Asbestos Testing & Abatement Requirements
Asbestos testing and abatement protects workers, homeowners, neighbors and emergency services responders from ex-
posure to harmful asbestos. It is your responsibility to be in compliance with the State. Please contact the State directly
for their requirements at the contact info listed below.
When is asbestos testina required?
ANY building projects disturbing more than these threshold levels of building materials require asbestos testing:
One- and Two - Family Dwellings: 32 square feet
All Others (commercial spaces, hotel rooms, etc): 160 square feet
Definition of a single - family dwelling: any dwelling unit that is used primarily for a single family, including
multi- family /condominium units, and fractional fee units.
Asbestos testing results must be provided with your application for a building permit.
Tests which identify POSITIVE results at more than 1% require abatement by a State - certified abatement contractor. The
clearance letter must be submitted to the Town of Vail before the building permit will be issued.

Tips & Facts:
Even recent construction projects may include asbestos - containing materials, so buildings of any age require testing.
• The "1989 Ban" on asbestos - containing materials is commonly misunderstood. "In fact, in 1991 the U.S. Fifth Circuit
Court of Appeals vacated much of the so- called "Asbestos Ban and Phaseout" rule and remanded it to the EPA. Thus,
much of the original 1989 EPA ban on the U.S. manufacturing, importation, processing, or distribution in commerce
of many asbestos - containing product categories was set aside and did not take effect." - CDPHE

Mr. Turner,
Foothills Environmental Inc. (FEI) conducted a limited asbestos inspection on September
12, 2011, of suspect asbestos materials that may be impacted during renovation activities at
the residence located at 610 W Lionshead Circle #704, Vail, Colorado. At your request the
inspection was limited to suspect drywall materials located in the main level hall bathroom,
main level east bedroom, master bathroom and all ceilings in the unit that may be disturbed
during renovation activities. Mr. Derek D'Avignon, an asbestos inspector certified by the
Colorado Department of Public Health & Environment (# 10177), conducted the limited
asbestos inspection. Aerobiology Laboratory, an independent laboratory accredited by the
National Voluntary Accreditation Program (NVLAP) and the American Industrial Hygiene
Association (AIHA), analyzed the samples utilizing Polarized Light Microscopy (PLM).
A limited bulk sampling of suspect building materials was conducted to identify any
Asbestos Containing Material (ACM) that would be impacted by planned renovation
activities in the unit. An ACM is defined by the EPA as a material with an asbestos content
of greater than one percent (1 %) by area. Select bulk samples of suspect building materials
were collected from areas that could be impacted by the remediation effort.
Only the textured drywall walls and ceilings within the two bedrooms, two bathrooms,
kitchen and living room (ceiling only) were inspected for ACM. FEI did not inspect
outside of the proposed scope of work, underground conduit, electrical panels instruments
or other appurtenances.
The acoustical texture (popcorn) ceilings located in the kitchen contains 5% chrysotile
asbestos. The orange peel drywall texture located on walls throughout the unit
contains 2% chrysotile asbestos.

DESCRIPTION
The building is a residential condominium unit located in a seven -story building. The
original date of construction is unknown.

The acoustical texture (popcorn) ceilings located in the kitchen contains 5%
chrysotile asbestos. The acoustical texture found on concrete ceilings appears to be
the same asbestos containing texture as found on the kitchen ceiling but it was not
sampled as it was out of the scope of work for this sampling event.
The orange peel drywall texture located on walls throughout the unit contains 2%
chrysotile asbestos.

Note:
There may be additional suspect asbestos containing materials located underibehind
building materials that were not sampled as part of this limited inspection. If additional

suspect materials are discovered they should be presumed to be asbestos until sampling and
analysis proves otherwise.
CONCLUSIONS and RECOMMENDATIONS:
Removal, in accordance with the Colorado Department of Public Health and
Environment's (CDPHE) Regulation No. 8, is required of materials with an asbestos
content of greater than one percent (1%) by volume that are friable or will be made friable
during renovation or demolition activities. Friable means that the material, when dry may
be crumbled, pulverized, or reduced to powder by hand pressure.
The one percent cut off is consistent with the definition of an Asbestos containing Material
(ACM) under the asbestos National Emission Standards for Hazardous Air Pollutants
(NESHAP). However, the OSHA standard has a definition for both "asbestos" and
"asbestos- containing materials." The (OSHA) definition of asbestos does not have a one
percent cut off, therefore, asbestos that is present in percentages less than one percent
continues to be covered by the OSHA Construction Standard, 29 CFR 1926.1101. A work
operation conducted in areas where the asbestos or asbestos product is below one percent is
an "unclassified" operation. The employer still must follow the requirements in paragraphs
(g)(1) [except (g)(1)(i)], (g)(2) and (g)(3) that describe engineering and work practice
controls operation.
Acoustical spray -on materials are classified as friable. These materials can be easily
damaged due to their lightweight physical consistencies. Abrasive or disruptive actions
such as drilling and mounting of equipment should not be employed due to the potential for
the generation of airborne asbestos fibers. Alterations to or the removal of these materials
requires adherence to all applicable local, state, and federal regulations concerning asbestos
removal and disposal.
Drywall Texturing Compound is classified as non - friable as long as the texturing
compounds remain painted and in good condition. If the texturing compounds are
damaged by cutting, drilling, sanding etc., or damaged by water or fire, the texturing
compounds could become friable and release fibers. Texturing compounds are also
classified as surfacing materials and must be removed by properly asbestos trained
personnel prior to building demolition or renovation.

LIMITATIONS
This report should not be used as a bid document or Project Design for the removal, repair,
encapsulation, enclosure, or Operations and Maintenance (O &M) of asbestos containing
materials as it does not include components of the design requirements set forth in
Colorado Regulation No. 8, Section III.C.3. Foothills Environmental, Inc. can prepare
asbestos abatement specifications, scope of work, project design, and bid documents for
this project at the client's request. This document describes the locations and conditions of
ACM identified in the facility during the inspection. This report is limited to the scope of
work identified in this report and should not be construed to represent anything outside the
scope of work.

Final Visual Inspection and Final Clearance Air Monitoring Protocol:
Foothills EnvironmenW, Inc (FEI) collected clearance samples in accordance with USEPA Regulation 40 CFR Part 763 (AHERA),
Colorado Department or Health Regulatiou 8, and the NIOSH 7400 method. At conclusion of the asbestos abatemcot action. FEI
visually inspected the work area to determine that all dust and debris had been removed. Any dust or debris identified during the
inspection was cleaned. Once the area passed the 5nal visual inspection, final air clearance samples were collected using aggressive
sampling in accordance with 40 CFR Part 763, Appendix A. Final clearance air samples were collected by individuals qualified as
"Air Monitoring Specialists" as defined by the Colorado Department of Health. The air samples were analyzed by FEI utilizing Phase
Contrast Microscopy (PCM), National Institute for Occupational Safety and Health (NIOSH) Method 7400. FEI analysts are NIOSH
582 or 582E trained and are successful participants in the American Industrial Hygicne Association (A1HA) Proficiency Analytical
Testing (PAT) program for phase contrast microscopy_ An abatement action is considered complete when all concentrations of the
five PCM results are less than or oqual to 0.01 Ucc.

Dear Todd
As you know, we met at the above noted remodel to assess the existing structure and design a support
system for the new drywall ceiling between the existing precast tee stems. This is a summary of my
findings.
I have reviewed the capacity of the existing 8DT12 double tees, and determined that this existing
system will be capable of supporting this additional dead load.
The existing ceiling for the unit consists of 8DT12 precast double tees. The new ceiling will consist of
5/8" drywall between the stems of the double tees. This new ceiling should be supported by a light
gauge framing system. This system should consist of Armstrong KAM -12 or LAM -12 Angle Mold
attached to the sides of the existing tee stems. This track should be connected to the stems with '/4'
diameter "Ramset" fasteners at 16" on center.
The drywall will be hung from Armstrong SS7708 light gauge tees spaced at 16" on center. These tees
will be supported by the angle mold at both ends. The drywall should be connected to the light gauge
tees with standard drywall screws at 16" o.c.
This completes my commentary for the structural requirements to support the new ceiling. Feel free to
