stream setback, and 100-year flood plain, if applicabte. Slopes of 40t or more sha11 be clearly delineated by cross hatching.
7. Ties to existing benchmark, either USGS landmark or serrer invert. This information must be clearly
staUed on the survey so that alL measurements are
based on the same sLarging point.. This is particularly imporEant for deLermining building height and driveway slope. See Policy On Survey

Galen Aasland said that all new logs would be the same size as Banner Sporls but
would be stained with a clear varnish. Bart and Yeti's logs would stay exactly the
same as what is out there now.
Dalton Williams agreed that Allison's suggestion regarding a copper gutter was a good
idea.
Allison, Jeff, Bill, Bob and Greg all ielt that the east side roof extension was okay the
way that was currently proposed and that it did not have to go all the way to the end of
the building.
Dalton Williams felt that the roof extension should be redesigned to go all the way to
the corner of the building. Dalton also stated that he did not have a problem should
the applicant wish to go forward with a possible loading variance, should one be
required as a result of the addition.
Jim Curnutte stated that the PEC still needed to discuss the pedestrian easement.
Mike Mollica asked the applicant whether they would be opposed to a pedestrian
easement through the Lifthouse site.
Bob Lazier lelt that the pedestrian easement would not change the existing situation,
so he did nol have a oroblem with it.
Jim Curnutte stated that staff wanted to insure pedestrian access across the site.
Mike Mollica stated that it was important for the Fire Department to review this
proposal prior to a final hearing before the PEC.
Jeff Bowen suggested that a comprehensive sign program be implemented for the
building and lhat new tenants be made aware of the program and that the DRB be
instructed accordingly.
4. A request ior a setback variances to allow for an addition to the residence located at
4237 Columbine Drive/Lot 22, Bighorn Terrace.

Andy Knudtsen made a presentation per the staff memo. He stated that stafl was
recommending approval of the requested setback variances with the live conditions
outlined on Pages 4 and 5 of the staff memo:
1. The variance approval shall be contingent upon the DRB approving the

Prior to DRB review, the applicant shall redesign the flagstone patio
entrance area so that it is located 10 feet from the property line, and
conforms to the setback.
Prior lo DRB review, the applicant shall amend the landscape plan
showing additional landscaping in the northeast corner of the site. The
proposed evergreen trees shall measure a minimum of 81 linear feet.
Prior to the issuance of a Temporary Certificate of Occupancy (TCO),
the applicant shall place the two existing overhead service lines below
grade.
Prior to issuance of a building permit, the applicant shall provide
protective fencing around the three evergreens to the north ot the
structure to ensure that they will not be damaged during construction.
Steve Riden, the architect for this project, stated that they planned to bury all overhead
utility and service lines.
The PEC members did not have any questions to ask either the applicant or statf with
regard to this proposal.
Bob Armour stated that he would like to see the one large tree (located to the north)
preserved.
Jelf Bowen stated that he had a basic public policy problem with this project. He felt
that this was not a proper situation for the PEC to grant a setback variance. He said
that he could not find justification for a hardship on the project. The specific problem
was that the setbacks were reduced to the point that the neighbor's property would be
encroached uoon.
Bob Armour made a motion to approve this request for setback variances per the statf
memo including the five conditions oullined on Pages 4 and 5 with the additional
condition that all overhead utility and service lines be buried and that a 6-foot buffer be
provided around the 60-loot tall tree.
Bob Armour subsequently withdrew his motion for further discussion concerning
protecting the 60 foot tree.
Bill Anderson suggested the wording "no structure within the drip line".
Andy Knudtsen stated that in order to clarify the condition, that the drip line was less
than-the 6 feet as previously cited and the more conservative wording was appropriate.
Bob Armour made a motion to approve this request for setback variances to allow for
an addition per the slaff memo outlined on Pages 4 and 5 with the following
amendment to Condition 4:

A request for setback variances to allow lor an addition to the residence located
at 4237 Columbine Drive/Lot 22, Bighorn Terace.
Applicant: Joyce Waters Planner: Andy Knudtsen
I. PROJECT DESCRIPTION
The owner ol the property described above, Joyce Waters, is proposing to expand half of the
duplex by approximately 727 square leet. Most of the addition will occur to the rear and side
of the existing duplex. The applicant is requesting variances to the setback standard to allow
for the addition. The required setbacks are 20 feet on all sides ot the property and the
.applicant is proposing setbacks ranging from 12 to 15 feet.
The specific variance requests are as follows:
.The front setback is required to be 20 feet and the applicant is proposing 13.25 feet.
.The side setback is required to be 20 feet and the applicant is proposing 13.25 feet.
.The rear setback is required to be 20 feet and the applicant is proposing 12 feet.
.ln addition, there is an entrance patio which would be required to have a 10 foot
setback and the applicant is proposing 6-'l/2 feet.
To allow the expansion, the applicant has requested to use a portion of the "250". As this is
an existing duplex older than tive years, the duplex is eligible for a 250. The Code states that
the Design Review Board (DRB) shall review the 250 request after any variance is revievved
by the Planning and Environmental Commission (PEC). lf the variance is approved, it should
be contingent on the DRB approving the 250. Stafl has provided a condition of approval at
the end of the memo stating this.
Currently, the owner uses parking spaces located to the south and north of the unit. Two
spaces are required with both the current amount of GRFA as well as the proposed amount of
GRFA. There is no net increase in the parking requiremenl. At this time, the two required
parking spaces are not located entirely on this site. However, since there is no change in the
parking requirement, the existing parking situation can continue to function as it does at this
time and legally fulfill the parking requirement.
There are two separate overhead utility lines which provide service to this unit. The architect
has said that, as part of the construction, the overhead lines will be buried. This is a
requirement and is listed at the end of the memo as a condition of approval.

There are seven evergreen trees in the area to the north of the structure that may be affected
by the addition. Staff believes that it is critical that three of these trees be protected during
construction. These include evergreens that are 60 feet, 12 feet and 5 feet tall that have
grown in a cluster. There are four other trees which must be cut down. These include 40
feet, 20 feet, 15 feet and 6 feet tall evergreens. There is also one 2-inch caliper aspen which
will be cut down. The applicant is proposing to add eight aspen and two lodgepole pine. Staff
will discuss the landscaping in greater detail later in the memo.

III. CRITERIA AND FINDINGS
Upon review of Criteria and Findings, Section 18.62.060 of the Vail Municipal Code, the
Community Development Department recommends approval of the requested variances
based on the following factors:
A. Consideration of Factors:
1. The relationship of the reguested variance to other existing or
potential uses and structures in the vicinity.
The property is within a development that is zoned Medium Density Multi-
Family. Compared to the surrounding properties in East Vail, it is a higher
density and the residences are closer together than most. With this addition,
the distance between this unit and the neighboring units would be 22 urd 28
leet. On a vicinity map provided by the architect, distances between nearby
existing structures are shown to be:
1. Bighorn Condominiums to Unit 23: 20 feet.2. Unit 8 to Unit 9 : 14 feet.3. Unit 15 to Unit 19: 18 feet.4. Unit 20 to Unit 21; 15 feet.
Staff believes that the proposed distance is consistent with the separation found
between existing units in this development.
Staff believes the most important issue dealing with the compatibility of the
addition to the surrounding properties involves landscaping. The proposed site
plan shows lour new aspen to the west, four new aspen to lhe north, and two
new lodgepole pines to the northeast. There will be several large spruce trees
removed at the rear of this property. Staff believes that the cluster of three
evergreens with heights of 60 feet, '12 feet, and 5 feet should be preserved.
During construction, the applicant should provide fencing to protect these trees.
There are four other trees; with heights of 40 feet, 20 leet, '15 feet and 6 feet
that will be cut down. Staff believes that the applicant should be responsible for
replacing these trees at a 1:1 ratio. For every linear foot of tree cut down, the
same amount should be replaced at the rear area of the site. This would result
in a total of 81 linear feet of new spruce trees. The two lodgepole trees shown
on the landscape plan may be counted as part of the 81 feet. This landscape
requirement has been included as a condition of approval.
There is a proposed flagstone patio that will be added in the front area. Staff
has recommended that the patio conform to the 10loot setback. At this time,
the patio is proposed to be setback 6-112 leet lrom the property line. We
believe that the patio could be reduced so as to provide a 10 foot setback from
the property line, and therefore not require a setback variance.
2. The degree to which relief from the strict and literal interpretation
and enforcement of a specified regulation is necessary to achieve
compatibility and unilormity of treatment among sates in lhe vicanity
or to attain the objectives of this title without grant ot special
privilege.
Concerning hardship, staff believes that the method by which the development
was originally planed results in a practical difficulty. Property lines were set in
such a way that almost all additions to these duplexes require variances. There
have been nine setback variance requests in the pasl within this development.
In general, staff has supported these variances based on the platting pattern.
For this particular lot, the area on-site that is not in a setback is approximately
40 square feet. Since a majority of the site is in the setback area, and since
there is available GRFA a variance is warranted, in staff's opinion.
3. The efiect of the requested variance on light and air, distribution ol
population, transportation and traffic facilities, public facilities and
utilities, and public safety.

There is no impact from the requested addition on the criteria listed above.
B. The Planninq and Environmental Commission shall make the followinq findinqs
before qrantinq a variance:
1. That the granting of the variance will not constitute a granl of special
privilege inconsistent with the limitations on other properties classified in
the same district.
2. That the granting of the variance will not be detrimental to the public
health, safety or weltare, or materially injurious to properties or
improvements in the vicinity.
3. That the variance is warranted for one or more of the following reasons:
a. The strict literal interpretation or enforcement of the specified
regulation would result in practical difliculty or unnecessary
physical hardship inconsistent with the objectives of this title.
b. There are exceptions or extraordinary circumstances or
conditions applicable to the same site of the variance that do not
apply generally to other properties in the same zone.
c. The strict interpretation or enforcement of the specified regulation
would deprive the applicant of privileges enjoyed by the owners
of other properties in the same district.
IV. STAFF RECOMMENDATION
Staff recommends approval of the request as it meets the criteria as discussed above and, in
staff's opinion, also meets the findings. Specifically, statf believes that Finding 1 is met in that
the variance is not a grant of special privilege. Other properties in the surrounding
development have received setback variances in the past. Concerning Finding 2, staff
believes that there will be no impact to public health, safety or welfare as a result of the
addition. Concerning Finding 3, staff believes that 3b is met with this request as the platting
pattern of the development is an extraordinary circumstance that warrants a variance.
Staff recommends approval of the variance with four conditions:
1. The variance approval shall be contingent upon the DRB approving the "250"
request.
2. Prior to DRB review, the applicant shall redesign the flagstone patio entrance
area so that it is located 10 feet from the property line, and conforms to the
setback.
3. Prior to DRB review, the applicant shall amend the landscape plan showing
additional landscaping in the northeast comer ol the site. The proposed
evergreen trees shall measure a minimum of 81 linear feet.
4. Prior to the issuance of a Temporary Certilicate of Occupancy (TCO), the
applicant shall nlacedF+j$Xoverhead service lines below grade.
5, Prior to issuance of a building permitl the applicant shall provide protective . fencingl to ensure that ;+

The medium-density multiple-family district is intended to
provide sites for multiple-family dwellings at densities to a maxi-
mum of eighteen dwelling units per acre, together with such
public facilities as may appropriately be located in the same
district. The medium-density multiple-family district is intended
to ensure adequate light, air, open space, and other amenities
commensurate with multiple-family occupancy, and to maintain
the desirable residential qualities of the district by establishing
appropriate site development standards. Certain nonresidential
uses are permitted as conditional uses, and where permitted, are ' intended to blend harmoniously with the residential character of

A pre-application meeting with a mernber of tbe planning

r-sponsibility to make an appointment with the staff to
determine if there are additional submittal reguirements.
Please note that a COMPLETE application will streamline the
approval process for your project.
In addition to meeting subrnittal reguirements, the
applicant must stake and tape the project site to
indicate propelty lines, building fines and building
corners. AII trees to be removed must be taped- AIt
site tapings and staking must be completed prior to the
DRB site visit. The applicant must ensure that staking
done during the winter is not buried by snow.
The review process for NEW BUILDINGS normally requires
two separate meetings of the Design Review Board: a
cotrceptual approval and a final approval . APPlicants
shoulb plan on presenting their development proposal at
a minimum of twb rneetings before obtaining final
approval .
Applicants who fait to aPPear before the Design Review
Bblrd on their scheduled neeting date and who have not
asked in advance that discussion on their item be
postponed, will have their iterns removed from the DRB
docket until such time as the item tras been
republished.
The foflowing items may' at the discretion of the
zoning administrator, be approved by the Community
Development Department staff (i.e. a formal hearing
before the DRB may not be required):
a. Windows, skylights and similar exterior changes
which do not alter the existing plane of the

Eagle County Assessor's office.
3. Condominium Association approval (if applicable).
4. Existing or proposed floor plans of structure.

H. lf this application requires a separate review by any local, State or Federal agency
other than the Town of Vail, the application fee shall be increased by $200.00.
Examples of such review, may include, but are not limited to: Colorado Department of
Highway Access Permits, Army Corps of Engineers 404, elc.
The applicant shall be responsible for paying any publishing fees which are in excess
of 50% of the application fee. lf, at the applicant's request, any matter is postponed for
hearing, causing the matter to be re-published, then the entire fee for such re-
-publication shall be paid by the applicant.
Applications deemed by the Community Development Department to have significant
design, land use or other issues which may have a significant impact on the
community may require review by consultants other than town staff. should a
determination be made by the town staff that an outside consultant is needed to review
any application, the community Development Department may hire an outside
consultant, it shall estimate the amount of money necessary to pay him or her and this
amount shall be forwarded to the Town by the applicant at the time he files his
application with the Community Development Department. Upon completion of the
review of the application by the consultant, any ot the funds fonrrarded by the applicant
for payment of the consultant which have not been paid to the consultani shall bb
returned to the applicant. Expenses incurred by the Town in excess of the amount
fonrvarded by the applicant shall be paid to the Town by the applicant within 30 days of
notification by the Town.

With this appllication we are requesting a varience to ordinance 18.8.060 to allow
for a setback of less than 20' (twenety feet).This is to allow for the proposed expansion of
the exisiting unit.In fact the building area would only amount to 600 s.f.
Specifically we are requesting setbacks as follows;
West lot line to l2'-0"
t*orth lot line to l5'-0"
East lot line to 12'-6"
Nrrmerous other units are in the same predicament as this nt[s annexed after the
developnent was constructed and the zoning is highty restrictive towards the owners and
their ablility to improve their residences.' Previous commissions have approved similar requests, we ask only the same
consideration
This addition will not effect the light,air ,population,transportation,,traffic,utility,or
public saftey.

It has been brought to our attention that several of the owners of the Bighorn
Terrace units have been experiencing venting problems with thejr boilers or
hot water heaters. Based on the information that we have received and further
investigation, leads us to believe that you may have a serious venting problem
with your boiler or hot water heater. According to Gary Hall' a Public Service
Compairy representative, there is evidence that the Type B vent located on these
appliances may be rusted or deteriorated to such a degree as to render them
unsafe.
Therefore, b,e are urging you to contact a profedsional to check the venting of
this appljance in your unit. If you so desire, you may contact me and I will
be glad'to perform this inspection for you. However, you must be aware that
snoutO carbbn monoxide be shown to be leak'i ng from these vents which would
pose a life safety threatr jour gas will be shut off unti'l the problem is
corrected.
