Attached are three sets of (hopefully the last) set of bluelines for this Wednesdays DRB meeting.
The changes incorporated include: shifting the building approximately 3'-0" to the east (to
within the Fire departments I5'hydrant clearance); the addition ofseveral trees, primarily on
the west; the addition of a planter in the driveway between the main portions of the garage; the
addition ofa Knox-box on the southeast corner ofthe building; and alteration to the grades to
maintain a 2: I slope. One other item discussed at the meeting that has not been changed is the
standing seam metal roof I believe this should sddress all the DRBs' concerns.
In reference to the neighbors concerns I think we've done all we're going to, and able to, do. ll/e
do not feel it is appropriate to have Mr. Kinney relocate, or even research relocating, the fire
hydrant. Ifthey do not desire to have a driveway and garage across the streetfrom their place of
residence, they should not reside in the suburbs. Also, we feel the proximity of the driveway to
those across the street will pose no problem. The sheer quantity of vehicles in this area is not, in
our opinion, enough to be ofconcern.

Attached are plans for the Kinney Garage Addition which reflect those items we spoke of last
week including: the dri'vev,ay being increase to 24'-0" min., plan and elevation changes, and
exterior lighting. Due to the driveway depth increasing, and the existing grading, the building
was raised 2'-o". However, because the floor and ridge were both raised the exterior elevations
remain proportionally the same.
Also attached is a reyised Zoningform reflecting the new Site Coverage and GRFA numbers. I'll
have thefascia detail and materials boardfor the meeting on l|/ednesday.

Attached are three blueline sets of the revised Kinney Garage Addition. The scheme has
been substantially revised. We have relocated the garage down adjacent to Main Gore Drive.
The old scheme required an enormous amount ofwork, and costs, that became prohibitive. The
old scheme required driveway work, connection to the existing stlucture, probable underpinning
of the existing structure, and large, dfficult areas of excavation. The new scheme is basically a
shed type structure which greatly reduces the amount of work and costs.
You'll notice the new structure is partially within the 20'front setback. This is allowed as the
slope ofthis area is greater than 3096.
Also attached is a revised Zone Check sheet. The additional GRFA is lower than the initial
submittal, since we've deleted the interior stair tower.
The exterior elevation sheet, A30I is for the construction documents. I'll provide yourself and the
DRB an elevation sheet which shows both the new structure and the existing, for comparative
purposes.

This packnge includes those items we spoke of this past l(ednesday, Dec 13. Attached is a
revised DRB submittal Zone Check sheet, a retaining wall height clarification sheet, and three
copies of revised sheet A30l Exterior Elevations.
The Zone Check sheet reflects the GRFA calcs, including the floor plan footprint on which the
GfuFA is based. I've noted the outlines of the two floors. The improvement survey, from which
thisfootprint came, is also attached.
Per our conversation, we would like to avoid having to create an as-built floor plan for Mn
Kinney. Given the allowed and proposed GRFA areas are not even close, I think using the
survey ( I've assumed a 6" total exterior wall thickness) should sffice for "estimating"
purposes.
Also, I've included an enlarged plan of the retaining walls and their elevations. These numbers
should be the same as those previously submitted on the full, I/4" scale plan. No single wall
exceeds 6'-0" in height.
Sheet A30I simply has more informationfor your review.

STIPULATIONS
(b) The insured shall notify the Company promptly in
writi;i (i) in case any action or proceeding is begun or de-
fense ii interoosed as 3et forth in (a) above, (ii) in case kno!vl-
edge shall cohe to an insured hereunder of any claim of title
or interest which is adverse to the title to the estate or interest,
as insured, and which might cause loss or damage for which
the Company mav be liable by virtue of this policy, or (iri) if
title to the estate or interest, as insured, is rejected as un'
marketable. If such prompt notice shall not be Siven to the
Company, then as to such insured all liability of the Company
shall cease and terminate in regard to the matter or matters
for which such prompt notice is required; provided, however.
that failure to notify shall in no case preiudice the rights ot any
such insured undei this poiicy unless the Company shall be
preiudiced .by such failuie and then only to the extent of
sucn prejuolce.
(c) The Company shall have the right at its own cost to
institute and without undue delay Prosecute any action or
proceeding or to do any other act which in its opinion may be
irecessary"or desirable- to establish the title to the estate or
interest as insured. and the Company may take any appro-
priate action under the terms of this policy, whether or not it shall be liable thereunder, and shall not thereby concede
liabilitv or waive any provision of this policy.
(d) whenever the Company shall have broughl any action
or interposed a defense as required or permitted by the pro-
visions of this policy. the Company may pursue any such
litigation to final determination by a court of competent juris-
diction and expressly reserves the right, in its sole discretion,
to appeal from any adverse judgment or order.
(e) In all cases where this policy permits or requires the
ComDanv to Drosecute or provide for the defense of any action
or orociedine, the insuied hereunder shall secure to the
Conipany the-right to so prosecute or provide defense in such
action or proceeding, and all appeals therein, and permit- the
Company to use, aiits option,-ahe name of such insured for
such- prirpose. Whenever requested by the Company, such
insured shall give the Company all reasonable aid in any- such
action or proceeding, in effecting settlement, securinB e.vrdence,
obtaining witnesses, or prosecuting or defending such actlon
or proceeding, and the Company shall reimburse such insured
for any expense so incurred.
4. NOTTCE OF LOSS - UMITATION OF ACTION
In addition to the notices required under paragraph 3(b)
of these Conditions and Stipulations, a statement in $'riting
of any loss or damage for which it is claimed the Company
is liable under this policy shall be furnished to the Company
within 90 days after such loss or damage shall have been de-
termined and no risht of action shall accrue to an insured
claimant until 30 dtys after such statement shall have been
furnished. Failure to furnish such statement of Ioss or damage
shall terminate any liability of the Company under this policy
as to such loss or damage.
CONDITIONS AND
I. DEFINITION OF TERIAS
The following terms when used in this policy mean:
(a) "insured": the insured named in Schedule A, and,
subject to any rights or defenses the Company may have
against the named insured, those who succeed to the interest of such insured by operation of law as distinguished from
purcbase including, but not limited to, heirs, distributees,
devisbes, survivors, personal representatives, next of kin, or
corporate or fiduciary successors.
(b) "insured claimant": an insured claiming loss or dam-
age hereunder.
(c) "knowledge": actual knowledge, not constructive
knowledge or notice which may be imputed to an insured by
reason of any public records.
(d) "land": the land described, specifically or by reference
in Scheduie A, and improvements affixed thereto which by law
constitute real property; provided, however, the term "land"
does not include any property beyond the lines of the area
specifically described or referred to in Schedule A, nor any riBht, title. interest, estate or easement in abutting streets,
roads, avenues, aiieys, lanes, ways or waterways, but nothing
herein shall modify or limit the extent to which a right of
access to and from the land is insured by this policy.
(e) "mortgage": mortgage, deed of trust, trust deed, or
other security instrument.
(f) "public records": those records which by law impart
constructive notice of matters relatinp to said land.
2. CONUNUATTON OF TNSURANCE AFIER CONVEYANCE OF
TITTE'
The coverage ot this policy shall continue in force as of
Date of Policy in favor of an insured so long as such insured
retains an estate or interest in the land, or holds an indebted-
ness secured by a purchase money mortgage given by a pur-
chaser from such insured, or so long as such insured shall have liability by reason of covenants of warranty made by
such insured in any transfer or conveyance of such estate or
interest; provided, however, this policy shall not continue in force in favor of any purchaser from such insured of either
said estate or interest or the indebtedness secured bv a Dur-
chase money mortgage given to such insured.
3. DEFENSE AND PROSECUTION OF ACTIONS - NOTICE OF
CIAIM TO BE GIVEN BY AN INSURED CIAIMANT
(a) The Company, at its own cost and \.!'ithout undue
delay, shail provide for the defense of an insured in all litiga-tion consisting of actions or proceedings commenced against
such insured, or a defense interposed against an insured in an
action to enforce a contract for a sale of the estate or interest
in said land. to the extent that such litigation is founded upon
an alleged defect. lien, encumbrance, or other matter insured
against by this policy.

5. OPTIONS TO PAY OR OTHERWISE 5EIT]E CIAIM5
The Company shall have the option to pay or otherwise
settle for or in the name of an insured claimant any claim in-
sured against or to terminate all liability and obligations of
the Company hereunder by paying or tendering payment of
the amount of insurance under this policy together with any
costs, attorneys' fees and expenses incurred up to the time
of such payment or tender of payment, by the insured claim-
ant and authorized by the Company.
6. DETERMINATION ANO PAYMENT OF ]OSS
(a) The liabilitv of the Company under this policy shall
in no case exceed the least of
(i) the actual loss of the insured claimant; or
(ii) the amount of insurance in Schedule A.
(b) The Company will pay, in addition to any loss insured
against by this policy, all costs imposed upon an insured in liti-
eition cairied bn bv ttre Companv for iuch insured, and all
Costs, attomeys' feei and expehses in Iitigation carried on by
such insured with the written authorization of the Company.
(c) When liability has been definitely fixed in accordance
r./ith the conditions of this policy, the loss or damage shall be
payable within 30 days thereafter.
7. uMIAT|ON OF UABIUTY
No claim shall arise or be maintained under this policy
(a) if the Company, after having received notice of an alleged
defect, lien or encumbrance insured against hereunder, by
Iitieation or otherwise, removes such defect, lien or encum-
brihce or establishes the title, as insured, within a reasonable
time after receipt of such notice: (b) in tlte event of litigation
until there has been a final determination by a court of com-
Detent iurisdiction, and disposition of all appeals therefrom,
idverse to the title. as insured, as provided in paragraph 3
hereof; or (c) for liability voluntarily assumed by an insured
in settling any claim or suit without prior written consent of
the Company.
8. REDUCTION OF TIABITIIY
All payments under this policy, except payments made for
costs, attorneys fees and expenses, shall reduce the amount
of the insurance pro tanto. No payment shall be made without
producing this policy for endorsement of such payment unless
the policv be lost or destroyed, in which case proof of such
loss -or destruction shall be furnished to the satisfaction of
the Company.
9. TIAEILITY NONCUMUI.ATIVE
It is expressly understood that the amount of insurance
under this policy shall be reduced by any amount the Com-
pany may pay under policy insuring either (a) a mortgage
shown or referred to in Schedule B hereof which is a lien on
the estate or interest covered by this policy, or (b) a mortgaBe
hereafter executed by an insured which is a charge or lien on
the estate or interest described or reierred to in Schedule A,
and the amount so paid shall be deemed a payment under this
policy. The Company shall have the oPtion to apply to the pav-

PUBLIC WORKS PERMIT PROCESS
How it relates to Building Permits:
1) Fill out our check list provided with a buildino oermit aoolication.
lf yes was answered to any of the above questions then a "public way" is
required. You can pick up an application at either community Development,
located at 75 S. Frontage Road or Public Works, located at 1309 Vail Valley Drive.
2) Notice sign offs for utility companies. All utilities must field verify (tocate)
respective utilities prior to signing application. Some utility companies iequire up
to a 48 hour notice to schedule a locate.
3) A construction traffic control/staging plan must be prepared on a separate sheet
of paper.An approved site plan may also be used. This plan will show locations
of all traffic control devices(signs, cones, etc..) and the work zone, (area of
construction, staging, etc..). This plan will expire on oct. 1sth. and will need to
be resubmitted for approval through the winter.
4) Sketch of work being performed must be submitted indicating dimensions (length,
width & depth of work). This may be drawn on the traffic control plan or a iite
plan for the job.
5) Submit completed application to the Public Works's office for review. lf required,
locates will be scheduled for the Town of Vail Electricians and lrrigation crew. The
locates take place in the morning but, may require up to 4g hours to perform.
The Public work's construction Inspector will review the application and approve
or disapprove the permit. You will be contacted as to the status and any that may
needed. Most permits are released within 48 hours of being received, but please
allow up to one week to process.
As soon as the permit is processed, a copy will be faxed to community
Development allowing the "Building Permif'to be released. please do not confuse
the "Public way Permit" with a "Building permit" to do work on a project itself.
NOTE:
* The above process is for work in a public way only.* Public Way Permits are valid only until November 15th.* A new Public way Permit is required each year if work as not complete.

Effective June 20, 199r, the Town of vail Building Department has deveroped the folrowing procedures to ensure that new construction sites have adequately established proper drainage from buirding sites along and adjacent to Town of VaiI roads oi streets.

on March 6. 1996, the Town of vail Design Rcview Board approved thc Kinney.
cletached garage. The approval granted thc applicant thc ability to construct a four-car'
dctachcd garage adjacenito Muin Gore Drivc. In revicwing thc applicant's requcst for the
dctachcd gu.ug., the Dcsign Revicw Board expressed conccrn over the appcarance of four
garage do-ors ilong Main Gorc Drivc. ln rcsponsc to the Board's concerns, thc applicant
ftop-or.a a 3'tall i Z' *1,t. X l0' long landscape plantcr in the center portion of thc
drivcway. Thc purpose of thc planteiwas to break up and softcn the street elevation with
landscaping, Thc applicant had proposed" and thc Design Revicw Board approvcd, thc
planting of four, 5-gallon shrubs in the landscapc planter'
The construction of the garage has bcen complcted. with the exception of grading and
landscaping around thc structure. The applicant has not installcd thc landscape planter'
The applicant has cxccuted a Dcveloper lmprovemcnt Agrecmcnt with thc Town of Vail
in thc sum of $3.375 to cover the costs of the completion of thc outstanding work.

III. STAFFRECOMMENDATION
Upon review of the applicant's request to eliminate thc landscape planter from the
proposal for the detachcd garage, staff rccommends that the Design Review Board deny
ihe rcquest. StafPs recomircndation for denial is basecl upon thc applicant's original
proposal to include the landscape planter into the design of the detached garage as a
mcans of mitigating the concem oinegative visual impacts exprcssed by several neighbors'
Staff continue, to Gli.u" that the landscape planter and required landscaping will
succcssfully mitigate the visual impact of the building. Additionally, the applicant has
expressed.oo."i that the landscape planter interferes with the snowplowing ofthc-
driveway. According to Town of vail regulations, the l2o/o driveway approved by the
Town of Vail, must ie heated. A heated driveway does not require snowplowing'

Gentlemen:
I am writing this to assure you that I had no intentions of violating any of the town
of Vail's rules pertaining to building my garage. The second floor of the garage, I
am told, was not on the drawings that you approved originally. The floor enabled
the builder to use less concrete in the back wall and provided me with a much
needed storage area. We have not provided any sewer service and so, at no time
will we ever have a bathroom or kitchen which should remove anv concerns of the
potential to add a unit in the future.
I have been at this address for eighteen years and finally decided I coutd not get
along without a garage and more storage space any longer.
I regret that this misunderstanding happened and trust that this issue will be
resofved at the DRB meeting on October 16, 1996.

induded. In an atempt, to simpli$r this, I've edded the area to thesecondary housing
unit. t have induded the strucrural franring plan for the loft, and a redlined plan
indicating where I had taken my eree celcularions.
