In consideration of the issuance of a revocable permit for the structure above indicated,
applicant agrees as follows:
1. That tlre structure herein autlrorized on a revocable permit basis is restricted
exclusively to the land above described.
2. That the permit is limited specifically to the type of structure described in this
application.
3. That the applicant shall notify the Project Planner and Public Works
Department, or their duly authorized agent, twenty-four hours in advance of the
time for commencement of conslruction, in order that proper inspection may be
made by the Town.
4. The applicant agrees to indemnify and hold harmless the Town of Vail, its
officers, employees and agents against all liability, claims and demands on
account of injury, loss or damage, including without limitation claims arising from
bodily injury, personal injury, sickness, disease, dealh, property loss or damage,
or any other loss of any kind whatsoever, which arise out of or are in any manner
connected with applicant's activities pursuant to this permit, if such i.njury, loss, or
damage is caused in whole or in part by, or is claimed to be caused in whole or in
part by, tlre act, omission, error, professional error, mistake, negligence or other
fault of the applicant, his contraclor or subcontractor or any officer, employee or
representative of the applicant, his contractor or his subcontractor. The applicant
agrees to investigate, handle respond to, and to provide defense for a4d defend
against, any such liability, claims, or demands at the sole expense of the
applicant. The applicant also agrees to bear all expenses relating thereto,
including court costs and attorney's fees, whether or not any such liability, claims,
or demands alleged are groundless, false, or fraudulent.
5.
Applicant agrees to procure and maintain, at its own cost, a policy or policies of
insurance sufficient to ensure against all liability claims, demands and other
obligations assumed by the applicant pursuant to this Paragraph 4.
Applicants further agree to release the Town of Vail, its officers, agents and
employees from any and all liability, claims, demands, or actions or causes of
actions whatsoever arising out of any damage, loss or injury to the applicant or to
the applicant's property caused by the Town of Vail, its officers, agents and
employees while engaged in maintenance or snow removal activities or any other
activities whatsoever on Town of Vail property, slreets, sidewalks, or rights-of-
way.
That the permit may be revoked whenever it is determined that lhe
encroachment, obstruction, or other structure constitutes a nuisance, destroys or
impairs the use of the right-of-way by the public, constitutes a traffic hazard, or
the propefi upon which the encroachment, obstruction, or structure exists is
required for use by the public; or it may be revoked at any time for any reason
deemed sufficient by the Town of Vail.
That the applicant will remove, at his expense, the encroachment, obstruction, or
structure within ten days after receiving notice of any revocation of said permit.
That the applicant agrees to maintain any landscaping associated with the
encroachment on the right-of-way.
That in the event said removal of the encroachment, obstruction, or structure is
not accomplished within ten days, the Town is hereby authorized to remove
same and have the right to make an assessment against the property and collect
the costs or removal in the same manner as general laxes are collected.
That the applicant has read and understands all of the terms and conditions set
forth in this application.
Recording Fee for Revocable Right-of-way Permit is $10.00 and $5.00 for every
page thereafter. Make checks payable to Eagle County Glerk and Recorder.

Attention Residents:
I hope you all are having a good summer and anticipating another great ski season. We
havi severat issues that nred to be taken care of immediately and if we all work together
then it will improve everyone's living environment. Due to several complaints from the
Vail police, the trash and car situation needs to be addressed. A new trash enclosure was
just built underneath the stairs which alt trash is to be put in to prevent bears and other
animals from getting into it. We have contacted Honeyvagon and they will be taking and
returning the trash from this enclosure. The owner ofany car preventing the enclosure
door from fully opening will be charged $25.00 for an extra pickup. In addition, there is
oil, garbage bags ofclothes, and other stranded articles outside by the parking area that
all nied to be removed within three days of this notice or they will be taken.
The second issue is with the cars. There are several cars that have been left stranded or
do not have current plates. These cars include: a Chevy Stationwagon, a Yamaha and
Honda motorcycle, a white eclipse, and an Oldsmobile Cutless This letter serves as a
formal notice to the owner of these cars that they have three business days to remove
them or update their tags or they will be towed at the owner's expense'

around thi'ltreehouses." This will help prevent further complaints and attention from the

In consideration of the issuance of a revocable permit for the structure above indicated,
applicant agrees as follows:
1. That the structure herein authorized on a revocable permit basis is restricted
exclusively to the land above described.
2. That the permit is limited specifically to the type of structure described in this
application.
3. That the applicant shall notify the Project Planner and Public Works
Department, or their duly authorized agent, twenty-four hours in advance of the
time for commencement of construction, in order that proper inspection may be
made by the Town.
4. The applicant agrees to indemnify and hold harmless the Town of Vail, its
officers, employees and agents against all liability, claims and demands on
account of injury, loss or damage, including without limitation claims arising from
bodily injury, personal injury, sickness, disease, death, property loss or damage,
or any other loss of any kind whatsoever, which arise out of or are in any manner
connected with applicant's activities pursuant to this permit, if such injury, loss, or
damage is caused in whole or in part by, or is claimed to be caused in whole or in
part by, the act, omission, error, professional error, mistake, negligence or other
fault of the applicant, his contractor or subcontractor or any officer, employee or
representative of the applicant, his contractor or his subcontractor. The applicant
agrees to investigate, handle respond to, and to provide defense for and defend
against, any such liability, claims, or demands at the sole expense of the
applicant. The applicant also agrees to bear all expenses relating thereto,
including court costs and attorney's fees, whether or not any such liability, claims,
or demands alleged are groundless, false, or fraudulent.
5.
Applicant agrees to procure and maintain, at its own cost, a policy or policies of
insurance sufficient to ensure against all liability claims, demands and other
obligations assumed by the applicant pursuant to this Paragraph 4.
Applicants further agree to release the Town of Vail, its officers, agents and
employees from any and all liability, claims, demands, or actions or causes of
actions whatsoever arising out of any damage, loss or injury to the applicant or to
the applicant's propedy caused by the Town of Vail, its officers, agents and
employees while engaged in maintenance or snow removal activities or any other
activities whatsoever on Town of Vail property, streels, sidewalks, or rights-of-
way.
That the permit may be revoked whenever it is determined that the
encroachment, obstruction, or other structure constitutes a nuisance, destroys or
impairs the use of the right-of-way by the public, constitutes a traffic hazard, or
the property upon which the encroachment, obstruction, or structure exists is
required for use by the public; or it may be revoked at any time for any reason
deemed sufficient by the Town of Vail.
That the applicant will remove, at his expense, the encroachment, obstruction, or
structure within ten days after receiving notice of any revocation of said permit.
That the applicant agrees to maintain any landscaping associated with the
encroachment on the right-of-way.
That in the event said removal of the encroachment, obstruction, or structure is
not accomplished within ten days, the Town is hereby authorized to remove
same and have the right to make an assessment against the property and collect
the costs or removal in the same manner as general taxes are collected.
That the applicant has read and understands all of the terms and conditions set
forth in this application.
Recording Fee for Revocable Right-of-way Permit is $10.00 and $5.00 for every

Dear Don,
The Community Development Department has received your Design Review Application for the
rebuilding and relocation of the slairs and the trash enclosure for 2850 and 2860 Basingdale. At
this time, I am unable to approve your application. As proposed, the relocation of the stairs
would require a variance from Title 14, which limits the distance decks, stairs, and porches can
encroach into a setback. You have the option of applying for a variance (one in which I believe
staff would support) or proposing a solulion which would not require a variance. As I have been
told, your problem is the lack of fire access to the struclures. I believe thal improving your
existing stairs and constructing a sidewalk from the parking area to the stairs would be an
acceptable solution and would nol require a variance.

account of injury, loss or damage, inclLrding without limitation claims arising from
bodily injury, personal injury, sickness, disease, death, property loss or clamage,
or any other loss of any kind whatsoever, which arise out of or are in any man-nur connected with applicant's activities pursuant to tlris permit, if such injury, loss, or
damage is caused in whole or in part by, or is claimed to be caused in whole or in part by, the act,_ omission, error, professional error, mistake, negligence or other
fault of the applicant, his contractor or subcoiitraclor or any offiderl empioyee or representative of the applicant, lris contraclor or lris srrbcontractor. The applicant
agrees to investigate, handle respond to, and to provide defense for and defend against, any such liability, claims, or demands at the sole expense of llre
applicant. The applicant also agrees to bear all expenses relating thereto,

impairs tlre use of the right-ot-way by the public, constitutes a traffic hazard, or

required for use by the public; or it nray be revoked at any time for any reason
deemed sufficient by the Town of Vail.
That the applicant will renrove, at his expense, the encroachrrrent, obstruction, or
structure within ten days after receivirrg notice of any revocation of said permit.
That the applicant agrees to nrairrtain any landscaping associated with tlre
encroachrnent on the righl-of-way.
