To Whorn It May Concern:
I am submitting an application to get approval for the location of the
snow-melt boiler which i-s required to be used at this residence. Please
see the :rttached site plan, which will show you that the boiler is proposed
to set next to the garage or,rtside. The dimensions of the boiler are 4\"
high x 26.5" wide x 18" long. The concrete pad for the boiler sets 48"
below the hcight of the driveway, so this boiler cannot be seen from the
street. I am submitting photos of'the site and the boiler for your review.
History of this project: The project rvas started in 1999 by A & B
Builders (Xavier Garcia). The owners ran out of money, so the project
was put on hold. I sold some property that the Huerta's owned and I got
involved about two and a half years ago to try and get this project done.
The money came to an end again and the project put on hold. I then sold
some land the Huerta's owned and continued with the project and it is
now ahnost complete. I just need to get the snow-melt boiler installed
and a few final inspections so that I can get a Certificate of Occupancy.

Snowmelt Boiler Installation
To Whom It May Concern:
The application that I submitted on January 25,2005 to get approval for
the location of the required snowmelt boiler shall be modifred to include
the following:
The rock retaining wall shall be added to, which will increase
the height on the south side and we shall plant at least 5 shrubs to the
south and east of the boiler. The boiler shall be painted brown in color to
blend in with the surroundings. The shrubs will be of a bushy type to
create of barrier so that you will not see the boiler from the street or the
neighboring house. As it exists now, the boiler will sit 7 inches below the
drivewav level.

This letter is being sent as a follow up to our conversation on site today in which I
informed you that a Change to Approved Plans application needs to be submitted for
the changes you decided to make to your project which I have listed below. Please
complete the attached application which should accompany a letter from you explaining
the reasons for the changes and details on the changes you decide to go forward with.
r On the attached elevations please note that all the new chimney caps will not be
installed at this time. Your letter can explain your logic behind not installing the
caps at this time.. On the attached elevation please note that the planter box has been replaced
with planting pots. A photograph of what you have will serve as an example.. Through the use of a photograph and your letter describe why you removed the
aspen tree near your entry. Also please detail what your intentions are with the
landscaping bed in front of the structure.
Please review these comments and if you have any questions regarding this letter
please contact me at 970-479-2148. Please submit revised plans at your earliest
convenience. This Change to Approved application may require Design Review Board

SCOPE OF STI]DY
This report presents the results of a Preliminary Subsurface Soil and Foundation
Investigation for the proposed residence to be constructed on Lot 9, Block 6, Vail Intermountain
Subdivision, Town of Vail, Eagle County, Colorado. The purpose of the subsurface soil and
foundation investigation was to provide the Structural Engineer with a preliminary data for the
foundation design, from a Geotechnical point of view. Additionai investigation and reevaluation of
the foundation recommendations will be done once the site is more accessible.
SITE DESCRIPTION
The proposed building site is on a0.22$ acre lot, at 3003 Bellflower Drive, offKinnickink
Road, in the Vail Intermountain Subdivision in West Vail, Eagle County, Colorado. At the time of
our site visit snow covered the site. The topography ofthe lot is steep, sloping to the north, toward
Gore Creek. Drainage is to the north. Vegetation consisted of pine forest. The lot is vacant.
PROPOSED CONSTRUCTION
We understand that the proposed residence will be a two to tkee story wood frame
construction. Loads are anticipated to be light, typical of residential construction.
If the finalized plans differ significantly from the above understanding, we should be notified
to reevaluate the recommendations of this report.
FIELD INVESTIGATION
The field investigation conducted on March 27, 1996, consisted of observing, logging and
sampling one Test Pit. The client hand dug the Test Pit, before the field investigation. We took Soil
" samples for laboratory soil analysis and observation at selected intervals. Around the Test Pit, there
as at least 6 feet of snow.
SUBSURFACE SOIL AI{D GROUNDWATER CONDITION
The soil exposed in the test pit, consisted of 1.5 feet oftopsoil over 3 feet of slightly clayey,
gravelly Sand with cobbles, boulders and fine roots, as shown on Figure No. 1.
We tested the soil samples for swelVconsolidation, natural dry density, and natural moisture
content. The test results are shown on Fizure No. 2.
FOUNDATION RECOMMENDATIONS
The following recommendations are preliminary. Additional sampling and testing of the
foundation soil must be done before construction. The clayey Sand showed low to moderate
potential for consolidation.
The proposed residence should be supported with conventional type spread footings,
designed for a maximum allowable soil bearing pressure of 1000 psf The footings should be placed
on the undisturbed clayey-gravelly sand with cobbles and boulders. We recommend minimum width
of 16 inches for the continuous footings and 2 feet for the isolated footing pads. Continuous
foundation walls should be well reinforced, top and bottom, to span an unsupported length of at least
l0 feet.
A minimum of 48 inches of bacldll cover is recommended for frost protection of the footing
subsoils. The foundation excavation should be free from excavation spoils, frost, organics and
standing water. Any overexcavation within the proposed foundation, should be backfilled, in 8 inches
loose, level lifts and compacted to l00yo of the maximum dry density and within 2 percent of the
optimum moisture content as determined in a laboratory from a Standard Proctor test (ASTM D-
698). Structural fill placed under footings should be tested by the engineer or her representatives on
regular basis.
SLAB CONSTRUCTION
The natural on-site soils, exclusive oftopsoil, organics, and fill, are suitable to support
I
light$ loaded slab-on-grade construction. The subgrade for the slab-on-grade construction should be
proofcompacted to detect and remove soft spots. Soft spots that have to be overexcavated and
bacldlled with structural material, and other underslab fill should be constructed with the on-site soil
or other suitable material, compacted to a minimum of 95 percent of the maximum standard Proctor
density (ASTM D-698). Suitable material should be free from topsoil, organics and rock fragments
greater than 3 inches.
The concrete slab should be constructed over a 4-inch layer ofclean gravel consisting of -3/4
inch gravel with at least 50% retained on the No. 4 sieve and less than 3 percent passing the No. 200
sieve.
The concrete slab-on-grade should be reinforced and controljoints scored in accordance with
the American Concrete Institute requirements and per the recommendations of the designer to
reduce damage due to shrinkage. The concrete slab should be separated from the foundation walls
and columns with expansion joints to allow for independent movement without causing damage.
RETAININGWALLS
Foundation walls retaining earth and retaining structures which are laterally supported should
be designed to resist an equivalent fluid density of60 pcffor an "at-rest" condition. Laterally
unrestrained structures retaining the on-site earth should be designed to resist an equivalent fluid
density of40 pcf forthe "active" case.
The above design recommendations assume drained backfill conditions and a horizontal
backfill surface. Surcharge loading due to adjacent structures, weight of temporary stored
construction materials and equipment, inclined backfill and hydrostatic pressure due to undrained
backfill should be incorporated in the design. They should make every attempt to prevent the buildup
of hydrostatic pressure behind the retaining/foundation walls.
I]NDERDRAIN SYSTEM
To reduce the risk of surface water infiltrating the foundation subsoil, we recommend
)
installation of a foundation perimeter drain. The foundation perimeter drain should consist of a 4-
inch diameter perforated pipe sloped to a suitable gravity outlet, or to a sump pump location, at a
l/4 inchper foot if flexible or at a ll8 of an inch if rigid pipe is used. They should line the bottom of
the trench next to the footing with a polyethylene moisture banier glued to the foundation wall. The
drain pipe should be placed over the moisture barrier and covered with a minimum of 6 inches of -
3/4 inchfree-draining granular material. Geotextile (Mirafi 140N or equivalent) should be used to
cover the free-draining gravel to prevent siltation and clogging ofthe drain. The backfill above the
drain should be granular material to within 2 feet of the ground surface to prevent a buildup of
hydrostatic pressure. The top one foot ofthe backfill material should consist ofa relatively
impervious fill. The backfill should be sloping away from the building.
SITE GRADING AND DRAINAGE
A grading plan was not available for review at this time. Following are general
recommendations for grading and drainage.
Exterior backfill should be compacted at or near the optimum moisture content to at least
95o/o of the maximum standard Proctor density under pavement, sidewalk and patio areas and to at
least9}o/o of the maximum standard Proctor density under landscaped areas. Mechanical methods of
compaction should be used. Do not puddle the foundation excavation.
The site sunounding the building structure should slope away from the building in all
directions. We recommend a minimum of 12 inches in the first 10 feet in unpaved areas, and three
inches in the first l0 feet in paved areas. The top ofthe granular foundation backfill should be
covered with a minimum of 1 foot of relatively impervious fill to reduce the potential of surface
water infiltrating the foundation subsoils.
Surface water naturally draining toward the proposed building site should be diverted around
and away from it by means of drainage swales or other approved methods.
The roof drains and downspouts should extend and discharge beyond the limits of the
bacldll.
LAWNIRRIGATION
It is not recommended to introduce excess water to the foundation soils by installing
sprinkler systems adjacent to the building. The installation ofthe sprinkler heads should insure that
the spray from the heads will not fall within 5 feet of foundation walls, porches or patio slabs. They
must control lawn inigation. On steep sites revegetation should be done as soon as possible, to
prevent erosion.
LIMITATION
This report has been prepared according to locally accepted professional Geotechnical
engineering standards for similar methods of testing and soil conditions at this time. There is no
other warranty either expressed or implied.
The findings and recommendations ofthis report are based on field exploration, laboratory
testing of samples obtained at the specific locations shown on the Location Sketch Figure No. I and
on assumptions stated in the report. Soil conditions at other locations may vary, which may not
become evident until the foundation excavation is completed. If soil or water conditions seem
different from those described in this report we should be contacted immediately to reevaluate the
recommendations of this report.
This report has been prepared for the exclusive use of Mr. Christer Eriksson for the specific
application to the proposed residence structure to be located on Lot 9, Block 6, Vail Intermountain
Subdivision, Town of Vail, Eagle County, Colorado.

The applicant, Guillermo Huerta, is requesting a front and side setback variance to allow for the
construction of a new single family residence. The variances are requested to allow the applicant
to construct approximately 90 square feet of GRFA below the garage in the front setback and to
reduce the east side yard setback requirement from 15 leet to 10 feet. The new front setback
requirement would be approximately 12 feet. The required front side back pursuant to the Zoning
Regulations is 20 feet. The variances are intended to facilitate easy vehicular access to the site and
to substantially reduce site disturbance.
Beause the applicant is proposing a reduction of 8 ft. in the front setback (2O ft.) ard 5 tt. in the east
side setback, a front-setback vaiance of I ft. and a side setback variance of 5 ft. must be reviewed
and approved by the Planning and Environmental Commission if the applicant is pemifted to

1. That the granting of the setback variances does not constitute a grant of special

in a practical difficulty or unnecessary physical hardship inconsistent with lhe

A. Consideration of Factors Regardino the Setback Variances:
1. The relationship ot the requested variance to otfier existing or potential
uses and structures in the vicinity.
Staff believes that the proposed setback variance request is compatible with
and comparable to the surrounding development along Bellflower Drive.
Many of the existing homes in the vicinity of the applicant's property have
setbacls of less than 20 feet and 15 feet. Due to the steep topography of the
area and the presence ol Gore Creek, the existing development along
Bellflower is located nearest the top and bottom portions of the lots. Stafi
anticipates that this development pattern occurred to insure adequate
vehicular access to the properties and to reduce the negative impacts of
spreading development across a steeply sloping lot. Staff believes that the
applicant's request for reliel from the fronl and side setback requirements will
not have any negative impacts on the existing or potential uses and
structures in the vicinity of the applicant's lot.
2. The degree to which relief from the strict and literal interpretation and
enforcement of a specified regulation is necessary to achieve
compatibility and uniformity of treatment among sites in the vicinity or
to attain the objectives of this title without a grant of special privilege.
Staff believes that the requested setback variances are warranted. The
applicant has revised the proposed plans to reduce the amount of relief
necessary, yet has been able to achieve compatibility and uniformity amongst
the sites. The front and side setback variances would permit the applicant to
construct a single family home and still meet and achieve vehicular
requirements without unnecessarily disturbing the development site.
B.
The Design Review board has conceptually reviewed the proposal. The Board
has recommended that the applicant keep the garage as close to the streel
as possible to reduce site disturbance. The Board's recommendation is
intended to meet the provisions of Section 12-21-14 (k). Statf has reviewed
the proposal and visited the site. Based upon our review of the proposal and
our site visit, we believe there is a physical hardship which impacts the
applicant's property.
Overall, statf believes that there would not be a granting of special privilege
il the variances were approved.
3. The effect ot the requested variance on light and air, distribution of
population, transportation and trafflc tacllities, public facilitles and
utillties, and Publlc safety.
Staff does not believe that there will be any negative impacts associated with
this proposal.
The Plannino and Environmental Commission shall make the followino findinos before
orantino a variance:
1. That the granting of the variance will not constitute a grant o{ special pfivilege
inconsistent with the limitations on other properties classified in the same
district.
2. That the granting of the variance will not be detrimental to the public health,
safety or welfare, or materially injurious to properties or improvements in the
vicinity.
3. That the variance is warranted for one or more of the following reasons:
a. The strict literal interpretation or enforcement of the specified
regulation would result in practical ditficulty or unnecessary physical
hardship inconsistent with the objectives of this title.
b. There are exceptions or extraordinary circumstances or conditions
applicable to the same site of the variance that do not apply generally
to other properties in the same zone.
c. The strict interpretation or enforcement of the specified regulation
would deprive the applicant of privileges enjoyed by the owners of
other properties in the same district.

Dear Mr. Huerta,
I have received your letter of March 23d addressing the revisions to the site plan for the proposed new
residence at 3003 Bellflower Drive.
Upon review of your letter and the proposed site plan it appears there are still several issues unresolved.
There needs to be a minimum of24' fiom the face ofthe garage doors to the edge of the sreet asphalt.
This distance will insure adequate snow storage and drainage.
The garage floor slab elevations need to be indicated on the plans. The elevations will allow our engineers
to determine the grade of the driveway.
The are to the east of the ehu garage needs to be landscaped. The landscaping will provide for a buffer
between your property and the property to the east.
There appears to be an increase in the amount of GRFA in the front setback. While it rvill most likely be
acceptable to have garage area in the required front setback, the least amount of GRFA as necessary in the
front setback is recommended.
The enclosed garage spaces shall be a minimum of 8'x 19' in size. Exterior spaces shall be 9'x 24'
minimum.

Dear Mr. Huerta,
I have completed a review of the proposed new residence at 3003 Bellflower Dirve.
Upon completion of my review, I have determined that there are numerous issues which must be addressed
prior to appearing before the Town of Vail Planning & Environmental Commission. The purpose of this
letter is to identify those issues rvhich must be ad&essed on your plans prior to appearing before the
Planning & Environmental Commission.
Please address the following issues:
l. Please submit a detailed site plan and landscape plan. The landscape plan shall include a plant
materials list identifying the types and quantities ofeach species ofplant.
2. Please indicate the driveway and stairway on the east side ofthe plan.
3. Please indicate a 4-foo1 wide concrete drain pan between fte edge of slreet asphalt and the
driveway.
4. Please shov,,all areas ofdisturbance on the plan. All d.isturbed areas need to be returned to a
maximum of 2: I grade.
5. Please show at least five parking spaces on the site plan. The parking spaces for the EHU must
function independent ofthe primary unit spaces.
6. Please identifu a snow storage location on the plans. An area equaling l0% of the driveway area
is needed if the driveway is heated and 30% if not heated.
7. Please provide driveway grade information on the plans. This shall include edge ofasphalt
elevation, garage slab elevation and a minimum oftrvo-foot contours along the driveway.
