PUBLIC NOTICE
NOTICE IS EEIIEBY GMN that Robert J. Alder has applied
for a variance from the provisions of Section 18.18.060, Setbacks,
and Section 18.18.09O, Density of the Munlclpal Code for the
Tovm of Vall, in order to construct an addition of approxinately
66 sq. ft. on an existing dwelling unit located on Lot 23,
Bighorn Terrace Subdivision. Application has been madeln accord
with Chapter 18.62 of the Munlcipal Code.
A Public Hearing,will- be held ln accordance with
Section 18.66.060 of the Municlpal Code on June 2?, L978 at
3:0O p.m. before the Torrm of VaiL Plannlng and EnvironmentaL
Commission. Said h6aring will be held in the Vail Municipal
Bullding.

Dear Mr. Marcus,
Attached are my drawings for the work at my place in the
Bighorn Temace. I appreciate your help in obtaining a
permit for this work by phone and letter to e1 iminate my
having to make yet another trip to Vai1.
I have made a pretty close estimate of materials for this job. Since we wil] be doing a'| 1 of the labor, the on'ly
expense wil'l be materials which I figure wi'll come to
approximate'ly $1,500.

BIGHORSI TERRACE ST'BDIVISTON
The applicant, Robert J. Alder has appi.ied for a
Gross Residential Fl-oor Area Variance of 75 sq. ft., and a
Setback Variance to allow a two foot setback in Lieu of the required. 10 feet on the south side of the property.
The proposed addition of 66 sg. ft. consists of a J-iving
and dining space.
The lot which is zoned Medium Density MuLti-Family is 21'104 sq. ft, al-I-owing 737 sq. ft. pf GRI'A. Ehe existing unit is 745 sq. ft., thus requiring a GRFA Variance of 75 sg. ft.
The reguested VarLance is approximately 4E in excess of the pemitted GRFA.
CoNSTDERATTON OF FACTORS (SECTION 19.600)
L. The reLationship of the requested variance to other existing or potentiaL uses and structures in ttre vicinity.
a.) GRFA Variance
Trco other GRFA Variances for Bighom Terrace Units ltere granted, one to allow an existing porch to be covered,
and the other for an add,ition. No other GRFA Variances have
been requested or granted in the Bighorn atrea. There are a number of the Bighorn Terrace units that added floor area prior to the annexation and as nany &ore that could reguest a sjrriLar
variance.
b. ) Setback Variance
The proposed addition does not encroach on any other
existing, structures and there is sufficient separation between the addition and the adjacent unit.
.2. The degree to which relief from the strict or
literal- interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment arnong sites in the vicinity, or to attain the objectives
of this ordinance without grant of special privilege.
a.) GRFA Variance
We feel that this would be a grant of special privil.ege.
The additional 66 sq. ft., would result in the GRPA exceeding

what is allowed by approximately 4€. Three variances for
less than. J-00 sq. ft. have been denied for expansion of
nrlti-fanily units in other areas.
b.) Setback Variance
The proposed Setback is somewhat closer to the property line than the balance bf the Bighorn Terrace units;
however, most are rnuch closer together than the proposed
addition is to its neighbor.
3. The effect of the reguested variance on light
and air, distribution of population, transpor-tation and traffic facil-ities, public
facLlities and utiLities.
a.) GRFA Variance
The proposed use of the increased sPace would not
be detrinental to the above factors.
b.) Setback Variance
We

excessively large multi-family units to be built or allowing
additions on units which already exceed or are very close to
the GRFA requirement of the Zoining Ordinance.
3. That the variance is warranted for the foLlowing
reasons: The strict or literal interpretation
and enforcement of the specified regulation
would not deprive the appJ-icant of privileges
enjoyed by the oltrners of other properties in

Struqbures in the Bighorn Terrase Subdivision generaLly are not in compliance with the GRFA requirement of the Zoning Ordi.nance. We therefore feel that a v€rriance is not warranted and would not deprive the applicant of privileges enjoyed by owners of other properties in the area.
The Department of Cosmunity Development recomend.s denial of the Gross Residential Floor Area Variance sought for the reasons stated above. We also feel there has been
no hardship shown j.n the reguest.
If the GRFA variance is denied, then the Setback variance becomes a moot issue.

RE: Attached Application for Setback and Density Variance
Dear Diana:
Attached is the informatjon which you've indicated is required for a
decision relating to the proposed alteration to our #23 Bighorn
Temace. Also enclosed is a check for $1OO.OO covering the cost of
the application.
According to ny calculations, our lot is 2104.8 square feet and thus
the Gross Residential Floor Area (GRFA) allowab'le using a .35 multiplier is 737.0 square feet. The existing floor area totals 745.5 square feet (lst floor 348.2 square feet and Znd floor 398.3). As you can see on
page 4 of 6 on the attached drawings, our proposed alteration is
approximately 81 0" x 7' 6" (plus the bay window area) which totals
66.8 square feet. t,.le are thus applying for a total variance of 75
square feet.
In considering this application I feel that there are several factors
that should favorably dispose the Coronission to approve this proposed
al teration:
A. The variance proposed is a modest one. GRFA would only
be 39% of the lot size (versus 36% presently).
B. The prgposed alteration is basica'l ly an enclosure of a
porch rfrch is a'lready largely covered by an existing
second f'l oor structure. This, as opposed to an outright
room addition.
C. The Cormjssion approved, within the past few monthsn a variance
of 130 square feet for unit #7 of our complex. That lot is
nearly identical in size to ours and our application is for
only a 75 foot variance,

D. Most Bighorn units have a'l ready made similaro if not
larger, expansions. Admittedly these were done prior to the Vail
annexation. Nevertheless, to deny our application would
constitute a hardship in that our unit would be inferior
and its value and utitity thus reduced.
E. The proposed alteration will trot increase the people
density of our unit (as opposEl-to, say, a bedioom addition).
F. The proposed alteration in no way blocks or restricts the
view of any surrounding units.
G. The open space to the S.S.E. of our unit (that is, the
direction of alteration) is quite 1arge. There is no unit
innediately adjacent.
H. The Board of Directors of the Bighorn Mutual Sanitation
and Recreation Company is aware of and fully endorses our
pl ans.
L Consideration should be given to the fact that the Bighorn
Terace unjts were annexed subsequent to their original des'ign
and construction. This proposed modest alteratjon for which
we are applying is very much within the original design
intent of the unit (witness al'l the sjmilar modifications
of other units). Some "grandfather" privi'leges or logic
must surely app'ly in this situatjon.
J. The proposed changes are the first and on'ly modifications
of this unit.
I can ful'ly appreciate the problems the Cormission has in containing and
controlling developnent of the City of Vail. Nevertheless, I feel
strong'ly, for the reasons stated above, that approval of this application
wou1 d be most reasonable and proper.
I note on the application reference to the setback variance. In our
discussion last week I understood this to be a subsequent and separate
process. There seems to be no reason, however, why this letter and
attached drawings cannot also serve as our application for the variance.
As such I would like to request that this also constitute the infonnation
necessary for that application. If this isn't acceptable or sufficient'
please let me know what else is required.
