Dear Mike:
Below is the current status of the several requests you have recently submitted to the Town.
In order to ensure both of us understand the issues regarding each request, I think it will be
helpful for the Town to provide a list of the issues to you in writing.
One of the requests you submitted was for the Town to review the proposed structure on the
west portion of Parcel A of Lot 34. We have scheduled this for the August 7 Design Review
Board meeting. Staff will be reviewing the proposal in the next two weeks, and will let you
know if there are any specific problems with zoning standards.
Concerning your requested changes to the structure built on the east half of parcel A of Lot
34, staff will approve two of the three changes you have shown on the plans. The fireplace
and stainvay modifications are consistent with the discussions you had with Mike Mollica
earlier. The third request listed in your memo of July 9, 1991, is to reduce the amount of
wood siding to be used on fte exterior of the structure. Staff is concerned that, without the
wood siding and the band around the building, the project's appearance will decrease in
quality. As a result, staff will not approve that portion of your request, but will put it on the
August 7, 1991 DRB agenda. We hope you will reconsider this, and find a way to retain some
of the quality achieved with the use of the wood siding.
Concerning the stamped, signed survey you submitted last week, staff has reviewed it and
believes the process of reanalyzing the portion of the lot exceeding 40% slope is worthwhile.
Unfortunately, we believe your surveyor did not look closely enough at the resulting
topography. Staff has done a slope analysis based on the topography submitted on the
survey of June 7, 1991 , and has found that there is actually 2,688 sq. ft. of lot area which
exceeds 40% slope. This reduces the amount of buildable lot area by 438 sq. ft. Please
have your surveyor revise the numbers to accurately reflect the topography shown on the
survey.

Concerning the changes you have requested for parcel 2 of Lot 34, I will be looking into these
changes with Mike Mollica, as he is the planner who permitted the project. As I understand,
only the north elevation will be modified.
Town staff appreciates the letters which have been attached to each one ol your requests,
specifically stating what changes are requested and which elevations are affected. lt was
unfortunate that, earlier this spring, you planned on requesting approval for several
modilications to the structJre under construction on the east half of parcel A, but only asked
for approval of a modification to the height. I have attiached a letter from Steven Riden, in
which he states that, 'no other alteration of the exterior elevations is anticipated at this time."
The staff relies on the text accompanying drawings to explain what the changes are. When
you present them as thoroughly as you have in these recent requests, it makes the staff
review much easier. Please keep in mind that the Town can only approve the changes you
actually request.
Regarding the Spruce Creek application you filed July 16, 1991, staff has scheduled that for
the Planning and Environmental Commission meeting of August 12. Please provide three
sets of the complete drawings. I mentioned the need lor this pQect to go to the PEC to you
while you were in the office in an effort to be helpful. About a month ago, while doing
research on another project, staff found that Spruce Creek has been included in a list ol
several other developmenb which must receive PEC approval for changes to approved
development plans. I have attached a copy of the ordinance requiring that Spruce Creek go
back to the Planning Commission for site plan review for your information. Unfortunately, this
ordinance was not in the file for Spruce Creek when I did the earlier research. Staff is not at
all indecisive about this issue, as the ordinance is very clear. Staff was merely trying lo be
helpful by bringing this to your attention. Given that grandfathered development which has
been approved in the County and built out in the Town can often involve complicated issues,
staff believes the tone of your letter of July 15, 1991 is misdirected. Staff hopes that we can
work together on your development proposals and you will be more cooperative than lhe
atlitude expressed in your July 15, 1991.

Dear Mike:
On ltarch 20, LggL' the DRB approved the proposal for the new
single-fanily house on the east portion of Parcel A on the above-
reftrenced lot. There are two conditions on this approval , which
are noted on the approval sheet. At this tirne, there are 1,7L7.8
sq. ft. of GRFA left on l-,ot 34 to be built. There are 111411.5
sq. ft. of site coverage also left to be developed. When you are
redesigning the western unit. be sure to take these two
constriinti into consideration. fn addition, be sure to rneet the
20 foot setbacks on aII sides of the site, the maximum 2:1 slope
which is allowed for finished grade, the parking requirement, the
maxirnum 6 foot wall height liuritation, and other zoning regula-
tions which come into PlaY.
I am concerned that, as this is the last house on the site to be
developed, you may have rrpainted yourself-into a cornerrrr and may
not be able-to construct what you would like to for the last
house.
I have discussed with the rest of the Town staff the issue of the
Upper Eagle Valley Water and Sanitation District topographic
survey that pre-dates the survey you have been using all along.on
tuis 3ite. -can you provide the Town with a stamped copy of this
survey? At this-tirne, I am not sure that the earlier survey can
be us6d as a basis for additional GRFA. At this time, the 6RFA
and site coverage calculations listed above rePresent the
remaining potentiat of the site.

A pre-application meeting with a menber of the plannlng staff is stronglv encouracred to deterrnine if any addltional application infornation is needed. It ls the applicantrs responsibility to uake an appointment with the staff to
determine if there are additional subrnittal reguirements.

approval process for your project.
III. TUPORTANT NOTICE REGARDTNG ALL SUBMISSIONS TO THE DRB:
A. In addition to meeting subnittal requirements, the
applicant must stake and tape the project site to
indicate property Iines, building lines and building corners. A11 trees to be removed nust be taped. AI1 site tapings and staking must be conpleted prior to the
DRB site visit. The applicant must ensure that staking
done during the winter is not buried by snow.
B. The review process for NEw BUILDINGS normally reguires
two separate meetings of the Design Review Board: a
conceptual approval and a final approval. Applicants
should plan on presenting their development proPosal at
a rnininum of two neetings before obtaining final
approval.
c. Applicants who fail to appear before the Design Review
Board on their scheduled meeting date and who have not
asked in advance that discussi-on on their itern be
postponed, will have their items removed from the DRB
docket until such time as the item has been
republished.
D. The following itens may, at the discretion of the
zoning administrator, be approved by the Conmunity
Development Department staff (i.e. a fornal hearing
before the DRB may not be required):

a. Windows, skylights and sinilar exterior changes
which do not alter the existing plane of the
building; and
b. auilding addition proposals not vj-sible frorn any
other Lot or public space. At the time such a
proposal is subrnitted, applicants must include
letters from adjacent property owners and/or from
the agent for or manager of.aDy adjacent
condominium association stating the association
approves of the addition.
ff a property is located in a mapped hazard area (i.e.
snow avalanche, rockfall, flood plain, debris flow,
wetland, etc), a hazard study must be subnitted and the
owner rnust sign an affidavit recognizing the hazard
report prior to the issuance of a building pernit.
Applicants are encouraged to check with a Town Planner piior to DRB application to determine the relationship of the property to all mapped hazards.
For all residential construction:
a. Clearly indicate on the floor plans the inside
face of the exterior structural walls of the building; and b. Indicate with a dashed line on the site plan a
four foot distance from the exterior face of the
building walls or supporting columns.

Such combustion air openings shall be as per UMc Ch.

Approved gas logs may be installed in solid-fue1
burning fireplaces provided the installation is
according to the listing instructions, any damper
sha1l be removed or permanently blocked, and a

Gas 1og lighters are not permitted within the Town
of VaiI unless they are a listed apparatus with a
thermocoupler and a pilot,
Gas fireplace appliances are required to be installed as per Iisting installation instructions -with a "B" vent only. Combustion air must be
supplied from the outside for alL new construction in the Town of VaiI.
Furnaces not listed for closet or alcove installation sha1l be instaLled in a room or space
having a volume at least 12 times the volume of the furnace. A boiler unit wi-ll requj-re a space l-6
