Due to an unforeseen concealed condition being unmvered by our clients General Contraetor, an
elternative struotural engineering solution needs to be adopted,
The discovery that a concealed existing structural member was smallcr lhan anticipated has led to
this proposed solution.
An unanticipated new wood column has to be introduced from below the deck down to grade. This
column is shown on thc attiachcd structural enginee/s detarl x1 as well as qn VMDA drawings
AD01a and AD02.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Depaftment review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
WCEKS,
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
depaftments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

DEVELOPMENT OF A NEW SIGN CODE
AGREEMENT
THIS AGREEMENT made is entered into on May_,2002, by and between the
Town of Vail, a Colorado municipal corporation "the Town", and @TLANTIS 1, LLC, a Colorado
limited liability company, ("the Consultant").
WITNESSETH
WHEREAS, a goal of the Town is to develop sign regulations that further the Town's
vision of being a "premier mountain resort community" and that are easy to understand and
enforce.
This agreement involves engaging the consulting services of @TLANTIS to work with
stakeholder groups to develop revised sign regulations for the Town of Vail
NOW, THEREFORE, the parties mutually agree as follows:
,1. SITE DESCRIPTIONS AND USES
The scope of services involves developing regulations for the Town of Vail. Proposed
regulations should consider the differences behveen the pedestrian villages and West Vail and
East Vail commercial areas.
2. PROJECT OBJECTIVES:
The following objectives shall be achieved in developing the overall community facilities
program:

Develop a new signage code for the Town of Vail that contributes to the Town's
vision statement of being the "Premier Resort Community." Signage and display
elements should add something to the Vail experience.. . not detracf from it.
Making the code easier to understand and implement by its users
Making the code easier to enforce consistently by the Town
While working to unify and upscale the Town of Vail as a whole, and to blend (to an
appropriate degree) with the architectural themes that have been established for the
various areas, the code should encourage creativity and innovation. lt is also
important that the individual businesses be able to use their storefronts and signage
for self-expression (to clearly communicate their brand/identity and their offering) as
well as venues for bringing vitality and visual excitement to the community through
unique visual elements, creative window displays, dimensional signage, etc.
A hierarchy of communication elements should be established that identifies the
various types of information that need to be communicated at the Town level, the
specific development / building level, as well at the level of the individual businesses
that make up the commercial community. The vehicular and the pedestrian scale of
the environments in the various zone districts will be considered when recommendino
new signage / display criteria.

The code should be a working tool for the community...it should contribute to a highly
successful business environment as well as to the Town's overall image as the premier
resort community. The "spirit of the law" should be conveyed in the code... first, through
a statement of purpose...to help users understand why the code is in place to begin with,
and what role it plays in building and maintaining the image of the community.
SCHEDULE AND SCOPE OF SERVICES
Phase 1 Data Collection, Directional Strateqies & Concept Development (1 initial
meeting; 3 work sessions lhis phase)
A. Work session with project team (signage committee) to kick off the project officially,
determine objectives for the program and to develop a list of deliverables,
roles/responsibilities, timelines and budgets
B. Review Town of Vail's current signage code and tenant/storefront design criteria
C. Discuss the desired image / positioning for the Town of Vail...as an entity, a
community, a brand
D. Conduct a visual audit of signs currently in place around the Town of Vail...all levels
of the system...from highway/road signs, to seasonal banners, building signs, tenant
signs, window and outdoor displays, etc. (document the various elements in photos for
group review)
E. Receive list of issues from the Town on the current sign code and consider alternative
solutions for addressing those issues (Attachment A).
F. Participate in a 3 hour site visit with the Town, Chamber, DRB to review issues and
ideas for addressing those issues. This tour will also highlight geographic differences
between different areas of Town i.e. West Vail commercial area from Vail Village.
G. Conduct a visual audit of signs used in other malls, resort communities, urban renewal
areas and other mixed use developments (document via images for group review and
reference), assess what's been most successful
H. Gather all other pertinent information from the Town of Vail, the Chamber, the DRB,
etc.
l. Review current Town of Vail requirements and procedures for permitting, review,
approval and enforcement
J. Worksession with Vail Chamber to gather input and discuss the Town's image and the
merchants' role in it
K. Worksession with project team after initial visual audits to review findings and discuss
implications
L. Develop a hierarchy of information to be communicated and the slgn types associated
with each level
M. Look at options for formatting the information... combination of verbiage and imagery
N. lnitial Dresentation of content and format ootions for the code to TOWN OF VAIL and
to the DRB
Phase 2 Concept Refinement & Document Mock-up (1 meeting/worksession wifh
TOWN OF VAIL; l trial sign process this phase)
A. Refine approved concepts from end of Phase 1 and develop final mock-up
document for further review
B. Look at options for production of final document in terms of physical format, how
it will be printed and disseminated, how easily it can be revised, web format for
internet access and printing, etc.
C. Trial process of a "prototypical sign"; send a sign concept through the review
process and observe from all perspectives; troubleshoot the process (and
perhaps the code) as required to streamline for al users.
D. Review draft regulations with the Design Review Board, Sign Committee, and the
Vail Town Council
Phase 3 Final Documentation & Production for Distribution (1 meeting this phase for
final review and sign-off)
A. Produce final regulatory documents for final review and editing
B. Produce final print files and produce initial run of documents for official
distribution
C. Review final version once with the Sign Committee, Design Review Board, and
Town Council.
D. The final regulatory document should be reviewed by the Town Attorney and he
will orovide comments on the document which the consultant will address.
E. Post-implementation evaluation after approx. 3 months to see how it's working
F. Provide a final version of the regulatory document and an electronic PC Word
file to the Town of Vail.
4. PERSONNEL
The Consultant agrees that the principal personnel responsible for the performance of
this project will be:

The Consultant agrees that no substitute of these personnel shall be made without the
prior approval of the Town. The Consultant represents that its personnel engaged in this project
are fully qualified and properly trained to perform the services related to this Agreement. None
of the services provided for in this Agreement, including personnel, shall be modified without the
prior written approval of the Town.
5. TIME OF PERFORMANCE
The services set forth above shall commence on the date of this agreement and shall be
completed by November 1,2OO2.
6. COMPENSATION & SCHEDULE
Work will be charged on an hourly basis at an average rate of $90/hr with the maximums'.

Reimbursable expenses totaling over $500 shall be approved by the Town of Vail prior to
that cost being incurred by the consultant. Approval can consist of an emall notification to the Town
of Vail and an approval or denial of that expense occurring from the Town of Vail point of contact
via email, fax or written correspondence. Total reimbursable cost shall not exceed 1,500. These
expenses may include: long distance phone charges, film and processing, reproduction (black-and-
white and color copies, blueprints, color prints, etc.), local / long distance delivery services,
copywriting, high-res scans, conversion of graphic files to usable formats, project-speciflc graphic
/ computer supplies, mileage, air travel, ground travel and lodging. Every effort will be made to keep
these expenses to a reasonable minimum. Fees and expenses will be billed monthly based on the
proportion of work that has been completed. Flexibility will be permitted between fee allowances
identified for various tasks and phases; the specific breakdown above is for planning and budgeting
purposes only. The not-to-exceed Grand Total figure will be the fee referenced when final invoicing
is prepared. lf the work can be done in less time, you will be charged less.
7. ASSUMPTIONS / TERMS
Fees proposed for services are based on the assumption that the information and
documents being provided by TOWN OF VAIL are accurate and up{o-date in their
representation of existing and proposed conditions. TOWN OF VAIL to provide
@TLANTIS with a hardcopy as well as a Word document (on zip disk or CD) of the
Town's current sign code.
Fees are also based on the assumption that all logos, fonts and images to be used
will be supplied to @TLANTIS in a high-resolution digital format. Logos and other
graphic information to be given to @TLANTIS on disk in Mac-compatible format.
Photographic images to be given to @TLANTIS either as high-resolution Photoshop
images (300 dpi at their final printed size),

3. In Mac-compatible format on disk, or as high-quality originals (negatives,
transparencies, 8x10 prints, etc.) that @TLANTIS can scan in-house. lf a super high-
quality image is required that cannot be produced in-house, a drum scan will be done
by an outside agency.
4. lt is further assumed that @TLANTIS will not be responsible for conducting a photoshoot
for the project; all images to be used will be casual "snapshots" or royalty-free
photography; if a professional photoshoot becomes necessary, it will be handled in a
separate agreement.
5. Any modifications to be made to the concepts or the final documents after approval
has been given by the TOWN OF VAIL team for each phase of each task (including
new directions resulting from internal reviews within TOWN OF VAIL, or their
associated agencies or chambers or review boards) will be addressed as Additional
Services and will be charged on an hourly basis at an average rate of 990/hour.
Any tasks (including additional work, documents, site visits, trips or meetings) outside
the scope of work identified in this proposal will also be considered Additional Services.
Any modifications to the objectives, budget or schedule set during Phase 1 is sufficient
cause to re-evaluate the scope of work, the corresponding fees, and the feasibility of
meeting the deadlines. In order to help keep the process clear for all parties, final sign-
off will be given by TOWN OF VAIL at the end of each phase to give @TLANTIS
approval to proceed.
@TLANTIS will coordinate getting the required information to the various reviewing
agencles for their approval. The acquisition of approvals from various private entities
and governing agencies will be the sole responsibility of TOWN OF VAIL.
Fees do NOT include costs to physically fabricate signs, displays, fixtures or construction
or any parts thereof. Fees also do NOT include any special models or artist renderings
beyond those design drawings necessary to convey the concepts during initial design
presentations and those othenvise specifically noted.
Graphic design services are NOT included in this proposal beyond the development of
the signage code itself. Design for any specific sign element is NOT part of the scope
of this proposal. lf more detailed graphic design services become a desired component
to this program (e.9., signage design for a speciflc business or merchant), those services
can be added at any time during the project as Additional Services, or a separate
agreement can be developed to address those services.
10. Fees include one (1) round of revisions during Phase 2 and anotherfinal "tweaking" at
the beginning of Phase 3. Any further rounds of revisions that become necessary (due
to in-house reviews, city reviews, forest service reviews, individual tenant or merchant
reviews, etc.) will be considered Additional Services and will be charged for on an hourly
basis.

8. DESIGNS, PLANS & DOCUMENTS
All designs, plans, digital files, and documents produced by the Consultant relating to this
scope of service shall become the property of the Town and it is agreed that the Consultant shall
not retain any proprietary rights of said designs, plans and documents.
9. INDEPENDENTCONTRACTOR
The Consultant is an Independent Contractor, and nothing contained in this Agreement
shall constitute or designate the Consultant or any of the Consultant's employees as agents or
employees of the Town. Further, it is agreed that:
A. The Town does not require the consultant to work exclusively for them;
B. The Town for whom the services are to be performed, do not establish a quality
standard for the Consultant:
C. The Town may supply documents and plans, identify sites, suggest uses, and
provide instructions as to the what the Consultants work should include; but will
not instruct the Consultant as to how the work will be performed;
D. The Town can terminate the Agreement if the Consultant violates the terms of the
Agreement or fails to produce a result that meets the specifications of the
Agreement;
E. The Town does not provide training for the Consultant's employees or workers;
F. The Town does not provide for travel, transportation, overnight accommodations,
meals, offices, tools or benefits to complete the Agreement although some copies
of documents, plans and maps may be supplied;
G. The Town does not dictate the time of performance except that a completion
schedule has been established, as referenced above, with which the Consultant
must comply;
H. Payment for services rendered pursuant to this Agreement will be made to the
trade or business name of the provider of services, rather than to the individual;

l. The Town does not in any way combine their business operations with those of
the Consultant.
THE CONSULTANT AS AN INDEPENDENT CONTRACTOR IS NOT ENTITLED TO
WORKER'S COMPENSATION BENEFITS AND THE CONTRACTOR IS OBLIGATED TO PAY
FEDERAL AND STATE INCOME TAX ON ANY MONIES EARNED.
10.INSURANCE
The Consultant covenants and agrees that it will, during the term hereof, carry a
comprehensive general liability insurance policy, including products liability, with limits of not less
than one million dollars ($1,000,000.00) per occurrence and not less than two million dollars
($2,000,000.00) general aggregate for bodily injury or death of any person or persons or
damage to property, naming the Town as an additional insured and will ensure that any
subcontractor will carry the same amount of relevant insurance. The Consultant shall furnish the
Town a certificate of insurance. All such policies shall contain a provision that the same may not
be canceled or materially changed or altered without first giving thirty (30) days prior written
notice to the Town.
11. NO WAIVER
No waiver of any of the provisions of this Agreement shall be deemed to constitute a
waiver of any other provision of this Agreement, no such waiver shall constitute a continuing
waiver unless otherwise expressly provided, nor shall the waiver of any default of the terms of
this Agreement be deemed a waiver of any subsequent default.
12. INDEMNIFICATION
The Consultant agrees to indemnify and save the Town, its officers, directors and
employees harmless from and against losses, claims, demands, liability, damages, suits, actions
or causes of action of every kind and nature, including court costs and reasonable attorney's
fees, defending such claim, which may be brought or asserted against the Town, its agents or
employees to the extent caused by the negligent acts, errors, or omissions of the Consultant in
the performance of this Agreement.
13. TERMINATION
The performance of the work provided for in this Agreement may be terminated at any
time in whole or, from time to time, in part by the Town for its convenience. Any such termination
shall be effected by delivery to the Consultant of a written notice specifying the date upon which
termination becomes effective. This Agreement may also be terminated by the Consultant in the
event of a material default of any of the terms and conditions of this Agreement by the Town,
provided the Consultant has first provided the Town with written notice of the default and the
Town shall have failed to cure the specified default within one (1) day of receipt of the notice. In
the event of termination, the Consultant shall be paid on a pro-rata basis for work satisfactorily
completed prior to the date of termination and for the expenses prior to the date of termination.
14. JURISDICTION. VENUE. ATTORNEY FEES
The jurisdiction and venue of any suit or cause of action to enforce the terms of
Agreement shall lie in Eagle County, Colorado. Should either party to this agreement bring suit
to enforce this agreement, it is agreed that the prevailing party shall be entitled to recover its
costs, expenses and reasonable attorney fees. A prevailing party is a party that shall have
obtained a final judgement or order no longer subject to appeal. ln the event of a settlement
before final adjudication, both parties shall bear their own respective costs, expenses and
attorney fees unless otherwise agreed.
15. NOTTCE
Any notice provided for in this Agreement shall be deemed given upon the mailing of said notice
by United States certified, firstclass mail, postage prepaid, and addressed to the parties at the
respective addresses as shall appear herein or upon a change of address pursuant to this notice
provision and received by the parties at the following addresses:

16. ASSIGNMENT
This Agreement is for expert services of the Consultant that may not be assigned without
the prior written consent of all parties to this Agreement.
17. COMPLIANCE WITH LAW
The Consultant will not perform any of the services specified in this Agreement contrary
to any local, state, federal, or county law.
18. SEVERAB]LITY
Should any section of this Agreement be found to be invalid, all other sections shall
remain in full force and effect as though severable from the part invalidated.
19. DISCRIMINATION
The Consultant shall not discriminate against any employer or applicant for employment
because of disability, race, color, age, sex, religion, or national origin.
20. INTENTION OF THE PARTIES
This Agreement contains the entire intention of the parties and may only be changed by

21. EXECUTTON

Outdoor Displays would be permitted 4 times a year or during an approved special event
directly adjacent to the store. Public vs. private land for displays. either we have 'em or
we don't. (l'm leaning towards 1)nothing out in Dec., Jan., Feb. and Mar. except during
special events. 2) limiting the number and/or size. 3) some sort of standard for rack
(clothes), table (shoes, books, etc.) and other display (baskets) ( something to get rid of
cardboard boxes)

. Some discussion that advertising on umbrellas is ok. However, staff feels that this
may need to be reviewed.
13) Enforcement
r We would need a Grandfather clause for permanent signs . Need to determine what type of warning is needed before a citation . TOV will look into what type of warning is needed, if any, to remove a sign.. We can look into including revoking a Business License as a penalty.
14) There are some very attractive photo/posters that display the type of merchandise that is
sold. Some look good some don't. I think we want to allow what Golden Bear has. This hits the
jewelry stores the wrong way.
15) lllumination of Signs.
What is most appropriate, We currently have a loop hole which allows argon signs but not neon

TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicabte).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtaln a building permit.
If this permit is for installation of an exterior hot tub or spa on any exisilng deck or elevated platform,
a structural engineer must review the existing condition and verify that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter oF permission
from the association is required.
o If this permit is for a commercial space, two (2) sets of stamped drawings are required.

IL IMPROVEMENT LOCATION CERTTFICATE (ILC)
Once a building permit has been issued, and construction is underway, and before the Building
Department will schedule a frarning inspection, two copies of an Improvernent Location Certificate
survey (ILC) stamped by a registered professional engineer must be submitted. The following
information must be orovided on the ILC:
o Basis of bearing and tie to section corner o All property pins found or set o Building location(s) with ties to property corners (ie. distances and angles)o Buibing dimensions, including decks and balconies, to the nearest tenth of a foot o Building and garage floor elevations and all roof ridge and eave line elevations o All drainage and utility service line as-builts, showing type of material, size and exact location o All easements

Gentlemen,
Thi-s is to confirm the above referenced reroofing project. That
the roofing will be installed according to the manufacturers and
the Town of Vail's specifications. The existing roof is a built-
up roof with gravel over insulation. We will remove the existing
roofing and insulation and then install new 3.5', roof insulation
and a four ply built-up roof with native gravel to match the
existing. There will be no alteration in the appearance of this
building.
