Gentlemen:
As requested by you, we observed the excavation aL the sub-ject site on May 3 and 7, 1985 to evaluate the exposed materj.als for foundation supporf. The proposed reverse cantilever wa1l is on the order of 10 f eet high and 40 feet long. I'le understand from Boyle Engineering that the design lateral earth pressure acting on the wa11 is 50 pcf and the maximum footing bearing pressure 1s 1000 psf.
During our site visits, the excavation for the proposed retaining waLl was observed. The excavation is located below the
resj.dence between an existi.ng wooden retaining walL and Snowberry Drj.ve and extends approximately west from a culvert below the road. The excavafion depth ranged to a maximum of about 10 feet. The upper 4 to 6 feet was retained by the existing timber walI. The materj.aLs exposed at the excavation boltom consisted of hard cement,ed sandstone,/silLstone bedrock. The cut slope profile exposed near the center of the excavatj.on consisted of fractured and broken bedrock below about l foot of topsoil at tbe
base of the existing timber waIl. About J foot depth of sandy silty clay with rock fragments was exposed near the west end of the excavation. The bedding of the rock is generally down to the north at a dip on the order of 2 horizontal to l vertical. A relatively minor amount of water was seeping from the lower portion of the cut bank. At the time of our May 7 site visit,the downhill (north) side of the excavation had been covered with a shallow depth of 3 to 4 inch size crushed rock and the boe of the footing had been formed. Some waLer was ponded in the crushed rock. Reinforeement dowels locat,ed directly below the wall Iine were being lnstalled into the sound rock.

DOUNHILL MOVEMENT TERMED 'CREEP" THE COLLUVIAL SOILS WERE
COMPOSED OF ERRATIC MIXTURES OF CLAY, SILT, SAND, GRAVEL.
COBBLES AND BOULOERS WITH SOME DISORIENTATED BEDROCK.

MOVEMENTS OF THIS PRESENTLY ACTIVE HILLSIDE.

APPLTCATTON FOR EXEMPTION FROM
EAGLE COUNTY SUBDIVTSION REGULATIONS
Pursuant to Section 6.01 of the Eagle County Subdivision
Regulations f hereby apply for exemption from the provisions of
said Regulations as to my proposed division of Lot 19, Block 9,
Vail Intermountain Development Subdivision, into two separate
interests and as reasons therefor state the following:
1. The Plat of Block 9, Vail Intermountain Development
Subdivision was approved by the Board of Commissioners of Eag1e
County and was recorded in September of L972.
2. Lot 19, Block 9, of said Subdivision was purchased
by this petitioner by Warranty Deed. dated May t, L973.
3. The Conditions, Covenants, Restrictions and Ease-
ments affecting said Lot 19, Block 9, were recorded September
6, L972, in Book 225 aL Page 315 of the Eagle County Records
and provide in paragraph 4 thereof that four units and two
separale buildings may be constructed on said Lot 19, BLock 9.
4. This petitioner proposes to divide Lot 19 j-nto two
separate interests, one on each side of the drainage easement
presently traversj.ng said Lot from north to south. This divi-
sion would not increase the burden on said Lot 19 in any way
since, because of the applicable setback requirements, it is
not possible to build more than one building on each side of
the easement. Thus, after the division of said Lot into two
separate interests still only two buildings containing two
dwelling units each can be built on said Lot--the same as con-
templated in said Restrj.ctions and Covenants.
The petitioner and his brother, John F. Hayhurst, each
plan to build on said Lot 19--one on one side of said easement
and one on the other. With the present single ownership or
even in the event of joint ownership of said Lot, it would be
difficult for them to obtain financing for their separate
buildings since each would be required to encumber his portion
of said Lot for the benefit of the other portion. rf said. Lot
can be divided into two separate interests, then each can
receive financing for and build on his portion of the Lot and
only encumber that portion.
5. Permission is sought to divide said Lot 19, Block 9,
into two and only tr.tro separate interests qrith no additional
burden on said Lot or the remainder of said subdivision at arl.
6. Water, sewer and. electric power are presently avail-
able to said Lot 19 and applicant has arranged for gas to be
brought into said Lot. The originat subdivider of said Bl_ock
t has already provided a road past Lot 19 which provides access
thereto.
7. ft is understood that any action by the Board of
County Commissioners of Eagle County granting said requesl for
said regulations exemption applies only to Lot 19. Block 9.
It is further understood that all rules, regulations, covenants
and restrictions that are presently applicable to Lot 19 will
remain applicable lhereto even after the requested. d.ivision.

The Vai I Planning Commission would like to comment on the
app licafion for exemption to the County Planning Commission
conce rn i ng the resubdivision of Lot 19, Block 9, Vail
Intermounta in Deve looment Subd ivis ion.
The purpose of exemptions such as this serves to potentially
multiply densities within areas originally intended for
res ident ia I occupancy. The overa I I concern of the Va i I Planning Commission and, as we understand it, the County Planning Commission is to try to limit densities in the
Upper Eagle Valley at this point in time. Consequently, the
Vai I Planning Commission would urge the County Commission in
the strongest possible terms not to consider an exemption
from Subdivision Regulations in the above case.
Granting exemptions such as these can on ly encourage others to try for similar exemptions; requiring full compliance
with subdivision reguiations may serve as a useful deterrent in the continuing prob lem of multiplying densities.

My client, James B. Hayhurst, recently purchased Lot 19 and is the sole owner thereof. He and his brother, John
T: Hayhurst, each desire to construct a building on Lot 19, one on each side of the drainage easement dividing the lot. .The applicable restrictions will only allow two buildings on the 1ot and the set-back regulrements necessitate only one building on each side of ttre ease-ment.
If the lot remains in single ownership, or even in the event of joint ownership by the two brothers, the financ-ing for their proposed buildings becomes very difficult since each must encumber his portion of the 1ot for the benefit of the other. The situation wourd be much simpli-fied if the lot could be divided into two interests and each brother could own his interest in fee.

As requested, I have compLeted a reiaining wall design tc retain cut slopes of various heights at the subject site.Attached to this letter you will find:I. A topographic raap shorving the site grading plan for the residence, the location of the retaining structures
vrhich vrill be required, and the ground elevations in the qrea.
2. Design drawings and details for a suitable cantilever . reinforoed concrete retaining rvall for retaining the potentially active slopes at the site.3. General notes pertaining to the retaining wall.4. The reinforcement schedule for various heights of r','a11 vrhich lvilI be required at different locations on the site.
In accordance with the soil report, the heights of the retaining wall should be such as to retain the fu11 height of the cut
slopes present. A guide to these heights can be obtained fron interpolation of the topographic map. However, the final heights should be as deternineci in the field during construction. The heights should be adjusted in the field at the tirne of construction using the attached design data. Sufficient design data is i'rr-cluded to cover all the walL heights which will be required.
The tops of lvalls can either be stepped dovrn to lorver required heights or else can be sloped dovrn to the lower heights. ilr the event that the "valls are slopgd dovrn, then the rei-nforcenent
schedule pertaining to the highar: Ievel of wall shalI be used until the lorver Ievel is reached.
