information is reguired:
1, A completed sign,/awning application (attached) .
2. A site plan showing the exact location where the sign
is to be located.
3. A photograph if possible and building elevation showing
the location of the proposed sign.
4. A scaled drawing which details the design of the sign,
as follows:
(a) Colored exactly as sign wil-I be.(b) A lisl of materials to be used in si-gn (metal,
wood, canvas, pai.nL, etc, )(c) Photograph of sign if available.(d) Specific lettering style and size.
5. If an awning is proposed, submiL drawings showing
exactly how and where Lhe awning is at-tached to the
building and how the awning is to be constructed.
6. Description of lighting that wiLl be used in
conjunction wj-th the sign or awning'. If proposing an
awning, Iighting is not alfowed to shine through the entire awning which cal1s undue aLtention to the
business. Lighting nay spotlight. only the ilctual sign
lettering on the awning.
RECOMMENDATIONS OR POINTERS
1. Check sign code - verify site, height etc.2. Be specific. Vagueness on design, size, construction may
delay the approval, of your sign.3. Measure frontage of business.
APPLICATION FEE WILL BE REQUIRED AT THE TIME OF APPLICATTON
SUBMITTAL.
If this applicat.ion requires a separate review by any local,
Stat.e or ['ederal agency other than t.he Town of Vail, the applicat.ion fee shall be increased by $200.00. Examples of such review, may include, but are not limit.eci to: Colorado DeparlmenL of Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shal-1 be responsible for paying any publi.shing fees which are in excess of 50% of the application fee, If, aL the applicantts requestr dDy matter is postponed for hearing, causing the matter to be re-published, then, the entire fee for such re-publication shall be paid by the applicant.
Applications deemed l,y the Community Deve.lolrmenL Department to have significant <1esi.gn, land use or other issues which may have a significant impact on the community may require review by consul-tants other that town staff. Should a determination be
rnade by the town staff that an outsj_de consul-tant is needed to review any apptication, Community Devel-opment. may hire an outside consultant, it shall estimate the amount of money necessary to pay him or her and this amount. shall be forwarded to the Town by the epplicant at the time he fil-es his application with the

Two Sign Variance reguests for Up The Creek Bar
and Grill located at 223 Gore Creek Drive in Gore
Creek Condominiun Building A (Creekside Building)Applicant: Peter Stadler
I. BACKGROUND
Up the Creek Bar and crill is located adjacent to Gore Creek in the core creek building. A public park is located west of and iurmediately adjacent to the building. There is no pedestrian traffic in front of the building, however, there is pedestrian traffic along the promenade south of the building.
At issue is an existing sign located on property which Up
The Creek Bar & Grill leases frorn the Town of Vail. In June of 1-989, Up The creek Bar & Grill received approval to
enclose their existing dining deck and create a new dining
deck on Town of Vail property. The submitted and approved plans called out the location of proposed signage and lighting. Throughout the diningrzdeck area review and
approval process, the restaurantrs proposed signage and lighting were not forrnally addressed by the applicant,
Conmunity Development Department, Design Review Board or
Planning and Environmental Commission. However, because the location of the proposed signage was shown on the approved
deck plans, the applicant assumed the proposed signage and Iighting were approved and had then installed.
Prior to incorporation into the free-standing sign, the face
board was affixed onto ttre restaurantrs west facade.
IT. THE REOUEST
The request involves the following section of the Town of vail sign code:
l-5.20.050 Freestanding Signs - Single Business Use
A. Purpose. to identify a business or organization being the sole business occupant within a building. The identification sign or signs for a business or organization rnay include the name of the business or
organization and the general nature of the business
conducted within or upon the premises. In no instance,
however, shall. the total portion of the sign describing the general nature of the business exceed 40 per cent of the total area of each sign perrnitted for this
purpose. The description of the general nature of the
business shall be incorporated into the sign or sign identifying the name of the business and should not exist as a separate sign.
E. Location, on the grounds of the building and adjacent to rnajor pedestrian hray which the building abuts,subject to the approval of the Design Review Board.
The applicant is reguesting the following:
1. Design Review Board and Toqrn Council approval to place a sign on public property.
2. Approval to allow a free standing sign for a single business in a rnulti-tenant building.
On July 24, 1990 the Tolrn council voted to allow the applicant to go through the sign variance process.
Following review and approval of the design and location of the signage by the Design Review Board, the
Town council will revien the issue of locating the
signage on Town of Vail property.
III. FINDINGS AND STAFF RESPONSES
Before the Board acts on a variance application, the applicant nust prove physical hardship and the Board must find that:
A. There are special circumstances or conditions applvinq to the land. buildings. topoqraphv. vegetation, sicrn structures or other matters on adjacent lots or within the adjacent right-of-way which would substantially
restrict the effectiveness of the siqn in cruestion;provided, however, that such special circumstances or
conditions are unique to the particular business or enterprise to which the applicant desires to draw attention and do not apply qenerallv to all businesses or enterprises.

The applicant believes that the restaurant has poor visibitity from the southern pedestrian approach as a result of a gallery awning located between the
restaurant and the pedestrian traffic and further that It is criticaL to the success of his operation to have this southern sj-gnage exposure.
There do not appear to be any good solutions to effectively incorporate the sign into the existing structure and stitt provide southern exposure.
Ilowever, the applicant could possibly accomplish his
southern visibility objective through a different sized
sign orr awning.
4n staff does not believe there are special circumstances
which warrant the granting of the requested variances.In fact, staff believes the applicant could place a
nenu board at the location of existing sign and still
neet his objectives while also cornplying with the sign
code.
B. That special circumstances were not created by the apolicant or anvone in orivv to the aoolicant.
Special circunstances nere not created by the applicant.
c. That the granting of the variance wiII be in general
materiallv detrimental to the persons residing or
working in the vicinity, to adiacent propertv, to the
neiqhborhood. or to the public welfare in qeneral .
Although the existing signage is consistent with existing projecting and wall- nounted signs, and
displays the type of business in a direct and
reasonable manner, there do not appear to be other
instances where a single business in a multi-tenant building has been allowed a free-standing sign. Staff
does not believe the granting of the variance is ln general harmony with the Sign Code.
D. The variance applied for does not depart forn the
applied for departf fron the provisions of sign code
more than is reguired to identify the applicantrs
business and use.
IV. STAFF RECOI,TMENDATIONS
The community DeveJ.opnent Department staff reconmends denial of the reguested variances.

Sign Variance Request-Gore Creek Condominium Building A
We are requesting permission for a single-tenant, free-standing sign to be located at the edge
of the outdoor patio west of the restaurant entrance as indicated on the site plan.
The regulation states the restriction of free-standing signs for multi-tenant use.
The subject restaurant is on the northwest corner ofthe Gore Creek Building adjacent to the
Gore Creek. The greenhouse addition and patio was built not only for additional setting, but
also for improved visibility.
The options for placernent of signage are limited as it is imperative that it face pedestrian
trafftc to the south. If placed on the south face of the greenhouse, it would be greatly
obscured and shaded by the adjacent gallery's awning. The proposed free-standing sign lends
ready viability to the south. Colors, lettering and graphics relate to the restaurant. The
physical sign is unchanged from the sign that was originally approved by the Town of Vail.
The sign is well removed from the other building's businesses and it was felt that it would
not create any confusion for other tenants.
The proposed sign is on land that "Up the Creek" is leasing from the town of Vail.

We have three major concerns about your restaurant.
1. I spoke with Peter last week, and he stated that he would pick up a sign variance application fron our department. As
he has not yet picked it up, I am enclosing the application.
At present, you have a sign that is on Town of Vail property
and a sign which also should not be freestanding. AII signs
must be located on the ownerrs property. Further, a freestanding sign is perrnitted for a building that has a single business use only. Therefore, yot nust request
variances fron Section 16.20.050, Freestanding Signs-Single
Business Use, A. Purpose and from E. Location.

Council . rt will be up to these boards to decide whether or not they are in favor of a freestanding sign in a nulti-
tenant building and located on Town of vail property. The staff finds that this request will be difficult to support.

which to resolve the problern.
2. The drain pipe on the northwest corner of the restaurant nust be connected to perrnanent underground drainage. Peter indicated that he would write a letter stating when this work will be done, but to date we have not received the letter. We are asking that you subrnj.t this letter by July 18, 1990.
This drainage work must be conpleted by Septernber 30, 1990.After that tine, it is possible that the ground may becone
frozen.
3. The paving on the north side of the restaurant extends 2 feet farther to the creek than is shown on our copy of plans
approved by the Design Review Board. Although Mike Hazard sent us a copy of plans which did show the pavers in their present location, I spoke sith Rick Srlman, and he does not recall approving the increased paver area. In the event that the streamwalk is constructed in this location, these pavers may have to be moved.
We are anxious to resolve these issues, and ask for your
cooperation. If you have questions or conments, please do not hesitate to call.

As outrined in the Zoning code, review criteria for requests of this nature are established by the vail Virrage urban 6esign Guide Plan. The emphasis of this review is on ttre projectis compatibility with both the urban Design Guide plan and the vail Village Design considerations. Detailed architectural and randscape considerations become the purview of the Design Review Board if this project is approved. Flanning commission is also charged with addressing stindard zoning issues not covered in the Urban Design Guide plan.

The Proposal . The applicant, Up the Creek Bar and Grill,Inc. is requesting to construct a nelr greenhouse addition in the amount of 250 square feet. The location of the addition is on the west side of the existing restaurant known as Up the Creek Bar and Grill.
Compliance with the Purpose Section of CCl Zone. As stated in Section L8.24.0L0 the Commercial Core One District is
intended to provide sites and to naintain the unigue character of the VaiI Village Conmercial Area with its
mixture of lodges, residential dwellings and conmercial
establishments in a predourinately pedestrian environment.
The Commercial Core One District is intended to insure
adequate Iight, air, open space and other amenities appropriate to the permitted tlpes of buildings and uses.
The District regulations in accordance with the Vail Village
Urban Design Guideplan and Design Considerations prescribe
the site development standards that are intended to insure the naintenance and preservation of the tightly clustered
arrangements of buildings fronting on pedestrian ways and public greenways and to insure continuation of the building scale and architectural quality that distinguish the
Vi11age.
The proposed addition is in compliance with the intent of the Zoning for CC1 District.

There are no Sub Area Concept areas relating to this addition. However, this addition and the completion of the patio in interloeking brick pavers will be one more step in the conpletion of the renovation in the conmercial area fronting along Gore Creek comnencing with the Sitzmark Building, The Plaza Lodge, Bell Tower Building and finally the Creekside Building.

greenhouse addition wiII provide a strong framework for the pedestrian walks as well as visual interest and
activity on a year round type basis.
D. Street Enclosure. There is no external enclosure being
created by this addition.
E. Street Edqe. The proposed addition will have a positive effect on street edge as it will provide an irregular facade, a building jog, in otberwise flat plain, brick pavers along with a greenhouse which should open up to the outside weather pennitting. All of these items will give life to the street and visual interest for pedestrian traffic.
F. Buildinq Heiqht. Section L8.24.120 defines the height reguirenents for CCL and all proposed heights are well
below the requirements as specified in the Vail Village
Urban Design Guideplan and Design Considerations.
c. Views. No views will be blocked by the addition of the
Greenhouse.

This Commitment is preliminary to the issuance ot such policy or policies of tifle insunnce and all liability and
obligations hereunder shall cease and terminate six months after the effective date hereof or when the poliry
or policies committed for shall issue, whichever first occurs, provided that the failure to issue such poliry or
policies is not the fault of the Company.
CONDITIONS AND STIPULATIONS
1 . The term "mortgage", when used herein, shall include deed of trust, trust deed, or other security instrument.
2. lf the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim

or other matter affecting the estate or interest 0r mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall lail
to disclose such knowledge t0 the Company in writing. the Company shall be relieved from liability lor any loss or damage resulting from any acl of reliance
hereon to the extent the Company is prejudiced by failure of the proposed Insured to so disclose such knowledge. lf the proposed Insured shall disclose such
knowledge to the Company, or if the Company otherwise acquires actual knowledge oi any such defect, lien, encumbrance, adverse claim or other matte[ the
Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously
incurred pursuant to paragraph 3 ol these Conditions and Stipulations.
3 Liability of fie Company under this Commitment shall be only to the named proposed Insured and such
parties included under the definition of Insured in the form of policy or policies committed for and only lor actual loss incuned in reliance hereon in
undertaking in good faith {a} to comply with the requirements hereof or {b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate
0r Interest or mortgage thereon covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the poliry or policies
committed fo and such liability is subject to the insuring provisions and the Conditions and Stipulations and the exclusions from Coverage of the form of
policy or policies committed lor in favor of the proposed Insured which are hereby incorporated by reference and made a part of this Commitment except as
expressly modified herein.
4. Any action or actions or rights of action that the proposed Insured may have or may bring against the
Company arising out of the status of the title to the estate or interest 0r the status of the mortgage thereon covered by this Commitment must be based on
and are subject to the provisions of this Commitment.

In addition to the matters contained in the Conditions and Stipulations and Exclusions from
Coverage above referred to, this Commitment is also subjectto the following:
1. Rights or claims of parties in possession not shown by the public records.
2. Easements, or claims of easements, not shown by the public records.
3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any facts
which a correct survey and inspection of the premises would disclose and which are not shown by the public records.
4. Any lien, or rightto a lien, forservices, la bo r or materia l the retofore o r hereafter fu rnished,
imposed by law and not shown by the public records.
5. Deiects, liens, encumbrances, adverse claims or other matters, if any, created, first

Please find enclosed the applicable sections of the Sign
ordinance relating to Menu Boards (Display Boxes) and
Projecting/Hanging/Awning Signage. Under the ordinance you can
construct a menu board and a projecting/hanging sign or awning
sj.gn (see pages 237 and 238).
In selecting someone to design, construct and install the menu
board and awning signage, I suggest you look around town at other
menu boards and awning signage and when you see somethinq you
like, find out who did the work and contact that company
directly.
Whatever design is developed for the awning sign and the menu
board, rnust be reviewed and approved by the Design Review Board
(DRB) prior to installation. Enclosed are two copi-es of the DRB
signlawning applicatj.on. Please subnit a cornpleted copy of this
form for the proposed awning signage and for the proposed menu
board. A11 subnission materials must be delivered to this office
no later then 5:0o p.n. on Tuesday' September 4th.
You are scheduled to appear before the DRB on Septernber L9th. At
this same meeting the DRB will want to address your solution to
the existing roof drainage situation so please be prepared to
respond to this issue on the 19th as well.

The expansion proposal for the Up The Creek Bar and Grill reguires both an exterior alteration approval and a Conditional Use pernit
approval from the Planning and Environmental Connission. The
Cornmercial Core I zone district requires that any building expansion receive an exterior alteration permit. It also specifies that the addition or expansion of any outdoor dining deck requires a Conditional Use pennit. In reviewing the Up The creek Bar and Grill file, I have deterrnined that there has not been an application filed for, nor proper legal notification given, for the required Conditional Use pennit. f believe that both of these applications
should be heard sirnultaneously by the Planning and Environmental
Commission in order to receive a proper review of this request. I am therefore requesting that we table the exterior alteration request
from the ylay 22 Planning and Environmental Commission meeting to the June l-2 meeting. This will allow us to properly apply and advertise for a Conditional Use pernit request for review at the June 12
meeting.

the site d6velopment standards that are intended to insure
the, maintenance and preservation of the tightly clustered
arrangements of buildings frontinq on pedestrian ways and

scale and architectural quality that distinguish the
Vi11age.
The proposed addition is in conpliance with the intent of
the Zoning for CCL District.

There are no sub Area Concept areas relating to this
addition. However, this addition and the completion of the
patio in interlocking brick pavers will be one more step in
the completion of the renovation in the comnercial area
fronting along Gore Creek commencing with the Sitzmark
Buildint, The Plaza Lodge, BelI Tower Building and finally
the Creekside Building.

Dear Jay:
Some members of the Planning staff conducted a site visit to Up the Creek Restaurant yesterday. We want to relay to you our concerns regarding the extent of the deck expansion in this location. Generally, lre feel that only a very small expansion of the existing outdoor dining deck onto Tosrn property shoutd be allowed.
The primary concern is encroachment for a private use into what is clearly a public park area. The Tohrn oi Vait land proposed for the expanded dining deck is highly utilized green space--one of the most popular in all of Vail. Moreover, there is a severe constriction at the northwest corner of the existing deck. Currently, this corner is no more than three feet fiour the creek bank. Expanding the deck to the west worsens this constriction.
We believe that the proposal should be substantialty scaled back. A greenhouse of lesser proportions with dining deck improvements concentrated basi-al1y on improving the existing area is appropriate. The curved stone wall proposed would be appropriate and would a1low a slight expansion of the existing deck. Encroachment greater than tnat wiff probably be opposed by the staff.
