DEVELOPER IMPROVEM ENT AGREEMENT
THIS AGREEflf,Nfmade and entered into this 2G a^yo, .)o,n*r.,u , 20Qs
by and among 'kY+ )nydef (the "Developer"), and the Town of
Vail (the "Town").
WHEREAS, the Develope_r,of ap I of the Temporary Certificate of
Occupancy for
(address, legal description, and project number) wishes to enter into a Developer lmprovement
Agreement; and
WHEREAS, the Developer is obligated to provide security or collateral sufficient in the
judgement of the Town to make reasonable provisions for completion of certain improvements set
forth in the attached estimated bid(s) in accordance with the approved plans and specifications
filed in the office of the Community Development Department of the Town of Vail; and
WHEREAS, the Developer wishes to provide collateral to guarantee performance of this
Agreement, including completion of the all improvements referred to in this Agreement, by means
of the following:
The Developer agrees to establish a cqsh d_epo_sit account with the Town of Vail, as
escrow agent, in t[e amount or $ 6 ?-7 fr A, (25% ot the total costs of the
attached estimated bid(s)) as collateral for the completion of all improvements referred to
in this Agreement, in the event there is a default under this Agreement by the Developer.
NOW THEREFORE, in consideration of the following mutual covenants and agreements,
the Develooer and the Town aqree as follows:
1. The Developer agrees, at its sole cost and expense, to furnish all equipment and
manner, dll imptovements refened to in this Agreement, in accordance with all approved plans
and specifications filed in the office of the Community Development Department of the Town of
Vail, and to do all work incidental thereto according to and in compliance with the following:
a. All said work shall be done under the inspection of, and to
the satisfaction of, the Town Planner, the Town Engineer, the Town Building
Official, or other official from the Town of Vail, as affected by special districts or
service districts, as their respective interest may appear, and shall not be deemed
complete until approved and accepted as completed by the Community
Develooment Department and Public Works Deoartment of the Town of Vail.

materials necessary to perform and complete all improvements referred to in this Agreement. The
Developg6 agrees to complete all improvements referred to in this Agreement on or before the I sY

2. To secure and guarantee performance of the obligations as set forth herein, the
Developer agrees to provide collateral as follows:

Agreement, in the event there is a default under this Agreement by the Developer.
3. The Developer may at any time substitute the collateral originally set forth above
for another form of security or collateral acceptable to the Town to guarantee the faithful
completion of those improvements referred to herein in this Agreement and the performance of
the terms of this Agreement. Such acceptance by the Town of alternative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
officer or employee thereof, be liable for any persons or property injured by reason of the nature
of said work, but all of said liabilities shall be and are hereby assumed by the Developer.
The Developer hereby agrees to indemnify and hold harmless the Town, and any of its
officers, agents and employees against any losses, claims, damages, or liabilities to which the
Town or any of its officers, agents or employees may become subject to, insofar as any such
losses, claims, damages or liabilities (or actions in respect thereof) arise out of or are based upon
any performance by the Developer hereunder; and the Developer shall reimburse the Town for
any and all legal or other expenses reasonably incurred by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which the Developer my have.
5. lt is mutually agreed that the Developer may apply for and the Town may
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of the collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements referred to in this Agreement.
6. lf the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall not be required to, draw upon the security refered to in this
Agreement and complete the uncompleted improvements referred to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy referred to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

lf the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at twelve percent
(12%) per annum, shall be a lien against the property and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. lf the Developer fails or refuses to complete the
improvements refened to in this Agreement, such failure or refusal shall be considered a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 14 (General Penalty),
of the Vail Town Code.
7. The Developer shall wananty the work and materials of all improvements refened
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.
8. The parties hereto mutually agree that this Agreement may be amended from time
to time, provided that such amendments be in writing and executed by all parties hereto.

ENCROACHMENT AGREEMENT
THIS AGREEMENT, is made and entered into this l0th day of April, 2003, by the Eagle
River Water & Sanitation District (District), a quasi-municipal corporation of the State of
Colorado, hereinafter refened to as "District", and Daniel & Julie Leever, hereinafter referred to
as'?roperty Owner".
WHEREAS, property Owner is presently the owner of certain real property described as
Lot 6, Block 3, Filing 1, V;il Vatley Subdivision, located in Eagle County, Colorado; and
WHEREAS, the District is presently in possession of an easement, 30 feet in width,
running through the aforementionei property, said easement is described on Exhibit A, attached
hereto and incorporated herein by this reference; and
WHEREAS, property Owner desires to construct permanent structures that will encroach
upon said easement in an at"a approximately 204 square feet (195 square feet - parking and 9
,qour" feet - roof). Said encroaihment is herein described on Exhibit A, which is attached
hereto and incorporated herein by reference.
WHEREAS, said easement is an active easement presently in use by the District'
NOW, THEREFORE, in consideration of the covenants and promises herein, the parties
hereby agree as follows:
l. The District shall pennit the permanent structure to encroach upon said easement.
2. The Property owner shall indemnify the District from tlrg costs of any repairs to
the District's utility lines which may occur as a result of the construction of the
permanent structures over and upon such easement'
3. The properly Owner shall hold the District harmless from the cost of repairing
any damage to the structures that may be caused by the installation of new utility
lines in safd easement, or by a break in present and future utility lines of the
Distnct, or by the repair ofiuch break by the District or by other maintenance of
its lines.
4. The property Owner shall indemnify the District from any increase in the cost of
construction of any new utility lines or in the cost of any repairs to the District's
utility lines, such increase, if any, due to the proximity of the permanent sffuctures
to the utilitY lines'
5. This Agreement shall bind the successors and assigns of the Property Owner, and
shall be appurtenant to and deemed to run with and for the benefit of the
aforr-"niioned property in Eagle County, Colorado until such time that the
District abandoni said easement. This Agreement shall be recorded against said
property in accordance with the laws of the State of Colorado'

This letter is being sent to inform you of several comments and questions the
Community Development Department staff have regarding your submittal for the
Lever Residence located at 1397 Vail Valley Drive. The follow comments should
be addressed in the materials submitted for your final review.
. The proposed plan shows 47 exterior light fixtures. The requirement is
one exterior light per every 1,000 square feet of lot area. This lot is
25,739 square feet in area permitting a maximum of 25 exterior light
fixtures. Please reduce the number of exterior light fixtures to total 25.
This includes the light posts along the driveway. In addition, please
provide sufficient information to verify the proposed light fixtures meet the
lighting requirement. Attached to this letter you will find the requirements
for exterior lighting.r Please provide several cross-sections through the house. One of the
cross-sections should include a north/south cut through the master
bedroom area depicting what is occurring beneath the room. There is
concern that this is a crawl space area and if so must meet several
requirements of the Town of Vail Code.. Review your proposed landscaping plan and the proposed location of
snow storage. You are proposing several trees in areas also designated
for snow storage. Town regulations restricts snow storage areas to
locations without trees. I have attached the regulation to this letter.. Does the site plan properly depict the addition of the new patio on the
lower level on the west elevation? lf not, please revise.

Public Works Comments:
Extend the silt fence on the north side of the lot to include the installation of the
proposed culvert.
Some form of rip rap is required below the day light area of the proposed culvert. This
will prevent erosion in the future. The proposed solution should be aesthetic to the
surroundings.. The proposed berm on the north side of the lot between the home and property line is
shown at 1:1 grade. Town of Vail Standards require that any new grading be returned
to 2:1 grade. Max allowed is 1.5:1, and must be approved by the Design Review Board,
and Town staff.r On the landscaping plan tree A3 on the east side of the proposed driveway must be
relocated to meet the Town of Vail site distance requirements.o The landscape plan and site plan do not match in the area of the proposed spa. Which
plan is correct? Please correct either plan.. Provide a stamped approved drawing from a licensed PE for the boulder retaining walls
between 4 feet and 6 feet. Keep in mind the maximum height of any retaining wall is 6
feet.. The two proposed parking spaces near the front entry do not have the required turning
radius to back out of the spaces and exit without doing numerous turning movements.
Adjust and revise per the Town of Vail requirement for a 20 foot radius.r A Revocable Right of Way Permit will be required when submitting for a building permit
for the improvements in the right-of-way.
Fire Department Comments
o This home will be required to be sprinkled as the driveway is not designed for
emergency vehicle access and staging will occur on Vail Valley Drive.

Heated Drives
Any heated portion of the drive located within the right-of-way must be in a separate zone. The
4' concrete pan cannot be heated.
Snow Storage
All required parking and access areas shall be designed to accommodate on-site snow srorage
(i.e., within boundaries of lot and notwithin the right-of-way). Turf areas and other areas without
trees may be utilized for this purpose.
Unheated Drives: A minimum functional area equaling 30% of the paved area shall be

Guard Rails

require the installation of a vehicular guardrail. The design and type of vehicular guardrail for
private properties shall be designed by a registered Colorado Professional Engineer. Vehicular
guardrails on public roadways or protecting the travelling public shall meet the standard of the
Town of Vail.

Approval Required:
All outdoor lighting within the Town limits shall conform to the standards set forth
below. For the purposes ofthis subsection, residentially zoned properties shall be
defined as those in Hillside Residential, Single-Family, Two-Family,
Primary/Secondary, Residential Clusrer, Low Density Multi-Family and Medium
Density Multi-Family Zone District, as well as all special development districts
which have any of the above referenced zone disfricts as the underlying zoning.
All other zone districts shall be considered, for the purposes ofthis subsection, as
beiug commercial zoned.
Luminance:
Light sources located on all property in the Town which are not fully cutoff shail
exhibit a ratio of source lumens to luminous area not exceeding 125. For examplc:
source lumens < 125.

A single artificial point source of luminescence that ernits measurable radiant
energy in or near the visible spectrum.
Outdoor lighting:
Any light source, or collection of light sources, located outside a building,

Source lumens:
Toal initial lamp lumens of the light source.
Luminous area:
The maximum light emitting area of a light source, measured in square inches. The
maximum tight emitting area is the area of translucent material which encases a
light source. In the case ofa clear glass covering, the luminous area is the area of
the light source. Examples of luminous area are shown below in figure l:
Full cutoff:
A tight Source in which no more than two and five-tenths percent (2.5%) of its
total output is emitted above ninety degrees (90") as measured from nadir as
shown in below in figure 2:

Matt Shoulders sent me a copy of your letter dated 4130104 regarding the attic
space in the Leever Residence. We had intended to utilize prefabricated roof trusses in
this area, however, the rooflines were too complicated for the truss company to fabricate.
We would like to work out a solution that will be acceptable to you but we are requesting
some time to do so without holding up the project.
Would it be possible for you to note this problem as a condition to be corrected
before TCO? This will allow us to design a solution that meets your approval without
delaying the project. In exchange we will leave the attic space as is, without insulation or
drywall, etc., until you have inspected and approved our remedy.

Mr. Shoulders,
This letter is being sent as a follow up to our phone conversation on November 3, 2003. Upon
receipt of your foundation ILC I visited the construction site at which point I became concerned
regarding the future plans of the crawlspace. From my visit it appeared that there were plans
to pour a slab in the crawlspace at the same elevation as the basement floor. In our
conversation I expressed my concerns at which point you informed me that it was your
intention to pour a slab with heat tubing installed at the same elevation as the basement floor
and then backfill till a crawlspace height of S feet was achieved.
As we discussed the poring of a slab and placement ol fill on top in order to meet the 5{oot
maximum height requirement for a crawlspace does not meet the definition of a crawlspace.
However, you may backfill the crawlspace with crushed rock and pour a slab on top of the
crushed rock.
Section 12-15-341c defines a crawlspace as:
c. Crawlspaces accessible through an opening not greater than twelve (12)
square feet in area, with five feet (5') or less of ceiling height, as measured from
the surface of the earth to the underside of structural floor members of the

This letter is to inform you that statf has received information regarding the framing which is occuring at
1397 Vail Valley Drive within the attic space located on the upper level floor. With this letter staff would
like to draw your attention to the requirements lor having an attic space not count lowards Gross
Residential Floor Area. Staff placed the requirements for an attic space on Sheet A4 of the Field Copy of
the approved plans. That requirements is as stated in Section 12-15-3(AX1)(b), VailTown Code.
b. Attic space with a ceiling height of five feet (5') or less, as measured from the top side of the
structural members of the floor to the underside of the structural members of the roof directly
above. Attic area created by construction of a roof with truss-type members will be excluded
from calculation as GRFA, provided the trusses are spaced no greater than thirty inches (30")
apart.
The bold portions of Section 12-15-3(AX1)(b), VailTown Code, above are very specific in requiring the
ceiling of an attic space to be created by structural roof trusses spaced no more than 30 inches apart.
The use of over-framing or a drop-down system of framing is not acceptable to achieve the s-foot
maximum height in the room. Please review your lraming technique in the attic area on the upper level
floor plan. Your framing inspection will be denied if this requirement is nol met.

Mr. Shoulders,
This letter is to inform you that staff has received information regarding the framing which is occurring at
1397 Vail Valley Drive within the attic space located on the upper level floor. With this letter staff would
like to draw your attenlion to the requirements for having an attic space not count towards Gross
Residential Floor Area. Staff placed the requirements for an attic space on Sheet A4 of the Field Copy of
the approved plans. That requirements is as stated in Section 12-15-3(AX1)(b), VailTown Code.
b. Attic space with a ceiling height of five feet (5') or less, as measured from the top side of the
structural members of the floor to the underside of the structural members of the roof directly
above. Aftic area created by construction of a roof with truss-type members will be excluded
trom calculation as GRFA, provided fhe trusses are spaced no greater than thirty inches (30")
apart.
The bold portions of Section 12-15-3(AX1)(b), Vail Town Code, above are very specific in requiring the
ceiling of an attic space to be created by structural roof trusses spaced no more than 30 inches apart.
The use of over-framing or a drop-down system of framing is not acceptable to achieve the s-foot
maximum height in the room. Please review your framing technique in the anic area on the upper level
floor plan. Your lraming inspection will be denied if this requirement is not met.
