Enclosed is a drawing depicting the retaining wa11 consEucted between the
buildings on parcel five and six. During construction of the retlining wal1, we
endeavored to recess the upper retaining wall at an initial height of six feet.
Lrnf ortunately, however, the hillside was burdened r.rith burj_ed utilities.
Therefore, as we discussed, we are to place boulders at the base of the existing wall so that the upper portion of retaining wa11 does not exceed six feet in height
from the current ten to twelve foot height. The boulders wilL be placed at the
base so as to a11ow planting on an interim ledge of approxirnately tkro to three feet in width, Planting is to consist of small- evergreens, potentillas, and aspens with a minimum combinatj-on of eighteen of Ehese species being planted. Due to
weather constraints and the need for a construclion staging area, this work will not be conpleted until June 1, 1992 and receipt of a final certificate of
occupancy will be withheld until these items are complete.
Lastly, enclosed are labeled elevation snapshots of the buildings on parcels one, five and six as you have requested,
I believe that this documentation presents a fair and accuraEe surunary of

As you mentioned in the oflice iast week, the DRB application for Parcel 5 was submitted to
the Town of Vail on Februara 15, 1991. Because you met the deadline stipulated in the
ordinance regulating fireplace installation, this lot may have woodburning fireplaces. I have
checked with Susan Scanlan, and the regulations which pertain to this construction are as
follows:
1. One woodbuming fireplace and one certified woodstove, or 2. Two certified woodstoves.

Pursuant to your suggestion, enclosed are tr^ro copies of an elevation,
floorplan, and engineered framing plan for the above referenced residence.
Crisscrossed areas on one of the floorplans identifies expanded floor areas.
Original GRFA per the building permit totaled 2,171 square feet. Current
GRFA is calculated at 2,288 square feet pursuant to the documented calculations
for a net increase of X square feet.<._p*,t *Pursuant to the enclos'ed letter dated March 22, I99I , 1,717 square
feet of GRFA continues to be available to this site, Please reduce the
remaining GRFA allowance for the sj-te by your calculation. Additionally,
the enclosed letter would seem to indicate that site coverage would not be a
concern. The building exterior changes seem to have been slight.
Any assistance you ean provi-de in allowing for a speedy remedy of our

Dear Mike:
On March 20 | L99L, the DRB approved the proposal for the new single-farnily house on the east portion of Parce1 A on the above-
referenced lot. There are two conditions on this approval , which
are noted on the approval sheet. At this time, there are 1,717.8 sq. ft. of GRFA left on Lot 34 to be built. There are 11,4LL.6 sq. ft. of site coverage also left to be developed. When you are
redesigning' the Trte.stern unit, be sure to take ttrese two
constraints into consideration. In addition, be sure to meet the
20 foot setbacks on all sides of the site, the maximum 2:1 slope
which is allowed for finished grade, the parking requirement, the
maximum 6 foot wall height linitation, and other zoning regula-tions which come into play.
I am concerned that, as this is the last house on the site to be
developed, you rnay have ttpainted yourself into a corner,I' and may not be able to construct what vou wouLd like to for the last
house.
I have discussed with the rest of the Town staff the i-ssue of the
Upper Eagle valIey Water and Sanitation District topographic
survey that pre-dates the survey you have been using all along on this site. can you provide the Town with a starnped copy of this
survey? At this tirne, I an not sure that the earlier survey can
be used as a basis for additional GRFA. At this tine, the GRFA
and site coverage calculations listed above represent the
remaining potential of the site.

I have exaEiDed a topographic nap of Lot 34, Block 1, Vail,/Potato Patch
Subdivision, which was prepared by John t. MacKown. The portions of the lot
having a slope exceeding 408 are shown and are stated to contain 4300 sq. ft.
You have asked ne to reeval.uate the nap and redeternlne. the extent of the
original , undisturbed natural slopes that exceed 40*, I have carefully
reevaluated the map, keeplng in nind the intent of the regulations, the
linitations of tbe topographic survey, the overall density of ground shots
taken to produce tbe contour nap, and further referencing a 19?3 topographical
survey which was obtalned fron the Upper Eagle Valley Water & Sewer Dlstrict.
Enploying these consideratlons, it is ny opinion that sore of the areas shown
as exceeding 40S slope could be deleted as follows:
1, An area of.340 sq. ft. on the east slde of the lot could be deleted.
because it does not exceed 40t slope.
2. Three snall areas along the northerly boundary of the lot, with a total of
240 sg. ft., are too snrall to be significant, and could easily be
interpreted as being slightly under 40t slope based on the linitations of
the nap,
3. A larger area of 970 sq. ft. in the west portion of Parcel. A and the
adjacent Connon Parcel. could be deleted assuming a natural average slope
between the 8520 and 8530 contours.
4. Four small parcels along Potato Patch Drive on the southerly bouodary of
the lot, contalning 350 sq. ft., are too snall to be slgnlficant, and
could easily be interpreted as not exceeding 408 slope based on the
llnltatlons of the nap.
5. A southerly portlon of the area in the Comnon Parcel
. contalnlng 150 sg. ft., located between the 8518 and
be deleted assunlng a natural average slope fron the
contours .

II. PRE-APPLICATTON MEETING:
A pre-application meeting with a rnernber of the planning
staff is strongly encouraoed to determine if any additional application inforrnatron is needed. It is the applicantrs responsibility to uake an appointment with the staff to
determine if there are additional subrnittal reguirernents.
Pfease note that a COMPLETE application will streanline the
approval process for your project.
III. II,IPORTANT NOTTCE REGARDING ALL SUBMISSIONS TO THE DRB:
A. In addition to neeting subrnittal requirernents, the
applicant must stake and tape the project site to
indicate property lines, building lines and buildingt
corners. All trees to be removed must be taped. AII
site tapings and staking nust be completed prior to the
DRB site visit. The applicant must ensure that staking
done during the winter is not buried by snow.
B. The review process for NEW BUILDINGS normally requires
two separate meetings of the Design Review Board! a
conceptual approval and a final approval. Applicants
should plan on presenting their devel-opment proposal at
a minimum of two neetings before obtaining final
approvaJ..
c. Applicants who fail to appear before the Design Review
Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be
postponed, will have their itens renoved fron the DRB
docket until such time as the item has been
republished.
D. The following itens may, at the discretion of the
zoning adninistrator, be approved by the Comnunity
Development Departnent staff (i.e. a formal hearing
before the DRB rnay not be required):
a. Windows, skylights and sirnilar exterior changes
which do not alter the existing plane of the
building; and
b. Building addition proposals not visible frorn any
other lot or public sPace. At the tine such a
proposal is subrnitted, applicants must include
letters froro adjacent property owners and/or from
the agent for or manag'er of any adjacent
condominium assocj.ation stating the association
approves of the addition.
E. If a property is located in a rnapped hazard area (i.e.
snow avalanche, rockfa]I, flood Plain, debris flow,
wetland, etc), a hazard study must be subnitted and the
oerner nust sign an affidavit recognizing the hazard
report prior to the issuance of a building pennit-
