agenda until such time as the item has been republished.

Eagle County Assessor's office.
3. Condominium Association approval (if applicable).
4. Existing or proposed floor plans of structure.
Your proposal will be reviewed for compliance with Vail's Comprehensive plan.
lf this application requires a separate review by any local, state or Federal agency
other than the Town of Vail, the application lee shall be increased by $200.00.
Examples of such review, may include, but are not limited to: colorado Department of
Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees which are in excess
ot 5ol" of the application fee. lt, at the applicant's request, any matter is postponed for
hearing, causing the matter to be re-published, then the entire lee for such re
-publication shallbe paid by the appticant.
Applications deemed by the Community Development Department to have sign1icant
design, land use or other issues which may have a significant impact on the
community may reguire review by consultants other than town staff. should a
determination be made by the town staff that an outside consultant is needed to review
any application, the community Development Department may hire an outside
consultant, it shall estimate the amount of money necessary to pay him or her and this
amount shall be fonvarded to the Town by the applicant at the time he files his
application with the community Development Department. upon completion of the
review of the application by the consultant, any ol the funds fonararded by the applicant
for payment of the consultant which have not been paid to the consultani shall be
returned to the applicant. Expenses incurred by the Town in excess of the amount

sq.ft. or more: 2.5 spaces per dwelling unit are required. This application will take
the secondary unit over 2,000 sq.ft. thus requiring an additional parking space.
Please indicate on your site plan how you will accommodate the additional parking
space requirement.
Again, if you wish to remain on the agenda for the April 5. 1995 DRB hearing agenda, you will
need to submit the abovc listed outstanding requirements to thc office of Community

1. Subsoil conditions are somewhat erratic.
Soil profiles varied from 3 to 4 feet of topsoil
underlain bv sand, qravel and cobbles to
2 feet of topsoil witf, fragmented rock under-
lain by highly fragmented bedrock.
2. The proposed residence should be founded
on conventional spread footings designed for
a maximum soil bearing pressure of 4000 psf.
SCOPE
This report presents the results of a Soils and Foundation
Investigation for the proposed residence on Lot 18, Block 5, Bighorn
Subdivision Fifth Addition, Vail, Colorado. The investigation was prepared
by means of test pits and laboratory testing of samples obtained from these
pits.
This investigation presents a description of surface and subsurface
conditions encountered at the site, recommended foundation systems,
allowable design pressures, and groundwater conditions as well as design and
construction criteria influenced bv the subsoils.
SITE LOCATION AND DESCRIPTION
The site is located at 4939 Meadow Drive. The site drains to the east.
Vegetation consists of grasses. The northwest corner of the lot drains to the
west, and vegetation there consists of spruce trees. The lot adjacent to the
east property line has a rock outcrop exposed. There was in excess of 4 feet of
snow on the lot at the time of the investigation.
SITE INVESTIGATION
The field investigation performed on March 9,7989, consisted of
ex(:avatin& logging and sampling two test pits. The locations of the test pits
are shown on Drawing No. 1. Summaries of the test pit logs are detailed on
Figures No. 1 and 2. A summary of the test results is shown on Figure No. 3.
The test pits were excavated with a conventional backhoe. Bulk
samples were obtained for laboratory analysis.
SUBSURFACE AND GROUNDWATER CONDITIONS
Refer to the summary of test pit logs, Figures No. 1 and 2. Subsurface
conditions are somewhat erratic, with soil profiles varying from three to four
feet of topsoil underlain by sand, gravel and cobbles, to topsoil lvith
fragmented rock to a depth of two feet underlain by fragmented bedrock.
No overlot grading has been done prior to this investigation.
No groundwater was encountered in either of the test pits at the time
of excavation.
GEOLOGICALLY SENSITIVE AREA
This site does not lie within a geologically sensitive area as defined by
the Vail Municipal Code and amended by Ordinance No. 5 (Series of 1985).
PROPOSED CONSTRUCTTON
No specific design data has been provided, but for the purpose of this
analysis, it has been presumed that the proposed residence will consist of two

floors without a basement, and that loads will be light. If the proposed
project differs significantly from this understanding, a review should be
made after the plans are more complete.
FOUNDATION RECOMMENDATIONS
Very low to non-swelling sands and gravels to fragmented rock will be
encountered in the excavation. The proposed residence should be founded
on conventional type spread footings designed for a maximum soil bearing
pressure of 4000 psf. At this pressure, foundation settlements will be
tolerable. It would be advisable to proportion footings so as to minimize
differential settlements. The bottom of the footing should be placed a
minimum of 48 inches below final grade for frost protection.
SLAB CONSTRUCTION
Care must be taken to insure that all excavations made for the
foundations are properly backfilled with suitable material compacted in
accordance with the procedures outlined in the specifications. Before the
backfill is placed, all water and loose debris should be removed from these
excavations.
Prior to the construction of concrete floors, the subgrade should be
thoroughly proof compacted to insure a uniformly high density. Special care
should be taken in areas where underground utilities have been installed.
The floor slab should be suitably reinforced to make it as rigid as

possible, and proper joints should be provided at the junctions of the slab and
the foundation walls, so that a small amount of independent movement can
occur without causing damage.
Prior to the placing of concrete floors or pavements on this site, the
subgrade should be proof-rolled until the grade offers a relatively unyielding
surface or until the specified degree of compaction has been achieved. Areas
of excessive yielding should be excavated and backfilled with clean,
compacted soil.
A granular mat should be provided below the floor slabs. This should
be a minimum of four inches in thickness and properly compacted.
GROLINDWATER AND DRAIN SYSTEM
While little or no groundwater was encountered at the time the field
investigation was conducted, it is possible that seasonal variations will cause
fluctuations, or for a water table to be present in the upper soils during the
spring months, or after a prolonged period of rain.
A peripheral drain system as detailed on Figure No. 4 should be
installed.
Basement construction is not recommended on this site.
REINFORCING
Foundation walls should be well-reinforced to minimize the effects of
differential movements. Refer to foundation designs for reinforcing details.

Foundation walls retaining earth should be designed to resist an
equivalent fluid pressure of 30 psf.
CRAWL SPACE COVER
When moist soils are encountered in the excavation, the ground
surface in crawl space areas should be covered with an impervious moisture
barrier sealed against the footings. This will help to reduce humidity in the
crawl space area and will also prevent the moist foundation soils from drying
and shdnking, which could possibly cause the structure to settle.
BACKFILL AND SURFACE DRAINAGE
Backfill should be moistened or dried to near its optimum moisture
content and compacted to at least 90Vo of the maximum standard Proctor
density. Structural backfill should be compacted to at least 9570 of the
maximum standard Proctor density. Excessive wetting or drying of the
exposed soils in the foundation excavation and underslab areas should be
avoided.
Surface water running toward the structure from upslope areas should
be diverted around and away from the building by means of drainage swales
or other similar measures.
The final grade should have a positive slope away from the
foundation walls on all sides. A minimum of 12 inches in the first ten feet is
recommended. Downspouts and sill cocks should discharge into splash

blrcks that extend beyond the limits of the backfill. Splash blocks should
slope from the foundation walls. The use of long downspout extensions in
place of splash blocks is advisable.
LAWN IRRIGATION
Do not install sprinkler systems next to foundation walls, porches or
patio slabs. If sprinkler systems are installed, the sprinkler heads should be
placed so that the spray from the heads, under full pressure, does not fall
within five feet of foundation walls, porches or patio slabs. Lawn irrigation
must be controlled.
If the fuhrre owners desire to plant next to foundation walls, porches
or patio slabs, and are willing to assume the risk of structural damage, etc.,
then it is advisable to plant only flowers and shrubbery (no lawn) of varieties
that require very little moisture. These flowers and shrubs should be hand-
watered only.
MISCELLANEOUS
The recommendations provided herein are based in experience in the
area and from the onsite field exploration. The information obtained from
the field exploration and laboratory testing reflects subsurface conditions
only at the specific locations at the particular times designated. Subsurface

RECITALS
I. ROBERT BORNE, JANE D. BORNE, EDI{ARD LEVY ANd JOANN
CARHART LEVY (collectively, rrDeclaraDt"), is the owner of the
real property (the "Property'r) situate in the County of Eagle,
state of- colorado, described on Exhibit A attached hereto and
made a part hereof, which rrill be resubdivided as ttlJot 18Art, ItIJot
l-88n, and ,tcommon Lot 18crr according to the plat to be recorded
thereof.
2. Declarant has constructed on Lot L8A and Lot 188 a
building consisting of two units, with each suclr unit designed
and int6nded for uie and occupancy as a residential dwelling
unit. Ttre units are designated herein as the rrnorth apartment
unitrt and the rrsouth apartment unitrr, respectively, which are
sometimes referred to herein separately as rrapartment unitrr or
collectively as rrapartment unitsrr.
3. Lot l,8A contains the north apartrnent unit and Lot 188
contains the south apartnent unj-t.
4. Declarant desires to and does hereby establish a plan
for the ownership of Lot 18A and Lot 188 as estates in fee siurple
and the co-ownership, by the individual and separate owners
thereof, as tenants in common, of common Lot L8c.
DECI,ARATION
Declarant does hereby publish and declare that the following
terms, covenants, conditions, easements, restrictions, uses,
reservations, limitations and obligations shall be deened to run
with the land described herein, shall be a burden and a benefit
to Declarant, their personal representatives, heirs' successors
and assigns and any person acquiring or owning an interest in the
real property which is described herein and improvements built
thereon, their personal representatives, heirs, successors and
assigns.
1. DIVTSION OF REAL PRoPERTY. (a) The Property is hereby
divided into tttownhouse unitsrr as follows:
(i) The rrNorth Townhouse Unitlr consisting of a fee
simple estate in Lot LBA and an appurtenant thereto one-half
undivided interest in and to Common Lot L8C' together with
the irnprovements, easements and rights located thereon or
appurtenant thereto in the same resPective interestsi
(ii) The trsouth Townhouse Unitrr consisting of a
fee simple estate in lot 188 and an appurtenant thereto one-
half undivided interest in and to Common Lot 18c, together
with the improvenents, easements and rights located thereon
or appurtenint thereto in the same respective interests.
(b) Each townhouse unit shall be inseparable, and may
be leased,'devised or encumbered only as a townhouse unit. No
owner (rrownerx) of a townhouse unit shall assert any right-of
partition with respect to Common Lot 18C and each owner waives
lny and all rights of partition he may hotd by virtue of his
ownership of an undivided interest in and to Common Lot 18C as a
tenant in common with the other owner.
(c) Title to a townhouse unit rnay be held individually
or in any iorn of concurrent ownership recognized in Colorado. In
case of any such concurrent ownership, each co-owner shall be
jointly and severally liable for performance and observance of
all the duties and responsibilities of an oltner with respect to
ihe townnouse unit in wtrictr he owns an interest. For all
fo"por"= herein, there shatl be deened to be only two owners, the
6wnlr of the North Townhouse Unit and the owner of the South
Townhouse Unit. The parties, if more than one, having the
ownership of each such townhouse unit shall agree among
thenselvls how to share the rights and obligations of such
otrt"t"hip; provided, however, ttrat if a corPoration, partnership,
association- or other lega1 entity shall become an oltner or the
parties, if more than one, have the concurrent ownership g! ?
Lownhouse unit, then such entity or concurrent owners shall from
tirne to tine desisnate one individual who shall represent such
entity or concurr6nt owners in all matters concerning all rights
and oiligations pursuant to this Declaration. Any such entity or
concurrent owners shall give written notice to the other owner
designating the indlvidual to act on its or their behalf and such
notite shall be effective until revoked in writing by such entity
or owners. Any act or ornission by such designated individual
shal1 be bindiirg on the entity or o\rners having designated hin in
favor of the other owner or any person rtho may rely thereon.
(d) Any contract of sa1e, deed, Iease, deed of trust,
mortgage, *iif or-other instrument affecting a townhouse unit
shall describe it by the legal description of the parcel
constituting such townhouse unit and as an undivided one-half
interest in Cornmon Lot 18C described by its legal description.
(e) Each townhouse unit shall be considered a separate
parcel of real property and written notice shall be given to the
issessor of Eagle County, Colorado, so that each townhouse unit
shall be separately assessed and taxed-
2. ENCROACHI{ENTS. If any portion of one of the three
above described parcels now encroaches upon any of the other
parcels as a resi.rlt of the construction of any building, or if
lny such encroachment shall occur hereafter as a result of
seltling or shifting of any building, a valid easement for the
encroachment and for the maintenance of the same so long as the
building stands, shall exist. In the event any-buitding shall be
partialty or totally destroyed as a result of fire or other
iasualty-or as a relult of condennation or eminent dornain
proceedings and then rebuilt, encroachments of parts of the
Luilding on any other parcel , due to such rebuilding, shall be
permitted, so long as such encroachnents are of no greater extent
Lhan those previously existing, and valid easements for such
encroachrnenls and the naintenance thereof shall exist so long as
the building shall stand.
3. PARTY WALL. (a) The comnon wall placed egually
divided on the conmon boundary separating the north apartment
unit and the south apartnent unit' the footings underlying and
the portion of roof over such wall is collectively referred to
herein as the rrParty Wallrr.
(b) To the extent not inconsistent with this
Declarationr'the general rules of law regarding party walls and
liability for damage due to negligence of willful acts or
omissions shall apply to the Party wall.
(c) The owners of either apartment unit shall have a
perpetual easement in and to that part of the other apartment
unit on which the Party Wall is located, for party wall purposes,
including mutual support, naintenance, repair and inspection. In
the event of damage to or destruction of the Party Wall frorn any
cause, the owners-shall, at their joint expenser repair-or
rebuild the Party Wall, and each ohtner shall have the right to
the full use of the rarty wall so repaired and rebuilt.
Notwithstanding anything contained above to the contrary, if the
negligence or wittiul ait or omission of any owner, his fanily,
agent or invitee, shall cause damage to, or destruction of, the
party wall, such owner shall bear the entire costs of repair or
recoirstruction, and an owner who by his negligent or willful act
causes the Party wall to be exposed to the elements shall bear
the full cost oi furnishinq the necessary protection against such
elernents.
4. T,ANDSCAPTNG, SERVTCE FACrLrTrEs.,ACCEES ANp P,ARKTNG.
(a) nxcepFEs otnervise specifically provided in- writing and
dxtept foi any expense or liability caused through the negligence
or willful acl of any owner, his farnily, agent or invitee, which
shall be borne solely by such owner, each owner shal1 share one-
half of all expenses, liabilities and general upkeep
responsibilities with respect to Common l.ot 18C and all
impioveuents thereon. The owners from time to tine, shall
undertake such landscaping and general outdoor improvements as
they nay mutually and unaninously deem proper for the harrnonious
irnpiovetrent of both toqrnhouse units in a common theme. The owner
of one townhouse unit shall not unreasonably danage the value of
the other townhouse unit such as by shoddy upkeep outside, but
both owners shall nake all reasonable efforts to preserve a
harnonious common appearance of the apartment units and Conrnon
Lot 18c. Each ownei nay use Comnon Lot 18C and improvements
Iocated thereon in accordance rtith the purposes for which they
are intended, including, but not linited to, access to his
apartnent unit, parking, landscaping' trash storage and open
slace, without hindering or encroaching upon the lawful rights of
the other owner.
(b) common utility or service connections or lines,
conmon facilities or other equipnent and property located in or
on Connon Ipt 18C or either of the apartnent units or the parcels
upon which such apartment units are located but used in common
for the benefit of Lot Common 18C or for both Lot 18A and Lot 188
and the apartment units located thereon, shall be owned as
tenants in common of equal undivided one-half interests by the
owners of each towntrouse unit and, except for any expense or
liability caused through the negligence or willful act of any
owner, his fanily, agent or invitee, nhich shall be borne solely
by such o$tner, all eipenses and liabilities concerned with such
ploperty shall be shaied proportionately nith such olrnership.
The-owner of the parcel and the apartment unit thereon on which
such property is not located shall have a perpetual easement in
and to that bart of such other parcel. and apartment unit thereon
containing such property as is reasonably necessary for purposes
of naintenance, repair and inspection.
(c) It is expected that comnon parking and access
facilities will be provided on a portion of conmon Lot 18c. The
orrners shall bave equal right to the use of such access and
parking faciLities and no owner shall hinder or perrnit his
invitees to hinder reasonable access by the other owner and his
invitees to the parking areas or such other ownerrs apartment
unit, and furthei, the ouner of the north apartment unit shall
not take or pennit his invitees to take more than one-half of the
parking spaces fron tirne to tine provided on Common Lot 18C
without the consent of the other owner' and the oldner of the
south apartment unit shall not take or petnit his invitees to
take more than one-half of the parking sPaces from time to time
provided on Cornmon Lot 18C without the consent of the other
owner. It is presumed that snowplowing will be reguired from
tine to time, the costs of which shall be shared egually by the
owners. other naintenance and repair of such parking and access
facilities, as may be reasonably required from time to time,
shall be undertaken jointly by the owners, the costs of which
shall be shared equally by the oltners.
5. ALTERATTONS. MATNTENANCE ANp REPAIRS. (a) In
addition, to naintenance provided for in Paragraph 4 above, the
owners shall, at their joint and equal expense, provide exterior
rnaintenance and exterior repair (naintenance, repair and
replacement of itens required-from ordinary use,and on a periodic
U"'ii=l upon each apartrndnt unit and the iroproved-and unimproved
po.[i6".-of the paicel upon which located including, but-not
iinit"a to, the Lxterior-walls, decks and staircases' and the
roof housing the apartment units and the parking and access
facilities located on such parcels, but excluding the exterior

respectiire owner thereof. If the need for repair is caused
thrlugh the negligence or willfut act of any owner, his fanily,
agent or invitee, such oltner shall bear the entire costs of such
repair or reconstruction.
(b) Each owner shall be solely.responsible for
maintenancd ina repair of the inside of his apartment unit
including, wittrout- limitation, fixtures and inprovements and al'l
utility iine= and equipment located ttrerein and senring such unit
only. In performing such naintenance and repair, or in improving
or iltering fris apartment unit, no owner shall do any act or work
which iropairs the structural soundness of either apartment unit
or the flrty WalI or which interferes with any easement granted
or reserved herein.
(c) utility or service connections or lines,
facilities'or other ulitity equipnent and property located in, on
or upon either parcel containing an.apartment unit, in such unit,
or in on or upon Conmon Lot 18C, which are used solely to supply
a service or utility to one apartment unit or the parcel upon
which it is located shall be owned by the owner of the apartment
unit using such utility or service and all expenses and
liabilities for repair and maintenance shall be borne solely by
the owner of such apartment unit, who shall have a perpetual
easement in and to that part of such other parcel or apartment
unit containing such property as is reasonably necessary for
purposes of maintenance, repair and inspection.
(d) No owner sha1l nake or suffer any structural or
design change (including a color scheme change), either pennanent
or teurporary or of any tlpe or nature whatsoever to the exterior
of his apartment unit or alter any present exterior improvement
or construct any additional exterior inprovement or addj.tional
building or structure of any tlpe or nature whatsoever upon any
part of the parcel containing his apartment unit or common Lot
18C without first obtaining the prior written consent thereto
from the other owner. In case of damage or destruction (other
than as provided for in subparagraph 5(a) above) of any apartment
unit or any part thereof or of any irnprovement upon any part of
the parcel containing an apartrnent unj-t by any cause whatsoever,
the owner of such apirtment unit or iurprovement shall cause with
due diligence the apartment unit or irnprovement to be repaired
and restored, applying the proceeds of insurance, if any, for
that purpose. If the cost of repair or reconstruction exceeds
such insurance, the excess shall be paid for by the owner of the
damaged apartment unit or improvement. Such apartrnent unit or
inprovement shall be restored to a condition comparable to that prior to the darnage and in a harmonious manner to promote the
connon therne of both apartment units and inprovements on the
parcels containing the apartment units.
6. l.[ECHANrcrs LIENS; INDEMNIFICATION. (a) Except for
items incurred as a conmon expense as provided for herein, if any
owner shall cause any material to be furnished to his parcel or
apartment unit thereon or any labor to be perfornred therein or
thereon, the other owner shall not under any circumstances be Iiable for the paynrent of any expense incurred or for the value of any work done or naterial furnished; all such work shall be at
the expense of the owner causing it to be done, and such owner shall be solely responsible to contractors, Iaborers, materialmen
and other persons furnishing labor or materials to his apartment unit or the parcel on which located or any inprovernents therein or thereon; nothing herein contained shall authorize either oltner
or any person deating through, with or under either owner to
chargl -cornott Lot 1gA or any apartment unit or parcel on which
locafed of the other oerner iitir any mechanicrs lien or other lien
or encumbrance lthateveri and, on the contrary (and notice is
hereby given), the right and power to charge any lien or
encunbrince of any kind against Common Lot 18C or one owner or
against one ottner-,s apartment unit or parcel on which located for
w5rk done or naterials furnished to the other ownerrs apartnent
unit or parcel on which located is hereby expressly denied'
(b) Except as provided for in Paragraph 8 below, if,
because of-any act or omission of any ohtner, any mechanicrs or
other lien or-order for the paynent of noney shall be filed
against connon Lot 18c or against the other orrnerrs apartnent
uiit or parcel on which located or any inprovements therein or
thereon, or against any other owner (whether or not such lien or
order is valid or enforceable as such), the ouner whose act or
omission forms the basis for such lien or order shall at his own
cost and expense cause the same to be cancelled and discharged of
record or bonded by a surety company reasonably acceptable to
such other ortner, within 2o days after the date of filing
thereof, and further shall indeurnify and save the other owner
harmless from and against any and all costs, expenses, claims,
losses or damages, including reasonable attorneyrs fees resulting
therefrom.
7. fNSURANCE. (a) Each owner shall keep his apartment
unit and all fixtures therein insured against loss or danage by
fire and extended coverage perils (including vandalisrn and
malicious urischief) for the naximum rePlaceDent value thereof.
Any owner may on 30 dayst written notice, at any time one year or
longer after the last appraisal of the apartment units, obtain a
wriiten appraisal of such units from a conrpetent appraiser,
charging both owners with the costs thereof. Such appraiser
shall be a disinterested and independent third party who is
unrelated in any manner to either ohtner whether through joint
business ventures or otherwise.
(b) Each owner shall provide and keep in force for the
protection of hinself general public liability and property
damage insurance against claims for bodily injury or death or
property darnage occurring in, on or uPon his parcel owned in fee
simple, the inprovements thereon, and Common Lot 18C and the
irnpiovenents thereon, in a lirnit of not less than $5o0rooo in
respect of bodily injury or death to any nurnber of persons
arising out of one accident or disaster, or for danrage to property, and if higher lirnits shall at any time be customary to protect against possible tort liability, such higher limits strall
be carried and each owner shall name the other owner as an
additional insured party under such policy.
(c) Each owner shall be separate)-y responsible for alL
insurance covering loss or damage to personal- property in his
apartnent unit and liability for injury, death or damage
occurring upon his parcel or inside his apartment unit thereon.
(d) Each owner shal1 deliver to the other
certificates evidencing all insurance required to be
under this Paragraph 7, each containing agreements by
insurers not to cancel or nodify the policies without
ohrner

(e) Nothing provided in this Paragraph 7 shall prevent the owners from jointfy acquiring a single policy to

8. RIGHT TO LIEN. (a) If an o{ner, at any time, shall

behalf of such other owner, expend such sun as may be necessary

restoration or naintenance, and sush other oUner shall have an
easement in and to that part of such defaulting ownerrs towntrouse
unit as is reasonably necessary for such rePair, restoration or
maintenance.
(b) AII surns so paid or expended by an owner, witlr
intereEt thereon at the rate of 18 Percent per annum fron the
date of such payment or expenditure until pald in full, shall be
payable by thL owner so failing to perforn (the rrdefaulting
ownertr) upon demand of the other owner.
(c) AII sums so denanded but unpaid by-the defaulting
oerner shall constitute a lien on the townhouse unit of the
defaulting owner in favor of the other.owner prior to all other
Iiens and encumbrances, except: (i) Iiens for taxes and special
assessmenti and, (ii) the tien of any first rnortgage or first
deed of trust of record encumbering such townhouse unit. The
lien shall attach frorn the date when the unpaid surn shall becorne
due and nay be foreclosed in like manner as a nortgage on real
property upon the recording of a notice or clain thereof executed
Ly Lne irondefaulting owner setting forth the arnount of the unpaid
iidebtedness, the nine of the defaulting owner, and a description
of the townhouse unit. If any such lien is recorded' the
defaulting ovJner shall be required to pay the costs and expenses
of the prtparation and recording of the nondefaulting ownerrs
lien, incfuaing reasonable attorneyrs fees, or $150.00, whichever
is greater. rn any such foreclosure the defaulting oltner.shall
be iequired to pay the costs and exPenses of such proceedings,
including reasonable attorneyrs fees.
(d) The lien provided for herein shall be subordinate
to the fieri ilf any first mortqage or deed of trust, including all
additional advances tbereon. SaIe or transfer of any to!ilnhouse
unit as the resul-t of court foreclosure of a mortgage'
foreclosure through the public trustee, or any proceeding in lieu
of foreclosure, inctuding the transfer of a deed in lieu of
foreclosure, shall extinguish the lien of such assessments as to
payments thereof which btcorne due prj.or to such sale or transfer,
LuL shall not relieve any forner owner of personal liability
therefor. The mortgagee of such townhouse unit who acguires
title by way of foreclosure or the taking of a deed in lieu
thereof, snitt not, however, be liabl.e for any Past due
assessment and shall only becone liable for future assessments on
the date it becomes tbe owner of such townhouse unit. No sale or
transfer shall relleve such townhouse unit from liability for any
assessments thereafter beconing due or from the lien thereof. In
the event of the sale or transfer of a townhouse unit with
respect to which suns shall be unpaid by a defaulting-owner,
except transfers to a first rnortgagee in connection with a
foreclosure of its lien or a deed in lieu thereof, the purchaser
or other transferee of an interest in such unit shal.l be jointly
and severally liable sith the seller or transferror thereof for
any such unpaid sums.
(e) Upon written request of any owner, mortgagee,
prospective mortgagee, purchaser or other prospective transferee
of a townhouse unii, the owner of the other townhouse unit shall
issue a written statement setting forth the amount he is owed
under this paragraph, if any, with respect to such townhouse unit. Such staternent is Uinaing upon the executing owner in
favor of any person who may rely thereon in good faith. Unless a
reguest for such statenent shall be conplied with within fifteen
dafs after receipt thereof, aII unpaid sums which became due
prior to the datL of rnaking such request shall be subordinated to
Lhe lien or other interest of the Person requesting such
statement.
9. USE RESTRfCTIONS. (a) Each apartment unit shall be
restricted to a residential dwelling as a permitted use, and such
use as weII as conditioned and accessory uses shall be as defined
by the Town of Vail Zoning ordinance.
(b) No exterior mounted radio, shortwave, television
or other tlpe of antenna whatsoever or tank of any kind, either
elevated ol buried, or clothesllne or incinerator of any kind
whatsoever or outside storage of any personal property shall be
pennitted or maintained on either townhouse unit without the prior written approval of both owners.
(c) No aninals shall be kept or maintained in, on or
upon either townhouse unit, except that each oldner nray keep and
rnlintain within his apartnent unit two domesticated dogs and two
domesticated cats; provided, however, that such donesticated
anirnals are kept under control at all tines, do not present a
nuisance to the other ortner and are kept and controlled in strict
conpliance with all Town of Vail ordinances that may apply to
such animals.
(d) In addition to the parking restrictions set forth in subparagraph 4(c) above, the owner of the north apartrnent unit
rnay keep no more than three automotive vehicles perrnanently on
Lot 18A, and the owner of the south apartnent unit shall keep no
nore than three automotive vehicles permanently on Lot 188.
Parking of boats, trailers, campers, motor homes, ATvs or
recreational vehicles on either townhouse unit is expressly prohibited. Parking of more than three autornotive vehicles by
either owner or his family, agent or invitee on such oqrnerrs
townhouse unit for rnore than a 48 hour period is expressly
prohibited.
(e) No rrtime sharingrr, rrinterval ownershiprr or sinilar interest, whereby ownership of a townhouse unit is shared by
oltners on a time basis, shall be established on either townhouse unit without the prior written approval of both ortners and all
Iienors holding a first mortgage or first deed of trust of record
on any portion of the Property which approval shall be reflected in a document of record.
10. NoTIcE. Each owner shall register his nailing address with the other orrner and all notices or demands intended to be
serviced upon onners shall be sent by certified nail, postage
prepaid addressed in the nane of the owner at such registered nailing address. In the alternative, notices may be delivered if in writing, personally to owners.
l-1. DURATfON OF DECLARATION. Each provision contained in this Declaration rvhich is subject to the laws or rules sometimes
referred to as the rule against perpetuities or the rule prohibiting unreasonable restraints or alienation shall continue
and remain in full force and effect for the period of 21 years
following the death of the last surrrivor of Michael Lauterbach'or until this Declaration is tenninated as hereinafter provided,
whichever first occurs. A11 other provisions contained in tbis
Declaration shall continue and remain in full force and effect until January 1 in the year 20L8 A.D., and thereafter for
successive periods of 10 years eachi unless at least 1 year prior
to January 1, 2oL8 A.D., or at least I year prior to the
expiration of any such 10 year period of extended duration, this
Deelaration is terninated by recorded instrument, directing temination, signed by all ohrners and all lienors holding a first
mortgage or first deed of trust of record on any portion of the
Property.
L2. AMENDI{ENT oR REvocATfoN. This Declaration nay be.
arnended or revoked onllt (a) by Declarant so long as Declarant
owns all of the property, or (U) upon unaninous written approval
in recordable forn 6f afi owners ana all lienors holding a first
roriq"g" or first deed of trust of record on any portion of ttre
Property.
13. EFFECT OF PROVISIONS OF DECI,ARATION. Each provision of
this Declaration, and agreement, pronise, covenant and
unaertaxing to comply with each provision of this Declaration,
and any necessary Lx-eption or reservation or grant of title,

Declaration: (i) shalL be deened incorporated in each deed or
other instrument by which any right, title or interest in any
portion of the Property is granted, devised or conveyed, whether -or not set forth oi referred to in such deed or other instrunent;
(ii) shafl, by virtue of acceptance of any right' title or
interest in any portion of the Property by an owner, be deened
accepted, ratified, adopted and declared as a Personal covenant
of such owner and, as a personal covenant, shall be binding on
suc[ owner and his heirs, personal representatives, successors
and assigns; (iii) shafl be deened a personal covenant to, with
and for the benefit of each owner of any portion of the Property;
and, (iii) shall be deemed a real covenant by Declarant, for
themselves, their personal representatives, heirs, successors and
assigns, and also an equitable servitude, running, in each case,
as a burden with and upon the titte to each and every portion of
the Property.
L4. ENFORCEI{ENT AND REMEDIES. (A)Each provision of this
Declaration shall be enforceable by any owner by a proceeding for
a prohibitive or mandatory injunction or by a suit or action to
recover damages. If court proceedings are instituted in
connection with the rights of enforcement and renedies provided
in this Declaration, the prevailing party shall be entitled to
recover his costs and expenses in connection therewith, including
reasonable attorneysr fees.
(b) Each owner hereby agrees that any and all actions
in equity or at law which are instituted to enforce any provision
hereunder shall be brought in and only in the courts of Eagle
County, State of Colorado.
(c) Failure to enforce any provision of this
Declaration shall not operate as a waiver of any such provision,
the right to enforce such provision thereafter' or of any other provision of this Declaration.
15. EXERCISE OF RIGHTS. Any exercise of any right granted
hereunder by one owner with respect to the other ownerrs
townhouse unit including but not linited to the use of any
easement granted herein shall be exercised in a manner which
shall not unreasonably trinder, irnpede or impose upon such other
ownerrs use of his townhouse unit.
16. SUCCESSoRS AND ASSfGNS. Except as otherwise provided
herein, this Declaration shall be binding upon and shall inure to
the benefit of Declarant and each owner and the personal
representatives, heirs, successors and assigns of each.
L7. SEVERABILITY. Invalidity or unenforceability of any provision of this Decl-aration in whole or in part shall not
affect the validity or enforceability of any other provision or
any valid and enforceable part of a provision of this
Declaration.

Dear Mr. Mo I I ica;
After our te lephone conversation yesterday I did rev iew the
concepfual plans that had been submiited and approved by the DRB
for my duplex on Lo+ 18, Block 5' Bighorn Fifih and compared them
wifh the final working drawings which were submitted for permif
approva | .
The original concepfual plan was drawn by Rick Gilette who
is an architect here in Florida. I employed him only for initial
des ign and conceptua I presentat ion. lt is my understandi ng that a
duplex which lam building for myself' does not need an architect
nor need it be sealed by one. Consequently Iemployed a drafting
service, whom we use f requent ly down herer to draw the actual
working drawings. I also employed Peter Monroe of Avon as the
str uctu ra I engineer and he has sealed all of the structural
p lans and deta i I s.
ldid find some details in the final plans which differed
from the approved DRB sef and I have llsted them herewith. I have
had the e levaf ions and the s ite p lan redrafted fo conform more
closely wi+h fhe DRB approval. All of these errors were made
inadvertenfly and were not an attempt to slip by a modificafion
wifhouf approval.
The d i screpanc ies and the cor rect ions are as follows:
1. The approved site plan had the driveway reduced in size
and a sno w storage area provided. The site plan resubmitted
herewith is now in conformiiy wifh fhe DRB set.

corrected to ref lect the chimney shape as originally

should have been shown as stucco and have also been revised to

told by con+rac+ors thaf fhey may not be avai lable and I
fherefore have shown f lai ch imney caps.
4. The front entries are as previously planned. They were
always to be a steel front entry door package with an insulafed glass side-life. The working drawings now show a little more
defail so that they do nof look like a sliding glass door system.
5. The windows are actua I ly slzed and are the Cresf line
series that was originally submitted. The only change is in the rear of the left un it. The rear e levation shows two banks of
seven windows and fwo banks of six windows actuallv f its into the
wall area fhaf is available.
6. The buildings are almost exac+ly as planned. The DRB plan
showed only nominal sizes and made no reference to whether they
were inside or outside dimensions. The working drawings are
acfual measurements. The following table shows the similarify of
the overall d imens ions between the preliminary and the f inal set.

I believe that the slighf difference in overall dimensions is
mere I y the fact fhat the conceptual drawings did nof reference
wether the dimensions were actually inside or outside of walls
whi le the working set actually does reflecf the exacf outside
d i mens ions.
The only change that I can find which makes a slight change to fhe outside shape of fhe building is in the right hand unit.
I had the drafting service move the stairwell out an additional three feet fo provide less congestion af the foot of the stair.
l+ was moved out to the same depth and therefore became a wall
continuance of fhe foyer, guest bafh protrusion. This resulted in fhis protrusion being elongated by 6oBn and moved northerly by that anounf. The window shown in the stair remains the same 6nd is in the same locaf ion in fhe corrected profrusion. This modification totals in increase of 20"0rt in f loor area. Since the
GRFA for this unit is well below fhe maximum it will nof make the
unit too large for the lot.

bulk of the driveway has approxirnately a 5* slope with only the
Easterly side of the driveway approaching but not exceeding an 88 s1ope. Ttris slope is necessary in order to acconmodate tbe grading to the stream without the need for extensive retaining walls , whicb I believe, would only detract from the natural
beauty of that lot.

CONDITIONS AND STIPULATIONS
The term mortgage, when used herein, shall include deed of trust, trust deed, or
other security instrument.
lf the proposed Insured has or acquires actual knowledge of any defect. lien,
encumbrance, adverse claim or other matter affecting the estate or interest or
mortgage thereon covered by this Gommitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in
writing, the Gompany shall be relianed from liability for any loss or damage
resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge. lf the proposed Insured shall disclose such
knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any zuch defect, lien, encumbrance, adverse claim or other matter,
the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability
prwiously incurred pursuant to paragraph 3 of these Conditions and Stipu lations.
Liability of the Company under this Commitment shall be only to the named
proposed Inzured and such parties included under the definition of In$red inthe
form of policy or policies committed for and only for actual loss incurred in
reliance hereon in undertaking in good faith (al to comply with the requirements
hereof, or (bl to eliminate exceptions shown in Schedule B, or (c) to acquire or
create the estate or interest or mortgage thereon covered by this Commitment. In
no event shall such liability exceed the amount stated in Schedule A for the policy
or policies commifted for and zuch liability is subject to the insuring provisions and
the Gonditions and Stipulations and the exclusions from coverage of the form of
policy or policies committed for in favor of the proposed Insured which are hereby
incorporated by reference and are made a part of this Commitment except as
expressly modif ied herein.
Any claim of loss or damage, whether or not based on negligence, and which arises
out of the status of the title to the estate or interest or the lien of the insured
mortgage covered hereby or any action asserting such claim, shall be restricted to
the provisions and Conditions and Stipulations of this Commitment.
