quality topsoil mix of a type and
amount recommended by the Ameri-
can Landscape Contractor Association
and the Colorado Nurseryman's Asso-
ciation.

Fences And Walls:
1. The placement of walls and lences
shall respect existing land forms and
tlt into land massing rather than arbi-
trarily follow site boundary lines.
Fences shall not be encouraged ex'
cept to screen trash areas, utilltY
equipment, etc.
2. Design ol fences, walls, and other
structural landscape features shall be
of materials compatible with the slte
and the materials of the structures on
the site. Retaining walls and cribbing
should utilize natural materials such
as wood timbers, logs, rocks, or tex-
tured, color tinted concrete. No chain
link fences shall be allowed except as
temporary construction fences or as
required lor recrsational facilities.
3. The allowable heights of retaining
walls shall be as stated in Section
12-14-2 oi this Title.
Accessory Structures; Utilities; Ser-
vice Areas:
1. Design of accessory structures
upon a site shall be compatible with

2. Accessory buildings generallY
should be attached to the main build-
ing either directly or bY means of a
continuous wall, fence or similar lea-
ture of the same or a complementary

installed underground. Any utility sys-
tem the operation of which requires
aboveground installation shall be
located andlor scrEened so as not to
detract from the overall site design
quality.
4. All utility moters shall be enclosed
or screened from public view.
5. Service areas, outdoor storage, and
garbage storage shall be screened
from adjacent properties, structures,

C. Applicants who fail to appear before the Design Review Board on their scheduLed meeting date and who have not asked in advance that discussi_on on their item be post.poned, will have their itens removed from the DRB docket until such time as the item has been republished.
D. The following items may, at the discretion of the zoning administrator, be approved by the Community Development Department staff (i.e. a formal hearinq before the DRB may not be requi_red):
a. Windows, skylight.s and similar ext.erior changes which do not alter the existi-ng plane of the building,' and
b. Building addition proposals not vi_sib1e from any other lot or public space. At the time such a proposal is submit.ted, appl_icants must incLude ]ett,ers from adjacent property owners and/or from the agent for or manager of any adjacent
condominium association stating the association approves of the addition.
E. If a property is located in a mapped hazard area (i.e.
snow avalanche, rockfall, flood plain, debris fIow,wetland, etc), a hazard sLudy must be submitted. and the owner nust sign an affidavit recognizing the hazard report prior. to the issuance of a building permit.Applicants are encouraged to check with a T-own planner

The applicant is proposing to build a deck around his unit at
the Bellflower Condorniniurns which were built under county
regulations. The existing building encroaches 9 fee!;199
th; 50 foot stream setback on the north side and 7 ' 5 fEEt
into the east side setbagk, making an addition of a deck
irnpossi-ble wi.thout iequesting a variance.
The proposed deck would be adjacent to the first floor level
of ti.re unit. The deck wraps around the northwest (rear) and
east (side) of the unit. Because of the steep bank on-t4e
north'or creekside of the unit, the deck is more than 5 feet
from the ground. Decks that are at a level of 5 feet or
higher above the ground may only encroach 5 feet into any

Dear Mr. Reid:
This letter is to confirm that on July 13, 1982, I discovered site
work being performed on Lot 2, Block 6, Vail Intermountain, which
consisted of the depositing of fill materia'l along the stream bank
of Gore Creek and the destroying of the vegetation in the area. This
area is located w'ithin the 100 year flood plain as defjned by the Gore
Creek Flood Plain Infomation Report, June, 1975.
It is a violation of Sectjon 18.69.040, E, of the Town of Vail Municipal
Code for any person desiring to modify the flood plain by fill,
construction, channelizatjon, grading, or other similar changes to not
receive an approval of the Zoning Administrator. The Zoning Administrator
may require an environmental impact statement to establish that the
work wJ'l I not adversely affect adjacent properties, or increase the
quantity or velocity of flood waters. I will require that before any
,work on Lot 2, Block 6, Intermountain, is resumed the following be
/submitted and approved:t v-.l) An improvement survey at a scale of one inch equals twenty feet or'larger completed and stamped by a Co'l orado Licensed Surveyor including
the fo1 lowing information:a. Al 1 property pins are to be either found or set and stated
on map;b. Basis of bearing to tie to section corner;c. All easements;d. Locati on and extent of 'l imi ts of 100 year f'l ood;- e. Location of centerljne of Gore Creek and edge of Gore Creek;f. Location of area disturbed with contour intervals of not
more than two feet.
2) A topographical survey of the lot prior to disturbance (if possible).
3) A plan for what you intend to do including:a. A site p'l an with contours showing finished grades, any

retaining structures or other site improvements including a landscape p1 an designating existing vegetation to be saved
and those to be lost, and designating sizes, quantities, and
species to be planted;b. A technical study comp'leted by a registered Co1orado
engineer qualified to conduct f1 ood plain studies indicating
whether the proposed work withjn the 100 year flood plain will adversely affect adjacent properties, or increase the velocity of the flood waters.
