General Information; This application is required for all proposals involving minor changes to buildings and site improv
ments, such as roofing,
fing painting window additions, landscaping, fences, retaining walls, etc. Applicabie Vail Town
Code sections can be found at AWAY ailaov corn under Vail Information — Town Code Online. All projects requiring de-
sign review must receive approval prior to submitting a building permit application. An application for Design Review
cannot be accepted until all required information is received by the Community Development Department, as outlined in
the submittal requirements. The project may also need to be reviewed by the Town Council and /or the Planning and
Environmental Commission. Design review approval expires one year from the date of approval, unless a building per-
mit is issued and construction commences,

Dear Members of the Design Review Board,
I'm writing on behalf of the Home Owners Association and all six owners at 4450 Timber Falls
Court. We were very surprised and disappointed to hear that the initial response to our design for
replacing and upgrading our rear decks would be difficult to approve.
We would ask you to reconsider your assessment based on the following:
Our HOA and home owners gave unanimous verbal and written consent to replace and
improve our deteriorating decks with the cleanest, least imposing design possible. This
includes a cable railing or grill system. The reasons include:
a. Upgrading and improving what is now a 35+ year old design.
b. Increased utility of space.
C. Superior environmental factors — significantly less wood, paint and stain required.
d. Enhanced fire resistance.
e. Lower maintenance requirements.
f. Significantly improved line of sight/views versus bulky wood railings.
g. Integrated design for all six units. Contrast this with the building directly north of
us that has 3 separate and distinct designs for six units.
h. Maintaining existing color scheme while taking advantage of minimalist approach
to materials and visual impact (internal and external).
i. Strong likelihood of increased value for each of the six units.
2. The design is a natural and integrated evolution. We intentionally want to reduce the visual
signature and blend in with the building and surroundings.
3. The decks are not visible from the frontage roads and back to open space.
4. The decks are only visible from one other building in Timber Falls.
5. Our building is on its own independent parcel of land and has a distinct and separate HOA
from the rest of the units in Timber Falls. Under the circumstances why is it subject to
uniformity regulations?
6. Timber Falls was built over a number of years and has a variety of architectural variations
and differing designs. Consider the following:
a. Distinct building types throughout the complex including one built in the last
decade that is completely different from anything else.
b. A unit (18) that, as mentioned above, has 3 separate and distinct rear balcony
designs for six units.
C. The second (of three) entry way uses two tone color bricks (red and black) for
retaining walls, but railroad ties are used everywhere else.
d. Different color buildings and the use of different paint/stain combinations.
e. Newly installed fencing around pool is spaced metal. It replaced the original
closed wood structure.
f. Distinctly different garbage /recycling buildings.
Ultimately, we struggle with the concept that homeowners throughout the Vail valley are allowed
to upgrade in multiple ways, but we're required to maintain a less than ideal 35+ year old design
with no variation or modification allowed. Our design is an update that respects existing
aesthetics, provides an integrated look/feel and reduces the external visual impact while
enhancing the internal. We specifically hired an architect to ensure our approach was balanced
and deferential. Under the circumstances we respectfully request reconsideration and approval of
the design. Thank you.
