BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Depaftment Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small,projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifli (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or,a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Depaftment will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above pnocess is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if is not complete. Re-application each November 15th does not
mean an a renewal.

DRAINAGE AND CULVERT INSPECTIONS ARE REOUIRED BY PUBLIC WORKS!
Please read and check off each of the items below:
a The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Depaftment for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at 479-2798 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.
Also, the Town of Vail Public Works Department will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Certificate of Occupancy issuance.

CODE 5-2-10: DEPOSITS ON PUBUC WAYS PROHIBTTED
Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
Notice; Abatement: The Director of Public Works may notiff and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 ofthis code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).

Problem Statement
The Vail Village and Lionshead Village are invaluable assets to the community. Thousands of people
come to Vail each year to sightsee, recreate, shop and to enjoy everything the Vail Valley has to offer.
The community and merchants rely upon our guest to generaie revenue. Our summer/winter guests
expect a pleasant experience while in Vail.
To insure that all of the proposed construction has as little negative impact on the community and on our
guest as possible, the Town of Vail finds ii imperative to create and implement the Vail Village and
Lionshead Village Construction Hours Handout.
It would be irresponsible for the Town of Vail, the Construction Contractors and the Merchants, to not
actively participaie to minimize the impact of construcjgn.in the Vail and Lionsfread,Jlllage areas.
New for 2004-2006 will be the Vail Village Streetscape lmprovement Project. Work to include all
utility related improvements, streetscape, drainage, snowmelt systems and landscaping.

I.OI EXECUTIYESUMMARY:
This inspection for asbestos containing materials (Actvf) was conducted in general
accordance with the guidelines of the Asbestos Hazard Emergency Response Act AHERA 40
CFR Part 763 and the Occupational Safety and Health Administration (OSHA) 29 CFR
1926.1101. A visual and tactile inspection of suspect ACM was performed. A minimum of
three bulk samples were collected randomly of each suspect ACM. The Environmental
Protection Agency (EPA) and the Colorado department of Public Health and Environment
(CDP[IE) recognize material that contains greater than one- percent asbestos to be ACM.
Laboratory analysis in this survey detected trace amounts of ACM in the wall and
ceiling texture on the second level
Although trace amounts of asbestos are not regulated by the State of Colorado, OSHA
maintains that during demolition/ remodel activities worker safety must be maintained.
Asbestos trained personnel with proper personal protective equipment (PPE) and engineering
controls to suppress dust must be used to perform demolition of asbestos materials less than
|Vo. Air monitoring must be performed to insure the engineering controls designed for each
project are effective. When air sampling establishes that fiber levels are stable and can be
maintained below the permissible exposure limit (PEL) engineering controls and PPE may be
re-evaluated. Demolished materials may be disposed of as construction waste.

1.05 EXCLUSIONSTATEMENTS:
EEM Consulting, lnc., warrants that the findings contained herein have been with the
level of care and skill exercised by experienced and knowledgeable environmental
consultant who is licensed or otherwise trained to perform asbestos inspections pursuant
to the scope ofwork required on this project.
The asbestos inspection included inspection of accessible materials such as above or
behind suspended ceilings or other non-permanent structures. EEM Consulting, Inc. did
not inspect or sample inaccessible areas such as behind walls or within ductwork and did
not dismantle any part ofthe structure to survey inaccessible areas. For the purpose of
this warrant, inaccessible is defined as areas of the building that could not be tested
(sampled) without destruction of the structure or a portion of the structure. In the event
that access to a portion of the building was not obtained (which otherwise would have
been tested), such limitations are specifically identified in Section 1.08.

Sample locations were selected in a random manner. A minimum of, three samples were
collected of each homogeneous material identified as suspect ACM in accordance with
AHERA 40 CFR 763 sampling protocol.

2059 Bryant Street, Denver, Colorado and analped by Polarized Light
Microscopy (PLM) in compliance with USEPA guidelines (EPA/600/R-93/ll6).
1.08 INACCESSIBLEAREAS:
Reasonable efforts were made to locate and inspect concealed areas in accordance with
40 CFR 763. Only the areas and the materials listed were inspected as part of this
inspection.

Vail Village Plaza Condominiums
I appreciated you and Mike McGee meeting with me this morning so that I
could gain a better understanding of the outstanding issues that must be
resolved at the Vail Village Plaza Condominiums in order to satisfy the
Town of Vail. Aswe discussed, lwill personally take this project over
in order to assure that the issues are addressed to your satisfaction.
Per your request, I've summarized the actions that I've taken today
along with the plan of action for each of the outstanding issues that
have been brought to my attention byyou and Mike. The summary is as
follows:
* lt is my understanding that the temporary water supply line that
supplies water to Verbatim Booksellers, Alpenrose bakery and the
common basement bathrooms has to be replaced by a permanent water
supply line that is installed in compliance with current building
codes. The temporary line was installed by Shaw Construction's
subcontractor after they broke the original one. lt is the
position of the Vail Village Plaza Condominium Association
("WPCA') that this is the responsibility of Shaw Construction
and/or the developers of the Vail Plaza Hotel since they broke the
original supply line. After my meeting with you I talked to Joe
DeTrolio with Shaw Construction and I left a message for Chuck
MacDonald with Shaw Construction to call me. Joe said that the
line never had a water meter on it previously and that Eagle River
Water & Sanitation District ("ERWSD") would require that a water
meter be installed as a part of the installation of a permanent
supply line. I haven't yet heard back from Chuck MacDonald. My
current plan of action is to set up a meeting with Sundance
Plumbing, ERWSD, Andrew Penland and myself on-site to discuss the
requirements. Sundance Plumbing will then prepare two separate
bids for installation of a new permanent supply line and
installation of a new water meter. The WPCA will then expect
Shaw Construction and/or the developers of the Vail Plaza Hotel to
pay for at least a portion of that work, as determined by the
WPCA Board of Directors. I talked to Ken from Sundance Plumbing
and he is ready to meet. I left a message for Fred Haslee with
ERWSD and he then left me a message asking me to call him on
Monday, April 25th. An alternative course of action would be for
Shaw Construction to get this work done and I would be happy to
coordinate with them on installation of a new water meter, as I
feel that installation of a new water meter is the responsibility
of the WPCA. I will continue trying to contact Chuck MacDonald
regarding this alternative.
* Mike McGee advised me that ERWSD might have other issues that
should also be addressed at the same time and that I should talk
to Fred Haslee about those issues. He said that these issues were
primarily in the basement of the liquor store and that they
involved domestic water supply. As mentioned above I traded
voicemail messages with Fred Haslee and he asked me to call him on

Monday, April 25th to set up a meeting. He also said in his
message that some portions of the Vail Village Plaza Condominiums
had been getting free water service, without the installation of
any meters, for many years and that he thought that some type of
"punishment" was in order. I subsequently talked to Joe Staufer
about this and he said that this was the first that he had ever
heard about it and that it would be totally inappropriate for
ERWSD to levy any type of punishment for what happened in the
past. I've never heard of this issue before either so I'm not
sure where Fred Haslee is coming from on this issue. I'm quite
sure that the WPCA Board of Directors is willing to install
whatever water meters are necessary to satisfy the ERWSD however
I'm also sure that if they attempt to levy some type of punishment
for past free water usage the Association will use all legal means
necessary to fight that attempt. That said, l'm hopeful that we
can work cooperatively with ERWSD rather than in a confrontational
manner to resolve their concerns. My plan of action on this issue
is to set up a meeting with Sundance Plumbing, ERWSD, Andrew
Penland and myself to explore the specific issues that need to be
resolved. I will then ask Sundance Plumbing for a bid for the
necessary work. I will then attempt to get the bid accepted by
the Board of Directors of the WPCA and to then have the work done.
* lt is my understanding from our meeting and from other documents
that you have supplied to me that the north wall of the basement
in which the Alpenrose bakery is located is not acceptable to the
Town of Vail because of safety concerns and because it is not in
compliance with current building codes. The problem with this
wall was apparently discovered after Shaw Construction did the
excavation for the Vail Plaza Hotel. I believe that Mike told me
that a number of years ago the wall was broken by a flood from the
Vail Village Inn swimming pool and that the wall was rebuilt at
that time in its current construction method which is concrete
blocks with waterproofed plyivood on both sides. Please correct me
if my understanding of this flood damage is incorrect. lt is also
my understanding that the waterproof plywood has deteriorated and
is not in place in some locations anymore. Furthermore, it is my
understanding that a person can actually see some daylight through
the wall in some locations near the top. After my meeting with
you I talked to Joe DeTrolio with Shaw Construction about this
matter and I left a message for Chuck MacDonald with Shaw
Construction to call me. I also met with Joe Staufer regarding
this matter. He told me that the wall was originally built to the
then current building codes, that is was never broken by a flood
and that it has never been rebuilt. Although I can't speak for
the Board of Directors of the WPCA at this time, l'm quite
certain that since the wall was never an issue orior to Shaw
Construction's excavation on the north side of the wall, Shaw
Construction and/or the develooers of the Vail Plaza Hotel will be
responsible for all engineering costs and the costs associated
with any improvements that are necessary to make the wall
acceptable to the Town of Vail. This would be the case whether
the wall is currently in compliance with building codes or not
since the Town of Vail had no problem with the wall prior to the
excavation. At the same time I recognize that the Town of Vail
expects the WPCA to address the problem. Therefore, my plan of

action is to hire Tim Boyle to inspect the wall and to make
recommendations that I will then run past you. After you have
reviewed those recommendations, l'll have Tim prepare bid
specifications. l'll then bid the reoair work out and have the
work done after the Board of Directors accepts one of the bids.
Alternatively, Shaw Construction may choose to do this work, in
which case I will make sure that it is done to the satisfaction of
the WPCA and the Town of Vail. I went to Tim Boyle's office this
morning after our meeting but it appears that he has already left
town for the weekend. I will contact him as soon as he returns.
I will also continue trying to contact Chuck MacDonald regarding
this issue.
Please be advised that the opinions expressed above are my own personal
opinions rather than those of the Board of Directors of the WPCA and/or
their legal counsel. I will let you know if I find that the Board of
Directors and/or their legal counsel disagrees with any of my opinions.

Architectural Comments:1 Include complete allowable area calculations for the building per IBC 506, table 503 and 302.3.2
Please include the existing area for the entire building and the allowable area to show the proposed
additional building area is permitted under type V-A construction. Sprinkler system increase per
section 506,3 is not permitted as not all portions of the existing building have a fire sprinkler system.
2 Include complete construction assembly details on the plans for all fire resistive assembly details

3 Amend plans to show I hour protection for the structural roof beams not contained within the t hour

16 Coordinate specifications notes, second and third level framing plans to show steel deck and concrete
floor construction as indicated on the architectural plans. Coordinate total proposed thickness of
concrete floor and gypcrete topping over existing concrete floor. Wood columns may not support

Per our discussion yesterday, the Contractor (J Viele Construction) has elected to
install the I Hour occupancy Separation originally submitted for the Separation between
the Commercial Uses (Croup B) on the Lower Level and the Residential Use (Group R_2)
on the upper floor in the northern portion of the above referenced property, generally
referenced on the right side of sectionl I A401 of the approved Building permit setof plans. The Separation for the southern portion of these spaces is described in my letter
of December 7 , ZOOS, copy attached, has been installed.
The proposed assembly for the northern portion of the space, starting at the top,
is: a 1 Yz" concrete slab on 3/q" plwood on 6" steel joists with 2 layers of 5/g" type X
gypsum board applied to black iron furring according to the insrructions described in Table720'l(3)ttemNumber23-l.1. Withtheexceptionoftheadditional concrere
topping, the assembly proposed closely resembles ltem 23-r.r, described above.
It is understood that a non-rated ceiling may be installed below the rated
assembly either now or in the future. lt is also understood that any penetration of
mechanical ductwork through the rated ceiling or wall assemblies will be protected with
fire dampers.
The work described above will be commenced this spring during the scheduled
closure of the Art Gallery on the Lower Level and will be completed prior to issuance of a certificate of occupancy (either Temporary or Final) of the Residential unit on the upper
Level.
Per our discussion, work on the Residential Unit can continue and inspections
will resume based on the conditions outlined above. Also attached are sheets Azol and
A202, dated March 24, 2006, that reflectthe changes made during construction ofthe
Residential Unit.

Amendment to the 2002 N.E.C. Town of Vail Ordinance 4, Series of 2005
Overhead services are not allowed in the Town of Vail.
Underground services shallbe in conduit (PVC) from the utility transformer to the electric meter, main
disconnect switch, and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall fu readily accessible, andlocated nelt to the meter on the exterior wall of
the structure. All underground conduib are required to be inspected before back-filling the trench.
In multi-family dwelling units, no electrical wiring or feeder cables shall pass from one unit to another. Common
walls and spaces are exempt
NM Cable (Romex) an be used only in single and multi-family dwellings net exceeding 3 stories.
Type NM annot be used in any building mixed with Type $B.E1F,H,+M &5.
Aluminum conductorssmaller than size #8 will be permitted with the Town of Vail,
TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an e)Cerior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and veriff that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-famif building with a homeowners association, a letter of permission
from the association is required.o If this permit is for a commercial space, two (2) sets of stamped drawings are required, Electrical
one-line and panel schedules are required if load is added or distribution is altered,

I have been informed that the new Vail International Gallery will need to
comply with the Intemational energy code guidelines. I have reviewed the code
and the drawings and have found the following:
1. I assumed that the gallery is categorized as a retail sales/wholesale
showroom. The acceptable light load is 1.7 wafts per sq feet.
2. Section 805.5.1.3 of the IEC states that display lighting for galleries
should not be included in calculating the total connected load.
3. The gallery is 987 sq feet.
I have changed the specification for the room lighting pendant fixtures to use a
27-watt twist tube compact fluorescent lamp. This lamp has its own ballast.
These fixtures will be switched rather than dimmed. The following chart shows
the calculations and compliance with the IEC code.

The Floor/Ceiling assembly between the Commercial Use on the First Floor and the
Residential Uses on the upper floors (shown on Sheet A401 of the Permit Set of Drawings) indicates a
One- Hour Floor/ Ceiling Assembly (lBC Table 720.1(3\ #6-4.1). At this point a mono-coat
protection layer has been added to the underside of the steel decking of the upper floor and an
additional 1'112" ol light weight concrete has been added to the existing 3" concrete deck. These
modifications increase the fire separation and resistance above the IBC standard referenced above.
The ceiling of the commercial space will be installed as indicated on the Permit plans although the
