only one without a window in that area.
We give the approval with the following conditions:

This application is required for proposals involving minor exterior alterations and/or site improvements.
Proposals to add landscaping do not require DRB approval unless they involve the addition of patios,
water features, grading, or the addition of retaining walls.

A pre-application neeting with a member of the planning staff is strongly encouraged to determine if any additional application information is needed. It is the applicantrs responsibility to make an appointment with the staff to determine if there are additional submittal requirements.

III. IMPORTANT NOTICE REGARDING ALL SUBMISSIONS TO THE DRB:
A. In addition to meeting submittal requirements, the applicant must stake and tape the project site to indicate property 1ines, building lines and building corners. AI1 trees to be removed must be taped. A1I site tapings and staking must be completed prior to the
DRB site visit. The applicant must ensure that staking done during the winter is not buried by snow.
B. The review process for NEW BUILDINGS normally requires two separate meetings of the Design Review Board: a conceptual approvaL and a final approval . Applicants should plan on presenting their development proposal at a minimum of two meetings before obtaining finaf
approval .
C. Applicants who fail to appear before the Design Review
Board on their scheduled neeting date and who have not
asked i.n advance that discussion on their item be postponed, will have their items removed from the DRB docket until such time as the item has been
republished.
D. The following items may, at the discretion of the zoning administrator, be approved by the Community
Development Department staff (i.e. a formal hearing before the DRB may not be required):
a. Windows, skylights and similar exterior changes
which do not alter the existing plane of the building; and
b- Building addition proposals not visible from any other lot or public space. At the time such a proposal is submitted, applicants must include Ietters from adjacent property owners and/or from the agent for or manag'er of any adjacent
condominium association stating the association
approves of the addition.
E. If a property is located in a mapped hazard area (i.e.
snow avalanche, rockfall, flood plain, debris flow,wetland, etc)r a hazard study must be submitted and the
owner must sign an affidavit recognizing the hazard report prior to the issuance of a building permit.
Applicants are encouraged to check with a Town Planner prior to DRB application to determine the reLationship of the property to all- mapped hazards.
F. For aII residentiaL construction:
Clearly indicate on the floor plans the inside
face of the exterior structural walLs of the
buil-ding,' and Indicate with a dashed Line on the site plan a four foot distance from the exterior face of the building wal-l-s or supporting columns.

6. Ties to existing benchrnark, either USGS landmark or sewer invert. This information should be clearly stated on the survey so that aII
measurements are based on the same starting point.
This is particularly important for height.

etc . must be shown.

landscape plan. The location of existing 4"
diameter or larger trees, the locatj-on, size,
spacing and type (common and l-atin name) of all existing and proposed plant materiaf. All trees to be saved and to be removed must also be indicated. The plan rnust also differentiate
between existing and proposed vegetation.
2. Complete the attached landscape material.s l-ist.
3. The location and type of existing and proposed
watering systems to be employed in caring for plant material following its install-ation.
4. Existing and proposed contour lines.
In order to clarify the inter-relation of the various
development proposal components, please incorporate as
much of the above information as possible onto the site plan.

Council memos may be requested.
4. Exterior surfacing materials and material colors
shall be specified on the attached materiaLs list.
This materials list rnust be cornpleted and
submitted as a part of DRB application. Cofor
chips, siding samples etc., should be presented to the Design Review Board meeting.

requirements set forth above, provided all important specifications for the proposal including colors and materials to be used are submitted.

VII. FINAL SITE PLAN
Once a building permit has been issued, and construction is
underway, and before the Building Department will schedule a framing inspection, two copies of an Improvement Location Certificate survey (ILC) stamped by a registered professional engineer must be submitted. The following information must be provided on the ILC:
A. Building l-ocation (s) with ties to property corners,i.e. distances and angles.
B. Building dimensions to the nearest tenth of a foot.
C. All- utility service line as-builts, showing type of material used, and size and exact location of lines.
D. Drainage as-buiLts.
E. Basis of bearing to tie to section corner.
F. Al-1 property pins are to be either found or set and stated on improvement survey.
G. All easements.
H. Building floor elevations and all roof ridge elevations with exist.ing and proposed grades shown under the ridge Iines.
vIII . CONCEPTUAL DE+\r REVIEW
Submittal- requirements: The owner or authorized agent of any project requiring design approval as prescribed
by this chapter may submit plans for conceptual review by the Design Review Board to the Department of
Community Development. The conceptual review is intended to give the applicant a basic understanding of the compat.ibility of their proposal with the Town's
Design Guidelines. This procedure is recomrnended primarily for applications more complex than single-family and two-family res j.dences. However, developers of single-family and two-family projects shalI not be
excluded from the opportunity to request a conceptual design review. Complete applications must be submitted
L0 days prior to a scheduled DRB meeting.
The following information shall be submitted for a conceptual review:
1. A conceptual site and Landscape plan at a minimum
scale of one inch equals twenty feet;
2. ConceptuaL elevations showing exterior materials
and a description of the character of the proposed structure or st ructures i
3. Sufficient information to show the proposal
complies with the development standards of the
zone district in which the project is to be located (i,e, GRFA, site coverage calculations,
number of parking spaces, etc.)t
4. Completed DRB application form.
Procedure: Upon recelpt of an application for
conceptual design review, the Department of Community
Developrnent shall review the submitted materials for general compliance with the appropriate requirements of the zoning code. If the proposal is in basic
compliance with the zoning code requirements, the project shall be forwarded to the DRB for conceptual review. If the application is not generally in
compliance with zoning code requirements, the application and submitt.al materials shall be returned
to the applicant with a written explanation as to why
the Community Development Department staff has found
the project not to be in compliance with zoning code requirements. Once a complete application has been received, the DRB shall review the submitted conceptual review application and supporting material in order to
determine whether or not the project generally complies with the design guidelines. The DRB does not vote on
conceptual reviews. The property owner or his representative shall- be present at the DRB hearinq.

Attached is a letter that our office has received concerning construction at Booth Fal1s Townhomes without building permits and the possibility that a dwelling unit has been added to one unit.This tlpe of letter is very difficult to respond to, as the author of the letter has not specified exactly which units are involved.
We are bringing these issues to your attention, as we understand that you are the president of the condominium association.
We do wish to let your organization know that construction without a building perrnit and approval from our office is illegal. one reason for reguiring a building perrnit is to ensure health and safety issues have been considered. Another is to ensure that the construction adheres to the Town of VaiI zoning code. We wish to be responsive to the cornplaint. However, we also have no direct
means to address the issues.

This is a very difficult letter for me to write. I feel
what my neighbor is doing is very wrong yet I do want to keep my
house and do not want problems on a day to day basis.
Several years ago my neighbor enclosed two porches on his
townhome. Last year he bought the adjoinirg unit just to the
East of his anC also enclosed the porches on that unit. This was just fine with me even though r am quite sure he did not have a
building permit to do the work as the unit sits against the
mountain with others units quite effecti.vejy blocking it from view. Other unir-s have been renrodeled this way and it seems to
fit and really makes them in nany ways more attractive.
The reason that I now feei it is necessaiy to write this
Ietter is that this Summer he turned the lower inclosed gorch on
the first unit into a kitchen and now rents thal lower part of
his townhome as a separate uni.t, When I walk in my door, I now
Iook at dishsoap, etc. in the windows.
If he is allowed to Co this, I afraid Lhat he won't stop
with the one. Next he will do the same with the second east
townhouse and he will have made four units out of lwo. My family
and I are not in Vail all the time and we really look forward to
and enjoy our peaceful moments here. We never anticipated that
we would have to deal with the problems associated with greater
density. I now feel his "il1egal" construction threats my
families ability to quietly enjoy our home and surroundings.
I don't know whal you can do after the fact. But perhaps if you are aware of the situation, you can keep this from happening
again.
