Plans for the proposed Riggs remodel and addition were
submitted by Jim Morter for the Design Review Board's approval
on July 8, 1976, A preliminary zoning check was performed' and it
wasdeterminedthatLot23,Yalr:-MeadowsFilingNo.lliespartially
withintheVailMeadowsAvalanchepath.Pursuanttotheprovisions
of Section 16.200 (5) which states:

An on-site inspection earlier thj-s spring by Art Mears of
McDowell,Scott&CoxindicatedthatthewatertankownedbyGore
ValleyWaterDistrictislocatedina"high]nazard'areaandcouldbe

galtons of water further endangering people and property in the vail
Meadowsavalanchearea,Artstronglyrecommendedthatnoimprove-
mentsbeallowedwithintheavalancheareauntilfurtherstudy
is completed and defense structures provided to protect the water
t ank.
Tocomplicatemattersfurther,thenecessarydetailedpre-
timinary report has been prepared for George Rau who also owns
an avalanche endangered 1ot; however, Mr' Rau refuses to make
the report publ-ic until such time as other property oqtners impacted
by the avalanche agree to share in the cost of the report ($2,500)'
Mr. Rau did provide me with a copy of the report for my use with
the absolute understanding that no copies would be made or circulated
until such time as an agreement on cost-sharing has been reached'
He has suggested that the Town of Vail reimburse him for a llrtion
of the cost of the report
The
o.nlrr*."t of community Development would recommend this approach
since the Town of va.il will need the report's contents to pursue
actiononthepartoftheGoreValleylYaterDistricttoprotect
the water tank,
The detailed report which cannot become a part of the public
record indicates that about l/3 of the Riggs 1ot is in the
avalanche path (approximately * in high lnazard' and * in moderate
nazard) and that the existing residence on Lot 23 could be impacted'

As provided for in Sectjon 21 .I03 of the Zoning 0rdjnance, Tovrn of Vai1, Colorado,
0rdinance No. 8 (series of .|973), we are hereby appealing the administrative
actions of the Zoning Aciminjstrator of the Town of Vail. The actjon being appealed is wjth regards to the proposed revisions to the Joseph A. Riggs resicience at Lot 23, Vail Meaclols, Fil jng l, Vail, Colorado.
The Riggs hone is presentiy a dupiex structure, vribh the rental unit occupying
the hottom floor, and the Riggs' private resjdence occupying the'cop tr.ro floors.
By modif.ying an existing interior sta'i r, the Riggs intend to occupy all t;rree floors, eliminating the i"ental unit contpletely. A1 so planned are the eniargement of the existirrg living room at level two, and the addjtion of a garage and storage
area.
According to i.he most recent Colorado Geological Study Report,, portions of the subject lot are in an avalanche hazard zone. In accordance wjth Section .l6.200(5)
of the Zoning 0rdinance, the Zoning Adnrinistrator has requested a more detailed
avalanche report, t^rith particular regard to the existing water stsrage tank which is locatcd aborre"i:he Riggs property, in the avalanche path. The Zoning Administra-tor has recluested that this study be completed before the aforementioned revisions to the Riggs home begin.
lrle concur completely that the study of the avalanche hazard with respect to the
water tank should be done, for the obvious health and safty reasons.
