Frontage Road Vail, CO 81657 Re: Lot 1E, Vail Village Filing 10 a/k/a 935 Fairway Drive Owner: Fairway Drive, a Variable-Capital Limited Liability Company, a Mexican company Dear Mr. Gibson: I represent Larry Allen and Lori Allen, the owners of Lot 1W, Vail Village Filing 10, a/k/a 925 Fairway Drive. The Aliens are aware that the owner or builder of the residence located at 935 Fairway Drive (the duplex residence constructed on Lot 10E adjacent to the Allens' residence) may soon be requesting an inspection to obtain a final certificate of occupancy from the Town of Vail. It is my clients' understanding from their architect, Hans Berglund, that several items constructed at 935 Fairway Drive do not comply with plans that were approved by the Aliens and Vail's Design Review Board. The purpose of this letter is to alert you and your staff to some of the non-compliant improvements, and to advise you that the changes that were made were not agreed to by the Allens. In particular, the hot tub on the back patio was supposed to be approximately 18 inches lower than it is presently installed. The Allens agreed to the location of the hot tub based on the significantly lower profile it had on the DRB-approved plans. Additionally, planters inside the front landscape wall were not built, a tree was installed in a different location than shown on the plans, changes were made to the driveway materials, and the landscape wall in front of the house was supposed to extend about four more feet to the west than it actually extends. As mentioned above, these changes were identified by the Allens' architect, Hans Berglund, but are not intended to be an exhaustive list. There may be other non-compliant improvements of which the Allens and Mr. Berglund are not aware. Riverwalk at Edwards • Emerald Building LARSEN& LYNCH LLC Bill Gibson,Planner II Town of Vail May 31, 2012 Page 2 The non-compliant items are significant to the Allens because during the design and planning stages of the reconstruction of the duplex residences, there were many negotiated items and "trades" made between the Allens and Manuel Castro, the owner of Fairway Drive, and many of the agreements made by Mr. Castro were not fulfilled. On the other hand, the Allens' improvements comply with the plans approved by Mr. Castro and the DRB. Thank you in advance for your careful attention to the non-compliant improvements when performing the inspection for the final certificate of occupancy for 935 Fairway Drive.
