Dear Ms. Barton:
Thank you for your letter. I'd like to explain the circumstances relating to
the Aspen trees.
I asked my son to cut down the two trees that were growing into the hot tub
and remove them for firewood. Apparently he cut more than the two I
indicated and failed to remove them.
I visited the property on July l7 and removed the trees that had been cut
down.
There are over 20 additional Aspen trees growing on the bank below my
property. In addition to that, I planted six spruce and pine trees shortly after
buying the property in 1992.
I am now aware, through your letter, of Design Review Board requirements
relating to shrubs and trees. Should there be a further need to remove trees
from the property. I shall consult the Design Review Board as indicated.

ptopefty. i visiied the site and obserued that 5 aspen had bcen cut down below the hot tub arca
of youip,operty. Thc Town of Vail requires that a Dcsign Revicw Roard.application be,
*ub-ltt.d and approved before rcmovai of vegctation occut-'ti. Trees help buffer houses from the
sights and tornOi oftheir ncighbols and maintain a folcstcd look for visitors to the area.
Thc Town of Vail rcqucsts that thc trces bc lcplaced so that you will no longer be in violation of
Title 12. Chapter I I of thc Code of the Town of Vail. The aspen trees that are requircd to be
leplaced arc as follows:

person to litter, track or deposit any soil, rock, sand, debris or naterial , including trash dumpsters, portable toilets and
rrorkrnen vehicles upon any street, sidewalk, alley or public
place or any portion ttrereof. The right-of-way on all Town of Vail streets and roads is approxinately 5 ft. off pavement.
This ordinance will be strictly enforced by the Town of VaiI Public Works Department. Persons found violating this ordinance
will be given a 24 hour written notice to rernove said naterial.In the event the person so notified does not conrply with the notice within the 24 hour tirne specified, the Public Works
Department will remove said naterial at the expense of person
notified. The provisions of this ordinance shall not be applicable to construction, maintenance or repair projects of
any street or alley or any utilities in the right-a-way.
