In consideration of the issuance of a revocable permit for the structure above indicated, applicant
agrees as follows:
1. That the structure herein authorized on a revocable permit basis is restricted exclusively to the land above
described.
2. That the permit is limited specifically to the type of structure described in this application.
3. That the applicant shall notify the Project Planner and Public Works Department, or their duly authorized
agent, twenty-four hours in advance of the time for commencement of construction, in order that proper
inspection may be made by the Town.
4. The applicant agrees to indemnify and hold harmless the Town of Vail, its officers, employees and agents
against all liability, claims and demands on account of injury, loss or damage, including without limitation
claims arising from bodily injury, personal injury, sickness, disease, death, property loss or damage, or any
other loss of any kind whatsoever, which arise out of or are in any manner connected with applicant's
activities pursuant to this permit, if such injury, loss, or damage is caused in whole or in part by, or is claimed
to be caused in whole or in part by, the act, omission, error, professional enor, mistake, negligence orother
fault of the applicant, his contractor or subcontractor or any officer, employee or representative of the
applicant, his contractor or his subcontractor. The applicant agrees to investigate, handle respond to, and to
provide defense for and defend against, any such liability, claims, or demands at the sole expense of the
applicant. The applicant also agrees to bear all expenses relating thereto, including court costs and

Applicant agrees to procure and maintain, at its own cost, a policy or policies of insurance sufficient to ensure

Apptiiarits further agree to release the Town of Vail, its officers, agents and employees from any and all
liability, claims, demands, or actions or causes of actions whatsoever arising out of any damage, loss or injury
to the applicant or to the applicant's property caused by the Town of Vail, its officers, agents and employees
while engaged in maintenance or snow removal activities or any other activities whatsoever on Town of Vail
property, streets, sidewalks, or rights-of-way.
That the permit may be revoked whenever it is determined that the encroachment, obstruction, or other
structure constitutes a nuisance, destroys or impairs the use of the rightof-way by the public, constitutes a
traffic hazard, or the property upon which the encroachment, obstruction, or structure exists is required for
use by the public; or it may be revoked at any time for any reason deemed sufficient by the Town of Vail.
That the applicant will remove, at his expense, the encroachment, obstruction, or structure within ten days
after receiving notice of any revocation of said permit.
That the applicant agrees to maintain any landscaping associated with the encroachment on the right-of-way.
That in the event said removal of the encroachment, obstruction, or structure is not accomplished within ten
days, the Town is hereby authorized to remove same and have the right to make an assessment against the
property and collect the costs or removal in the same manner as general taxes are collected.
That the applicant has read and understands all of the terms and conditions set forth in this application.
The Revocable Right-of-way Permit fee is 935.00; $'11.00 of the fee pays for Eagle County Clerk and
Recorder recording. Make checks payable to Town of Vail.

In oddltion to the chonges submitted to you lost October 3lst,; three other oreos
hove been odjusted, First, the eost elevotion wos revised is to ollow on
unintenupted view of the Gore Ronge. This is done by chonging window #38 to
motch window #36 ond reducing the triple door to o single. The west elevotion
(odding o tronsom window) wos to emit more light into the bedroom. The owner
felt the room wos too dork, Lostly, the double door lo the rlght of the entry door
wos chonged to o window becouse Mr. Frompton chonged his mind obout the
necessity of outside occess to thot porticulor room.
Wlth the exception of the odded tronsom ln the moster bedroom, the olterotions
occur within the existing rough opening heights ond widths.
Pleose find the occomponying drowlng indicoting the requested chonge of
windows.

building deiportment noted thot the potentiol of odditionol GRFA exists in the

My calculation for the allowable area of the structure is based on 20,734 s.f. lot
size. Zoning for this property is two family.
46 s.f. per 100 for the first 10,000 s.f. lot area = 4600 s.f.
38 .s.f per 100 for the next 5,000 s.f. lot area = 1900 s.f.
13 s.f. per 100 for the remaining lot area = 745 s.f.
total allowable = 7245 s.f.
Actual area for the structure is as follows:
garage level = 665 s.f.
lower level = 1882 s.f.
main level = 3033 s.f.
"loft" area = 1037 s.f.

My observation of the easterly garage level space (below living room) to be

Dear Duane,
The Town of Vail Public Works Department has reviewed the Design Review application for the
proposed Frampton residence located at l4 Beaver Dam Road. The following are the comments
from their review:
1. Provide a grading plan on l':10' or l':20' scale.
2. Per the Town of Vail site distance standard, lf backing vehicle out onto Beaver Dam Rd.
Driver must be able to see 250' in both directions from 15' inside of driveway. Proposed
boulder walls and new landscaping cannot exceed 3 ft in height. Existing Pine Trees on
West side of driveway will have to be trimmed, 7 ft from the ground. Show on site plan.
3. Is Driveway heated? If yes, driveway within the Town of Vail right of way must be on a
separated zone and marked at the control box. Show on site plan. Area in ROW maybe
highlighted.
4. Show on site plan, Snow storage area. l0o/o for heated driveway, 30o/o for unheated , all
within property boundaries.
5. Show proposed positive drainage from south side of SFR. ( low areas)
6. Provide stamped approved drawings of boulder retaining wall from a license PE. Single,
double and triple tier wall drawing must be submitted when apply for a building permit.
On the south west side of lot, boulder wall is shown at 9 ft, no wall allowed to exceed 6 ft
in height. Adjust and revise. Also 4 ft bench befween walls is required, adjust bench just
above proposed tenace on south east side oflot. On the front set back no wall can exceed
3 ft in height. Adjust and revise.
7. Show some form of Erosion Control on site plan near Beaver Dam Rd.
8. Need additional information on Staging Plan. Proposed access.
9. Show on site plan all required parking spaces.

The structural framing of the above residence was observed by Monroe & Newell
Engineers, Inc. during constuction.
It is our opinion, based on our limited visual observations, that the framing of the
residence is constructed substantially in compliance with the intent of the construction
documents prepared by our office. To the best or our knowledge, any deficiencies found
during our observations have been corrected. The attached package ofstructural addenda,
field reports and answers to RFI questions were reviewed in the field by Monroe &
Newell Engineers, Inc..
