RE: PRINTERY BUILDING AS OFFICE USE
Dear Mr. Beaudin:
I am writing in regard to your recent request for a hearing before the Town Council to
determine if an office use is appropriate for the Printery Building located at 901 North
Frontage Road. As we have discussed, further information is necessary to review this item
before it can be heard by the Town Council. The following items will be necessary to proceed
with the application.
1. Survey of the property showing existing conditions and parking.
2. List of names and addresses of adjacent property owners.
3. The owners original written approval.
4. A copy of the ninety-nine year lease agreement between Sandstone 70 and
The Printery owners.
After discussing this item with Larry Eskwith, our Town Attorney, I have determined that the
date that the Printery ceased to conduct business on the property will be considered the date
for the discontinuance of use. The date of bankruptcy settlement will not be the date of
discontinuance. This is very important in that when a legal nonconforming use is discontinued
for a period of more than one year, it is no longer considered a legal nonconforming use and
the standard zoning is applicable.

RE: STATEMENT OF THE NATURE OF THE VARIANCE REQUESTED
1. The variance requested is from the GRFA requirements of the
Town of Vail Zoning Code. The purpose of the request is to allow
the applicant to enclose a second floor balcony of approximately
100 square feet; the balcony would thereby become part of the
applicant' s living room. Other existing uses in the neighborhood
are primarily residential, the exception being The Printery, a
commercial use.
2 . Only a very minor degree of relief from the existing zoning
is necessary to the granting of this application; compatability
of this residential unit with the neighborhood will not be affec-
ted. It should be noted that the Ted Martin residence at Sandstone
70 has an enclosed balcony.
3. The effect of the variance on light and air, distribution of
population, transportation, traffic facilities, utilities and pub-
lic safety will be nil.
The applicant wishes to refer the Department of Community Develop-
ment and the Planning Commission to the following considerations :
a. One of the purposes of the Zoning Title of the Code is "to
conserve and maintain established community qualities and econ-
mic values; " . This improvement would help to maintain economic
values.
b. The applicant also wishes to direct attention to Vail ' s Community
Action Plan; in it' s statement of purpose, the Plan specifically
is directed towards "recognizing the special needs of neighborhoods" .
One specific need of this neighborhood, located directly across
from Lionshead, is the upgrading of some of the older condominium
projects. The Plan further recognizes that "New Growth and re-
vitalization are essential to the continued success of Vail" ,
and urges the adoption of measures aimed at accomplishing "Neigh-
borhood planning and upgrading" and "Community incentives and awards
programs for upgrading of buildings and sites" .

B. A topographic and/or improvement survey at a scale of at least 1" - 20' stamped
by a Colorado licensed surveyor including locations of all existing improve-
ments , including grades and elevations. Other elements which must be shown
are parking and loading areas, ingress and egress , landscpped areas and
utility and drainage features.
C. A site plan at a scale of at least 1 " = 20' showing existing and proposed
buildings.
D. All preliminary building elevations and floor plans sufficient to indicate
the dimensions, general appearance, scale and use of all buildings and spaces
existing and proposed on the site.
E. A preliminary title report to verify ownership and easements
F. If the proposal is located in a multi-family development which has a homeowners'
association, then written approval from the association in support of the
project must be received by a duly authorized agent for said association.
G. Any additional material necessary for the review of the application as
determined by the zoning administrator.,
* For interior modifications, an improvement survey and site plan may be
waived by the zoning administrator.
IV. Time Requirments
The Planning and Environmental Commission meets on the 2nd and 4th Mondays
of each month. A complete application form and all accompanying material
(as described above) must be submitted a minimum of 4 weeks prior to the date of the
PEC public hearing. No incomplete applications (as determined by the zoning
administrator) will be accepted by the planning staff before or after the desig-
nated submittal date.

Dear Linda and Jerry :
This letter will confirm our phone conversation on September 24
regarding possible uses of the Printery Building. We checked our
files on the Printery Building relative to conditional uses, and
found that it is possible to have another use in the Printery
Building if the Town Council deems the new use to be similar to the
approved Printery use . This procedure is described in the letter
to Anna Marie Mueller dated July 16, 1991 . The files reveal the
following:
1 . On May 9, 1974, the Planning Commission heard the request for
a conditional use for the Printery Building. The application
states: "to convert present dormitory units and studio
apartment to professional office for graphics, design and
lithographic services. This was approved.
2 . We can find no memo to the Planning Commission meeting, but
did find a memo to the Town Council and Town Council minutes .
3 . At the time the Printery began doing business, the property on
which it was located was zoned Medium Density Multiple Family
which allowed offices as conditional uses. The Printery
received a conditional use permit to operate as an office.
The zoning code was changed in Ordinance # 37 of 1980, and
offices were removed as conditional uses . The Printery then
became a nonconforming use.
4 . A nonconforming use may not be enlarged. A nonconforming use
cannot be changed to another nonconforming use unless
permission has been granted by the Town Council . Prior to
granting permission, the Town Council shall determine that the
proposed use does not substantially differ from the existing
nonconforming use.
Enclosed are the papers from the Printery file which relate to this
subject along with a list of zoning actions .
I want to emphasize that you could quite possibly have another non-
conforming use in the Printery Building as long as the Council
gives their approval .
Furthermore, the Printery building can be used for residential use,
and if you wished to have an office in the residence, you could
apply for a home occupation license.
Zoning information is as follows :
Zone : Medium Density Multi-Family (please see MDMF zone
district enclosed)
Lot size: 6, 641 sq ft (This is based on information you gave us .
This lot area would have to be verified by a surveyor. )
Allowed Gross Residential Floor Area (GRFA) : 2, 324 sq ft
Existing GRFA: 2, 954 sq ft (This is based on information you gave
us . GRFA would have to be verified from floor plans . )
Number of units permitted: 2
You state that you have the use of 4 parking spaces full time and

In your letter of June 12th, you requested to move an Interior
Design Service and Shop into the Printery Building. The Printery
moved out of this location approximately three months ago . At the - -
time the Printery began doing business, the property on which it
was located was zoned Medium Density Multiple Family which allowed
offices as conditional uses. The Printery received a conditional
use permit to operate as an office . The zoning code was changed in
1980 and offices were removed as conditional uses . The Printery
then became a nonconforming use .
A nonconforming use may not be enlarged. Therefore, a second floor
.. may not be added to the Printery Building in its present use.
According to the Vail zoning code, Section 18 . 64 .080, a
nonconforming use cannot be changed to another nonconforming use
unless permission has been granted by the Town Council. Prior to
granting permission, the Town Council shall determine that the
proposed use does not substantially differ from the existing
t . nonconforming use.
If you wish, you may apply to the Town Council for a determination
of whether of not an interior design service and shop is a use that
does not substantially differ from the Printery. It is staff' s
opinion that the proposed interior design use is different from the
Printery operation. .

In your letter to Jerry and Jill Scheinbaum on February 25 , 1974 •
you state thatthey must be in compliance with Town of Vail
Zoning Ordinance. There, is nothing listed as a permitted or
conditional use in a'MDMF" zone which fits this type of operation.
There is one simple way this could be handled. The entire
Sandstone Staff House is presently a non-conforming use and
the Council can vote to allow a different non-conforming use if
it is in keeping with the character of the neighborhood and
not substantially different from the former non-conforming use.
The area of the building which they propose to use was formerly_______
occupied by the Vail Properties-maintenance operation and also
contains a small appliance repair shop and a laundry. The use
the Scheinbaum's propose is not so dissimilar that it should
cause any problems . - -

MEMORANDUM

RE: CONDITIONAL USE PERMIT REQUEST -
LOU PARKER - SANDSTONE STAFF HOUSE - THE PRINTERY .
DATE: JUNE 4, 1974
At its May 9, 1974 meeting, the Planning Commission unanimously
approved the Conditional Use Permit request for Lou Parker to
establish a printing business and office in the Sandstone Staff
House. The Commission found that the Conditional Use Permit could
be granted based on the following findings, in accordance with
Section 18.600 of the zoning ordinance: --
(1) That the proposed location of the use is in
accord with the purposes of this ordinance
and the purposes of the district in which the
site is located;
(2) That the proposed location of the use and the
conditions under which it would be operated or
maintained will not be detrimental to the public '
health, safety, or welfare, or materially injurious
to properties or improvements in the vicinity;
• (3) That the proposed use will comply with each of
the applicable provisions of this ordinance.
The Commission is also in receipt of a letter from the Sandstone
Condominium Association indicating that they do not object to the
requested use.

Regarding a request by Mery Lapin for a time extension
for a variance previously granted to Crossroads East, it was
explained that the variance was initiated at the Town' s
request. Councilman Staufer stated that if this time ex-
tension is granted, the zoning ordinance should be amended.
He recommended that instead Mr. Lapin should re-apply for the
variance after its expiration, and if there is no significant
change in the Master Plan at that time, the variance would
again be granted. Mr. Minger instructed his staff to send
such a letter to Mery Lapin. Councilman Donovan moved that
the matter be handled in accordance with Mr. Minger' s in-
structions . Mayor Dobson stated that the variance request
will be approved at a later date if there is no significant
change which would affect the public good.
With regard to a request by Lou Parker for a Conditional Use
Permit to allow the Sandstone Staff House to be used as offices
for The Printery, the zoning administrator stated that there
were no objections by the surrounding neighbors . Councilman
Donovan moved to grant the Conditional Use Permit; Councilman
(` White seconded the motion; the vote was unanimous in favor;
and the motion carried.
With regard to a request for a parking exemption to allow
expansion of the Covered Bridge Store , Mayor Dobson stepped
down and Mayor Pro Tem White presided over this portion of
the meeting. Mr. Dobson requested an exemption of three
spaces for enlargement of the building to be used as office ,
storage and retail space. The Covered Bridge Store is presently
a non-conforming building with regard to parking. According
to Mayor Pro Tem White , the precedent has been set with
variances granted to the Red Lion , Slifer and Company, and
Manfred Schober. Councilman Donovan moved to grant the
exemption; Councilman White seconded the motion; the vote
was unanimous in favor and the exemption was granted.
Mr. Minger stated the administration policy that all signs
which are not official regulatory signs shall in future be
submitted to the Design Review Board for their approval.
A member of the audience, Mr. Robert Buterbaugh, asked that
there be an ordinance restricting cigarette smoking at Town
Council meetings.
Since there was no further business, the meeting was adjourned ,
at 10 : 40 P.M.
The Local Liquor Licensing Authority was then convened at
10 : 45 P.M.
With regard to a request for a Beer, Wine and Liquor License
from Lothar and Lieselotte Klaschik for the Hansel and Gretel
Restaurant to be located in the Sunbird Lodge at Lionshead,
the Mayor asked if the application were in order. The Town
Clerk and Chief of Police reported that requirements had been
fulfilled. Stewart Brown, representing the Klaschiks ,
submitted petitions of approximately 115 names as Exhibit A
to indicate the needs of the neighborhood. Mr. and Mrs.
Klaschik were then sworn in by the town manager; they proceeded

RE: THE PRINTERY BUILDING APPLICATION FOR
AMENDMENT TO CONDITIONAL USE PERMIT
TO ALLOW SWEDE'S SIGN SHOP
Application has been made by Lou Parker for an amendment
to the existing Conditional Use Permit on the Printery Building
to allow Swede's Sign Shop to occupy approximately 180 square feet
formally occupied by. the laundromat. The Zoning Ordinance requires
in Section 18.60.020 that application be made which includes a
description of the precise nature of the proposed use and its operating
characteristics and measures proposed to make the use compatible with
other properties in the vicinity. The applicant states that most of
the work performed is silk screening which creates no dust or noise
and that most signs are silk screened directly on customers windows
on site. No traffic is generated as customers do not come to the
shop.
The Planning Commission must make the following findings before
granting the amendment to the Conditional Use Permit:
1 . ) That the proposed location of the use and
in accordance with the purpose of this
Title and the purposes of the District
in which the site is located.
2.) That the purposed location of the use and
the conditions under which it would be
operated or maintained will not be detrimental
to the public health, safety, or welfare or
materially injurious to properties or improvements
in the vicinity.
3.) That the pvtposed use will comply with each
of the applicable provisions of this Title.
The Department of Community Development feels that a sign shop as it
is being operated, in this location would not be detrimental to the residential
character of the area and would therefore recommend approval of the amendment
to the Conditional Use Permit.

Sandy Mills wondered whether Commission should table the
plaza landscaping plan at this time and have the Town Council take up
the entire project.
Dudley Abbott felt that the Commission should give a conditional
approval only, to be tied into the decision made by the Town Council
for the entire landscaping project.
Dudley Abbott made a Motion to deny amendment of the approved
landscaping plan until such time as a Master Plan be submitted to
the Vail Town Council . Scott Hopman seconded this Motion. It
was then open for discussion.

THE PRINTERY - AMENDMENT TO CONDITIONAL USE PERMIT TO ALLOW SIGN SHOP.
The question posed by the Commission" pertained to customers for
the sign shop causing increased traffic in an area that is predominantly
residential . The applicant replied that most of her customers telephone
her shop, and she goes to their businesses rather than they coming to her.
She does silk screening, painting, and cuts an occasional board; but alot
of her work is graphics which are done on the customer's premises rather
than in her shop. It was noted that approval was given by the Sandstone 70
residents by letter to Lou Parker, and a copy is held by Diana Toughill
for the record.

The next item on the agenda:
THOMAS RESIDENCE - A REQUEST FOR A SETBACK VARIANCE FOR LOT 2,
BLOCK 1 , VAIL VILLAGE 13th FILING.
A set of plans along with a model were presented for Commission
review. The applicant asks for a 31/2-foot variance which is caused by
the height of the house. The Commission was in agreement that to keep trees,
and to minimize cuts and retaining walls, requests for setback variances
of this type are valid.
The Motion was made by Gerry White for approval of the
request for a Setback Variance and distance between buildings for
the Thomas Residence on Lot 2, Block 1 , Vail Village 13th Filing in
accordance with the memorandum as issued by the Department of Community
Development. Seconded by Scott Hopman.
There was no discussion and this Motion was unanimously approved.
The next item on the agenda:
GORE CREEK FLOOD PLAIN.
After discussion by the Commission, a Motion was made by
Gerry White to accept the study done by Hydro-Triad on the Gore Creek
Flood Plain dated January 1978 and amend the comprehensive maps and
plans, in accordance with the memorandum issued by the Department of
Community Development. Seconded by Pam Garton. The vote was unanimous
for approval .
A Motion was made for postponement of the Public Hearing of
all Zoning Amendments as published, to February 28, 1978. This Motion
was made by Pam Garton and seconded by Scott Hopman and unanimously approved.
Ed Drager then called for a Motion to approve the Minutes
of December 13, 1977 with any changes or additions and as written. Sandy
Mills so moved and this was seconded by Scott Hopman. These Minutes
were approved with Dudley Abbott abstaining.
Dudley Abbott and Sandy Mills will attend the Town Council meeting.

next week, February 21 , 1978, so that a complete list of applicants for the
vacancies on the Planning Commission can be presented to Council .

On behalf of the Sandstone 70 Condominium Association, -
I request that a formal hearing of your board be held to
review the Condition Use Permit granted Vail Guides , Inc .
several years ago . Vail Guides, Inc . occupies a portion
of .the Printery building located at the northwest corner
of the North Frontage Road and Red Sandstone Road in the
Town of Vail . The Printery building shares a total of 7
parking spaces with the Sandstone 70 Condominium Association
with mutual consent . The seven parking spaces are for use
of all customer and employees of the Printery building and
are intended for normal passenger vehicles .
At the time that the Conditional Use Permit was granted
Vail Guides , Inc . , we felt that the operation was small
enough to be com-oaLible with the residential character of
. our neighborhood . Due to apparent growth of Vail Guides
Inc . and the elaboration of their services, we feel that
. the use is no longer compatible with the residential -
character of Sandstone 70 Condominium Association for the
following reasons :
A . The number of vehicles controlled by Vail Guides • often- " "
• exceeds the number agreed to for the entire Printery
building.
B . The parking spaces shared by the Printery building and .
- Sandstone 70 are customarily occupied by Vail Guides Inc .
outside the hours agreed to .
• . •.C . In fact, access to Sandstone 70 through our south parking
" access is "often blocked by vehicles controlled by Vail •
. Guides , Inc . . This is both an inconvenience and 'a danger
in that this access is often closed to emergency-vehicles
-- - as well as vehicles owned by persons residing .in .Sandstone
70 Condominiums.
D. Vehicles-such as buses , overly large liraosines .vans, trucks,
and other equipment controlled by Vail Guides,.. Inc. are. ,
often parked on our. property. These vehicles remain beyond
agreed upon hours, obstruct, access, prevent visual . ob-
• structiono for use of our driveway and are incompatable , .
with the residential character of Sandstone 70 Condominium
. Association.
For the reasons given above I would again request your
attention to this mutter at your earliest convenience . We
would like resolution of this matter before winter. arrives.

1. Approval of minutes of meeting of 10-27-80
After discussion about John Perkins' vote on part VII Density Control,
Gaynor moved for approval, seconded by John, and vote was 4-0, unanimous
for approval.

2. Knox, density control variance, applicant asked to table till the
meeting of November 24. John Perkins moved to table and Jim Morgan second
Vote was 4-0, unanimous.
3. Gart Garage front setback variance, Lot 12, Block 7, Vail Village 1st
Peter presented the memo and said that there still remains basically no
hardship, and that there was not much change from the first memo sub-
mitted for the October 13 meeting, recommending denial.
Jerry Gart explained that there were only 2 units in the building, not 3,
and that he was using it as a single family home. He added that there had
been a garage, but that the driveway was too steep and the garage had been
changed into the secondary unit. Mr. Gart described neighbors on either
side of his house who were closer to the street than his requested garage
would be. He felt that the garage would add to the appearance of the
house while hiding the trash.
Jim Morgan moved to approve the variance, and John Perkins seconded it. T.
vote was unanimous, 4-0 in favor of approval.
. 4. Vail Guides Conditional Use Permit Review Applicant asked to :able ti.

Peter Patten thanked John Perkins for serving on the Commission and for

Gaynor moved to approve minutes, seconded by Roger. The vote was 2-0,

2.Review of Vail Guides conditional use permit.
Peter Patten explained that there was no memo, and that the letters
received frcm the Sandstone 70 condominium association, and from Vail
Guides, and copies of the original Planning minutes and memo explained
the problem. He added that excessive vehicles and not adhering to the
original agreement by Vail Guides not to store any vehicles there, seemed
to be the major problem.
Jim Rea, owner of Vail Guides, Inc. , addressed the Commission to point
out that until he received a copy of the letter from Sandstone 70 to
the Planning Commission, he had not been aware of any problem. He admitted
that sometimes there had been too many vehicles, and that he planned
to modify the employee manual and make clear that this is not to happen
again. He explained that drivers park to come in to get their instructions
perhaps 10-15 minutes.
Bill Pierce, President of Sandstone 70 Condos read from the letters and
minutes that Peter referred to, adding that the vehicles block the South
access. He stated that Sandstone's agreement eith the Printery Building
was that 9 parking spaces was for the Printery from 8-5. Ted Martin,
an owner in Sandstone and a Vail fireman stated that the number of vehicles
from Vail Guides presented a problem with fire access.

Dan Corcoran added that some of 'the Vail Guide vehicles had been observed
parking on the Frontage Road as well.
Several commission members suggested that the two parties should get
together to try to solve the problem themselves. Bill and Jim agreed,
and Bill Pierce asked to have .the matter tabled until January 12 when
they would bring back a mutual agreement containing- conditions agreed
to

Dick stated that at present only the HDMF and CCI and CCII zones could have time sharing

1 E character of accommodations in Vail. Bill Wilto stated that the Council's concern was
that public accommodations would be reduced.
The vote was 6-1 in favor of removal. Duane Piper voted against removal.

( 5. Review of Vail Guides conditional use permit (printery Building) .
' Bill Pierce and Jim Rea stated that they had worked out an agreement and that Vail Guides
had 4 parking spaces to be used during Vail Guides business hours--3 on the west and
Q one on the North. Dan asked that the Rocky Mountain Airlines bus be instructed to pull
farther away from the intersection so as not to obstruct visibility to the West.
-6. Luke density control variance, Lot 3, Block 3, Bighorn Sub, Third Addition
j Peter Patten presented the memo, explaining that Lots 1, 2 and 3 are RC zoned, and Lot
4 LDMf. All of these have 40%slope. He referred to the memo, reiterating that much
study had been done and much deliberation went into the hazard ordinance (see memo) .
i Vail has received much praise from the Colorado Geological Survey concerning this or

\ dinance which was well researched.
1 (::)Ni) The second point is the concern with downzoning. Luke purchased his property in 1966
when it was in the County, and then he could have 28 units on lots 2 3. Now it is
zoned for a total of 6 units on lots 2 $ 3. This is the issue: progressive ordinance
is inevitable. Peter asked for denial .
Bill Luke spoke about the site plan that was approved in 1973 by the County for 12 units
for lot 3, and added that the soil report for 1973 was "clean". He explained that the
Town of Vail did road improvement which resulted in huge boulders being placed on his
property. Now with Town zoning, 5 units could be built on lot 2, and one on lot .3.
The commission members discussed changing the zoning, and asked Peter more questions
about the hazard zoning. 'Mr. Luke reiterated that the boulders had changed the grade.
He asked to have the request tabled until he could bring in the survey made before the
road work, and one made after.
Roger moved that this item be tabled, seconded by . Vote was in
favor of tabling, unanimous vote, 7-0.
7. Landmarc setback variance, Lot 7, Block 1, Gore,Creek' Park.
Peter Patten presented the memo, described the background, recommended approval.
Rick Baldec of Mountain High Enterprises explained that the gas line had been located,
. but the size had not been known. Peter said the gas company would really like to see
10' distance from the house. He went on to repeat that the alternatives are worse.
They are: move the gas line
redesign the house
Rick mentioned that the gas company wanted someone from their office on the site at-
: „ all times when work is underway. He explained that the gas line is not in the center
of the right of way. The deck would be in the flood plain if the house was moved,
i but that was all.

Gaynor moved the meeting be adjourned, seconded by Dan. The meeting was adjourned

NOTICE IS HEREBY GIVEN that Mr. John B. McQuaid, representing
Dr. Thomas Duncan, has applied for Conditional Use Permit in
accordance with Article 18 , Section 18 .400 of Ordinance 8 (Series
of 1973) in order to permit a Chiropractic office in a Medium
Density Multiple Family Zone, located on a portion of Tract A,
Vail Village 9th Filing (Sandstone Staff House) .
NOTICE IS HEREBY GIVEN That Vail Associates,, Inc. has
applied for A 'conditional Use Permit in accordance with Article
18, Section 18.406 of Ordinance 8 (Series of 1973) in order to
permit a counter weight cover to be constructed on lift #8 in
an Agricultural zone.
NOTICE IS HEREBY GIVEN That Er. Jim Newkam, representing
UEG, Inc. , has applied for a Conditional Use Permit in accordance
with Article 18 , Section 18 .400 of Ordinance 8 (Series of 1973)
in order to permit a family entertainment center in a Commercial
Core 2 zone in the Vail 21 building.
A Public Hearing will be held in accordance with Section 21.400
of Ordinance No. 8 (Series of 1973) on December 13, 1973 at 2 :00
p.m. in the Vail Municipal Building. Said Conditional Use Permit
applications will be heardbefore the Town of Vail Planning Com-
mission and findings will be transmitted to the Town Council of
the Town of Vail for final hearing on December 18 , 1973 at 7 :30
p.m.

BACKGROUND:
The Planning Commission,; on December 13, 1973 , considered
an application for a Conditional Use Permit by Dr. Thomas
Duncan, in accordance with Article 18, Section 18 . 400 of
Ordinance 8 (Series of 1973) in order to permit a Chiro-
practic office in a Medium Density Multiple Family Zone,
located on a portion of Tract A (Sandstone Staff House) .
The Zoning Administrator advised the Commission that there
were no technical problems . The parking requirement requires
one additional space, which can be provided. It was noted
that there has been no public opposition voiced to the •project .

The Planning Commission then determined that the application
was in accord with Section 18. 600 - Criteria and Findings
(Series of 1973) , and in particular, the use is in accord
with the purposes of said ordinance and the purposes of the
district in which the site is located; that the proposed
location of the use and the conditions under which it would
be operated or maintained is not detrimental to the public
health, safety, or welfare, or materially injurious to
properties or improvements in the vicinity; and the proposed
use. will comply with each of the applicable provisions of
said ordinance .

Therefore, upon motion duly made by Jen Wright to approve the
Conditional Use Permit, seconded by Gordon Pierce, it was •
unanimously voted to approve the Conditional Use Permit.
RECOMMENDATION:
• - The Planning Commission .recommends to the Council that the .
Conditional Use Permit be issued to Dr. Duncan for his office .

In your letter to Jerry and Jill Scheinbaum on February 25, 1974 .
you state thatthey must. 1)e in compliance with Town of Vail
Zoning Ordinance. There, _is nothing listed as a permitted or
conditional use in a'1-1DMF zone which fits this type of operation.
There is one simple way this could be handled. The entire
Sandstone Staff House is presently a non-conforming use and
the Council can vote to allow a different non-conforming use if

it is in keeping with the character of the neighborhood and

not substantially different from the former non-conforming use.
The area of the building cihich_they 1-'..ropose to lase was formerly
occupied by the Vail Properties-ziaintenance operation and also .
• contains a small appliance repair shop and a laundry. The use
the Scheinbaum's propose is not so dis-sindlar that it should
cause any problems.
Also, the Mayor told Jerry that this is a temporary occupancy.
If so, how long is temporary in this case? .

LOU PARKER - SANDSTONE STAFF HOUSE - THE PRINTERY
DATE: JUNE 4, 1974
At its May 9, 1974 meeting, the Planning Commission unanimously
approved the Conditional Use Permit request for Lou Parker to
establish a printing business and office in the Sandstone Staff
House. The Commission found that the Conditional Use Permit could
be granted based on the following findings, in accordance with
Section 18.600 of the zoning ordinance: --
(1) That the proposed location of the use is in
accord with the purposes of this ordinance
and-the purposes of the district in which the--
site is located;
(2) That the proposed location of the use and the
conditions under which it would be operated or
maintained will not be detrimental to the public
health, safety, or welfare, or materially injurious
to properties or improvements in the vicinity;
(3) That the proposed use will comply with each of
the applicable provisions of this ordinance.
The Commission is also in receipt of a letter from the Sandstone
Condominium Association indicating that they do not object to the

Re: Printery Building at Sandstone 70
Dear AnneMarie:
In your letter of June 12th, you requested to move an Interior
Design Service and Shop into the Printery Building. The Printery
--------moved out of this location approximately three months ago. At the -- --
time the Printery began doing business, the property on which it
was located was zoned Medium Density Multiple Family which allowed
offices as conditional uses. The Printery received a conditional
use permit to operate as an office. The zoning code was changed in
1980 and offices were removed as conditional uses. The Printery
then became a nonconforming use.
A nonconforming use may not be enlarged. Therefore, a second floor
may not be added to the Printery Building in its present use.
• According to the Vail zoning code, Section 18 .64 .080, a
• nonconforming use cannot be changed to another nonconforming use
unless permission has been granted by the Town Council. Prior to
granting permission, the Town Council shall determine that the
.. proposed use does not substantially differ from the existing
- ; nonconforming use.
If you ,wish, you may apply to the Town Council for a determination
of whether of not an interior design service and shop is a use that
does not substantially differ from the Printery. It is staff's
opinion that the proposed interior design use is different from the
- Printery operation.
