Topographic survey:r Wet stamp and signature of a licensed surveyor . Date of survey . North arrow and graphic bar scale . Scale of 1"=10'or 1"=20'). Legal description and physical address . Lot size and build able area (build able area excludes red hazard avalanche, slopes greater than 400/o, and
floodplain). Ties to existing benchmark, either USGS landmark or sewer invert. This information must be clearly stated
on the survey . Property boundaries to the nearest hundredth (.01) of a foot accuracy. Distances and bearings and a basis
of bearing must be shown. Show existing pins or monuments found and their relationship to the established
corner.. Show right of way and property lines; including bearings, distances and curve information.e Indicate all easements identified on the subdivision plat and recorded against the property as indicated in
the title report. List any easement restrictions,. Spot Elevations at the edge of asphalt, along the street frontage of the property at twenty-five foot intervals
(25'), and a minimunl of one spot elevations on either side of the lot.. Topographic conditions at two foot contour intervals
. Existing trees or groups of trees having trunks with diameters of 4" or more, as measured from a point one

Thank you for providing us, on April 28,2007 , the Joint Property Owner Written
Approval Letter packet, dated March 2l , 2007 , furnished by Ms. Rachel Friede of the
TOV Community Office, as well as an unscaled, conceptual rendering, of your property
improvement plans.
Nancy and I share your enthusiasm for getting your home improvement completed and
avail ourselves to support your needs while you under construction.
The unscaled, conceptual rendering shows a glass sliding door and safety railing on the
plan's North Elevation. At this juncturg the intent ofthis "glass sliding door to
nowhere" is unclear. Unclear also, is the scale of the safety railing distance from the side
ofthe house, ie, does this represent a very narrow deck?
It is prudent on our behalf to remind you and Kara of previous conversations with regard
to adding a deck on the west/north west side of you duplex half
To reiteratg when we added our dech it was our strong desire to place the deck in the
west/north west wall of our duplex half- the same location you are now seeking. We
wished, as you do, to capture the vista of Mt. Baldy and the down valley corridor.
Town of Vail Community Development due process, required us to solicit the approval of
our neighbor, the same process you and Kara are now engaged with.
Our neighbor, at that time, voiced his objections to having a deck so close to the party
wall, citing it would constitute a serious breach of his privacy. He did not want us
looking into his dining room and bedroom windows from a deck in such close proximity.
He expressed additional concerns oflighting pollutio4 noise from sound system speakers
and party revelers, and a nuisance in general. He asked ifwe planned to put a hot tub on
our deck and pointed out the potential for late night nuisance from all the above. Finally,
he expressed concern that ifwe rented our halfofthe duplex, the potential would
increase, ten-fold, to deny him peace and tranquility for his duplex half
Armed with the realization of his concerns and a desire to nurture good neighbor
relations, we abandoned our initial deck location and moved our deck around the corner,
to the south side of our duplex half. This relocation was somewhat painful, both
aesthetically and financially; we were burdened with extra construction costs and
compromise of our view corridor from the downstairs bedroom window; however, this
was slight in comparison to the amount of neighborly goodwill it generated. This pro
active decision mitigated all concerns our neighbor had voiced and he willingly signed
offon our Joint Property Owner Written Approval Irtter.
We would ask for this same consideration from you and Kara. Please honor our request
to place any present or future declq landing and stairways, around the corner ofyour
duplex half, to the NorthA.{ortheast side. This actioq coupled with a dimensioned and
scaled drawing, (I am quite certain Community Development will require a
detailed/scaled drawing for your permit) will be well received by us and we will gladly
and promptly give strong consideration to sign offon your Joint Property Owner Written
Approval Letter, thus, avoiding any construction delays and undue duress.
Your cooperation will be greatly appreciated.

Thank you for your email of Friday, January 21 . I seek your help and
assistance in resolving the ambiguity contained in the Duplex Plat of Lot
32, Vail Meadows. I do not wish to be difficult, believe me.
Still, I am puzzled that no changes can be made in the language of the block
entitled Certificate of Dedication and Ownership. Vail's application form
for Duplex Subdivision Review implies that changes, as appropriate to the
circumstances, can be made. Consider item "F'Materials to be Submitted,
paragraph 1(l), which states: Should the certificate of dedication and
ownership provide for a dedication of land or improvements to the public,
all beneficiaries of deeds of trusts will be required to sign. In our case,
we agree, do we not, no dedication of land or improvements to the public is
involved. Hence, no need for the signatures by the holders of a deed of
trust. In that regard, this plat may be uncommon. Be that as it may, it
does happen. That being the case, why insist on language of dedication in
the certificate block?
Paragraph 1(l) requires an attomey's certificate to the effect that the
owner of record dedicating to the public right of way, etc., is the owner in
fee simple. But if the plat provides for no dedication, why require an
aftorney's certificate? The law does not require a useless thing, I recall.
But lwish to move on. lf we make no changes to the language of the
certificate block, and if we provide for the title certificate, can you
accept including a new paragraph , to be placed immediately following the
certificate block, which explains why the amended plat was processed and
recorded? lattached a copy ofsuch paragraph to the mark-up ofthe plat
which I sent you.
The parking easement will be identified as being limited for use by Lots
32-E and 32-W. ls that acceotable?
I hope to obtain your concurrence with these suggestions so Mr. Mahoney can
have an amended plat prepared for submission to and processing by your

Dear Mr. Campbell:
We follow up on the discussion between you and George Mahoney, our client. George and
I agreed that I should call you. But before doing so, I thought it appropriate to write this letter to give
you an opportunity to review the specific points to be resolved by the amended plat of Lot 32, Vail
Meadows, Filing 1.
I . As you suggested in your letter of December 12,2OO4, an amended plat will be submitted
to your office, once we understand and concur what they amendments should look like. Mr.
Mahoney will then submit the desired changes to the surveyor, Johnson & Kunkel, for the purpose
ofrequesting said firm to finalize an amended plat.
2. We agree, I believe, that the existing plat shows no easements intended to be dedicated
to the public. It therefore raises the question whether the standard language contained in the pro
forma statementof CertiJication of Dedicatiott and Ownership is appropriate and should be tailored
to the specifics of this plat. However, there seems to be reluctance on the part of the Town of Vail
to deviate from the pro fonna language. We think the standard language will not be unduly
confusing so long as the additional language, which was inserted in the plat presently on record, is
deleted in the amended plat. The additional languase to be deleted is as follows: . . . and does

marked up copy of the existing plat which shows the additional language deleted. I hope you will
concur with the deletion of the additional language.
3. I suggest thal a new paragraph be added, undemeath the Certification of Dedicattan snd
Ownership, which explains why the amendment was made. I hope you will concur with this step.
If you have concems about the wording, please call.
4. Since the plat shows no easements, roads or places to be dedicated, I view asa unnecessary
the Title Certificate, and suggest that it be deleted from the amended plat. What is your view?

This letter is being sent in response to your letter from Dietze and Davis, P.C., in which there is a request
to have a resolution passed to resolve your con@rn regarding the language used in identifying the
Common Parking Easement". Staff does not believe a resolution is the proper method to deal with your
concern. The appropriate method would to amend the existing plat by recording a new plat in its place.
By doing this the issue will be resolved and be recorded on the plat in perpetuity so that no future buyer
has the same concerns and must do extensive research to find a resolution.
Please find the attached duplex subdivision review application attached. The fee is $100 and the plat is
administratively reviewed and then recorded. The fees for recording the plat with Eagle County are an
additional $1 1 for the first page and $10 for any additional pages. For greater detail if need regarding the

The Mahoneys entered into a contmct with Ruel C. Mercure and Nancy S. Mercure for the
purchase of I-ot 32-E on August l, 2000. Although many years ago a duplex was built on Irt32 and
occupiedbytwoseparatesetsofowners,Lot32hadnotbeensub-divided. TheMahoneysdidnotwish
to becometenants in common with the Reids, the occupants of the other unit, and so the duplex plat was
prepared, formally dividing the lot into two lots, Lot 32-E andLot 32-W. The duplex plat was routed
through the platting process of the Town of Vail, and was finally recorded in the Clerk and Recorder's

Office of Eagle County on October 13, 2000, as Reception No. 741618. The Mahoneys closed the
purchase of I-ot32-E in November of that year.
Eadier this fall, the Mahoneys consulted with us about matiers concerning their Foperty in Vail,
and in the course of our review of the real estate documents, we noted that the Certification of Dedication
andOwnership setforth onthe duplex plat dedicatedtothepublicforeverthose portions of the lotwhich
are created as easements. Only one easement is shown on the plat: the Common Parking Easement
located on the Mahoneys' lot (I-at3z-E). Hence our concern that the Common Parking Easement,
intended for the private use of the owners of Lots 32-E and 32-W, bythe language on the plat became a
public parking easement.
BruceDierking,Esq., the attorneywhorepresentedtheMahoneys in 2000, contactedWarren
Campbell, Senior Planner, and discussed the matter with him. Mr. Campbell wrote a letter, dated October
25,20M,whichhesenttotheMahoneysandMichaelandNancyReid. ThesalientpointMr,Campbell
made is that the Town of Vail does not lay claim to the Common Parking Easement shown on l-,ot 32-E.
A copy of his letter is enclosed.
We appreciate the views expressed by Mr. Campbell. It is a legal fact, however, that Mr.
CampbelldoesnothavethelegalauthoritytobindtheTownofVailinmaftersofthiskind. OnlytheTown
Councilhassuchauthority. InordertobackupandsupportMr.Campbell'sstatementstotheeffectthat

PARTY WALL AGREEMENT
This Party Wall Agreement is made this 3'd day of October 2000 by Ruel C. Mercure Jr. and
Nancy S. Mercure, the owners of Parcel 32 E, and Michael J. Reid and Nancy L. Reid, the
owners of Parcel 32W, a resubdivision of Lot 32, Vail Meadows, filing No. 1, according to the
recorded map thereof, County of Eagle, State of Colorado.
I, General Rules of Law to Applv
To the extent not inconsistent with the provisions of this Party Wall Agreement the
general rules of law in Colorado regarding the party walls and liability for property
damage due to negligence orwillful acts or omissions shall apply to the party walls.
2. Sharinq of Repair and Maintenance
The cost of the reasonable repair and maintenance of a Party Wall shall be shared by
each Party Wall Owner thereof in proportion to such Owner's proportionate use of the
Party Wall. The proportionate use of a Party Wall by its Party Wall Owners shall be
based on the respective lengths of such Party Wall, which is then used to enclose the
Residence located on each lot.
3. Destruclion bv Fire or Other Casualtv
lf a Party Wall is destroyed ordamaged by fire or olher casualty, any owner of Owners
shall contribute to the cost of the restoration thereof in proportion to such Parly Wall
Owners proportionate use thereof determined in accordance with the provisions of
Paragraph 1 above, as of the date immediately prior to such damage or destruction.
Nothing herein shall prejudice lhe right of any Party Wall Owner under any rule of law
regarding liability for negligent or willful acts or omissions.
4. Weatherproofino
Notwithstanding any other provision of this Party Wall Agreement, any Party Wall Owner
who by his negligent or willful act causes the Party Wall to be exposed to the elements
shall bear the whole cost of repairing lhe damages caused lhereby and furnishing the
necessary protection against such elements.
5. Riqhl to Contribution Runs with Land
The right of any Party Wall Owner to contribution from any olher Party Wall Owner under
this agreement shall be appurtenant to such Party Wall Owner's Lot and shall pass to
such Owner's successors in title.
6. ArbitEtion
In the event any dispute arises concerning a Party Wall or concerning the provisions of
this Agreement, each Party Wall Owner shall choose one arbilrator and such arbitrators
shall mutually choose one additional arbitrator, and the decision of a majority of such
arbitrators shall be binding upon such Owners and may be enforced in any court having
jurisdiction in the Slate of Colorad0. The costs of such arbitration shall be paid as
directed by such arbitrators.
