BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Depaftment Approval, Engineer's (Public Works)
review and approval, a Planning Depaftment review or Health Depaftment review, and a
review by the Building Department, the estimated time for a total review may take up to
six (6) weeks.
All commercial (large or small) and all multFfamily permib will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser
amount of time. However, if residential or smaller projects impact the various above
mentioned depaftments with regard to necessary review, these projec[s may take up to
six (6) weeks to review and approve.
Every attempt will be made by this depaftment to expedite this permit as soon as
possible.

Information Handout
, Problem Statement
The Vail Village and Lionshead Village are invaluable assets to the community. Thousands of people come to Vail each
year to sightsee, recreate, shop and to enjoy everything the Vail Valley has to offer. The community and merchants rely
upon our guest to generate revenue. Our summerlwinter guests expect a pleasant experience while in Vail.
To insure that all of the proposed construction has as little negative impact on the community and on our guest as
possible, the Town of Vail finds it imperative to create and implement the Vail Village and Lionshead Village Construction
Hours Handout.
It would be irresponsible for the Town of Vail, the Construction Contractors and the Merchants, to not actively participate
to minimize the impact of construction in the Vail and Lionshead Village areas.
New for 2004-2006 will be the Vail Village Streetscape lmprovement Project. Work to include all utility related
improvements, streetscape, drainage, snowmelt systems and landscapin g.
All Gonstruction projects and/or remodels within the Vail Village Gore Area should contact Scott Bluhm
Town of Vail Streetscape Goordinator at970477-3418 for further information.
Givens
The following givens are intended to provide the basic foundation by which construction will be completed in the Villages:
r The public's health, safety and welfare shall be honored at all times.
r Adequate pedestrian, loading/delivery, vehicle, and emergency vehicle access and circulation shall be maintained.
r Roadways and pedestrian walkways shall be kept clean and free of dirt and debris.
. All construction deliveries, equipment, tools and materials entering the Vail Village and Pedestrian areas must go
through Check Point Charlie. All Lionshead construction activity must go to the Vail Police Department for a
parking permit. Do not use delivery zones for construction parking, refer to approved staging plan or make other
arrangements for parking.
. The hours of Outside Construction Activity shall be as follows:
- April 15-June 18&SeptemberT- Novemberl9,7a.m. until 7 p.m., seven daysaweek.
June 18 thru September 10, work must end by 4:00 p.m. on Fridays.
November 1 3 - April 15, 2005 work allowed within daylight hours only.
- Deliveries shall be restricted to the hours of 7 a.m. to 1 1 :30 a.m. on Gore Creek Drive and 7 a.m. to 8:30 a.m. on
Bridge Street.
- Special Construction delivery permits must be requested in advance, from Public Works in conjunction with Code
Enforcement at Checkpoint Charlie.
- No construction activity shall occur on Saturday or Sunday between June 19 and September 5.
- No outside construction activity shall occur on the following dates:

FOR PREVENTING NON.EMERGENCY FIRE ALARMS
In order to prevent a non-emergency response from the Vail Fire
Depaftment
Suppression crews to the construction location you may be working on we
ask that you perform the following tasks:
Determine what kind of fire alarm system exists within the
structure you are working in with the owner or the manager of
the property involved or by contacting the Vail Fire Depaftment.
Determine with the owner or manager of the property, which
alarm aompany services the system for them.
Become familiar with the different components that are
associated with the fire alarm system and how they operate
before the DEMO begins.
Never paint a smoke detector, thermal detector' or any other
compohent of the fire alarm system, and never paint a sprinkler
head.
For small nroiects bag detector within the area you will be
working in before you star! and remove the bags after work is
done for the day.
For larger projects, please contact the Vail Fire Department so
that we cah work with you in determining what needs to be done
to alter or "Zone Out" specific areas of the alarm system for the
structure.

to try and meet with your group to try and address the issue in a comprehensive manner.
When an application is approved by the DFIB, the applicant relies upon that approval to move
forward and assumes the responsibility of completing the project to the specificalions

The first step is to request a meeting with the zoning administrator to assist the
applicant in meeting lhe submittal requiremenls and to give the proposal a preliminary
review.
SUBMITTAL REQUIREMENTS
1. The applicant shall submit three copies, two of which must be mylars, of the
proposal following the requirements for a final plat below. Certain of these
requirements may be waived by the zoning administrator and/or the Planning
and Environmental Commission if determined not applicable to the project.
2. A list of all adjacent property owners (including those behind and across the
street) WITH COMPLETE ADDRESSES shall also be submitted. ln addltlon,
submit addressed, stamped envelopes for each ol the above.
3. Title Report verifying ownership and easements. (Schedules A & B)
4. An environmental impact report may be required as stipulated under Chapter
18.56 of the zoning code.
5. FINAL PLAT - REQUIREMENTS AND PROCEDUHE:
(Some of these requirements may be waived.)
a. The suMivider shall submit four copies of the final plat, two of which
shall be mylars, twelve copies of the final EIR (if required) and any
additional material as required below. Within thirty days of receiving the
complete and correct submittal for a final plat, the zoning administrator
shall cause a copy of a notice of the time, place and general nature of
the hearing and proposal to be published in a newspaper of general
circulation in the Town ol Vail at least fifteen days prior to said hearing.
Also, adjacent property owners to the proposed subdivision shall be
notified in writing at least seven days prior to the public hearing.

B. Final Plat - Staff Beview.
The final plat shall be circulated to and reviewed by the town's departments,
including, but not limited to Public Works, Transportation, Community
Development, Recreation, Administration, Police and the Fire Department.
Comments and concerns of these departments will be foruarded to the PEC
prior to the public hearing.
C. Final Plat and Supplementarv Material - contents.
The final plat and supplementary materialshallcontain the following
information:
1. The final plat shall be drawn in India ink, or other substantial solution, on
a reproducible medium (preferably mylar)with dimension of twenty-four
by thirty-six inches and shall be at a scale of one hundred feet to one
inch or larger with margins of one and one-half to two inches on the left
and one-half inch on all other sides.
2. Accurate dimensions to the nearest one-hundredth of a foot for all lines,
angles and curves used to describe boundaries, streets, setbacks,
alleys, easements, structures, areas to be reserved or dedicated for
public or common uses and other important features. All curves shall be
circular arcs and shall be defined by the radius, central angle, arc chord
distances and bearings. All dimensions, both linear and angular, are to
be determined by an accurate control survey in the field which must
balance and close within a limit of one in ten thousand.
3. North arrow and graphic scale.
4. A systematic identification of all existing and proposed buildings, units,
lots, blocks, and names for all streets.
5. Names of all adjoining subdivisions with dotted lines of abutting lots. lf
adjoining land is unplatted, it shall be shown as such.
6. An identification of the streets, alleys, parks, and other public areas or
facilities as shown on the plat, and a dedication thereof to the public
use. An identification of the easements as shown on the plat and a
grant thereof to the public use. Areas reserved for future public
acquisition shall also be shown on the plat.
7. A wriften survey description of the area including the total acreage to the
nearest appropriate significant figure. The acreage of each lot or parcel
shall be shown in this manner, as well.
8. ,A description of all survey monuments, both found and set, which mark
the boundaries of the subdivision, and a description of all monuments
used in conducting the survey. Monument perimeter per Colorado
statutes. Two perimeter monuments shall be established as major
control monuments, the materials which shall be determined by the town
engineer.
9. A statement by the land surveyor explaining how bearing base was
determined.
10. A certificate by the registered land surveyor as ouilined in Chapter 17.32
of this title as to the accuracy ol the survey and plat, and that the survey
was perlormed by him in accordance with Colorado Revised Statutes
1973, Title 38, Article 5'1.

option may amend Schedule B ol this Commitmenl acc0rdingly. but such amendment shail not relieve the Cornpany from liability previously incurred pursuant to

RECITALS
John Muel1er, (hereinafter referred to as "Declarantr') is the owner
of the real property situate in the Town of Vail-, County of Eag1e, State
of Colorado, described as Fj-nal PIat, a Resubdivision of Lot 1, Block 5,
Bighorn Subdivj-sion Fifth Additi-on, Town of Vai1, Eagle County,
Colorado, subject to the restrictions set forth in the attached Exhibit
rrAr| .
Declarant has constructed on Lot 1A and Lot 18 a building consisting of two units, each desj-gned and intended for use and
occupancy as a residential dwelling unit, which are sornetimes referred to herej-n separately as rrunitrr or col-l,ectiveJ-y as rrunitsrt.
DECLARATION
Declarant does hereby publish and declare that the following terms,covenants, conditions, easements, restrictions, use, reservations,linitations and obtigations sha11 be deemed to run with the Iand described herein, sha11 be a burden and a benefit to Decl-arant, his personal representatives, heirs, successors and assigns and any person acquiring or owning an interest in the real property which is described herein and irnprovements built thereon, his grantees, personal representatives, heirs, successors and assi-gns.
1. DEFINITIONS, Unless the context shall" expressly provide otherwise, the following terms shaLl have the foJ-lowing meanings:
A. rtThe Properti-es" means all of the reaL estate legalIy described as Lots 1A and 18, Final P1at, a Resubdivision of Lot 1, Block 5, Bighorn Subdivision Fifth Addition, l-ocated in Eagle County,Colorado.
B. rrl-,otrr or trBuilding Sitett means Lot l_A or Lot 18 as shown on the Map together with all appurtenances.
c.trDuplexrr or ilBuildj-ngrr means Lhe two contiguous dwelling units
constructed upon the Lots.
D. rrunitrr means any one of the two dweltings comprising the rrDuplexrr.
E . ItOwnertr means a person, persons , f irrn, corporation,partnership or associatj-on, or other lega1 entity, or any combination
thereof, owing an interest in the Lots.
F. ttMaptt means the engineering survey of the Properties by Duane
D. Fehringer, Registered Land Surveyor No, 26626, depicting and locating specificity thereon the Lots and improvenents thereon, recorded on

G. rrAssessmentrr means any periodic or one time charge to cover the cost of any expense or charge that becomes due and owing by virtue of this Declaration.
2. DESCRfPTfON AND RESERVATfON. Every Contract of Sale, Deed,Lease, Mortgage, Trust Deed, Will or other instrument shal1 legally describe a Unit or reaL property interest as follows:
Lot 1-A or Lot 18 (as the case may be), according to the Final plat,
a Resubdivision of Lot 1, Block 5, Bighorn Subdivision Fifth Addition,
Town of VaiI, EagJ-e County, Colorado recorded on in
Book _ at Page _, County of Eagle, State of ffi
Every such description shal1 be good and sufficient for all purposes to selI, convey, transfer, encurnber or otherwise affect the Lots and all appurtenant rights, benefits, and burdens thereto as created by the provisions of this Declaration, and each such description shalL be so construed. This provision shall apply to the properties as said term (the Properties) is defined in this Declaration.
3. PROPERTY DTVISION.
A. Declarant hereby estabLishes this plan for the Properties into ?wo (2) Parcels for ownership in individual and separate owners of Lot l-A and Lot l-8.
B. Lot LA and Lot 18 shall be subject to the tbe nap and those set forth herein.

D.. The parties, if more than one, having. the ownership of each such unit shaLl- aqree among themselves how to share the righti and
obligations of such ownership; provided, however, that if a corporation,
partnership, association or other legal entity shall become an owner or
the parties, if rnore than one, have the concurrent ownership of a unit,
then such entity or concurrent owners shalI from time to tirne designate
one individual who shall represent such entity or concurrent owners in
aII matters concerning all rights and obligations pursuant to this
Declaration.
E. Any such entity or concurrent owners shall give written notice
to the other owner designating the individual to act on its or their
behalf and such notice shalL be effective until revoked in writing by
such entity or owners. Any act or omission by such designated
individual sha11 be binding on the entity or owners having designated
hin in favor of the other owner or any other person who nay rely
thereon.
F. Each Unit shall be considered a separate parcel of real property and shal-1 be separately addressed and taxed.
4. ENCROACHMENTS. If any portion of Lot l-A or 18 nohr encroaches
upon the other parcel as a result of the construction of any building,or if any such encroachment shall occur hereafter as a result of settling or shifting of any building, a valid easement for the
encroachnent and for the rnaintenance of the same so long as the building stands, shal} exist. In the event any building shal1 be partially or totally d.estroyed as a result of fire or other casualty or as a result of condemnation or erninent domain proceedings and then rebuilt,
encroachments of parts of the building on the other parcel, due to such rebuilding, shall be permitted, so long as such encroachments are of no greater extent than those previously existing, and vatid easements for such encroachrnents and the maintenance thereof shall exist so long: as the buil-ding shatl stand.
5. PARTY WALL.
A. The common walL placed equally divided on the conmon boundary separating Lot 1A and Lot 18, the footings underlying and the portion of roof over such waLl are collectively referred to herein as the "Party Wallrr.
B. To the extent not inconsistent with this Declaration, the general rules of law regarding party walls and liability for damage due to negligence, willful acts or omissions shall appty to the Party wal-l.
C. The owners of either unit shall have a perpetual easernent in and to that part of the other unit on which the Party WaII is located,for party walI purposes, including mutual support, maintenance, repair and inspection. rn the event of darnage to or the destruction of the Party wall- from any cause, then the owners sharr at joint expense in equal shares, repair or rebuild said party wall, and each owner, shaI1
have the right to the full use of said party wall so repaired and
rebuilt. Notwithstanding anything contained above to the contrary, if
the negligence, willful act or onission of any owner, his farnily, agent
or invitee, shall cause damage to or destruction of, the Party WaIl,
such owner shall bear the entire cost of repair or reconstruction (to
the extent that such damage is not covered by insurance). and an owner
who by his negrligent or wj.llful act causes the Party WaI1 to be exposed to the elements shall bear the full cost of furnishing the necessary protection against such elenents.
6. LANDSCAPTNG, SERVTCE FACTLTTIES AND PARKTNG.
A. The owners from tirne to tirne sha1l undertake such landscaping
and general outdoor irnprovements including but not tirnited to driveway
and parking areas as they nay mutually and unaninously deen proper for the harmoni-ous irnprovement of both units in a common theme, and, except
. for any expense or liability caused through the negligence or willful act of any owner, his fanily, agent or invitee, which shall- be borne solely by such owner, each owner sha11 share all expenses, liabilities
and general upkeep responsibilities with respect to such landscaping and outdoor inprovements. The owner of one unit shall not unreasonably
damage the value of the other unit such as by shoddy upkeep outside, but both owners shal1 make all reasonable efforts to preserve a harnonious
connon appearance of the units. Each owner shall bear the entire cost and responsibility for installation and rnaintenance ,of landscaping on their respective Lots.
B. Common utility or service connections or Iines, common facilities or other eguiprnent and property located in or on either of the units but used in common with the other unit. if any, shall be owned as tenants in comrnon of egual undivided one-hal.f interests by the owners of each unit and, except for any expense or liability caused through the negligence or willfu] act of any owner, his family, agent or invitee,which shall be borne solely by such owner, aII expenses and liabilities concerned with such property shall be shared in the proportions set forth in paragraph I below. The owner of the unit on which such property is not located shal1 have a perpetual easement in and to that part of .such other unit containing such property as is reasonably necessary for purposes of naintenance, repaj,r, and inspection.
C. The owners shall have the right to the use of parking areas Iocated on his Lot and no owner shall hinder or permit his invitees to hinder reasonable use by the other owner and his invitees of the parking area. rt is presurned that snowplowing will be required from tine to time, the cost of which will be shared by the owners, each owner shalr be responsible for decks and walkways located on his Lot. other maintenance, repair or improvement of such parking facirities may be required frorn time to tirne, and the sarne sha}l be undertaken upon the unanimous agreement of the owners who shalt share arl expensel . Arr such expenses, as set forth herein, shall be all-ocated as set forth in
paragraph 8.
7. ALTERATION. MAINTENANCE AND REPAIRS.
A. In addition, to maintenance provided for in paragraph 6.A.,
the owners sha1l pay their proportionate share as allocated in paragraph
8 of the total cost allocated to each parcel, in order to provide
exterior maintenance and exterior repair upon the units and all portions
of the parceJ- upon which each unit is located including, but not limited
to, the exterior and the roof housing the units; provided, however that if the condition requiring repair only affects one of the Units, the
owner of that Unit shall bear the entire cost thereof. Repair,
replacement or cleaning of exterior window glass shall be considered interior naintenance. If the need for repair is caused through the
negligence or willfu1 act of any owner, his farnily, agent or invitee,
such owner shall bear the entire costs of such repair or reconstruction (to the extent that such damage is not covered by insurance). Both units must be painted at the same time and with the same materials and no exterior nodifications shal-I be made with the character of the building without unanirnous approval of both parties. A11 repairs to the valley formed at the joinder point of the respective roofs shall be born equally by the parties; irrespective of which parcel, or which side of the party walI, the actual point of damage or failure necessitating the repair is located.
B. Each owner shaI1 be soJ-e1y responsible foi maintenance and repair of the inside of his unit including fixtures and improvements and al"l- utility lines and eguipment l-ocated therein and serving such unj-t only. Window glass shall- be deemed interior maintenance. In performing
such maintenance and repair, or in inproving or altering his unit, no
owner shall do any act or work which irnpairs the structural soundness of either unit or the Party Wall or which interferes with any easement granted or reserved herein.
C. Utility or service connections or lines, facilities or other utility equiprnent and property located in, on or upon either of the units, which are used solely to supply a service or utility to one unit shall be owned by the owner of the unit using such utility or service and al1 expenses and liabilities for repair and maintenance shall be borne soIely by the owner of such unit, who shall have a perpetual
easenent in and to that part of such other parcel or uni-t containing such-property as is reasonably necessary for purposes of maintenance,repair and inspection.
D. No owner shall make or suffer any structural or design change (incruding a color scheme change), either permanent or temporaiy and of any type or nature whatsoever to the exterj.or of his unit or construct any additional building structure of any type or nature whatsoever upon any part of his parcel without first obtaining the prior wrj-tten consent thereto from the other owner, such consent shall not be unreasonably
withheld. In case of damage or destruction of any unit or any part
thereof by any cause whatsoever, the owner of such unit shall cause with
due diligence the unit to be repaired and restored, applying the
proceeds of insurance, if any, for that purpose. Such unit shall be
restored to a condition comparable to that prior to the damage and in a
harmonious manner to promote the common therne of both units.
8. ALLOCATION OF EXPENSES. Costs and expenses of exterj-or
repainting, service facilities, paved driveways, snow removal,
maintenance and repaj-rs of the roof, and all other common expenses as set forth herein to be shared by both owners, except as caused by
negligence of will-ful act of an owner, shalI be allocated in the
following proportions :

9. MECHANIC'S LIENS: INDEMNIFICATTON:
A. Except for items incurred as a common expense as provided for herein, if any owner shall cause any naterial to be furnished to his lot or unit thereon or any labor to be performed therein or thereon, the other owner shalL not under any circumstances,be liable for the payrnent of any expense incurred or for the value of the work done or material furnished; all such work shalL be at the expense of the owner causing it to be done, and such owner shal1 be solely responsible to contractors,l-aborers, materialmen and other persons furnishing labor or materials to his parcel or any improvements therein or thereon; nothing herein contained shalL authorize either owner or any person dealing through,with or under either ohrner to charge the unit of the other owner with any rnechanic's lien or other l-ien or encumbrance whatever,. and, on the contrary (and notice is hereby given) the right and power to charge any lien or encumbrance of any kind against one ohrner or against one owner,s parcel for work done or materials furnished to the other owner's parcel is hereblr expressly denied.
. B: Except as provided for below, if, because of any act or omission of any o$rner, any rnechanicrs or other lien or order for the payment of money shall be filed against the other ownerrs parcel or any improvements therein or thereon or aqainst any other ownei (whether or not such lien or order is valid or enforceable as such), the owner whose act or omission forms the basis for such l-ien or order sha11 at his own cost and expense cause the same to be canceLLed and discharged of record or bonded by a surety company reasonably acceptable to sueh other owner,
within 30 days after the date of filing thereof, and further shall
indemnify and save the other owner harmless from and against any and all
costs, expenses, claims, losses or damages, including reasonabl-e
attorney's fees resulting therefron.
10. INSURANCE.
A. Each owner shalL keep his unit and alL fixtures therein
insured against loss or darnage by fire and extended coverage perils
(including vandalism and malicious rnischief) for the maximum replacement
value thereof. Any owner Inay on 30 days' written notice, but not more
frequently than once every two years, obtain a wrj-tten estimate of the
replacement cost of the Units by a licensed contractor, and the amount.
Such contractor shall be a disinterested and independent third party who
is unrelated in any manner to either owner whether through joint
business adventures or otherwise..
B. Each owner sha1l provide and keep in force, for the protection
of hirnself, general public liability and property damage insurance against cl-ains for bodily injury or death or property damage occurring
in, on or upon, his parcel owned in fee sirnple and the improvements
thereon, in a lirnit of not less than $300,000.00 in respect of bodily injury or death to any number of persons arising out of one accident or
disaster, or for damage to property, and if higher lirnits shall at any time be customary to protect against possible tort liability, such
higher lirnits sball be carried and each owner shall naine the other owner as an addi.tional insured party under such policy.
' C. Each owner shall deLiver to the other owner certificates
evidencing all insurance required to be carried under this paragraph,
each containing agreements by the insurers not to cancel or rnodify the policies without giving the other owner written notice of at least 30 days. Each owner shall have the right to inspect and copy all such insurance policies of the other owner and require evidence of the
payrnent of premiums thereon.
D. Nothing provided in this paragraph sha1l prevent the owners fron jointly acquiring a single policy to cover any one or more of the
hazards required in this paragraph to be separately insured against by
each owner,
E. A11 insurance policies obtained by either owner shaLl expressly waive all rights of subrogation as against all other owners
and their respective famil-ies and invitees.
11. In the event of damage or destruction to a unit by fire or other disaster, the insurance proceeds shall be deposited into a bank account which requires, for withdrawals, the signatures of both the owners, or disbursed directly by the insurance carrier. The owners sharL then pronptly authorize the
necessary repair and reconstruction work and the insurance proceeds wilI
be applied by the owners to defray the cost thereof. 'rRepair and
reconstructionrr of units, dS used herein, means restoring the
improvernents to substantially the same condition in which they existed prior to the damage with each unit having the same boundaries as before.
].2. RTGHT TO LIEN.
A. If an owner, at any time, shall neglect or refuse to perform
or pay his share of any obligation required hereunder, the other owner
nay, but shalI not be obligated to, after 30 days written notice unless the circumstances require irnrnediate action, make sucb payment or, on
behalf of suctr other owner, expend such sum as may be necessary to perform such obligation including, but not limited to, the payment of
any j-nsurance premiums required hereunder or the undertaking of any work reguired hereunder for repair, restoratj-on or maintenance, and such other owner shall have an easement in and to that part of such defaufting owner'S unit as is reasbnably necessary for such repair,restoration or maintenance.
B. A11 sums so paid or expended by an owner, with interest
thereon at the rate of 18 percent per year from the date of such payment or expenditure, shall be payable by the owner so failing to perforrn (the rrdefaulting ownerrr) upon dernand of the other owner.
C. AIl sums so demanded but unpaid by the defaulti.ng owner shall constitute a lien on the lot of the defaulting owner in favor of the other or{ner prior to aIl- other l- j-ens and encumbrances, except: (i)liens for taxes and special assessments; and, (ii) the lien of any first
mortgage or first deed of trust of record encumbering such 1ot. The lien shall attach from the date when the unpaid surn shal-l become due and
may be foreclosed in like manner as a mortgage on real property upon the recording of a notice or clairn thereof executed by the nondefaulting
owner setting forth the amount of the unpaid indebtedness, the name of the defaulting owner, and a description of the unit. In any such foreclosure the defaulting owner shall be required to pay the costs and
expenses of such proceedings, including reasonable attorney/s fees.
D. The lien provided for herein shal1 be subordinate to the lien of any first mortgage or deed of trust, including atI additional
advances thereon. Sale: or transfer of either parcel as the result of court foreclosure of a nrortgage, foreclosure through the public trustee,or any proceeding.in lieu of foreclosure, sha1l extinguish the l-ien of
such assessments as to payments thereof which become due prior to such sale or transfer, but sha11 not relieve any forrner owner of personal liability therefor. The mortgagee of such parcel who acquires title by way of foreclosure or the taking of a deed in lieu thereof, shall not however, be liable for any past due assessment and sha11 only become Iiable for future asserisments on the date it becomes the owner or is entitled to become the owner of such parcel . No sale or transfer shall-

relieve such parcel from Iiability for any assessrnents thereafter
becoming due or from the lien thereof. In the event of the safe or
transfer of a parcel with respect to which sums shalI be unpaid by a
defaulting owner, except transfers to a first mortgagee in connection
with a foreclosure of its lien or a deed in lieu thereof, the purchaser
or other transferee of an j.nterest in such parcel shal-l be jointly and
severally liabl,e with the seLl-er or transferor thereof for any such
unpaid sums.
E. Upon written request of any owner, mortgagee, prospective
mortgagee, purchaser or other prospective transferee of a parcel , the
owner of the other parcel shall issue a written statement setting forth the amount he is owed under this paragraph, if any, with respect to such
unit. Such statement is binding upon the executing owner in favor of
any person who may rely thereon in good faith. Unless a request for
such statement shaLl be cornplied with within fifteen days after receipt thereof, a1f unpaid sums which became due prior to the date of making
such request shalL be subordinated to the Lien or other interest of the person requesting such statement.
USE RESTRICTIONS.
A. Each unit shall" be restricted to a residentiaL dwelling as a perrnitted use, and conditional and accessory uses as defined by the
Town of Vail Zoninq Ordinances.
B. No exterior mounted radio, shortwave, televis j-on or other type of antenna whatsoever or tank of any kin, either el.evated or buried, or clothesline or incinerator of any kind whatsoever or outsj-de storage of any personal property sha] 1 be permitted or maintained on either unit without the prior written approval of both ok/ners.
C. No animals shal-1 be kept or maintained in, on or upon either unit, except that each owner rnay keep and maintain within his unit a total of two domesticated animals either: two domesticated dogs and/or
two domesticated cats; provided, however, that such domesticated animals are kept under control at all times, do not present a nuisance to the other owner and are kept controlled in strict compliance with all Town of Vail ordinances that may apply to such animals.
D. In addition to the parking restrictions set forth in
subparagraph LANDSCAPING, SERVICE FACILITIES AND PARKING above, each
owner may keep no vehicles perrnanently on the paved driveway. Parking of boats, trailers, campers, motor homes, ATVs or recreational vehicles is expressly prohibited, unless located within an ovrnerrs garage.

F. The olrners understand and agree that potential developrnent
rights may exist under present or future Town of VaiI regulations that
rnay permit expansion of the dwelling units, which deveJ-opment rights
have not been utilized to date, The owner of Lot 1A shall be deened to
have exclusive ownership of and rights to sixty percent (60?) of those
development rights. The owner of Lot 33-E shall be deemed to have
exclusive right to forty percent (40?) of those development rights. No exercise of those development rights shall be made by one owner without first obtaining the written consent of the other owner, which consent shaI1 not be unreasonably withheld. The other owner, before giving written consent, shaIl be entitled to review the development plans and
any blueprints or surveys prepared in connection with the development plans.

15. DURATION OF DECI"ARATION. Each provision contained in this Declaration which is subject to the laws or rules sometimes referred to as the rule against perpetuities or the rule prohibiting unreasonable restraints on alienation shal-l continue and remain in fulL force and effect for the period of 2L years following the death of John Mueller and his living issue, or until this Declaration is terminated as hereinafter provided, whichever first occurs. AII other provisions
contained in this Declaration shaLl continue and renain in ful1 force and effect until January 1, 2024 A.D. I and thereafter for successive periods of 10 years each; unless at least l- year prior to January 1,
2024 A.D., or at least L year prior to the expiration of any such 10 year period of extended duration, this Decl-aration is terminated by recorded instrument, directing ternination, signed by all owners and all lienors holding a first rnortgage or first deed of trust of record on any portion of Lot 1A or Lot 18.
16. AMENDMENT OR REVOCATION. This Declaration may be amended or revoked only upon unanimous written approval in recordable form of all owners and all lienors holding a first rnortgage or first deed. of trust of record on any portion of Lot l_A or Lot 18.
L7.. EFFECT OF PROVISIONS OF DECLARATION. Each provision of this Decraration,. and agreement, promise, covenant and undertaking to compry with each provision of this Declaration, and any necessary eiception or reservation or grant of title, estate, right oi interest to efiectuate any provision of this Declaration: (i) strltt be deemed incorporated in

each deed or other instrument by which any right, title or interest in
any portion of Lot 1A or Lot 1B iE granted, devised or conveyed, whether
or not set forth or referred to in such deed or other instrurnent; (ii)
shalI, by virtue of acceptance of any right, title or interest in any portion of Lot LA or Lot 1Et by an ov/ner, be deerned accepted, ratified,
adopted and declared as a personal covenant of such owner and, as a personal covenant, shall be binding on such owner and his heirs,personal representatives, successors .and assigns,' and shall be deerned a personal covenant to, with and for the benefit of each owner of any portion of Lot 14 or Lot l-B; and (iii) shall be deemed a real covenant by Declarant, for himself, his heirs, personal representatives,
successors and assig'ns, and also an eguitable servj-tude, running, in
each case, as a burden with and upon the title to each and every portion
of Lot 1A and Lot 18.
18. ENFORCEMENT AND REMEDIES.
A. Each provision of this Declaration shall be enforceable by any
owner by a proceeding for a prohibitive or rnandatory i.njunction or by a suit or action to recover danages. If court proceedings are instituted in connection with the rights of enforcement and remedies provided in this Declaration, the prevailing party shall be entitled to recover its costs and expenses in connection therewith, including reasonable attorney fees.
. B. Each owner hereby agrees that any and all- actions in equity or at law which are i-nstituted to enforce any provision hereunder shalt be brought in and only in the District Court of Eagle County, State of
Colorado.
C. Failure to enforce any provision of this Declaration shall not operate as a waiver of any such provision, the right to enforce such provision thereafter, or of any other provision of this Declaration.
1,g. EXERCISE OF RIGHTS. Any exercise of any right granted
hereunder by one owner with respect to the other owner's unit including but not linited to the use of any easement granted herein shall be exercised in a rnanner which shal1 not unreasonably hinder, impede or
irnpose upon such other owner's use of his unit.
20. SUCCESSORS AND ASSfGNS. Except as otherwise provided herein,this Declaration sba1l be binding upon and shall inure to the benefit of each owner and the heirs, personal representatives, successors and assigns of each.
