If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works) review and approval,
a Planning Department review or Health Department review, and a review by the Building Department, the
estimated time for a total review will take as long as three (3) weeks.
All commercial (large or small) and all multi-family permits will have to follow the above mentioned maximum
requirements. Residential and small projects should take a lesser amount of time. However, if residential or
smaller projects impact the various above mentioned departments with regard to necessary review, these
projects may also take three (3) weeks to review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

Amendment to the 2002 N.E.C. Town of Vail Ordinance 4, Series of 2005
Overhead services are not allowed in the Town of Vail.
Underground services shall be in conduit (PVC) from the utility transformer to the electric meter, main
disconnect switch, and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall be readily accessible, andlocated next to the meter on the exterior wall of
the structure. All underground conduits are required to be inspected before back-filling the trench.
In mulU-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
wafls and spaces are exempt
NM Cable (Romex) can h ured only in single and mufti-family dwelllngs net ex@eding 3 stories.
Typ IIM cannot be ad in any building mixed with fype $B,EEH,I,M &5 occupancies.
Aluminam anduttorcsmaller than size #8 are not permitted with the Town of Vail.
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of e)derior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and veriry that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multFfamily building with a homeowners association, a letter of permission
from the association is required.
If this permit is for a commercial space, two (2) sets of stamped drawings are required. Eledrial
one-line and panel schedules are required if load is added or distribution is altered.

To whom it may concern:
The purpose of this letter is to convey the approval of the lnterlochen Condominium Association
Board of Directors (the "Board") for Pat and Carol Dowling (the "Owners") to undertake certain
refurbishments to their condominium, Interlochen Unit 8-6 (the "Unif'). Specifically, the Dowling's
have the Board's authorization to replace the current 33-year-old windows and sky light in the
same identical size, style, and exterior color as present, so as to maintain the aesthetic integrity
of the complex. The Dowling's further have approval to proceed with other proposed renovations
as set forth in the drawings they provided to the Board for its September 23, 2006 meeting.
No structural changes to the Unit are to be made without further consent of the Board.
Construction debris will be handled via existing on-site dumpsters managed by the HOA, in
accordance with Interlochen Homeowner's Association policies.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Enginee/s (Public Works)
review and approval, a Planning Department review or Health Department review, and a
review by the Building Depaftment, the estimated time for a total review may take up to
six (6) weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser
amount of time. However, if residential or smaller projects impact the various above
mentoned depaftmenb with regard to necessary review, these projects may take up to
six (6) weeks to review and approve.

We were notified that some remodeling had been completed in this unit, and the following items were verbally
relayed to us by Paul Chapman in addition to supplemental sections, dimensions, and pictures of these areas.
The existing loft was added on to with a strip of floor approximately 3 -7" wide. This floor consists of 2x6 joists
spaced 16" on center and hangs on a 2x6 rim with pre-manufactured hangers. The rim is supported by vertical
2x4 tension studs spaced at 16" on center, which hang from the roof timber beam (approximately 6x18). These
2x4's are attached to the rim and the timber beam with 1/4" diamter lag screws. The 2x6 floor rim on the other
end of the joists is aftached to the cantilevered2ll2" decking with 1/4" lag screws as well.
A beam was replaced next to the stairuell spanning approximately g'€" and supports a floor purlin and the
staimay header. The replacement beam consists of a (2)-2x12 beam.
Although we were not able to view the items listed above during construction and the loft is now drywalled, the
framing members and connections indicated above are structurally adequate to support the design loads
imposed.
Also, we were informed that an egress window will be added at one end of the loft between the roof purlins. The
top of the window opening shall be no closer than 12" to the ceiling at any point (assuming the window is not in
line with any roof purlins).

I disagree in part with her letter, as I believe it is misleading and not ."\'-t.A;
factual.
Please be advised of the following:
l. I CONFIRM, with the exception oJ"the egress window, the renovation
pro.iect which is the sub.iect of my application for building permit was not reviewed or
approved by the Board of Directors of the Interlochen Condominium Association. This is
because it was from the outset, and continues to be, my trelief that, with the exception of
the new window, none of the renovations require approval of the Board of Directors. Our
bylaws only require a prior approv al of "structursl modifications or alterations ". None
of my renovations involve General Common Elements, nor modifrcation of any structural
element of this building. 'fhe window penetrates an exterior wall, which is not a structural
wall, although it is a General Common Element.
2. My renovations began on or before August 13. At least 4, but possibly all
5, of our directors were aware of the renovations from the outset (2 of them, including
Ms. Needham and Mr Sellers, walk past my door in getting to their units !). Furthermore,
there was a formal board meeting on August 21, at which all Board Members were
present, plus the 2 local residents hired as our new managers. The subject ofmy
renovation was not on the agenda, and was not even raised by anyone before, during or
after the Meeting. I believe that was entirely in keeping with the Association's historical
lack of interest in interior renovations ofany sort, apparently even including replacement
of exterior windows and doon. To emphasize the depth of lack of interest, a number of
such replacements now in place may violate our own written rules (and perhaps DRB
guidelines for conformity within a project) requiring the exterior windows and doors and
their trim to be painted black (now, windows /doors may also be vamished natural wood).

To my knowledge, the Board/Association has not even written any letters to request
remcdy by the offending owners.
3. I was also not aware that certain aspocts of my renovations (as they
progressed, the work expanded) crme to be in violation of the requirement for a building
permit. As a consequence, my project came to be red-tagged on 8129/05. At that point, I
immediately visited the Building Department, discussed the project, and began the
process of satisling the pre-filing requirements to obtain a permit. During my meeting
with Mr Suther, he strongly suggested ( which I took to mean a polite way of saying it
would be required) that I also apply for the installation of an egress window in my loft for
safety reasons. I entirely agree with his suggestion ! My loft ( the A building, the first of
the complex, was built in 1970 or so) is the ONLY loft touching an exterior wall in the
entire project without such a window. If an egress window is installed, I may have the
ONLY current-code-conforming egress window in a loft in the entire complex. In facl
many of the existing windows in bedrooms throughout the complex do not conform with
current code either, but that is another matter.
4. AT TTIIS POINT, I was firlly aware of the necessity of obtaining Board
Approval for the window in the exterior wall, as requircd by DRB regulation, if not by the
limited provisions of our own bylaws. (A window in a nonJoadbearing wall might not be
a struclurol modification). To that end on September 2, I emailed a request to each of
the Board Members to seek their approval of the egress window, a procedure in
conformity with our Board's agreed (albeit not written) procedures for consultation wilh
each other between formal Board Meetings. After discussion with and approval of the
window by, Ms Needham and Ms l^ane, Ms lame, our duly elected Secretary of the
Association, wrote the letter, having the approval of 3 (the 3'o being my S. Kaemmerlen
Living frust which holds a seat on the Board) of 5 Board Members, confimring approval
of the window installation which I submitted to the DRB and subsequently with my
application. The other 2 Board Members received my email but did not respond to me --
although Mr Sellers stated to Ms Needham that he had no problem with the window. The
5b Board Membcr to my knowledge only responded Oct 14, after the fact. Accordingly,
the lettcr from the Association Sccretary Liz Lane, Esq., dated Sept 6 appears to have
been validly issued in good faith with appropriate support of a majority of the Board
Members, infact with the support by Ms Needham, the Vice President of the Associution.
I therefore request that my application be given due consideration in the time
sequence of it's submittal.

Interlochen - request for information
Dear Mr Davis:
As your Department knows, I have submitted an application for a building
permit to the Building Department regarding renovation work in my unit A-2 at
Interlochen Condominiums.
You presently have that application on hold pending a letter from the
Association (Board) giving their consent to our application.
In our meetings with Joe Suther regarding the various requirements to be
met, he has stated that TOV requires a current-code compliant egress windovv to
be installed in the loft exterior wall in order to approve the application
for any work to the loft, including replacement of the weak and non-compliant
railing (which we have already replaced with a partial wall of sheet rock).
We are entirely in agreement with the TOV to install the egress window, both
as a safety issue, and because the A building was originally built (1971 )
with no window in the lofts at all. All subsequent buildings and lofts in the
complex were built with windows in their lofts (10 in B building, and 4 each
in C and D buildings, 18 in total). As far as we know, all the lofts in all
the buildings have been used for sleeping at one time or another.
We are currently working with the Association to obtain approval for our
renovations including the egress window. We are having a Board meeting Nov 12
on which the subject is on the agenda. However, because there is no
definitive literature (no TOV hand outs), we are having some difficulty in getting
the message across (and being believed without supporting documentation) that
a) the TOV requires the window
b) the current building code requires it ( we do have your copy of the code
specifications for a window itself)
c) just replacing the old railing with a code compliant railing ( or, our
choice, sheet rock partial wall) in the loft would require a building permit,
which in turn requires the window to be installed
d) removing our partial wall and replacing it with a railing - even the
original railing ( which now does not exist) would not remove the necessity for
an egress window.
e) merely replacing an existing exterior window or sliding door requires a
building permit.
Accordingly, I request an explanatory email or fax (203454-5741) from the
Building Department to this effect: a) b) c) d) e) above are all required.
Perhaps the most simple end effective reply would be to copy this email in
it's entirety and send it back to me with your comment in BOLD/RED such as :
I CONFIRM A B C D E of your email are required by TOV.

I have received your email> listed below are the responses to your

A) "the TOV Requires The Window" lf the loft area in question is used
for sleeping purposes and is located below the 4th story of the building
the 2003 International Building Code (lBC) requires a window to be
installed in that room that has direct access to the exterior intended
for use as an emergency escape and rescue opening. This can be found in
the 2003 lBC, Section 1025.1 states: "ln addition to the means of egress
system required by this chapter, provisions shall be made for emergency
escape and rescue in Group R applicable in Section 101.2 and in Group
l-1 occupancies. Basements and sleeping rooms below the fourth story
above grade shall have at least one exterior emergency egress and rescue
opening in accordance to this section." Section 1 01 .2 is defining
whether or not the unit located in the Interlocken Condo building is
regulated by the lBC. There are more than three units in this building,
this is considered an R-2 occupancy and is then regulated by the lBC.
It's not the Town that requires the window but the code in which we have
adopted requires the window in this area if used for sleeping purposes.
I believe you are eluding to the fact that the existing situation and
space does not have a window that can be used for emergency escape and
rescue. lt may have been that when the original construction of the
Interlocken Building was completed, these lofts may not have been
identified or used for sleeping purposes. Now that we have discovered
this the 2003 lBC, Section 3403.1 "Existing Buildings or Structures"
must be employed lo provide some guidance. This section states"
Additions or alterations of a building or structure shall conform with
requirements of this code for new construclion. Additions or alterations
shall not be made which will cause the existing building or structure to
be in violation of any provisions of this code. ..." Again the code is
requiring lhis window and the Town is under legal obligation to enforce
the code.
B)"The Current Building Code Requires it" See Response to ltem A.
C) " just replacing the old railing with a code compliant railing ( or,
our
choice, sheet rock partial wall) in the loft would require a building
permit,
which in turn requires the window to be installed" Yes, again see
response in item A

an egress window." Again, yes, once we discover a code violation we
must act upon that discovery and require the minimum code compliance in
accordance the 2003 lBC. Again see the response to item A.
E) "merely replacing an existing exterior windot or sliding door
requlres a
building permit." The answer is yes. This is supported by the 2003 lBC,
Section 105.2," Work Exempt form permit." this section has a list of
specific work that is exempt from obtaining a building permit. That list
ts:
1 ) One story detached accessory structures used as tool and storage
sheds, playhouses and similar uses, provided that the floor area does
not exceed 120 square feet.
2) Fences not over 6 feet high.
3) Oil denicks.
4) Retaining walls....
5) Water tanks....
6) Sidewalks and drivewa)E not more than 30 inches above grade and not
over any story or basement.
7) Painting, papering, tiling, carpeting, cabinets, counter tops, and
similar finish work.
8) Temporary motion picture, television and theater stages...
9) Prefabricated swimming pools accessory to Group R3 occupancies....
10) Shade cloth structures constructed for nursery operations...
1 1) Swings and other playground equipment...
12) Window awnings supported by an exterior wall...,
13) Movable cases, counters and partitions not over 5'9" in height.
As you may notice, window replacements and sliding glass doors etc..
are not mentioned on this list. That is how we got to the requirement.
I hope this answers your questions. We are still waiting for the Condo
Association approval, I hope that this explanation above helps you in
your attempts.

As your Department knows, I have submitted an application for a
building
permit to the Building Department regarding renovation work in my unit
A-2al
Interlochen Condominiums.
You presently have that application on hold pending a letter from the
Association (Board) giving their consent to our application.
ln our meetings with Joe Suther regarding the various requirements to
be
met, he has stated that TOV requires a curentcode compliant egress

We are entirely in agreement with the TOV to install the egress
window. both
as a safety issue, and because the A building was originally built

with no window in the lofts at all. All subsequent buildings and
lofts in the
complex were built with windows in their lofts (10 in B building, and
4 each
in C and D buildings, 18 in total). As far as we know, all the lofts
in all
the buildings have been used for sleeping at one time or another.
We are cunently working with the Association to obtain approval for
our
renovations including the egress windon/. We are having a Board meeting
Nov 12
on which the subject is on the agenda. However, because there is no
definitive literature (no TOV hand outs), we are having some
difficulty in getting
the message across (and being believed without supporting
documentation) that
a) the TOV requires the window
b) the curent building code requires it ( we do have your copy of the
code
specifications for a window itself)
c) just replacing the old railing with a code compliant railing ( or,
our
choice, sheet rock partial wall) in the lofr would require a building
permit,
which in turn requires the window to be installed
d) removing our partial wall and replacing it with a railing - even
the

was red tagged today for working without permits. They have enclosed the loft area as well as extended it out about 3 feet.
There are new can lights and new wiring. I did not go up into the loft as I didn't think the extension looked very safe. There is
also a new beam (removed a wall?) along the left side of the lower lwel stairway.
The bathroom downstairs has been redone but I could not tell if anything was done that was not cosmetic, Kitchen also (neur
cabinets, countertops, etc).

I have received your letter and a couple more from other Board members. I spoke with the Town Attorney about this and we
will hold up the building permit until they get a different association sign off letter. I believe that Art A. (attorney hired by the
HOA) is also supposed to be drafting a letter officially asking us to withhold the permit until this is straightened out. The owner
of the unit happened to come in to check on the progress of the permit and was advised that it was on hold and that she
needed to contact the Board to straighten this out. Warren Campbell, the Planner on the window addition has gone back into
the system and denied the approval as he was unaware of the scope of interior changes and wanted to speak with another
Pfanner (Elisabeth) as she had spoken with the owners regarding the interior changes. It is possible that no interior changes are
truly "structural" in nature but they must now get the HOA to sign off on the entire job. Thanks for your patience and please

I have received your email and the faxed correspondence that is associated with the email. Upon review
of the latest information, it appears that you are actively pursuing the Condo Association approval for your
project.
At this time, I am still unable to release your permit until we receive a lefter of approval from the Condo
Association board. The letter must be on the Association letterhead and signed by the board president
stating that your project is approved for construction. The latest correspondence only states conditions in
which the approval will be granted.

Dear Mr. Davis,
I sending to you by fax copy of a letter I received December 5 from
Interlochen's President Teresa Day. Her letter says that if I vacate my seat on the
Board and refrain from seeking a Board position for two years, then they will
send a letter of approval, etc. This seems like blackmail to me, but I
certainly don't represent myself as an attorney.
Nevertheless, is not President Teresa Day therefore saying in her letter
that the renovations really are okay with the Board? That is, her issue is not
the renovations/window of A2, but rather her issue is that I satisfy the
punitive demands in her letter in order to win approval.
Will you please consider Ms. Day's letter as the needed letter of approval
from the Board??
lf not, please note, that even if I agree to the conditions in the letter,
Teresa Day states that lwould only get the approval lefter "immediately after
a telephone confirmation call with all board members." At our November 12

A meeting in December, even by phone, will not be possible for at least
three of the five board members. Since we have received a letter from a lawyer
regarding the main issues to be resolved (the elegibility of Fred Sellers to
vote as a board member and the A2 window), unfortuantely the lawyers will now
have to resolve the matter.
On the subject of lawyers, neither Ross Davis, Jr., my counsel, nor our
Secretary Liz Lane, nor I have received notice of appointment of attorney by the
Association, or stated correspondence, or opinion re Fred Seller's status,
and so forth. While a Director, I have been inappropriately excluded from much
correspondence, as has our Board Secretary Liz Lane, who also specifically
requested the aforementioned information by e-mail on November 30, but
received nothing.
(l don't know what "lawyer" Ms. Day is referring to in her letter, but if
the lawyer is Mr. Alpenlof, Fred Seller's lawyer, he is a very inappropriate
choice.)

Charlie Davis - Re: A-2 lnterlochen.
I simply do not know what to do. Within the past few years, at least 10
Interlochen owners have made imorovements in their units which lacked the
necessary Board approval. lt's clear that I am being unfairly targeted. Paul
Chapman and I have pushed for safety improvements for everyone in the complex,
and while it appears that a very few members prefer to have things rot, this is
certainly not the case with majority of all residents, who have expressed in
writing their support for my unit's safety egress window required by code.
While dealing with the aforementioned Board members is a humongous pain in
the neck, I do not want to give up my Board directorship, because I feel it is
my duty and responsibility to represent the owners who elected me. These
owners do not want to shoulder the burden of a lawsuit caused by inesponsible
(or lack of) action re safety on the part of the Board.
In reviewing Interlochen's finances, this association does not have money to
sue or engage i;r a lawsuit. In fact, I don't know how Interlochen will get
through the winter without their tapping their small emergency reserve fund,
and that would be in violation of the new CO law 05-100. Already in my
opinion (and I believe Liz Lane would stand beside me on this), the other three
members on this Board have violated and continue to violate several rules
regarding condominium directorship.
Please consider the issues involved.
Please help me, or if you really feel that your hands are tied, please
advise me as to what you would do.

I am the owner of Unit C-8 and would like to briefly comment on the request
to have Susan resign from the Board of Directors in exchange for
"permission" to have changes made to her Unit, as well as requesting this
apology before "permission" is given.
It appears that the changes made to 42 were reasonable, will be done to
code, and will benefit Interlochen as a whole by renovating and upgrading
this unit, and that the board is willing to give permission afier a review
of these renovations.
I find it offensive, unrelated, and irrelevant and totally without merit to
tie-in this request for Susan to resign from the Board in exchange for a
letter from the Board to comolete renovations to Unit 42.
lfeel that we should consider ourselves fortunate to have good people on
our Board who are willing to help Interlochen in positive, productive ways,
and it would be a loss to the Association to force
Susan & Paul (Trust) to resign.
Please give permission for the appropriate renovations and retract this
ridiculous request to resign.

I write you with a concern regarding the on going controversy about the 'window' issue in the A Bldg of the
lnterlochen Condominium complex.
My name is John Thomas, and I have been a resident of Interlochen since 1975.
Since the matter of modifying the exterior of the A bldg with a windo4 which is directly across from my
unit, D-4, I have been determinedly opposed to any such modification. Fortunately, our Board has recently
gone on record as being against any such approval of a window in the A Bldg.
It is apparent that the owners have recently seen fit to allow residency in the unit in question, and it has
been my understanding that any occupancy was not appropriate until the Interlochen board gave approval
to the'windovt/. lt would appear that the unit is being occupied, and thd owners have'refused'to abide by
the decision of your office[ no occupancy until safe] and have chosen to ignore the denial of the window by

To the President of the Board of Interlochen, to the Board Members and to
Susan Skaemmerle:
I am the owner of Unit C-8 and would like to briefly comment on the request
to have Susan resign from the Board of Directors in exchange for
"permission" to have changes made to her Unit, as well as requesting this
apology before "permission" is given.
It appears that the changes made to A2 were reasonable, will be done to
code, and will benefit Interlochen as a whole by renovating and upgrading
this unit, and that the board is willing to give permission after a review
of these renovations.
I find it offensive, unrelated, and irrelevant and totally without merit to
tie-in this request for Susan to resign from the Board in exchange for a
letter from the Board to complete renovations to Unit A2.
I feel that we should consider ourselves fortunate to have good people on
our Board who are willing to help Interlochen in positive, productive ways,
and it would be a loss to the Association to force
Susan & Paul (Trust) to resign.
Please give permission for the appropriate renovations and retract this
ridiculous request to resign.
