, so I am
requesting that both windows be approved.
change in Roof - This change is also shown on Exhibit A. I am requesting
that the half dormer be moved out approximately three feet. It is not moved
out all the way to the end. It is moved out to match the dormer that is on the
southeast side (exhibit C).
The requested changes do not change any ofthe other elevations on the other
sides oithe house. I did attach the other elevations (Exhibit B and C) for
your information.

1. DEFINITION OF TEBMS
The following terms when used In lhis policy mean
(a) "insured": the insured named in Schedule A. and, subject to any righls
or delenses the Company would have had against the named insured. those
who succeed to the interest ol the named insured by operation of taw as
distinguished from purchase including, but not limited lo, heirs. disl.ibutees.
devrsees, survivors, personal representatives. next ol kin, or corDorate o,
fiduciary successors. .
(b) "insured claimant": an insured claiming loss or damage.
(c) "knowledge" or "known"; actual knowledge, not constructive knowt_
edge or notice. which may be imputed to an insured by reason of the public
records as defined in this policy or any other records which impart construc-tive notice of matters atlecting the tand.
(d) "land": the land described or referred to in Schedule A, and imorove-
ments atfixed thereto which by law constitute real property. The term .,land"
does not include any properly beyond the lines of the area described or
reterred to in Schedule A. nor any right, litle: interest, estate or easement In
abutting streets, roads, avenues, alleys, lanes, ways or waterways, but noth_
ing herein shallmodity or limitthe exlent towhich a right ol access to and from
the land is insured by this policy.
(e) "mortgage": mortgage, deed ot lrust, trust deed, or other securitv
instrument.
(0 "public records": records es{ablished under state statutes at Oate ol
Policy for the purpose ol imparting construclive notice ol matters relatino to
real properly to purchasers for value and without knowledge. With respect to
Section 1(aXiv) ot the Exclusions From Coverage, ,'public;ecords" shatt atso
include environmental proteclion liens tiled in the records of the clerk ol the
United States district court lor the district in which the land is localeo.
. (g) "unmarketability ol the title": an alleged or apparent matter afiecting
the litle to the land. not excluded or excspted from coverage, which would
entitle a purchaser of the estate or interest described in Schedute A to be
released from the obligation to purchase by virtue of a contractual condition
requiring lhe delivery of markelable title.
2. CONTINUATION OF INSURANCE AFTER CONVEYANCE OF TITLE
- The coverage of this poticy sha continue in force as of Date of policy in
favor of an insured only so long as the insured retains an estate or intereit in
the land, or holds an indebtedness secured by a purchase money mongage
given.by a purchaser from the insured, or only so long as the inlured shall
have liability by reason ol covenants of warranty made by the insured in any
transler or conveyance of the estate or interest. This policy shall not contrnue
in torce in favor of any purchaser from the insured ol eithsr (i) an estate or interest in the land, or (ii) an indebtedness secured by a purchase money
mongage given lo the insured.
3. NOTICE OF CLAIM TO BE GIVEN BY INSURED CLAIMANT
... The insured shall notity the Company prompfly in writing (i) in case ol any
litigation as.set lorth in Section 4{a) below, (ii) in case knowledge shall come to
an insured hereunder ol any claim of ti e or interesl which i; advers€ lo the tille to the estate or interest, as insured, and which might cause loss or oam-
age lor which the Company may b6 tiabte by virtue of this policy, or(iii) if riltelo
tne eslate or Interest, as insured. is reiected as unmarkelable. lf p.ompt notice
shall nol be given to the Company, then as to the insured a iiabilii ol the
Company shallterminate with regard to the matteror maters forwhich prompt
no$ce rs requrred; provided. however, that tailure to notity the Company shall rn no case prejudice the rights ol any insured under this policy unlels the
Company shall be prejudiced by the tailure and then only to the ;xtent of the preiudice.
4. DEFENSE AND PROSECUTTON OF ACTTONS; oUTy OF INSURED
CLAIMANT TO COOPEAATE
(a) Upon wrinen request by the insured and subject to the ootons con-
tained in Section 6 of these Conditions and Stipulations, the Company, at its
oyvn cosl and without unreasonable delay, shall provide lor the defense of an insured in litigation in lvhftrh any third pany asseds a claim advefse to the tiuo
or anteresl as insured, but only as to those stated causes of action alleging a defect,lien or sncumbrance orothermatter insured against by this polici. T:h6

(b) The Company shall have th€ right, at its own cost, to institute and prosecure any action or proceeding or to do any olher act which in its opinion
may be necessary ordesirable to establish th€ iitls to the estato or interest, as Insured, or io prev€nt or reduce loss or damage to the insured. The Company
may tal@ any appropriats action undor the terms of lhis policv. whether or not
il shall be liabts hereunder, and shallnot therebyconced; tiau'iiity or waive any provision.ot this policy. lf the Company sha exercis€ its riglits under thii paragraph. il shall do so diligently.
. (c) Whenever the Company shalt have broughi an action or interposed a defense as required or permilled by the provrsions of this poticy. the Company

(d) In all cases where this policy permits or requires the Company lo prose.
cute or provide lor lhe delense ol any action or proceeding, lhe insured shalt secure to lhe Company the right to so prosecute or provide defense In the action or proceeding, and all appeals therein, and permil the Companv ro
use, at its oplion, the name of lhe insured for this purpose. When-ever
requested by the Company, the insured, at the Company's expense, shall oive
the.Company all reasonable aid (i) in any action- or proceeding, secuiing
evidence, obtaining wilnesses. proseculing or defending lhe action or pro_
ceeding. or effecting setttemenl, and (ii) in any other lawful act which in the
opinion of the Company may be necessary or desirable to establish the title lo
the estate or interest as insured. lf the Company is prejudiced by the failure ol
the insured to lurnish the required cooperation, the Company,s obligattons to the insured under the policy shatt terminate, including any tiabitity or obliga-
tion to delend, prosecute, or continue any litigation, with regard to lhe maner or matters requiring such cooperation.
5. PROOF OF LOSS OR DAMAGE
In addition lo and atler the notices required under Section 3 ol these Condi-lions and Siipulalions have been provided the Company, a proot ot toss or damage signed and sworn to by lhe insured claimanl shail be iurnished to lhe
Company wilhin 90 days atter the insured claimant shall ascertain lhe facts giving rise to lhe loss or damage. The proof of loss or damage shall describe the defect in. or lien or encumbrance on the title, or othet matter Insureo
against by this policy which consritutes the basis of toss or damage and shall
state, to the extent possible. the basis ol calculating the amount of the loss or
damage. lf the Company is pre,udiced by lhe taiture of the insured claimant to provide the required proof of loss or damage, the Company,s obligations to
Ihe insured under the poticy sha terminate, including any liabitity br obliga_
tion to defend, prosecute, orcontinue any litigation, with regard to the matrer
or matters requiring such proof of loss or damage.
ln addition, the insured claimant may reasonabty be required to Submit to
examination under,oath by any authorized representative of the Company
and shall produce for examination, inspection and copying, at such reason_
able times and places as may be designated by any authorited representative
of the Company, all records, books, ledgers, checks, correspondence and memoranda, whether bearing a date before Or atter Date of policY which
reasonably perlain to the loss or damage. Further, if requested by any aulho_rized representative of the Company, the insured claimant shall qrant its permission, in wntrng. fo. any authorized represeniative of the Cor;pany to
examine, inspect and copy all records, books, ledgers, checks, correspon-
dence and memoranda in thecustody or controlofa ihird party, which reason_
ably p€rtain to the loss or damage. All information designated as confidential
by the insured claimant provided to the Company puisuant to this Section
shall nol be disclosed to others unless, in the reasonable iudgment of the
Company, it is necessary in the administration of the ctai;. Flilure of the
insured claimant to submit for examination underoath, Droduce other reason-
ably fequesled information or grant p€rmission to secure reasonablv neces-
sary inlormation lrom thtrd parties as required in this paragraph sh;ll termi-
nate any liability of the Company under this poticy as to thtt claim.
6. OPTIONS TO PAY OR OTHERWISE SETTLE CLAtitS: TEBMTNATTON
OF LIABILITY
.ln case ol a claim under this policy, the Company shall have the following
additional options:
(a) To Pay o. Tendar Payment of the Amount ol Insurance.
To.pay 9l lender payment ot the amount of insurance under this poticy
together with any costs, attorneys' fees and expenses incurred by the Insureo
claimant, which were authorized bythe Company, up tothe time of payment or
tender ot paymenl and which the Company is obligated to pay.
Upon the exercise bythe Company ol this option, a liabitity and obtigations
tolhe insured underthis policy, othef than to make the paymenl required, shalt
lerminate. including any liability or obligation to defend, pros€cute, or con-
tinue any liligation, and the policy shall be surrendered to the Company for
cancellation.
(b) To Pay or Othcrwi3e Settte With Parties Other than the Insued or
wlth the lnsured claimant.
(i) to pay or otherwise settle with other parties for or in the name ol an
ansured claimant anyclaim insured againsl under this policy, togetherwith any
costs, attorneys' fees and sxpenses incurred by the insured claimant which
were authorized by the Company up to the time ot payment and which the
Company is obligaled to pay: or
(ii) to pay orotherwis€ s€ttle with the insured claimant the loss or damage
provid€d tor under this policy, together with any costs, attornevs, lees and
expenses incurrod by the insured claimant which were autho;ized by th€
Company up to the time ol payment and which tho Company is obligated to
pay.
Upon the efercise by the Company ol erther/lhe options provided tor in
paftigraphs (b)(i) or (ii). the Company s obtigatltro the Insured under this
policy lor the claimed loss or damage. olher lhsnJFe payments required lo be
. made, shall terminate, including any liability or obligation to delend, orose-
cute or contrnue any liligalion.
7. DETERMINATION, EXTENT OF LIAAILITY AND COINSUBANCE
This policy is a contract of indemnily against actual monetary loss or dam-
age sustained or incurred by lhe insured claimanl who has sutfered loss or
damage by reason ol malters insured againsl by lhis policy and onlv to the
exlenl herein descnbed.
(a) The liability ol the Company under lhis poticy shall not exceed the teasl
of:
(i) the Amounl of Insurance slaled in Schedule A: or.
{ii) the difference between the vatue ol the insured eslale or inlerest as
insured and the value of lhe insured eslale or interest subject to the defect,
lien or encumbrance insured againsl by this policy.
(b) In the event the Amounl of Insurance slaled in schedule A at the oale ol
Policy is less than 80 percenl ol the value ol the insured estate or inleresr or
the full consaderation paad for the land, whichever is less, or if subseouent ro
the Date ol Policy an improvement is erecled on the land which increases the
value ofthe insured eslate or inlerest by al teast 20 percenl overthe Amount of
Insurance staled in Schedule A, lhen this Poticy is sublect lo the lollowing:
(i) where no subsequent improvemenl has been made, as to any parlial
loss, the Company shall onty pay the loss pro rata in the proponion that the
amount ol insurance al Date of Policy bears to the total value of the insured
estate or interest at Date of Policy; or
(ii) where a subsequent improvement has been made, as lo any panral
loss. the Company shall only pay the loss pro fata in the proportion that .l2O
percent ot the Amount of Insurance stated in Schedule A bears to the sum ol
the Amount ol Insurance slated in schedute A and the amount exoended lor
the rmorovemenl.
The provisions oI this paragraph shall nol apply to cosls. a orneys. lees
and expenses for which the Company is liabte under lhis policy, and shalt only
apply to thal portion of any loss whrch exceeds, in the aggregale, 1O percent ol lhe Amounl ot Insurance stated in Schedule A
(c) Tl9 Company will pay only those costs, anorneys' fees and expenses incu(ed in accordance with Section 4 of these Conditions and Stipuiations.
8. APPORTIONMEIIT
lf lhe land described in Schedule A consists ol two or more parcels which
are nol used as a single site, and a loss is established attecting one or more of the parcels but not all, lhe loss shall be compuled and senled on a pro rata
basis as if the amounl of insurance under this policy was divided oro rata as lo the value on Dale ol Policy ol each separate pa(cel to the whole. exclusive ol any tmprovements made subsequenl to Date ol policy, unless a liability or value has olherwise been agreed upon as to each parcel by the Company ano the insured at the lime ol the issuance of rhis policy and sliown by an express slalement or by an endorsement attached to this policy.
9. LIMITATION OF LIABILITY
(a) ll the Company establishes the ti e, or removes lhe a eged defect, lien or encumbrance, or cures the lack of a right of access to or lrom lhe tand. or cures the claim ol unmarketability ol tille, all as insured, in a reasonably
diligenl manner by any method, inctuding titigation and lhe completion ol any app€als thersfrom, it sha have lu y perlormed its obtigations with respecr ro lhat matter and shall not be liable for.any toss or damige caused theieby.
.- {b} In the event of any titrgaton, inctuding titigalion byihe Company or with lhe Company's consent, the Company sha have no liabitity lor lbss or dam-age untillhere has been a final delerminalion by a coun ol competent jurisdic-
tion,.and disposition of a appeals therelrom, idverse lo lhe t; e as insured.

10. REOUCTION OF TNSURANCE; REDUCTTON OR TERT NATTON OF LIABILITY
.- Allpayments under_this policy, except payments made for costs, attorneys'lees and expenses, shall reduce lhe amount ol the insurance oro tanro.

described or referred to in Schedule A, and the amount so paid shall be deemed a payment under lhis policv to the insured owner.
12. PAYIIENT OF LOSS
(a) No payment sha be made lyilhout producing this poticy for endoGe.menl of lh-e paymenl unless the poticy has been lo-st or degroyed, rn which case proof ol loss or destruction sha

in accordance with thdFondrtrons and Stipulations, lhe loss or dimage
shall be payable within 30 days thereatler.
13. SUBROGATION UPON PAYMENT OR SETTLEMENT
(a) The Company's Right of Subrogation.
Whenever the Company shall have settled and paid a claim under lhis
polacy. all right of subrogalion shall vest in lhe Company unaftecled by any acr
of the insured claimant.
The. Company. shall be subrogated to and be enli ed to all righls and
remedies which the insured claimant would have had against any p"rson or property in respect to the claim had this policy not been issued. tf rsqes51g6 py
the Company, the insured claimanl sha lransfer lo the Company all nghtl
and remedies against any person or properly necessary in order to perlect
lhis right ot subrogation. The insured claimanl shall permit the Companv to
sue, compromise or sel e in the name ol the insured claimant and to useihe
name ol lhe insured claimanl in any lransaclion or litigalion invotving these
rights or remedies.
lf a payment on accounl of a claim does not lully cover lhe toss ol the
insured claimant, the Company shall be subrogated to these r|ghts and reme-
dies in the proportion which ihe Company's paymenl bears to the whole
amounl of the loss.
ll loss should result from any act ol the insured claimant, as stated above,
lhat acl shall not void lhis policy, but the Company, in lhat evenl, shalt be
required to pay only that part ol any losses insured against by this poticy which
shall exceed the amounl, if any, lost to lhe Company by reason ol lhe rmpair_
ment by lhe insured claimanl of the Company's nght ol subrogalion.
(b) The Company's Righls Against Non-insured Obtigors.
The Company's right ol subrogation against non-insured oblaaors shall
exist and shall include, wilhout limitation, lhe rights ol the insured-to Indem-
nities, guaranlies, other policies ol insurance or bonds. nolwithslanding any
terms or condilions contained in those instruments which provide lor subiooa--
lion righrs by reason ol rhis policy.
14. ARBITRATION
Unless prohibited by applicable law eitherthe Companyorthe insureo mav
demand arbilration pursuant to the Title Insurance Arbilration Rutes oi th6
American Arbitration Association. Arbitrable matters may include. but are not
limited to, any conlroversy or claim between the Company and the insured
arising oul of or relating lo this policy, any service of the Companv rn connec-
tion with ils issuance or lhe breach ol a policy provrsron or olher obhoatron. Atl
arbitrable matters when the Amount of Insurance is $ I,OOO,OOO or'iess shatl
be arbitrated al the option of eilher the Company or lhe insured. A arbitrable
matlers when lhe Amount of Insurance is in excess ol $1,000,000 shall be
arbitrated only when agreed to by both the Company and the insured. Arbitra-
tion pursuanl to this policy and under the Rules in eftect on the date the
demand for arbitration is made or, at the option of the insured. the Rules in
eftect at Date of Policy shall be binding upon lhe parties. The awaro mav
include attorneys'lees only il the laws of the state in which the tand is locaiea
permil a coutl lO award a[orneys' tees to a prevailing pany_ Judgmenl upon
the awaid rendered by the Arbitrator(s) may be enlered in any court havang
iurisdiction lhereof.
The law ol the silus ol the land shall apply to an arbilrarion under the Tifle
Insurance Arbitration Rules.
A copy ol the Bules may be obtained from the Company upon request.
15. LIABILITY LlllITED TO THIS POLICY; POLICY ENTTRE CONTRACT
_ (a) This policy logether with all endorsements, if any, a ached hereto by the
Company is the entire policy and contract between the insured and lhe iom-
pany. In interpreting any provision of this policy, this policy shall be construed
as a whole.
(b) Any claim of loss or damage, whether or not based on negliqence, ano
which arises out ot the status ol the title to the eslate or int;e-st covered
hereby or by any action asserting such claim, shalt be restricted to fhis policy.
(c) No amendment of or endorsement to this policy can be made ercepl by
a wriling endorsed hereon or attached herelo signed by either the presroenr, a
Vice President, lhe Secretary an Assistanr Secretary. or vatidating oflicer or
aulhorized signatory of the Company.
16. SEVERABILITY
In lhe event any provision ol the policy is held invalid or unenforceabte
under applicable laq the policy shall be deemed nol to inctude that provrsron
and all olher provisions shall remain in lu force and elfect,
17. NOTICES, IVHERE SENT
All notices required to be given the Company and any statement in writing
required to be furnished lhe Company shall inctude the number ol this pohcy
and shall be addressed to the Company at the issuing oftice or to:

EXCLUSIONS FROM COVERAGE
The tollowing matlers are expressly ercluded frcm lhe coverage ot this poticy and the Company will not pay loss or damagc, cosls, anorneys' lees or expenses which arise by reison of:
l' (a) Any law, ordinance or governmental regulalion (including but not limited to building and zoning laws,ordinances' or. regulallo.ns).restricting, ;egulating, prohib'iting or retating ro ffrtru i""upuncy, use, or enioym€nt of the land; (ii) the characler, iimensioris or tocaiion ot any"impr&ement no* or herealer erccted on the.land;_(iii).a separation in ownership or a change in the dimensiins or aiea ol the land or any parcel ot which the land is or was a part; or (iv) dnvironmenial protection, or rne ereciot any viotation oi thes€ laws' oldinances or governmental regulations, except to the extenl that a nolice of the entorcemeni thereof or a notice ot a det;ct, lien or encuirbrance resulting lrom a violation or aliejed violation affecfing lhe land has been recorded in the public rccords at Date ol-policy.
(b) Any govemmental Police power not excluded by (a) above, excepr to the extent that a notace ot the exercise Inereo! or a notlce ol a delect, lien or encumbrance lesulting from a violation or alleged violation attecting the land has been recorded in the public records al Date of policy.
