As you are aware you are in violation of your approved Design Review approved plans and in violation of performing working on Lot 3 without a building permit. I am writing this letter on behalf of Bill Gibson, whom is out of the office until August 6th, in an effort to provide you with comments to keep you on track for a possible August 15th hearing with the Design Review Board. This item will need to be reviewed and approved by the Design Review Board per Section 12-21-14(2), Restrictions in Specific Zones on Excessive Slopes, Vail Town Code, which states: E. Site coverage as it pertains to this chapter, as permitted by sections 12-6A-9, 12-68-9, 12-6C-9 and 12-60-9 of this title, is amended as follows: 1. Not more than ten percent (10%) of the total site area may be covered by driveways and surface parking. 2. In order to protect the natural/and form and vegetation on steep slopes, not more than sixty percent (60%) of the total site area may be disturbed from present conditions by construction activities. The design review board (DRB) may approve site disturbance in excess of the sixty percent (60%) maximum if specific design criteria warrant the extent of the requested deviation. The landscape plan you submitted for revegetating that potion of the site that was disturbed, but was to remain untouched, is not adequate as it needs to depict the following elements per the Design Review application check list. o Landscape Plan* • Scale of 1" = 20' or 1" = 10' • Landscape plan must be drawn at the same scale as the site plan. 0 RECYCLED PAPER • Location of existing trees, 4" diameter or larger. Indicate trees to remain, to be relocated (including new location), and to be removed. Large stands of trees may be shown (as bubble) if the strand is not being affected by the proposed improvements and grading. • Indicate all existing ground cover and shrubs. • Detailed legend, listing the type and size (caliper for deciduous trees, height for conifers, gallon size for shrubs and height for foundation shrubs) of all the existing and proposed plant material including ground cover. • Delineate critical root zones for existing trees in close proximity to site grading and construction. • Indicate the location of all proposed plantings. • The location and type of existing and proposed watering systems to be employed in caring for plant material following its installation. • Existing and proposed contour lines. Retaining walls shall be included with the top of wall and the bottom of wall elevations noted. To be clear about Staffs expectations, we will be looking for a professionally prepared landscape plan that includes a sufficient amount of native plants and native grasses to cover the area to be revegetated. The plan should include the incorporation of native plant species that would be typically found on an undisturbed south facing hillside. Several examples are sage brush, serviceberry, rabbit brush, native grasses, etc. The number of each of these plant species should be sufficient to cover the entire area to be revegetated.
