BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.
I, the undersigned, understand the plan check procedure and time frame. I also understand
that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application.
If yes was answered to any of the questions then a "Public Way" permit ls required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper,
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit",
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

conplaints fron your neighbors have ranged frorn concerns about two horse trailers parked. in front at the botton of the stairs, to electrical cords extending fron the house dorr,n to the street. At tirnes there has been hay and trash scattered around the front of the lot. Wetre sure youtll agiee that this treatrnent of your pxoperty is not good for the entire neighborhood, arrd your neighbor,i hive i legitirnate complaint. This condition is also against many of the Town of Vail regulations and is totally unacceptable.
According to section 18.66.025 of the Town of vail l'funicipal code,
such violations can result in a fine of up to $300 andr/or 90 days in jail for each and every day that such violations occur. I am sure you do not wi sh to face such legal action.

lJe have just completed the proposed site plan and cross sections for your
house and parking area on Lot 14, Vail Village Sixth Filing. trrle recommend
gabions be placed on the steeper cut and fill slopes for protection from erosion.
Ihese can be fi11ed over vith about B" of topsoil and seeded if desired. The
gabions should be anchored down with 24" Tong 1/2" round steel anchor rods at
about 5 foot centers.
Also, 'we recomend reinforced concrete wa11s and footings, at least for the
rear and two sides of your house. The wa11s should be 8" thick. Vertical
reinforcing bars should be il5ts G 12" on center and horizontal bars ll4's @ 12"
centers. Standard 8" x 20" footings vith three ll4 trorizor.tal reinforci-ng bars will
be satisfactory,
As recormended by the soils engl-neer, all your utilities should be brought up
your temporary access road and the backfill should be well coopacted. The location
of this road can be varied to miss as many trees as possible, and the entire area
restored and reseeded upon completion.

subject site. The 'investigation shall include sufficient fjeld
investigat'ion and laboratory tests to determine the present-

Excavation shall be of only two c1asses, as follows:

necessary to be excavated and moved to permit the construct'ion

3.02 CLEARING & GRUBBING:
A, Adequately protect roots and branches of trees and other features
not designated to be removed.
B. Clear and grub only within the construction limits' removing
all materiil includ'ing trees des'ignated to be removed and shrubs
stumps, roots and rocks, and existing construction to a depth of
six in€hes below sub-grade.
c. Remove obstructjon jnside bu'i lding lines to a mjnimum depth of
twelve (12) jnches.

debris, and excess material.
EXCAVATION:
A. Strip topsoil from all excavation or fill areas and stockpile
in areas designated by owner.
B. Excavate to grades and dimensions indicated or as necessary to
accomodate the installation of the Wrok.
c. Excavate all soft spots and other unsuitable soils' conditions
and fill as described herein.
D. Excavations for footings: extend minimum 4" into undisturbed
earth or to solid rock.
E. Do not expose footing excavation to freezing.
WATER CONTROL:
A. Provide adequate drainage at all times during construction'
excavating,'and filling 'including pump'ing of low places in order
to ensure dry subgrade and bottoms of excavations.
B. Where sojl has been softened or eroded by f'looding or placement
during unfavorable weather, remove al 1 damaged areas and recompact
as specified for fill and compaction below-

ditions. Do not resume operations until moisture content and fill
density are satisfactory to the Architect.
E. Water or aerate the subgrade or fill material as necessary and
thoroughly mjx to obtain a moisture content which will permit
proper compaction. Place no frozen or muddy materials in com-
pacted fi'lls. Compact each layer of fill to the spec'ified
degree; repeat compaction process until indicated grade is attained.

3.09 PLACEMENT OF PAVING BASE COURSE:

and existing grades with smooth transjtions between different slopes.

3.IO PLACEMENT OF PAVING PRIME COAT:
A. App'ly prime coat within twenty-four hours of placing asphaltic
concrete surfacing.
When base course surface is dry, apply primer, with approved dis tributor, at the rate of 0.25 to 0.50 ga'llons per square yard
depending on the conditions of base. Primer sha1 'l be of proper
consistency when applied to insure satisfactory spreading. Remove
pools of primer which remain on the surface after the application.
Primer shal'l be properly cured and the primed surface shall be
cleaned, if necessary, preparatory to placing the surface course.
3.'II PLACEI{ENT OF ASPMLTIC CONCRETE SURFACING:
A. Lightly sand the areas where prime coat is not fully absorbed
before placing the asphaltic concrete.
B. Place asphaltic concrete surface course of the specified mix-
ture on top of the base course at a temperature of 250 to 325
degrees F. and roll to a compressed thickness as shown on the
drawings. The finished course: free from waves or imegu'larities.
C. Roll surface unti'l a smooth and dense texture is obtained, free
draining and free from birdbaths. Compact to at least 90%of lab density as determined by ASTM Dl559-GIT (Marshall design).
3.12 APPLTCATToN 0F pAVrNc SURFACE AGGREGATE: (pEA GRAVEL)
After instal'lation of the aspha'l tic concrete course apply emulsified
asphalt RS-z at the rate of .20-.35 gallons per square yard, after
cl eaning surface. Apply Pea Gravel chips at the rate of 20-25 pounds
per square yard. Chips shall be uniformly spread, broomed, and dragged
and left in a level uniform surface. Rol I with a roller weighing not
less than eight (8) tons. Broom up and remove excess gravel . Remove al'l spilled lravdt'from grass and bther non asphaltic iurfaces adJacent
to the work.

Eagle County, Colorado, and JUSTINE H, SMITH' an individual' with

IIHEREAS, the purpose of this agreement is to set forth
a procedure to guarantee that a proposed tanporary access road
located on Lots 14 and/or 15, Block 1, Vail Village' S'ixth Fil'ing'..
will be restored to a condition that will assure the health' safeW;
morals and general welfare of the citizens of the Town of Vail;
N0ll, THEREFORE' the parties hereby agree to the following:
(a) That a savings account be opened at the Bank of Vail'
Colorado, identified as Account Number 888-92-3' in the names of the
Town of Vail and Justine H, Smith on October 10, 1.974;
(b) That the account shall be opened entirely with funds
provided by Justine H. $nith in the amount of Three Thousand and 00/100
($3,000.00) tbtlars, and shall draw interest at the rate in effect at
the time of opening, which interest shall accrue tor become a part of'
and ,be available to the final possessor of;said account;
(c) That said account will guarantee the restoration of
said temporary access road, located on Lots 14 and/or 15' Block 1' Vail
Village, Sixth Filing, County of Eagle, Colorado, to the condition of
structural stability of the surrounding hi'llside;
(d) That the structural stability of said restoration
shall be attested to by Thomas E. Summerlee, a Professiona'l Engineer
experienced in soil engineering, or a party acceptable to the Town of
Vail, at the so] e expense of Justine H. 9nith;
(e) That the restoration of said temporary access road
shall include revegetation, as soon as possible to prevent any damage
caused by erosion,'in a manner and type satisfactory to the Town of Vail.
(f) That all aforesaid work shall be completed on or before
September L, L975, to an extent that all structural so'il work is comp'l ete
and al 1 revegetation is in p'l ace, although not fully grown;
(S) That upon completion of the aforesaid work in a manner
satisfactory to the Town of Vail, as outlined aboveo and within twenty
(20) days of acceptance of the aforesaid work by the Town, the Town of
Vail shall cause Justine H. Sm'ith to become so'le possessor of Account
Number 888-92-3 at the Bank of Vail, Vail, Colorado, free of any c1a'ims,
liens or encumbrancesn by any party;
(h) That inthe event the aforesaid work is not completed'
as outlined above, by September 1, 1975, the entire account, including
any interest earned, at the Bank of Vail, Vail, Colorado, numbered
888-92-3, shall become the possession of the Town of Vai1, free of any
claims, liens or encumbrances by any party, for the purpose of completing
said work to the satisfaction of the Town of Vail;
(i) That in lbe event the Town of Vail exercises its right
*fW"to execute said work - Ull expenditures, including reasonable legal
fees, shall be less than the value of the aforesa'id account, the Town
of Vail shal'l return the remainder of the account to Justine H. Smith

Dear Ms. Toughill:
Personnel of this laboratory conducted an on-site resonnaissance of the above referenced site on Friday,March 5, 1976 by the request of the owner in order to evaluate the erosion potential of the existing access road to the residence.
Due to excessi-ve snow, the Laboratory must presently decline in making any eonclusions about the site. morals and general welfare of the citizens of the Tovrn of Vail;

(a) That a savings account be opened at the Bank of Vail'
Co'lorado, identified as Account Number BBB-92-3' in the names of the
Town of Vail and Justine H, Smith on 0ctober 10' 1974;
(b) That the account shall be opened entirely with funds
provided by Justine H. Smith in the amount of Three Thousand and 00/100
($3,000.00) Dollars, and shall draw interest at the rate'in effect at
the time of opening, vlhich interest shall accrue to' become a part of'
and be available to the final possessor of:said account;
(c) That said account wi1'l guarantee the restoration of
said temporary access road, located on Lots 14 and/or 15' Block I' Vail

Village Eirst Flling, d& respect to the drtveway entrance, to be
Iocated on the norttr side of Forest Road. Secretary Froehli,cb
stated that lvfr. Fischer is reqr:esHng approml for the Robert lvlartin
residence to use t,he nortb ten feet of tbe right-of-way along Forest
Road for a drlveway entrance; that tlre revised plot pan, dated
October 25, 1965, lndicates that tbere would be a cribbing along tbe
edge of Forest Road; and that Forest Road wouldbe 26 feet vide,
wtth the proper shoulder and dttcbing along tbe south side of Forest
Road. tr was exdained that it wonld rpt necessitate the relocating of
the eudsHng roadway on lbrest Road. Followtng a discussion on this
