Buy some qua.ts of the paint corors I've given you. In an area about 4 or 5 feet
square, where all the colors come together,.put rip your sample. A cornice area is usua.lly

the gray intended for the window trim, we thought it looked too dark (this was before the main green
$as on the body of the house.) Jack ran to the paint store to find another color. He came home with
two different shades of gray (one with a blue tinge and one with a yellow tinge) and a yellowish green.
We sfapped some test patches on and YIKES! That's when we realized there was a reason we had paid

AN EXPI.ANATION OF THE COLOR SCTIEME FOR
THE I-AUGHING MONKEY
Our two main concerns in creating a design for the building were first to make
,the shop stand out from it's comriercial neighbors as a unilue and exciting buiiness and
second, to make sure we do not overvhelm the condos behind or make impact them in any
negative way.
To address this last concern we starled by selecting a light color for the stucco. This assures
that the store will not jump out from the connected architecture behind. We have also selected
a fairly dark fascia color so that there is a similarity in style what with the dark fascias of the
condos bejng a significant design staternent. These two visual similarities will create a strong
visual tie to the back building even though the colors are quite dissimilar.
Where the front colors break with the rear will separate the front and back buildings allowing
the condos to distance themselves from the commerce going on in the front and I think, give
the condos a better look by now stepping bacA and differentiatirrg themselvcs.
For our body color we picked a light yellow which will blend well with the stone color. This
stone is very handsome and making sure that it works well with the stucco will make the condos
look good as well because the stone is quite imponant to them a-s well.
This is a fun shop, we want people to feel that they will have a plea^sant experience when they
go inside; To tiat end we complemented the yellow stucco color with a fashionable, yet
natural, green to create a sense of freshness and light-heartedness. We have also eliminated the
foreboding darkness which the windows lrave now. Light colored windows open a building up
and make it feel airy and sunny so oui new trim color will go a long way to changing the
demeanor of the cunent look.
As stated above, we have used a dark green for the fascias to feel in kind with the upper fasicas
of the background building. The other thing this color does is it cornpletes the color scheme
insuring that all the colors feel nanrral and have kinship to the colors in the hills and
mountains surrounding the village.
Lastly we have given over to sorne serious color firn but in a manner that only serves to highlight
the shop entrance in such a way that it will not impact the decorum of the condos in any way.
We have picked a deep plum for the door trim which will create a real focus for the entrance
while at the same time adding some life to the dark brown anodized door. And I am sure we
do not have to point out how much this color will highlight the signage.
So we have created a good look for the whole building while making a needed change in how
well the business attracts cudtomers, drawing them in and pre selling.thern at the same time.

Dear Dan:
This is to confirm that I have made a final framing inspection of the above noted addition. I have found
that this framing confonns to the plans and specifications issued by this office with only a couple of minor
modifications, which are hereby approved by this office.
The hangers for the ridge and valley beams at the existing building line were not coordinated with this
ofTice during construction. The hanger for the west valley is adequate as constructed, but the hangers for
the ridge and east valley do not have a sufficient number of bolts through the beams. A saddle seat should
be welded to the existing side plates to achieve a minimum of 2" of bearing under these two beams.

Dear Dan:
This is to confrm that I have inspected the site for the above noted addition prior to the forming of the
footings. At the time ofthis visit, the bearing soil was exposed and had been compacted in the areas where
the footings are to be located. The soil was fairly dry throughout tlle excavation.
Since the foundation design for this project was based upon a fairly light assumption, I am comfortable that
the footings can be poured on the native soil.

Dear Mr. Murrain;
As the representative for the Laughing Monkey, I am requesting an appeal from
the Uniform Building Code standards for accessibility for existing buildings
because of physical site contraints and because the cost of compliance would
exceed 25 percent of the total pro.ject cost.
Because of the existing building conflguration, elevation, and location of
the property, ramp access to the Laughing Monkey is not possible. Therefore
we have studied the alternative of installing a vertical wheelchair 1ift.
The only site area available to install a lift which could a11ow access to
the Laughing Monkey is in the southeast corner of the Creekside Building
property. In order to be within the property, a lift will need to be located
so that the line of ingress and egress are para11e1 to the existing deck.
Therefore an exit platform at the deck leve1 i-s required.
The cost to provide wheelchair accessibility to the Laughing Monkey is
$17,175.00. This figure if based on Vertical Wheelchair Lift CDE-72 from
the National Wheel-O-Vator Company, Tnc., furnished and installed by Access
Elevator Company, Denver, Colorado; the required exit platforrn; and screen
wa11s on the two public faces of the unit.
The above cost assumes that the Town of Vail Planni.ng and Environmental
Commission and the Design Review Board vould approve the installation in
this location with ninimal enclosure and screening, stuccoed rather than
stone veneer wa11s, no decorative treatment to the gate, and no additional
landscaping.
The elevator quote was given by Ron Brewer of Access Elevator. It is identical
to the one installed at Garton?s in late L992 at a cost of $10,200.00. The
construction costs for the exit platform and screen wa11s were provided
by Albert Ewing of Spencer Concrete, Inc., the general contractor for the
project.

exceeding the 25 percent referenced in Section 3lL4(a)2. of the Uniform
Building Code.

III. IMPORTANT NOTICE REGARDING AI,L SUBMISSIONS TO THE DRB:
A. In addition to meeting submitt.al requirements, the applicant must stake and tape the project site to indicate property lines, building Lines and building corners. All trees to be removed must be taped. AII site tapj.ngs and staking must be conpleted prior to the
DRB site visit. The applicant must ensure that staking
done during the winter is not buried by snow.
B. The review process for NEW BUILDINGS normally requires
tvro separate meetings of the Design Review Board: a conceptual approval and a final approval . Applicants
should plan on presenting their development proposal at a minimum of two meetings before obtaining final
approval.
C. Applicants who fail- to appear before the Design Review
Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB docket until such time as the item has been
republished.
D. The following items may, at the discretion of the zoning administrator, be approved by the Community
Development Department staff (i.e. a formal hearing before the DRB may not be required):
a. Windows, skylights and similar exterior changes
which do not alter the existing plane of the building; and
b. Building addition proposals not visible fron any other lot or public space. At the time such a proposal is subrnitted, applicants must include letters fron adjacent property ovrners and/or from the agent for or manager of any adjacent
condominium associatlon stating the association
approves of the addition.
E. ff a property is located in a mapped hazard area (i.e.
snow avalanche, rockfall, flood p1ain, debris flow,wetland, etc) r a hazard study must be submitted and the
owner must sign an affidavit recognizing the hazard report prior to the issuance of a building permit.
Applicants are encouraged to check with a Tovrn Planner prior to DRB application to determine the reLationship of the property to all mapped hazards.
F. For all residential construction:
a. Clearly indicate on the floor plans the inside
face of the exterior structural walls of the building; and b. Indicate with a dashed line on the site plan a four foot distance from the exterior face of the building walls or supporting columns.
If DRB approves the application with conditions or modifications, all conditions of approval rnust be
resolved prior to Town issuance of a building permit.

3. Existing trees or groups of trees having trunks with diameters of 4n or more, as measured from a point one foot above grade.
4. Rock outcroppings and other significant natural features (Iarge boulders, intermittent streams,etc. ) .
5. Hazard areas (avalanche, rockfal1, etc.),centerline of stream or creek, reguired creek or
stream setback, 1OO-year flood plain and slopes of 40* or more, if applicable.
6. Ties to existing benchmark, either USGS .Iandmark or sesrer invert. This information should be clearly stated on the survey so that all
measurements are based on the same starting point.
This is particularly important for height
measurements. See Policy On Survey Information,for more information regarding surveys.
7. Locations of the following:a. Size and type of drainage culverts, swales,etc. must be shown.
b. Exact location of existing utility sources

VII. FINAL STTE PLAN
Once a building permit has been issued, and construction is
underway, and before the Building Department wil.l- schedule a framing inspect.ion, two copies of an Improvement Location Certificate survey (ILC) stamped by a registered professional engineer must be submitted. The following information must be provided on the fLC:
A. Building location(s) with ties to property corners,i.e. distances and angles.
B. Building dimensions to the nearest tenth of a foot.
C. A11 utility service line as-builts, showing type of material used, and size and exact location of Lines.
D. Drainage as-built.s.
E. Basis of bearing to tie to section corner.
F. All property pins are to be either found or set and stated on improvement survey.
G. A1l- easernents.
H. Building floor elevations and all roof ridge elevat.ions with existing and proposed grades shovrn under the ridge Iines.
vrrr.coNcEPruAL p|tcN REvIEw
A. Submittal requirements: The owner or authorized agent of any project requiring design approval as prescribed
by this chapter may submit plans for conceptual review by the Design Review Board to the Department of
Community Development. The conceptual review is intended to give the applicant a basic understanding of the compatibility of their proposal with the Town, s
Design Guidelines. This procedure is recornrnended primarily for applications more conpl-ex than single-family and two-family residences. Hovrever, developers of single-family and two-family projects shall not be
excluded from the opportunity to reguest a conceptual design review. Complete applications must be submitted 10 days prior to a scheduled DRB neeting.
The foLlowing information shall be submitted for a conceptual review:
1. A conceptual site and landscape plan at a minimum scale of one inch eguals twenty feet,.
2. Conceptual elevations showing exterior materials
and a description of the character of the proposed
structure or structures;
3. Sufficient infornation to show the proposal
complies with the development standards of the
zone district in which the project is to be located (i.e. GRFA, site coverage calculations,
number of parking spaces, etc.)i
4. Completed DRB application forn.
B. Procedure: Upon receipt of an application for
conceptual design review, the Department of Community
Development shall review the submit.ted materials for general compliance with the appropriate requirements of the zoning code. If the proposal is in basic
compliance with the zoning code requirements, the project shall be forwarded to the DRB for conceptual review. If the application is not generally in
compliance with zoning code requirements, the application and submit.tal materiaLs shall be returned to the applicant with a written explanation as to why the Community Development Department staff has found the project not to be in compliance with zoning code reguirements. Once a complete application has been received, the DRB shall review the submitted conceptual review application and supporting material in order tO
determine whether or not the project generally complies with the design guidelines. The DRB does not vote on
conceptual reviews. The property owner or his
representative shall be present at the DRB hearing.

RE: CREEKSIDE WINDOW
This project is an addition of a window on the north waII of the
Creekside Building. Project has been on hold because of lack of signature and condominium letter. The applicantts representative,
Rusty Wood, was in the process of getting these requirements,
although I have not heard from him since. I have since attempted to reach Rusty Wood to no avail.
