All installations of exterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installaHon of an e"yterior hot tub or spa on a new elevated platForm or deck over
30" above grcde, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must reMew the o<isting condition and veriry that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this applicaUon.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.
If thls permit is for a commercial space, two (2) sets of stamped drawings are required. El*frical
one4ine and panel schedules arc regulrcd if load is added or distribution is alfurcd.

Pursuant to our conversation late last week it is possible to add not more than
250 sq. ft. of Dwelling Unit GRFA to individual Units at the 9 Vail Road Condominium.
This additional space would be allowed under Section |2-15-5 D. The condition
described in l2-15-5 D7 is satisfied because there is no Dwelling Unit GRFA available.
The property is zoned Public Accommodation (PA) and Dwelling Unit GRFA is limited to
30% of Accommodation Unit GRFA. There is no Accommodation Unit GRFA on the site
consequently there is no Dwelling Unit CRFA available except as available under l2-l 5-
5D.
Per l2-l 5-5 D6, the Condominium Association will make the application on
behalf of the individual Dwelling Unit Owners.

A. Unlawful deposits: Subj ect to subsection C thereol it is unlawfrrl for any person to litter,
track or deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt,
snow, ice, or any other debris or material upon any street, sidewalk, alley or public place, or
any portion thereof.
B. Notiie; Abatement: The Director of Public Works may notifu and require any person who
violates or causes another to violate the provision of subsection A hereof, or who has in the
Director's employment a person who violates or causes another to violate the sarne. top
remove such iand, gravel, rocks, mud, dirt, snow, ice or any other debris or material within
twenty four (24) hours after receipt of said notice by the Director of Public Works. In the
event the person so notified does not comply with the notice within the period of time herein
specified, the Director of Public Works, or other authorizcd agent, may cause any such san-d
gravel, rocks, mud, dirt, snow, ice, debris or any other nulterial to be removed from any street
or alley at the expense ofthe notified.
C. Exceptions: The provisions of subsection 4 6.1ssf5hall not be applicable:
t. Wittrin the immediate area of any construction, maintenancc or repair project of any
street or alley or of any water main, sewer main, electricity line, gas line, telephone line
or any apPurtenance thereto;
2. To dcposits of sand, dirt or materials necessary for the protection of the public safety; and
3. To public arcas designated for the dumping or depositing of said materials.
D. Summons; Penalt-v: As an alternative to the notice for removal provided in subsection B
above, any
person who violates or causes another to violate the same, may be issued a summons to
ippear before thc Municipal Court of the Town for said violations, and upon being found
guilty ofa violation hereunder be punished as provided in Section l-4-l of this code.
g. Notiie; Penalty: It is unlawful for any person to fail or refuse to comply with the noticc of
the
Director of Public Works as provided in subsection B hereof, and any such person shall, in
addition to paymcnt of the expense of removal incurred by the Director of Public Works, as
provided in subsection B hereof, upon being found guilty ofa violation hereunder, be
