Dear Ray:
on Tuesday' November 24th, we met to discuss modifications to the Tennenbaurn residence landscape plan. The discussion centered around the request to remove two mature trees from the site.
The Department of Cornmunity Development, with the consent of the adjacent property owners, Richard and Mary pownall, agrees to grant a staff DRB approval to the nodified Tennenbaum landscaping plan final revision date, Ll-/24/g7.
This allows the applicant to remove the large Englemann and blue spruce trees as per your request. I condition of approval is that the trees will not be rerioved until a temporary certificate of occupancy is granted to the Tennenlaum residence. This condition serves to reduce the tirne period between removal and re-planting, and should satisfy your clientst view corridor requirements. This plan al-so-requires the applicant to add two 3orspruce trees and one 25r sliruce tree at the southeast deck areaf to upgrade the proposed 1Ot spruce to a 20t spruce, and to add a 2Or spruce Lree to the west side of the residence. The appricant is also required to replace the aspen tree that was removed at the retaining wall driveway area with an aspen tree of sirnilar caliper.
The Town of vair encourages the applicant to remove the b]ue spruce and Engremann spruce trees one at a time. we feer that

removal of just one of the trees may acconplish the applicantrs goars and enable the applicant to mlintain one of the Lxisting trees as a landscape buffer between the two adjoining properties.

This is in response to your letter of septenber 24th and also to update you and other interested area property orrrners on the status of the Tennenbaum construction projeLts.- The staff nremorandun that you found in our files dated December 22, 19g6 was in error as it related to the maxiroum GRFA on the three parcels. The correct figures are as follows:
Parcel A: 31750 sq ft for a duplex Parcel B: 3r0OO sq ft for a single fanily Parcel Cz 2,OO5 sq ft for a single farnily
These numbers are reflected on a recorded subdivision plat. we have recentry worked out the problern with the single ffunily structure on Parcel B regarding GRFA. The structure wirr iot contain more than 3,OOO square feet of GRFA. Regarding the duplex under construction on parcel A, we have founA tfris afternoon that the structure is three feet over the height rinit and have stopped work on the project unti] the siiuation is rectified.
r would hope that these actions reassure you and other area property osrners that the rures and regurations regarding zoning and construction will be enforced with regard to trris aia alL other construction projects in vail on a iair and equitable basis.

A request for a side setback variance in order to construct a residence on Parcel- B, a Resubdivision of Lots 14 and 17, Block 7, VaiI Village First Filing.Applicant: Mr. Michael Tennebaurn
I.DESCRTPTION OF VARIANCE REQUESTED
The applicant, Michael Tennenbaum, is requesting a 10 foot variance from the required l-5 foot side setback for the newly created Parcel B: a resubdivision of Lots 1.4 and 17, Block 7, Vail Village lst Filing. Parcel B is roughty 9Or x lOOl with a narrorir dog leg that extends to the east of the property. This parcel contains slightly more than 12r5OO square feet, which is the minirnum lot size for the Single Farnily zone district. This parcel was created through a previous subdivision action by Mr. Tennenbaun. Mr. Tennebaum resubdivided the Prirnary/Secondary zoned Lots 14 and 17 into three parcels. Parcel A which remained a priroary/Secondary
zoned property and Parcel-s B and C which each becane Single Fanily zoned parcels.
The applicant, who still controls the adjacent parcel A, has stated a willingness to restrict development on parcel A to a distance of 25 feet from the property line. By restricting this development through either covenants or deed restrictions, the applicant would provide a 30 foot separation between structures equal to the normal 15 foot setback from each property line. The proposed site
development which encroaches up to 1.0 feet into the required 15 foot setback fron property line also entails creating an access easenent, retaining wall and asphalt drive through this 30 foot area. The actual driveway that accesses pircel
B initiates approxirnately 20 feet from the property line on Parcel A.
In an effort toward conpromise, the staff reguested the applicant to maintain this 30 foot buffer as undisturbed open space. The applicant, however, declined to amend the site plan and design prograrn to allow this buffer. The side setback area requested for encroachment contains several fairly significant natural features, including two large

Upon review of Criteria and Findings, Section 18.Gl.060 of the municipal code, the Department of Community Development recommends denial of the requested setback variance based upon the following factors:
Consideration of Factors:
In a situation where the average slope underneath proposed parking areas exceeds 3O?, staff and Design Revj_ew Bolrd. rnay waive the reguired front setback standardt. The garage area for this proposar meets this criteria, so the tocition of the garage in the front setback of this proposal is not an issue.With regard.to the encroachrnent into the side setback, staff feels that if the applicant were willing to restrict development including site work to a 25 foot setback on Parcel A through a deed restriction or covenant to which the Town is a party, there would be little inpact on other potential structures in the vicinity.
The Community Development Department staff feels that approval of this request would be a grant of special privilege. we believe that there is little to no physical hardship on this parcer requiring a side setback vir-iance.In fact, we see significant natural features on the lot located within the L5 foot setback which enhance the site and should be preserved.
The subdivision regurations are designed to ensure that an adequate buirding envelope will be cieated during developnent or subdivision of any 1ot. The applicant, throu{h recent previous actions, created this lol- and should be-able to design within the parameters of that parcel of ground which he has created. Any clairo of hardship aue to fot size or shape is self imposed by the owner as a result of the previous resubdivision application.

There are exceptions or extraordinary circumstances or conditions applicable to the same site of the variance that do not apply generally to other properties in the
same zone.
The strict interpretation or enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same district.
IV. STAFF RECOMMENDATTON
Staff recommendation is for denial of the side setback variance. we feel there is no physical hardship driving the side setback request and feel that it would be a grant of special privilege. Indeed, physical features within the area of the 15 foot setback warrants its preservation. This lot
was recently created and great efforts were taken at that tine to ensure that this tot did neet the ninirnura lot reguirement for this zone district. We feel adequate space exists for the siting of a single farnily structure without reguiring a setback variance. Fina1ly, any hardship is self-
imposed by the owner through his previous minor subdivision reguest and subsequent design.

Dear Rick:
We are requesting side setback variances for Parcel A and
Parcel B, a resubdivision of Lots 14 and 17, VaiI Village First Filing. Please refer to the enclosed site plan,
Exhibit A.
We would like to change the east setback of Parcel A from 15r-0'to 25r-0'and the west setback of Parcel B from 15r-0" to 5r-0". These changes would still maintain a
30t-Ott clear setback separation between Parcels A and B.
The following reasons apply to our request:
1. It is understood that a portion of our hardship may
be considered to be self=imposed due to the recent resubdivision of Lots 14 and 17. However, the critical positioning of the proposed residence is
meant to respect those views and open spaces currently enjoyed by aIl other existing parcels.
The easternly "dog-leg portion" of Parcel B will be
an undeveloped portion of the property primarily for the purpose of.protecting the view corridors of
Parcels A, B and C of the resubdivision.
2. A 10r-0" setback reduction from the west property line would provide a better buffer between the existing Parcel C residence and the proposed residence. The separation would provide better light and air between these two adjacent properties.

Many of the larger and healthier spruce and fir trees are located on the eastern portion of Parcel B. It is our intention to preserve these trees as
much as practical by keeping the proposed residence further to the west.
The views for the proposed residence on Parcel B will be greatly enhanced by bringing it closer to the western property line $rithout interfering with other properties in the adjacent area. Al1 heights for the proposed structure will be within the
zoning limits for the property.
In conclusion, we feel that by increasing the eastern
setback of Parcel A to 25'-0n from its existing 15'-0" will
accommodate a reciprocal setback adjustment of 10r-0rr to the
west property line of Parcel B. The creation of a 30r-0tr structure separation would result which is currently
observed by the Town of Vai] zoning ordinances for such properties. This would follow the intent of the Town's
zoning regulations.
We hope the Town staff duly considers this variance request.

Rick Pylnan showed site plans and explained that the applicant
hras requesting a 10 foot variance from the 15 foot side setback regulrenent for a lot which had recently been created by the applicant. Rick stated that the applicants also owned the property to the east (Parcel A) and were willing to restrict development on Parcel A to a distance of 25 feet from ttre property line by use of a deed restriction or covenants. Rick explained that the staff requested that this area be left as undisturbed open space, but the applicants declined to leave this buffer undisturbed. Rick also stated that the sid.e setback area reqluested for encroachment contained several fairly significant natural features, inctuding two large spruce trees. The staff recommendation was for denial of the side setback variance because they felt there was no physical hardship driving the side setback encroachnent and felt it would be a grant of special privilege.
Jay Peterson, representing the applicants, stated that the applicants could have achieved the requested setbacks if they had requested a special developrnent district. but had preferred to go through a subdivision process instead. They felt that any problems could be achieved through the variance procedure. He felt the integrity of the setbacks was being maintained.
J.J. Collins stated that he did not see why a building could not be designed in such a vray that it remained within the setbacks and did not destroy large trees. .fay replied that this was the area in which to place the house to take advantage of the views.

J.J. pointed out that the applicant had a clear lot on which to build and plenty of room. Jay replied that when the trade-offs
became too great, they decided to ask for a variance. He added that hundreds of hours lrere spent on various schemes on all three sites.

Peggy asked if there was any interest in protecting the two evergreen trees that would be lost. Jay replied that they were already spending a lot of money on l-andscaping. peggy said J.J.did a good job of expressing her views. She felt that she would work with the proposal if the lost landscaping would be replaced.
Jay stated that a landscaped buffer could be a condition of approval . Kurt Cegerberg stated that they were trying to bring landscaping into the building area and attention would be paid to bring landscaping into the buffer area.
Diana felt it was too bad that the applicant first created the lot and then could not design a house to fit the lot.
Jay replied that he could have asked for a special development distict and gotten rid of the property line and kept within the interity of the zone code and received approval . He added that he would rather use the variance procedure as long as he could keep the integrity of the zone code.
Sid shared a lot of the feelings the other nembers stated. He wished it hadnrt gotten to this state, but feJ-t if there hras a 30r buffer between the houses, it would preserve the distance factor. He added that he did not feel driven to preserve the rock outcropping.
Pam felt that there was no trardship on which to base the granting of a variance.
Jay replied that any tine the PEC is given a variance, they look at it on a site by site basis, that each project stands alone.
Jiur Viele agreed with Jay with respect to the proces. He add.ed that if there is no objective judgernent involved, there would be no variance procedure. He stated that in the overall view,the purpose of the setbacks is to maintain the distance of separation between dwellings. He wondered if the project would be a better one if it conformed to the setback regulations and added that he would rather see the house where is was proposed.to be rather than take out additional trees.
J.J. asked why the house was sited where it was on parcel A to the west, and Kurt replied that they were trying to pick up views of core Range and down val1ey and that tne awelting was broken up to help to reduce the massiveness of the project.
J.J. stated that on Parcel B he saw plenty of room within the required setbacks.
Curt said he could not arg"ue with the fact that one can fit
(something on the lot, but the trees hrere a major concern. Jay added that on any given site one can build without going into setback areas, but it may make an uninteresting town.J.J. pointed out that each tine he had seen the pEc challenge an architect, ttre architect had been able to come up with a plan within the setbacks. He repeated the fact that the architect in this case had a clean piece of property. Jay answered that they had voluntarily torn down the existing structure and should be given latitude to build, that they were being penalized for naking a clean site.
Viele spoke in favor of the proposal as long as the buffer would remain. Jay anshrered that there would be a deed restriction that only the Town of Vail could remove the buffer.
Parn Hopkins pointed out that another owner could hire Jay to ask to remove the buffer. She added that the pEC !,ras going through this process because parcel A had to be a ninimum iite.Jay said the purpose of the subdivision was to stop from having two old hornes being added onto. He added that they knehr they night have to ask for variances when they planned the subdivision.
Peter Patten felt that the natural features should be preserved within the L5 foot setback area and added that this was a self created hardship.
Jim Viere rnoved to approve the variance with the findings that the strict or literal interpretation or enforcernent of the specified regrrlation would result in practical difficulty or unnecessary physical hardship inconsistent with the obje-tives of the zone code. He specified that particular attention be paid by the DRB of landscaping planned to be in the 30 foot buffer. Sid seconded the motion and the vote was 4 in favor and 2 (JJ and Pam) against.

Betsy Rosolack presented the proposal, stating that the applicants wanted to build two 2-car garages and additional square footage allowed under ordinance 4 of 1995. The staff reconmendation was for denial as it was felt the additions could be constructed within the setback areas.
Tom Briner, one of the architects on the project, spoke in favor-of the project and Dan Rickli, another architect,extrrlained that there seemed to be a discrepancy in the arnount of square footage that they were adding. Jerry Lewis and John

Diana agreed and added that hei niin concern was the stream setback.

Pam asked if valet parking was pranned for the commerciar area,and Jay replied that it was not. Joe Staufer stated that he had 30 - 50 parking spaces that are always empty. He added that the Sonnenalp, Plaza, and BeIl Tower had all expanded and none had added any parking.
Jay then pointed out that there were no large projects being constructed at this tine which were not phased.
Pam agreed with the parking, and felt that perhaps more locaLs wouLd be using this parking lot. Sid also a:.a not have any problem with the parking and felt that to receive the 4rOO-0 square feet of space in the building was better for the Town than for the Town to receive g15,OOO to relocate the Ski Museum. He did feet that the new residential units shourd be controlled for public use. Diana felt the units needed to be availabre for rentar. she felt that the Museum rerocation must be worked out and nrust be a part of this arnendment.
Joe Staufer felt that the Town did not gain anything by rrkicking the owner outrr especiarry if the ownei wanted-to be in Vail for two months in the summer. Mr. staufer suggested that the unit be available for rental and not be the prliary residence of the ohrner.
Diana stated that she did not patronize many of the stores in the Vail village rnn cornprex because she did not have any prace to park. Diana asked for a con:nitnent to finish the ruirainq as proposed. However, she still felt that there would be a parking problen. Jay said that for the parking to work, a1l the phases must be done.
Peggy osterfoss felt that the proposal should include assurance that the deveroper wirl retocate the ski Museum and rel_andscape because a landscaped area was being removed in the proposal .Jay repried that with the new proposar, the Town of vai-l wourd end up with a large chunk of real estate. He added that the applicant was willing to participate in redoing the intersection. Peggy stated that lhe did not wait to see the landscaping issue lost in the shuffle, and felt the responsibility rested with the developer.

Joe Stauffer said he would like to be able to pay into the parking fund as did businesses in Commercial Core I and II.J.J. suggested that perhaps Staufer could pay the Town for parking at building perrnit tirne and the Town could repay Staufer when his parking was conplete.
The Ski Museum uas discussed. Torn stated that at present the
amended SDD did not address the needs of the Ski Museum. Jay pointed out that the space offered to the Tolyn was worth 91 Million. J.J. said it seemed like an opportunity for the Town,the space could be sold for a substantial amount of cash. Tom pointed out that one condition was that it be used for the public. Jay stated that they were willing to remove that stipulation.
J.J. felt the key issue of the owner/rental question was occu-pancy and this issue was discussed. Also discussed was the deretion of landscaping for parking. saundra srnith stated that they were willing to remove two parking spaces and place landscaping in place of the spaces.
Peter felt to approve the proposed shortfall of parking would be inconsistent. He pointed out that the Westin was not able to do any more construction until the parking structure hras finished. He stated that the plaza and BeII Tower were different, in that they were in a pedestrian area and paid into the parking fund. He pointed out that the proposal under construction was adjacent to the 4-sray stop with vehicre access and must have on-site parking.
J.J. discussed the parking figures. Joe Staufer proposed to make the dwelring units be available for rental when they were unoccupied.
Sid Schultz moved and J.J. Collins seconded to approve the amendments to SDD 6 as submitted with the following conditioins:
The use of the units be restricted to non-primary residence and be part of a rental pool .
The applicant shall participate in and not remonstrate against a special improvement district for the intersection of VaiI Road and Meadow Drive.
