Mr. Cahill,
This letter is being sent to inform you of my findings regarding the proposed garage at 2963
Bellflower Drive. After reviewing the file I found that this property has had a variance granted
previously in October of 1992. That variance was for density and setbacks to allow for an
addition to the home. As you are aware many of the lots in the Intermountain area do not meet
the minimum requirements of the current Town of Vail Zoning Code as many were platted and
constructed under Eagle County review prior to annexation. Several of the lots in the area
have received variances in the past as it has been found that there were hardships which
others in the same zoning district were not subject to.
Your specilic proposal, should you choose to proceed, would require a variance application for
front ahd side yard variances and a Design Review Board application. With the information
provided I cannot state that your proposal would meet the criteria for approval of a variance for
both the front and rear setback. I do feel that other options may exist such as shifting the
garage to the east on the lot to be located in the current parking area. On the phone you
expressed concern about that location as it may block the sunlight which reaches the house
currently. Although that is a valid concern it does not necessarily preclude that from being a
better option which would require less deviation from the requirements of the Code.

Jeff Bowen pointed out that the Master Plan should be revievved and usad as the basis
for this review.
Greg Amsden stiated that he would also like the building 'lined o-ut'for a period o1
appio*imatefy two weeks and to let the public visualize it as well. He also stated that
hb would like to see the flat elevations of the building.
Diana Donovan was concemed with the re-zoning of Tract E. She also had concems
with tha mass of the building as proposed.
The general consensus by the Board was that there was concem with the height' mass
and Sutk of the building airc tnat the accurate staking of the building, for the site visit
November 23, will be necessary.

the applicant has an amendment to the landscaping and driveway area which

Hans Vlaar presented his conceptual revision to the driveway area using more grass
and less paving or incorporating grass pavers (Grasscrete)'
Dalton williams suggested that the Grasscrete concept was acceptable to him and that

Diana Donovan stated that she would like the pavement reduced and that the applicant
should work with Public Works on the driveway entry. Diana also stated that she
would like to see a documented plan of what's on sits. She also stated that the
planting inventory should include hearty shrubs in the planter and small spruce
else$/here.
Jeff Bowen motioned to approve the request per the memo, per the applicant'g
submittal, and the suggestibns from the Board, with Chuck Crist seconding he motion.
The Planning and Environmentral Commission voted 6-0 unanimously to approve the
request. The approved landscape plan consisted of a 2.5' x 12" L-shaped, raised
planting box at he northwest corner of the parking area. This area w1]l receive a
ininimu-m of four handy shrubs (dogwood, potentilla or mugho pine.) The area south of
the house will be completely reseeded with a native grass seed mix, except tor th€
grasscrete strips. Three hardy shrubs (5 gallon minimum) and one 6' spruce will be
planted between the house and the northsrn most grasscrete sfip.

Susan Scanlan
Susan Scanlan and Russ Forrest presented the proposed brochure to the Planning
and Environmental Commission members. Susan explained lhe purpose of the
brochure and where and when it will be distributed'
General discussion regarding the material the brochure should be made ol, the colors'
the footnotes, and the wording resulted in a few word changes suggested by the
Board.
Jeff Bowen stated that he was in favor of the brochure and to "go for it."
Dalton Williams stated that he felt that the first paragraph on the second page was too
technical and should not explain an inversion. Kristan Pritz stated that she did not feel
it was too technical and that the inversion explanation should remain. Russ Fonest
stated that he felt the public should understand why the inversion happens and what it
means. Dalton then agreed that perhaps it is not too technical. Greg Amsden added
that he liked the technical application of the brochure and that it is important that
people know why our climate is prone to inversion.

This letter is to serve as a reminder that staff is awaiting a substitute trim color from the
proposed "Velvet White". On October 2,2002 the Design Review Board reviewed your
application in your absence and tabled it to a later meeting pending a substitute trim
color. At that meeting the Board stated that the proposed wall color, "Sandstone", and
the proposed facia color, "Brown Acorn", were acceptable. The Board stated that a
warmer color should be chosen to replace the proposed "Velvet White". Please select a
substitute trim color and submit it to staff. Please submit a color no later than November
18, 2002 in order to be placed on the November 20 Design Review Board agenda for
review.

Commission (PEC) meeting at which your variance requests were approved. The Attached
copy of the meeting minutes will serve as your record of the conditions of approval.
Please note that the approval of this variance shall lapse and become void if a building permit
is not obtained and construction not commenced and diligently pursued toward completion, or
it the use lor which the permit is granted has not commenced within two years from approval

Jeff Bowen pointed out that the Master Plan should be reviewed and used as the basis
lor this review.
Greg Amsden stated that he would also like the building "lined out' for a period of
approximately two weeks and to let the public visualize it as well. He also stated that
he would like to see the flat elevations of the building.
Diana Donovan was concerned with the re-zoning of Tract E. She also had concerns
with the mass of the building as proposed,
The general consensus by the Board was that there was concern with the height, mass
and bulk of the building and that the accurate staking of the building, for the site visit
November 23, will be necessary.

Hans Vlaar presented his conceptual revision to the driveway area using more grass
and less paving or incorporating grass pavers (Grasscrete).
Dalton Williams suggested that the Grasscrete concept was acceptable to him and that
it was a good idea.

Diana Donovan stated that she would like the pavement reduced and that the applicant
should work with Public Works on the driveway entry. Diana also stated that she
would like to see a documented plan of what's on site. She also stated that the
planting inventory should include hearty shrubs in the planter and small spruce
elsewhere.
Jefl Bowen motioned to approve the request per the memo, per the applicant's
submittal, and the suggestions from the Board, with Chuck Crist seconding the motion.
The Planning and Environmental Commission voted 6-0 unanimously to approve the
request. The approved landscape plan consisted of a 2.5' x 12', L-shaped, raised
planting box at the northwest corner of the parking area. This area will receive a
minimum of four handy shrubs (dogwood, potentilla or mugho pine.) The area south of
the house will be completely reseeded with a native grass seed mix, except for the
grasscrete strips. Three hardy shrubs (5 gallon minimum) and one 6' spruce will be
planted between lhe house and the northern most grasscrete strip.
4. Beview of Air Quality Brochure for lodges in Eagle County.

Susan Scanlan and Russ Forrest presented the proposed brochure to the Planning
and Environmental Commission members. Susan explained the purpose of the
brochure and where and when it will be distributed.
General discussion regarding the material the brochure should be made of, the colors,
the footnotes, and the wording resulted in a few word changes suggested by the
Board.
Jeff Bowen stated that he was in favor of the brochure and to "go for it.'
Dalton Williams stated that he felt that the first paragraph on the second page was too
technical and should not explain an inversion. Kristan Pritz stated that she did not feel
it was too technical and that lhe inversion explanation should remain. Russ Forrest
stated that he felt the public should understand why the inversion happens and what it
means. Dalton then agreed that perhaps it is not too technical. Greg Amsden added
that he liked the technical application of the brochure and that it is important that
people know why our climate is prone to inversion.

DESCRIPTION OF PROJECT AND REQUESTED VARIANCES
The applicants, Hans and Mia Vlaar, are requesting density and setback variances to allow for
a proposed addition on the east side of the building located on Lot 7, Block 6, Vail
Intermountain. The lot is zoned Primary/Secondary Residential and has an existing "over-'under" duplex on it. The Vlaars own both haives of the duplex. The proposed addition to
the lower unit involves enclosing approximately 90 square feet of area on the first floor,
where the enEance stairs are curently located. This area will be used as a walk-in closer for
the eastern most bedroom and as a storage area that is accessible from the units entryway. A
new stairway will be constructed from the parking area to rhe lower level unit. Improvements
to the upper level unit are located directly above the lower level walk in closet and storage
area. These improvements include a new deck/entry and bay window adjacent to thc master
bedroom and a new enclosed entryway (airlock). The total square footage of the proposed
improvements to this level is 79. In conjunction with the proposed building addition
described above, the Vlaars are also proposing to pave their driveway and parking area, reroof
the building and replace the existing retaining walls around the house and parking plaform.

DENSITY VARIANCE
Section 18.64.050 (B) of the Vail Tnning Code, states that "structures which do not conform
to density controls may be enlarged, only if the total gross residential floor area of the
enlarged structure does not exceed the total gross residential floor area of the pre-existing,
non-conforming structue." This duplex does not conform to density controls because the lot*
on which it is located is less than 15,000 square feet. Although the lot has additional GRFA
which could be used, the number of dwelling units on the site (2) exceed what the culrent
code allows. The code only allows two units on a lot less than 15,000 square feet, if the
secondary unit is restricted for employee housing.
In May of 1976, Eagle County issued a building permit for the construction of this duplex.
In November of 1983, the Town of Vail approved a duplex subdivision plat for this property
thereby creating two separate pieces of property. The Vlaars purchased both halves of the
duplex in 1990 with the intention of living in the upper level unit and renting out the lower
level unit. The ownership situation is considered a legal non-conforming use.
Because the applicant's do not wish to deed restrict either of the units in this duplex, a
variance from the non-conforming section of the code is needed to allow for the use of
the remaining GRFA.
SETBACK VARIANCE
The Primary/Secondary Residential Zone District requires a minimum front setback of 20 feet
and a side setback of 15 feet from their respective property lines. The existing building on
the site currently encroaches approximately 9 feet into the front setback area. In addition, a
second story deck, a retaining wall and a stairway leading to the lower level unit also
encroach into the front setback area. Encroachments into the side setbacks include retaining
walls, portions of the west side of the building and a portion of the frst floor deck on the
east side of the lot. The applicant's proposed addition would encroach into the front
setback approximately 14 feet, which would leave a 6-foot setback. A l4-foot setback
variance is requested.

Upon review of Criteria and Findings, Section 18.62.060 of the Vail Municipal Code,
the Community Development Department rccommends approval of the requested
variances based on the following factors:

There is an overwhelrning amounL of unscreened storage of rafting equipment, as well as conmercial vehicles on the property across the stream from our home. The storage of this equipment started last year and has continued to increase.
It is my inpression that our neighbors are running a commercial enterprise out of their home in noncornpliance with the terms of a home occupancy pernit.
We have one of the few, if not the only, year-round owner occupied residences in the area, so I would assume that you have not had many other complaints to date even though the volume of exterior storage has increased sig-nificantly.

REQUIREMENTS
The Planning and Environmental Commission meets on the
2nd and 4th Mondays of each month. A cornplete

described above) must be submitted a minimum of four (4) weeks prior to the date of the PEC public hearing.
No incomplete applications (as determined by the zoning
administrator) will be accepted by the planning staff
before or after the designated submittal date.

The variance application requests reconsideration of the Town of vail section 18.L8.060 regarding mininum front setbacl<s. The existing non-conforming residence etas built according to Eagle
county standards. Following annexation and Town of VaiI front
setback regulations, the residence became non-conforming. It is for this reason that front setback variance is always reguired for
any nodifisations to the Vlaar residence.
The request for front setbagk encroachrnents is to accommodate a dormer roof on east elevation. The roof height and GRFA is
proposed to rernain the sane. The intention is to atter last pitch
of the existing roof, greatly reducing the risk of snow and ice buildup and subsequent avalanching off of the roof onto the
stairway below. The lower stairway becomes treacherous in Winter
due to the constant sloughing of snow directS.y onto the stairway.Stairway will be renoved and nevr stairway built in front of
retaining wall facing creek, a more protected area not in avalanche
danger.
The request also includes an enhancement to the existing entry upstairs through the addition of an airlock. The airlock will narkedly improve the heat efficiency in the upper unit, will provide added storage in the front entry, and will inprove the
appearance of the home frorn the roadside.
The request also Lncludes replacen€nt of the existing railroad-tie retaining wall with an irnproved, permanent solid concrete wall.
The current wal1 is in need of najor repair and a strongetr, uore
durable structure wlll reduce rnaintenance and better protect the
dwelling units.
Because the existing building footprint wiIl not be siqnificantly
expanded, the variance will have no slgnif,icant inpact upon other existing or potential uses and structures in the irnnediate area.
The existing Interurountain area has lot configurations which na*e it alnost inpossible to nodlfy the units without requiring
varlanceB.In fact, the existing units already encroach significantly lnto the reguired front setbacks.These
encroachments are due to the fact that the lots are very shallow.
We believe that there are extraordinary circumstances due to the original Iot layouts and that approval of the variance request
would not be a grant of special privilege. Internountain homes
have received similar setback varianees for rernodels.
The effect of the variance on light and air, distribution of population, transportation, traffic facilities, utilities, and public safety is negligible to the adjacent properties.
Ladies and gentlenen, we have owned this home for two years and take great pride in inprovinq its appearance and efficiency, to
make it a special- part of a neighborhood we love. we have added insulation, replaced a leaky roof, and painted the exterior of the
horne. The proposed upgrades also improve the safety of our lrorne for our son and our tenants. The requested variance would allow ug to significantly enhance the appearance of the house from the
roadside, while improving energry efficiency and adding much needed storage for both ourselves and our tenants. we respectfully request that the variance be granted swiftly as the lfinter

2- An improvement location survey showing the limits of your existing parking area

III. TMPORTANT NOTICE REGARDTNG ALL SUBMISSIONS TO THE DRB:
A. In addition to meeting submittal requirements, the applicant nust stake and tape the project site to indicate property lines, building lines and building corners. Alt trees to be rernoved must be taped. AII site tapings and staking must be conpleted prior to the
DRB site visit. The applicant must ensure that staking
done during the winter is not buried by snow.
B. The review process for NEW BUfLDINGS normally requires two separate meetings of the Design Review Board: a conceptual approval and a final approval . Applicants should plan on presenting their development proposal at a minimum of two meetings before obtaining final
approval .
C. Applicants who fail to appear before the Design Review
Board on their scheduled neeting date and who have not asked in advance t,hat discussion on their item be postponed, will have their items removed from the DRB docket until such tirne as the itern has been republished.
D. The following items may, at the discretion of the zoning administrator, be approved by the Community Development Department staff (i.e. a formal hearing before the DRB may not be reguired):

The variance application requests reconsideration of Town of Vail Section 18.18.060
regarding minimum front setbacks. The existing non-conforming residence was built
according to the county standards. Following annexation and Town of Vail front setback
regulations, the residence became non-conforming. lt is for this reason that front setback
variance is always required for any modifications to the Vlaar residence.
The request for front setback encroachments is to accommodate a dormer roof on the
east elevation. The roof height and GRFA is proposed to remain the same.
Because the existing building footprint will not be expanded, the variance will have no
significant effect upon other existing or potential uses and structures in the immediate
area-
The existing Intermountain area has lot configurations which make it almost impossible
to modify the units without requiring variances. In fact, the existing units already ehcroach
significantly into the required front setbacks. These encroachm-ents are due to the fact
that the lots are very shallow. We believe that there are elitraordinary circumstances due
to the original lot layouts and that approval of the variance request would not be a grant
of special privilege. Intermountain homes have received similar setback variancei for
remodels.
The effect of the variance on light and air, distribution of population, transportation, traffic
facilities, utilities, and public safety is negligible to the adjacent properties.

As reqgqsted, we lnspected the subJect excavation on l'lay'll, 1976.
At the tlme of our lnspectlon', th6 excavatlon was near flnal grade.
The excavation ls In a steep north-faclng hlllslde. The maxlmum cut
slope helght at the uphlll, south, part of the excavation is ll feet.
Solls exposed at the bottom of the excavatlon conslsted of a medlurn stlff, sandy silt wlth scattered angular sandstone fragments. The
consol ldatlon characterlstlcs of thls soll are shown on the attached flgure, No free water wal observed In the excavation, al though portlons
of the excavation were very molst and the solls havd been softened
by equ lpment .
Based on the type of construct lon proposed and the subsol I condl-
tions, the most desirable foundatlon for the proposed residence
would be spread footlngs placed on the natural upper subsolls. The
followlng deslgn and _constructlon detaf ls should be observed:
(l) Footlngs place{ on the rpp", n"tu.al sandy sllt subsolls should be
designed for a maximum soll pressure of 2,000 psf. Under thls
jlressure we estlmate that total settlement wlll be on the order of I lnch maxinum and dlfferentlal settlement across the proposed
resldence will be less than 3/4 lnch.
(2) Contlnuous foundatlon walls should be relnforced too and bottom to
span an unsupported length of at least l0 feet.
(3) Local soft pockets of soil found wlthln the loaded depth of the
footlngs should be removed and the footlngs extended to lovrer flrmer solls. The volds formed by removlng sof.t solls may be backfllled wlth a clean gravel instead of extendlng the footlngs to

faclng hl I I s lope, The cut s lope at the southern, uphi I I portlon
of the excavat lon, had a maxlmum helght of 7 feet. The southern
two-thirds of the excavatlon ls in medium stlff, light brown sandy.

dark brcun, soft, moderately organic, si lty topsoil whlch overlies a I lght brown, soft sandy si lt soll. Consol idatlon characterlstics of the solls from the northern and southern part of the excavatlon are shown on attached Flgure l. llo free water was encoilntered fn the excavatlon al though the solls are Very moist and have been
softened by equipment worklng In the excavet lon.
