TOWIT OFVAIL ELECTRICAL PERMIT GUIDELINES
All installations of exterior hottubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above gnde, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condiUon and veriff that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.o If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.o If this permit is for a commercial space, two (2) sets of stamped drawings are required. Electrical
one-line and nanel schedulw are rcguircd if load is added or distribution is athtd.

Town of Vail Fireolace Ordinance
In September of 199t the Vail Town Council adopted an ordinance which rcsbicts te oonstructon and
use of open hearth ffieplaces wlthin municipal boundaries. Since that time the otdinance has
undetgone numerous changes and rcvisions, strlving for comprcmise, yet effectiveness in addressing
the air quality issue. Tlrerefore the following criteria has been adopted:
o Construction of open hearttr wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
Dwellino Units- Each new dwelling unlt may Gontain:
One (1) EPA Phase II certifted solid fud buming dwir:e and no mole $an turo (2) gas appllances
(B vent)
OR
Two (2) gas tog fireplaoes and no more t{ran hro (2) gas appliance fireplaces (B bent).
Restrlcted Dwelllno Units - Each new restricbd dwelling unit may contain:
One (1) gas log fireplace and not morc than one (1) gas appliance fireplace.
Accommodatiorl Units- Each new accommodaUon unit may contain:
one (1) gas log ftreplace or one (1) gas appliance ftreplace.
If two or morc separate dwelllng units or acommodation units are combined to form one latger
unit, the combined unit may retain one woodburning fireplae (if one already exists) and no mote
than 2 gas appliance fircplaoes, or may convert up to two odsting fireplaces to gas.
If during flre cource of a rcmodel an existing woodburning fireplace is altered or moved, the unit
must t{ren comply with all provisions of the oldinance. That is, the fireplace must be convelted to
natural gas or rFplaced by an EPA Phase II ceftified unit.

This offrce represents that Skaal Hus Phase II Condominium Association, the property
immediatly east of the unit that is the subject of the application. I have distributed the plans and
elevations of RAL Architects, Inc. that were provided to my office, dated May 15, 2006 and
April 17, 2006. The consensus of the members of the association that I have been instructed to
convey to you is almost compete opposition to the plans as proposed.
The relocation and reconfiguration ofthe staircase is completely unacceptable. It severally
impacts the views to the west from our entrance and appears to encroach in excess of four feet
frorn the eristing stairs. The reconfiguration ofthe stair is also unacceptablc as the exisring stair
is shielded from our view currently by the slanting masonry wall.
The expansion ofthe upper level deck by what appears to be about 2 feet is unacceptable for the
same reason, it encroaches into our westerly view.
The expansion ofthe unit appears to be in excess ofthe scope ofexpansion historically approved
by the Phase I Association, (to the existing supporting beam), which we remain in accord with
and oppose any change from that pattem ofrenovation.

Although the Skaal Hus Condominium Association, which the applicant owner of Unit 6 is a
member, is a completely separate association from our Skaal Hus Phase II Condominium
Association and we have no vote in their internal approvals, we do share a common wall and
property line and the proposed expansion ofUnit 6 does impact our adjacent properfy, even ifit
is designed and constructed so as not to technically touch our property. We have traditionally
worked with the Phase I Association to maintain a common and cohesive architectural theme for
our properties, and feel that the current application radically departs from the traditional and
previously accepted standards for modification and remodeling ofthe properfy.
For that reason the position of the Skaal Hus Phase II Condominium Association is to request a
denial of tlre application.

Thank you for submitting an application for the above addition. I have placed it on the September 21st
DRB agenda for review simply because it is just one of six units asking for this addition. In this kind of a
situation, the DRB has historlcally requested to know what the Condominium Association's intent is for the
remainder of the units. Would this occur at every other unit to provide aesthetic equality: i.e. Units 2, 4,
and 6? Or wpuld it occur just on the end units? Or is thls the only unit that will ever apply for an addition?
I realize that these things are often impossible to predict. However, the DRB has been intent on ensuring
that visual continuity is achieved at the exterior when all ie said and done.
Regardless, l'll plan to see lou on the 21st at Spm. I have yet to review the plans thoroughly and will get
back with you once I have done so with any comments. I will be out of town now for about ten dala and
will touch base with )lou upon my return.
